INTRODUCTION
The First Phil Environmental Law 1977
All agencies and instrumentalities of the national government, including government owned
and controlled corporations as well as private corporations, firms and entities are required to
prepare an ENVIRONMENTAL IMPACT STATEMENT (EIS) for every action, project or undertaking

Phil Environmental Impact Statement System (PEISS) 1978


Section 4 provides that no person, partnership or corporation shall undertake or operate
any such declared environmentally critical project (ECP) or area (ECA) without first
securing an Environmental Compliance Certificate (ECC).
Full implementation transpired after the issuance of Presidential Proclamation 2146 in
1981 where the technical definition of ECP and Environmentally Critical Areas (ECA)
was provided.

POLICY
To implement a systems-oriented and integrated approach to the PEISS to ensure a
rational balance between socio-economic development and environmental protection.
ENVIRONMENTAL IMPACT ASSESSMENT (EIA)
I s a PROCESS involving predicting and evaluating the likely impacts
of a project on the environment during construction,
commissioning, operation and abandonment.
EIS
It is a comprehensive study of the significant impacts of a project on the
environment. It includes an E M P /Program that the proponent will fund and
implement to protect the environment.

EMP and EMoP


Section in the EIS that details the prevention, mitigation, compensation,
contingency and monitoring measures to enhance positive impacts and minimize
negative impacts and risks of a proposed/existing project or undertaking.

EPRMP
E P R M P is a documentation of actual cumulative environmental impacts and
effectiveness of current measures for single projects that are already operating.

EMP : Environmental Management Plan


EMoP : Environmental Monitoring Plan
EPRMP: Environmental Performance Report and Management Plan
ECC
Is a document issued by the DENR/EMB after a positive review of an ECC
application, certifying that based on the representations of the proponent,
the proposed project or undertaking has complied with all the requirements
of the EIS System and has committed to implement its approved Environ-
mental Management Plan, EMP to address the environmental impacts.

PLANNING AND DECISION-MAKING TOOL


ECC is not a permit per se but a planning tool for lgus to consider
in their decision whether or not to issue local permit.

ECC VALIDITY
ECC is valid through out the entire project lifetime
provided:

1. There is no significant project expansion


2. There is no change in technology
3. There is no change in location
4. Project was implemented within five
(5) years from the date of issuance
