RA 7160 says that your primary mandate as LCE is to promote the
general welfare of the barangay and its inhabitants.

Punong Barangay Presiding Officer of the Sangguniang Barangay
Read and understand the following:
Sections 48 to 59 (Local Legislation)
Sections 391 to 392 (Powers, Duties and Functions of the Sangguniang Barangay)

exercised by the sangguniang barangay thru an ordinance)

Execution
Enforce all laws and ordinances which are applicable within the barangay;
Negotiate, enter into, and sign contracts for and in behalf of the barangay
Prepare the annual executive and supplemental budgets of the barangay;
Approve vouchers relating to the disbursement of barangay funds;
Enforce laws and regulations relating to pollution control and protection of the environment;
Conduct an annual palarong barangay which shall feature traditional sports and disciplines
Promote the general welfare of the barangay; and
Exercise such other powers and perform such other duties and functions as may be prescribed by
law or ordinance.
Administration and Supervision
Administer the operation of the katarungang
pambarangay
Exercise general supervision over the activities of the
sangguniang kabataan;
Ensure the delivery of basic services as mandated
under Section 17 of this Code.
Legislation
Call and preside over the sessions of the
sangguniang barangay and the barangay assembly,
and vote only to break a tie;
Upon approval by a majority of all the members of
the sangguniang barangay, appoint or replace the
barangay treasurer, the barangay secretary, and
other appointive barangay officials.
As presiding officer, he shall:
Call over the sessions of the sangguniang
barangay, which is to be conducted at least twice a
month;
Preside over the sessions of the sanggunian;
Vote only to break a tie
Call and preside over the conduct of barangay
assembly, which is to be done twice a year.
Maintenance of peace and order
Maintain public order in the barangay and, in pursuance
thereof, assist the city or municipal mayor and the
sanggunian members in the performance of their duties
and functions;
Organize and lead an emergency group whenever the
same may be necessary for the maintenance of peace and
order or on occasions of emergency or calamity within the
barangay;
Possess and carry firearm in the performance of his peace
and order function, subject to pertinent laws, rules and
regulations
Session
Session twice in a month
Passing papers around, such as barangay ordinances and
resolutions, for signatures of the members without meeting
on them as a collegial body (session) is highly illegal and
anomalous and renders all such acts done in such manner
null and void
Honorarium
Honorarium is given not as a matter of right but in appreciation for actual services rendered
(Santiago vs. COA, July 12, 1991).
Actual service of barangay official is measured by his attendance in regular and special
sessions (2007).
DILG-DBM Joint Circular No. 90-1 dated February 14, 1990, paragraph 3.2 provides:
3.2. A Barangay Official who is on leave of absence shall not be entitled to the Benefits
(Honoraria) provided herein.
There is no reduction in honorarium when the absence in sessions by the Punong Barangay
or the Sangguniang Barangay Member is for the performance of public duty as in attending
the problems of the constituents - on officials business. (DILG Opinion 35, s. 2007)

Important Reminders
As Presiding Officer vote ONLY TO BREAK A TIE (Art. 102, IRR of RA 7160)
The IRP must either be adopted or updated on the FIRST REGULAR SESSION
and WITHIN 90 DAYS (Art. 103, IRR)
You have NO VETO POWER. (Art. 108(c) and 109(b), IRR)
You are MANDATED TO SIGN the ordinances enacted by the sanggunian upon
approval by the majority of the sanggunian members (Art. 108 (c) and 109(b), IRR)
You can be SUSPENDED or DISMISSED from office if you enforce any
DISAPPROVED ordinance or resolution adopting your BDP and/or AIP (Art. 112,
IRR)
Distinction between ORDINANCE and RESOLUTION
More Important Reminders
Monies or properties donated by private agencies and individuals for specific purposes shall be
accounted for as TRUST FUND (Art. 101(a)(8), IRR)
When implementing public works or/and cooperative enterprises with N/P/M agencies, the
sanggunian SHALL NOT PLEDGE any sum of money beyond what is currently in the barangay
treasury or assigned for the purpose (Art. 101(a)(9))
An increase in the compensation or honoraria of the PB and SB shall be effective ONLY AFTER
THE FULL TERM of all the members that approved the increase had been completed. This does
not apply to APPOINTIVE officials.
Proceeds from fund raising shall be tax-exempt and shall go to the barangay general funds. In
appropriating such fund, the specific purpose for which the fund raising activity has been held shall
be first satisfied.
No fund raising activity shall be held within 60 days immediately before and after an election, recall,
referendum or plebiscite.

Remember: The appointment have to be concurred by the majority of the sanggunian
members.
All Secretaries, Treasurers and other functionaries shall be issued a NEW appointment.


Determine the financial health of your
barangay

Visit NGOs, churches, etc in your barangay
Reconstitute and Meet the BDC
Issue an Executive Order reconstituting the BDC
Barangay Development Council
Members of the sangguniang barangay
Representatives of the NGOs, POs operating in the barangay (25%)
Representative of the congressman
*Expanded BDC to meet the requirement of the national government for
purposes of the BUB program.
Reconstitute and Meet Other Barangay-Based
Institutions
Issue an Executive Order reconstituting the following:
Barangay Peace and Order Council
Barangay Anti Drug Abuse Council
Barangay Disaster Risk Reduction and Management Council
Barangay Council for the Protection of Children
Barangay Human Rights Action Officer
Barangay Ecological and Solid Waste Management Council

Ensure that the Barangay has an approved
Annual Budget for 2014
Punong Barangay is mandated to prepare the annual budget for the next year
in coordination with the BDC
Submit budget proposal to the sangguniang barangay for legislative
enactment not later than October 16
The budget becomes OPERATIONAL only after approval of the
sangguniang barangay by virtue of an appropriation ordinance
In case the previous PB did not prepare budget?
Without an approved budget what happens?
Administrative Requirements
Please submit the following to the DILG Office:
Bio-data with 3 pcs 1x1 ID picture of barangay officials
Appointment, Resolution of concurrence, Oath of Office and Biodata of
Secretary and Treasurer
List of Barangay Tanods and Lupong Tagapamayapa with copy of appointment
Copy of Executive Orders
IRP and mandatory standing committees
