CONSTITUTION AND BY-LAWS
A Review on the Constitution and By-laws of
PYAP
PREAMBLE

“We, the Officers and members of the Pag-asa Youth Association of the
Philippines, Inc., (PYAP, Inc.) imploring the aid of the Almighty God in
order to build a just and humane society that promotes the total
development of the out-of-school youth to become self-reliant and
become economically productive and socially responsible citizens
endowed with values and behavior to assist the government in
promoting justice, freedom, values, love, equality and peace do ordain
and promulgate this constitution and By-Laws.”
THE PAG-ASA YOUTH ASSOCIATION
OF THE PHILIPPINES

PYAP is. . .
• Organized nationwide from municipal/city, province up to the
regional level;
• Serves as a strategy to discuss and address issues and
concerns of the youth sector and projects and to come up
with possible solutions;
• PYAP utilizes the Unlad Kabataan Program (UKP) of DSWD.
ARTICLE 1-MEETINGS

• National Federation (twice a year)


• Regional Federation (Quarterly)
• Provincial/City Federation (Quarterly)
• Municipal/Barangay Federation (monthly)
• Special Meetings
QUORUM- ANY number shall consist a quorum may decide any question at the meeting, except those matters
where the corporation Code or other laws that requires affirmative vote of a greater proportion
ARTICLE II-BOARD MEMBER

• Board member- the corporate powers of


the association shall be exercised, its
business conducted and its property
controlled by the Board Members.
ARTICLE III-OFFICERS

• OFFICERS- the officers of the association is composed of the President, V-President, Secretary,
Treasurer, Auditor, Public Information Officer and Business Manager
• QUALIFICATION- no members shall be eligible for election to Board members unless he/she has
the following qualifications:
a. An out-of-school youth not enrolled/not graduate from any 4-year course;
b. Must be 15-24 year old, single
c. Not employed
d. If elected OSY had the chance to go back to school or/and be employed after election, he/she has to
continue office base on term limit or until the end of his recent term
• TERM OF OFFICE OF OFFICERS- an officer shall hold an office of 3 years and
or until their successor are duly elected or qualified.
• COMISSION ON ELECTION – the outgoing officers shall serve as the
COMELEC wherein the out-going president shall serve as the presiding
officer while the rest will act as the support staff and act as the Technical
Working Committee. The COMELEC shall ensure that protocols constituted
by the by-laws are strictly implemented. COMELEC has the power to act on/
decide on matters arising that are not constituted by the by-laws.
• MANNER OF ELECTION- should be done through election and by secret
balloting
REGIONAL FEDERATION shall be among the president of the Provincial and
City Federations and election should be done on the month of November.
ARTICLE IV- FUNCTIONS AND
POWER OF OFFICERS

• PRESIDENT - will act as the Chief executive officer of the association;


- Preside all meetings of the Board of Trustees and those of the member of the association.
- Execute all resolutions and or decisions of the Board of Trustees
- Act as Overseer of the activities of the association
- Have control over all members of the association
- Approves expenses voucher with the secretary and the treasurer
- submits financial reports

• VICE PRESIDENT – the Vice-president shall exercise all powers and perform all duties of the president during
the absence or incapacity of the latter.
• SECRETARY - Shall give notices required by these by-laws and
keep the minutes of all meetings of all committees in a
book kept for the purpose.
- He/she shall keep the seal of the association
- He/she shall have custody of the of the correspondence
files and all other papers that are to be kept by the treasurer
- Maintains members’ registry
- Responsible in making communication/ document intended
for info-dissemination and pass to the Public Relations
Officer
• TREASURER - Shall have charge of the funds, receipts and disbursements
of the association;
- Keep Money and other valuables;
- keep charge of the book od accounts;
• AUDITOR - Shall examine financial records, properties and audit
money.
• P.I.O. - Public Information Officer
- Responsible for the dissemination of communication
letters
• BUSINESS MANAGER- Responsible for the planning of Projects;
- Responsible for looking for venue, bookings, food, etc. of
the project/s to be undertaken.
ARTICLE V-MEMBERS

QUALIFICATION:
• OSY unemployed;
• 15-30 years old;
• In school youth (can enjoy the same privilege but can
not be elected as officer)
• Working youth (can enjoy the same privilege but can
not be elected as officer)
• Youth with Special Needs;
RIGHTS OF MEMBERS:
• To exercise the right to vote on all matters relating to the affairs of the association;
• To be eligible to any elective or appointive office of the association;
• To participate in meetings;
• To avail of the facilities of the association;
• To examine the book of records of the association during business hours.
DUTIES AND RESPONSIBILITIES OF THE MEMBERS:
• To obey and comply with the by-laws, rules and regulation that may be promulgated
by the association;
• To attend all meetings called by the president;
• To pay membership dues and other assessment that may be imposed by the
association
ARTICLE VI-SUSPENSION,
EXPULSION AND TERMINATION OF
OFFICERSHIP

• Three (3) consecutive absences to meetings;


• When he/she got married;
• Gross disrespect to subordinates/superior;
• Violations of any provision of this constitution
and by-laws
ARTICLE VII-FUNDS

• Funds -of the association shall be derived from the dues and
special assessments of members, gifts, donation and benefits;
• Fees and Dues- every member shall pay dues in addition to
membership as imposed by the association;
• Disbursements- withdrawal from the funds of the association,
whether by check or any instrument shall be signed by the
treasurer and President;
• Fiscal Year of the association is from 1st of January to 31st of
December.
ARTICLE VIII-OFFICIAL SEAL

• Form- the official seal of the association shall be


determined by the board
ARTICLE IX-DOCUMENTATION

• All PYAP at all levels shall submit semestral


accomplishment report (SAR) for the National Officers
and Quarterly Accomplishment report for the lower level
of organization.
