ABOUT THE AUTHOR Tinsley Grey Sammons, 1936 is a self-educated Geezer with an abiding passion for liberty and justice. He served as an enlisted man in the Naval Reserve, the Coast Guard, and the Air Force during the Cold War and later retired from his automobile service and repair business in 1998. He describes himself as a very angry, blue-collarto-the-marrow unapologetic curmudgeon. It has allegedly been said by drunken sailors, prostitutes, and at least one muleskinner that his ability to meld the vilest profanity with impressive scholarly opinion punctuated by irreverent flatulence is unsurpassed. Perhaps regrettably, readers of this collection will be spared what is surely some of the most colorful and passionately sincere profanity imaginable. Following a rather harrowing yearlong readjustment after the destruction of our home in St. Bernard Parish by Hurricane Katrina in 2005 we settled comfortably in Gonzales Louisiana. I have intimately shared my life with this interestingly complex man since the mid-1970s. When I was finally able to proofread the entire work without making any changes I knew that against all odds I had to offer my conclusions to my fellow Citizens. Hopefully my nagging conclusions will eventually play at least a small part in the salvaging of the American Ideal so eloquently expressed by Thomas Jefferson in 1776. I fervently hope that my laboriously-arrived-at-conclusions will somehow seep through the powerful Establishment Curtain and assist those who read them in disabusing themselves of the mind-numbing effect of the structured misinformation, half-truths, deception and bald-faced lies produced by their own government and disseminated by an unpardonably lapdog media. ACETAMINOPHEN (Real Drug-related Crime) So-called drug-related crime is in reality prohibition-related crime. Absent prohibition and the prohibition inflated cost of doing illicit business, those now trafficking wouldnt bother with trying to compete with your local drugstore for customer satisfaction. It is in the best interest of the long suffering, statute-plagued American People to become aware of who the real criminals are in the so-called War on Drugs. De facto Drug Prohibition is the Alpha Precedent that continues to nullify Constitutional Restraint and pave the way for the States utter domination of the Individual. Deception and Dollars It is in the immediate financial interest of the statists to continue with the present institutionalized deception as its operatives seek new ways to Plunder by Law. Read on to discover just how criminally low the statist parasites will go: HYDROCODONE The purpose of the non-controlled drugs in combination is often twofold: 1) To provide increased analgesia via drug synergy. 2) To limit the intake of hydrocodone by causing unpleasant and often unsafe side effects at higher-than-prescribed doses. Wikipedia ACETAMINOPHEN (TYLENOL). . . acute overdoses of paracetamol can cause potentially fatal liver damage and, in rare individuals, a normal dose can do the same; the risk is heightened by alcohol consumption. Paracetamol toxicity is the foremost cause of acute liver failure in the Western world, and accounts for most drug overdoses in the United States, the United Kingdom, Australia and New Zealand Wikipedia Opioids are effective analgesics that need no mixing with other substances to control pain. Contaminating an opioid with Tylenol is a potential violence committed against persons seeking relief from pain. It is in fact intrinsically criminal and those responsible should be brought to justice. Capitalizing on state and media generated opiophobia to justify its unlawful interference in the lawful practice of medicine, unnecessary government inspired meddling in pain control is morally equivalent to inflicting the suffering. Interfering with an innocent Individuals unalienable right to Life, Liberty, and the pursuit of Happiness is a fundamentally criminal act. 4

How can an Individual possibly pursue Happiness when he is denied or simply cannot afford the cost involved in acquiring written permission to purchase the means to relieve his pain? Even worse, how can he pursue Happiness when he is experiencing the consequences of having been systematically poisoned. As the consequences of the Drug War accumulate consequences that include imprisonment and in some cases, collateral damage that includes the death of innocents the War on Drugs surely has standing as an ongoing crime against humanity that merits a reaction based on the powerful Precedent set by the Nuremberg War Crimes Trials. (There was also a lesser known but perhaps more interesting Trial of the Judges* that immediately followed the War Crimes Trials.)
*The movie Judgment at Nuremberg is a keeper and well worth studying.

