ESI Act- 1948

Employment injury: Sec-2 (8) Means personal injury to the employee caused by accident or an occupational disease arising out of in course of his employment, The accident may occur with in or outside the territorial limits of india.

Employee : Sec-2 (9) Any person employed for wages or in connection with work of a factory or Esta. With direct or by agent or contractor

Exempted Employee: Sec:- 2 (10) Who is not liable under the act to pay the employees contribution Family: Sec-2(11) Family means all the relatives of an insured person (same As Dependants)

Factory , sec-2(12) Manufacturing process Power all definitions as same as mentioned in factories Act-1948 Immediate employer: sec-2 (13) Is one who employees , employed by him directly , after 1989 amend. Contract labour is also included.

Insurable employment;: sec-2(13-A) Means employment in the factory or ind. Esta. To which this act applies. Insured person : sec-2(14). Means a person who is or was an employee in respect of whom contributions are or were payable U/this act. And get the benefits.

Managing agent: sec-2(14-A) ; Any person appointed or acting as representative of another person for the purpose of carrying on such persons business or trade. Miscarriage: Sec-2(14B) It means expulsion of the content of pregnant uterus at any period prior to or during 26 weeks of pregnancy. The causing which is punishable under IPC.

Occupier- Same as Fac-Act-1948. Disablement :May be 1. Permanent 2. Temporary Permanent : 1 Permanent Partial Disablement
2. Permanent Total Ddisablement. 1. Permanent partial disablement.: Sec-2(15-A) Means disablement of a permanent nature as reduces the earning capacity of an employee in every employment. Every Injury specified in part II of 2nd schd.

2. Permanent Total Disablement : sec-2(15-B) It means disablement of permanent nature as incapacitates an employee for all work every injury specified in part I of second schedule. Temporary Disablement: sec-2(21) Means condition of resulting from an employment injury which requires medical treatment and renders an employee as a result of such injury, temporarily incapable of doing of the work which he was doing prior.

22. Principal employer: sec-2(17) Means owner or occupier, legal representatives of owner, manager under fac-Act 1948 and establishment under control of Govt. /state or central authority or HO Dept.

Regulations : sec-2(18); Regulations made by the employee state insurance corporation. Sickness : sec-2 (20): conditions which requires medical treatment and attendance on medical ground

Wages : sec-2(22) Means all remuneration paid or payable in cash to an employee if the contract of employment is expressed or implied. were fulfilled. Wages include any payment to employee in respect of any period of 1 authorised leave 2. lockout or strike which are not illegal 3. layoff 4 other additional remuneration if any.

Wages doesnt include: 1. contribution paid by the employer to pension fund, provident fund, 2. any traveling allowance 3. any sum paid to employer as special expenses 4. any gratuity payable on discharge.

Wage Period: sec-2 (23) Means the period in respect of which wages ordinarily payable to him in terms of contract of employment expressed or implied.
