Labor Laws and Social Security :The Constitution of India which provides the jural basis for laws regulating employment and labour in India provide equality before the law and for prohibition of discrimination on the basis of religion, caste, sex, etc. The Constitution emphasis on the concept of social justice as one of the fundamental objects of State policy and these protective provisions edify the spirit of Indian industrial laws. Labour welfare, trade union, industrial and labour disputes and factories are items found in the Concurrent List of the Constitution.

Introduction :Set up by the Ministry of Labour, Government of India 4th March, 1966 to generate, develop and sustain a voluntary movement on Safety, Health and Environment (SHE) at the national level. Objectives :To take Safety, Health and Environment (SHE) movement to different parts of the country. To promote use of participative approach by employers by involving their employees in SHE activities. To promote development of professional SHE management systems at work places. NSCI Awards

The Workmens Compensation Act, aims to provide workmen and/or their dependents some relief in case of accidents arising out of and in the course of employment and causing either death or disablement of workmen. It provides for payment by certain classes of employers to their workmen compensation for injury by accident.

Employers liability
The employer of any establishment covered under this Act, is required to compensate an employee : 1).Who has suffered an accident arising out of and in the course of his employment, resulting into (i) death, (ii) permanent total disablement, (iii) permanent partial disablement, or (iv) temporary disablement whether total or partial, or 2).Who has contracted an occupational disease.

THE EMPLOYER SHALL NOT BE LIABLE


In respect of any injury which does not result in the total or partial disablement of the workmen for a period exceeding three days; In respect of any injury not resulting in death, caused by an accident which is directly attributable to1). the workmen having been at the time thereof under the influence or drugs, or

2). the willful disobedience of the workman to an order expressly given, or to a rule expressly framed, for the purpose of securing the safety of workmen