A LEGAL OUTRAGE (Who are the REAL Criminals in This Endless Drama?) To control a particular pain that I will likely have for the remainder of my life, I am required by law to get permission from a licensed physician. In America today, doctors are virtually Agents of the State. In addition to my personal inconvenience, each quarterly thirty mile round trip visit involves testing and recording my blood pressure and pulse, both of which I can easily do at home for $0.00 at my convenience. But no visit, no prescription. No prescription, no pain relief. Chronic pain sufferers are probably familiar with that cute little Smiley Card displaying the facial expressions that are professional medicines best effort to actually measure the intensity of a sufferers pain. Not wanting to appear drug greedy or looking as though I wished to merely experience a chemically induced feelgood, I always absentmindedly point to the moderately unhappy face in the middle. Each quarterly visit costs about $260.00. THATS TWO HUNDRED AND SIXTY DOLLARS folks. Blue Cross pays all but $40.00 and Medicare pays the remainder. . . . And of course my wife and I pay Blue Cross . . . PLENTY! Is it any wonder that medical professionals wont join freedom lovers in an effort to repeal de facto Drug Prohibition? Yet isnt forcibly withholding the means to relieve suffering morally equivalent to inflicting the suffering. And is that not intrinsically criminal? 5

So then, for me to comply with the Draconian law, $1200 a year must be paid for permission to purchase a few bucks worth of needlessly acetaminophen-contaminated pain relief. Why are WE the People so unnecessarily fearful, and so unpardonably gullible? Surely we cannot all be that stupid. Are WE the People ever going to demand an end to this insane legal extortion? Hey my fellow Taxpayers, can you hear me . . . or do you need one of those NCIS attention getters that Special Agent Jethro Gibbs occasionally administers to his underlings? Or perhaps you need something much more violent to shock you out of your psychological torpor. Like a trip to jail for committing a non crime and the legal extortion of a considerable sum of your hard earned dollars.

ACQUIESCING IN UNLAWFUL POWER (*shrug* Well, its the law.) *shrug* Well, its the law. How many times have I heard that stupid expression of hopeless resignation when, to comfortably acquiesce in all laws it would be necessary for a person to assume that there are no bad ones. Why does a homo sapiens acquiesce in laws that stifle his very nature? Bad law should not be merely avoided thereby leaving the unwary and unlucky to be legally rendered by an insatiable faction made up of legal parasites it should be openly defied by more citizens than can possibly be arrested, jailed, impoverished or otherwise ruined by the unlawful Legal System that has supplanted the genuine Law of the Land. Know the Often Crucial Difference Lawful and legal are not synonyms. There is an ethical element in lawful that is often painfully absent from things that are legal. Encroaching Tyranny Unmistakable signs of legal tyranny have been increasingly visible in America for more than ninety years. For an opener, consider the Eighteenth Amendment along with lawyer Harrison's infamous Act1.

Principles routinely Contravened Beginning with Power that obviously contravenes Unalienable Rights, all laws that are repugnant to the July 1776 Action of the Second Continental Congress should be systematically eliminated. Laws that are expected to be the most difficult to eliminate should be eliminated first. The non-amendable July 1776 Action of the Second Continental Congress clearly establishes the philosophical, i.e., lawful, limits to Governments Power to interfere with the peaceful exercise of the Individuals Rights. In the light of the Principles that inspired the Unanimous Declaration, Americans today have greater lawful cause for rebellion than did the Colonists in 1776. WE hold these Truths . . .

A PHILOSOPHICAL LITMUS TEST Where do you stand on Drug Prohibition? This simple, straightforward question quickly eliminates the half-hearted, the hopelessly ill-informed, and the Stealth Statists. Simple is best, so keep it simple by insisting upon an across the board repeal of de facto Drug Prohibition. Interfering with an adults efforts to relieve his personal suffering is morally equivalent to inflicting the suffering. Deliberately inflicting suffering is intrinsically criminal. The insane and intrinsically criminal Drug War has brought dreadful suffering to millions. The Drug War is a Power Precedent that has been instrumental in the legislative and judicial nullifying of the Bill of Rights. Without Bill of Rights protection for the Individual, the United States is simply another totalitarian nation that systematically inflicts Draconian punishment for legislated offenses that are not real crimes. Nothing endangers the American Ideal* more than whimsical lawmaking and judicial ukase that bypasses Bill of Rights restraint. No foreign enemy could ever have damaged America as deeply as our own lawmakers and judges have succeeded in doing.
*The American Ideal is expressed with incomparable eloquence in the non-amendable Unanimous Declaration approved by Congress in July 1776.

The Nuremberg Precedent, which brought crimes against humanity to humankinds administration of Justice, is morally applicable to the War on Drugs and/or any other government sponsored crime.

