CONSIDERATION
Consideration must be of value (at least to the

parties), and is exchanged for the performance or


promise of performance by the other party.
Consideration being one of the essential elements of
a valid contract, the general rule is that an
agreement made without consideration is void. But
there are a few exceptions to the rule, where an
agreement without consideration will be perfectly
valid and binding
In this case we will consider one exception to this.

Agreement made on account of natural love and affection [Sec.


25(1)]

An agreement made without consideration is

enforceable if, it is
Expressed in writing
Registered under the law for the time being in force
for the registration of documents
Made on account of natural love and affection
Between parties standing in a near relation to each
other.

Facts about the Case of Rajalakhi Devi Vs. Bhootnath


There were frequent quarrels and disagreement between

Bhoothnath and his wife Rajalakhi Devi. The promise was


made in writing and the quarrels the husband and wife had
were also mentioned. A case was filed to recover the
amount promised to be paid as maintenance. He finally
executed a registered document in favour of his wife
agreeing to pay for the separate residence and
maintenance. After six months husband refuses to pay the
amount. Rajalakhi Devi went to court and insisted on
specific performance by her husband of what is stated in
the registered document.
Hearing of this case was held at Calcutta high court

Judgement on the case


The judge decided in favour of the defendant. Wife

cant get her agreement enforced against her


husband in court of law (1900) 4 Cal WN 488
Reason- The court held that there was no natural

love and affection between them
