What is structure plan?
The draft structure plan for the State shall be a written statement formulating the
policy and general proposals of the State Authority in respect of the development
and use of land in that State,

• including measures for the improvement of the physical living environment

• the improvement of communications and the management of traffic
• the improvement of socio-economic well-being and the promotion of economic
growth
• and for facilitating sustainable development;

The publicity in connection with preparation of
Structure Plan
 The period of this publicity process shall be not less than one month from the
date of notification in local newspaper. An additional period of protest may also
be made at the request of any objection but shall not exceed one (1) month.
Pursuant to subsection 9 (3) of Act 172 , there are two (2) conditions in which an
objection period can be extended :

(a) When there is a request from the protester to extend the objection and the
extension period is only granted to the particular protester; and

(b) State Director of Town and Country Planning Department itself feel that it is necessary
to extend the term of protest. A public notice of extension of the term of protest shall be
made in the press as it involves the public.
The publicity in connection with preparation of
Structure Plan
 Upon completion of the publicity process, the Draft Structure Plan will be addressed to
the SPC (state planning committee) for its approval and the submission shall be
accompanied by a statement that the provisions under subsection 8 (1) have been
complied .
 A statement or record of the negotiation that a joint negotiation between the Director of
the Town and Country Planning Department involved with the parties making the
objection / appeal during the publicity process should be included

 If the State Planning Committee is satisfied, the Draft Structure Plan may be approved .
But if the state planning committee is not satisfied with the Draft Structure Plan it will be
returned to the Director of the relevant Town and Country Planning Department to be
fixed. However, the State Planning Committee can not make any modifications if it
expires within three (3) months from the date the JPBD Director submits the draft to the
State Planning Committee
The procedure for alteration of Structure Plans
(ACT 172) Section 11B
1 If it is decided under section 11 that an alteration is to be made on the
structure plan for the State, the State Director shall prepare and submit to
the Committee proposals for such alterations.
2 In formulating the proposals for such alterations, the State Director shall
have regard to such matters as the Council or Committee may direct.

The State Director shall submit the structure plan in which the proposed
alterations have been incorporated to the Committee and at the same time
publish a notice in at least two local newspapers, one of which being in the
national language, stating that copies of the plan are available for inspection
and that objections may be made within a period of one month from the date
of such publication. 30 Laws of Malaysia ACT 172

4 The Committee shall appoint a subcommittee consisting of four members of
the Committee, one of whom shall be appointed chairman of the
subcommittee, and the sub-committee shall hear every objection made in
accordance with the rules made under section 17.

The Committee shall then consider the proposed alteration to the structure
plan, and either approve it, in whole or in part and with or without
modifications, or reject it.

The Committee shall submit the approved altered structure plan to the State
Authority for the assent of the State Authority to the plan, and upon the
assent being given, the altered structure plan shall come into effect.
7 The Committee shall cause the fact of the assent of the State Authority to
the altered structure plan to be published in the State Gazette.