ACCOUNTABILITY There is no substitute for consistent Personal Accountability and merely losing an election is as ineffective as flatulence in a hurricane. Absent personal accountability, America will continue being governed by statist criminals. Unfortunately, the ballot alone will never salvage the non-amendable American Ideal recorded July 1776 by the Second Continental Congress. Respect for Unalienable Rights should never be taken lightly. If all else fails to provide the lawful respect they merit, then the use of deadly force is morally acceptable. From a philosophical point of view, what was true in 1776 is equally true today. WE hold these Truths GATEWAY LAW

The core issue in the Drug War is not drugs themselves but the unalienable right to possess and use them. And of course it stands to reason among a free people that if a right to possess something exists, a right to market the product or substance in question also exists. Governments only legitimate interest is honesty in labeling. Beyond that its simply caveat emptor. De facto Prohibition has degenerated into a legal racket that serves opportunists, parasites, and criminals on both sides of the law. It is Gateway Law* that firmly establishes a legal, albeit unlawful, precedent for the power to violate the Bill of Rights under color of law**.
*The authors deliberately mocking take on so-called Gateway Drugs. When it comes to defending their financial turf, no lie is too absurd for the Drug Gestapo and their political handlers. Criminals each and all. **color of law. The appearance or semblance of a legal right. The term usually implies a misuse of power made possible because the wrongdoer is clothed with the authority of the state.

WE hold these Truths

AN AMERICAN HERESY Forcibly* interfering with an individuals effort to relieve his suffering is morally equivalent to inflicting the suffering. For this reason, such interference is intrinsically criminal.
*Fundamentally there are but two types of real crimes, 1. force and 2. fraud.

Today, any rational discussion of prohibition is considered heresy by America's ruling establishment du jour and its collaborating, lickspittle media. Since I am by nature hostile to Utopian Folly and I utterly detest those who profit from it, I am fiercely determined to share the conclusions I've drawn from a long and intense study of the intrinsically criminal, constructed de facto enterprise referred to as: The War on Drugs. So then, what are the prohibitionists really afraid of? Do they fear propagation of the unpleasant truth that the problem actually a multitude of personal problems they pretend to address is not only insoluble by government sanctioned force but grossly exaggerated as well? Are they afraid too, that folks will eventually wise up to the fact that a personal vice is simply not a crime? Are they also afraid of the loss in their Legal Plundering Privilege that might follow repeal? Since the real cause of a problem must be identified before any serious attempt to apply a solution can be implemented, I submit that there is a sinister financial motive behind the incrementally worsening oppression.

Cui bono?
Both philosophically and lawfully, the Declaration of Independence is America's fundamental legal source and the final authority on lawful, i.e., morally legitimate, power. The Declaration is a non-amendable promise made to every American. It is in fact a declaratory judgment recorded by the Second Continental Congress, July 1776 and enforced by the Continental Army and Patriot Volunteers. The Constitution was created to fulfill the promise of the Declaration. If it can be said that it has a weakness, it is the interpretive vulnerability of the Commerce Clause. In fact, the Commerce Clause has proven to be the Constitutions Achilles' heel1. It has given the unprincipled opportunists of America's professional politician and lawyer burdened legislative bodies virtually unbridled lawmaking power. By wrongful employment of the Commerce Clause, Americas legislators have successfully alienated unalienable rights. Politicians called judges have underwritten the crimes of the elected legislators and executives, and by so doing have become culpable accessories.

American government has become a legal Protection Racket by which a Judicial Industry continues to grow like some evil hydra. Those entrusted with our most sacred liberties have become the greed-driven Utopian destroyers of those very liberties. Whether consciously or not, individuals and factions are naturally driven by selfish interests. So then, in the absence of ruthless personal accountability, America will continue to degenerate into a totalitarian state, serving the greedy unprincipled few at the expense of the shamefully acquiescing multitude. In politics and government there is no such thing as self-limiting power, so, a significant number of Citizens must act on the certainty that elections alone will never salvage the American Ideal that is so eloquently expressed in the non-amendable Unanimous Declaration. Drug Prohibition has created an unacceptable precedent for unlawful power. The Legal System of Precedents that has supplanted the legitimate Law of the Land has little to do with justice and everything to do with politics, plundering, and profit. Judges have become haughty revenue collectors and the courts have become instruments of legal extortion. The outrageous legal income that is produced by unlawful prohibition and other unlawful power goes unnoticed by most folks. But Folks, We the People have a moral duty to ourselves and to our posterity to wake to the danger and destroy the ever-growing Bad-law Monster . . . in detail. The growing Judicial Industry has no interest in ending the evil Drug War or in the repeal of bad law generally. The unfortunate arrested victims and the taxpayers will continue to lose while the judicial plunderers grow richer with every unlawful arrest. The moral legitimacy and the actual lawfulness of powers that are systematically disregarded with a clear conscience by more than 30 million Americans ought to be seriously questioned by every American worthy of American Citizenship. DEFENDING THE AMERICAN IDEAL

Lawful and legal are not synonyms. There is an ethical element in lawful that is often

painfully absent in legal. Power that is legal can be lawful only when it does not offend a healthy conscience. And if it offends a healthy conscience, it surely contravenes the Principles underpinning the Unanimous Declaration. No power that contravenes the principles supporting the non-amendable July 1776 10

Action of the Second Continental Congress can rightly be considered lawful. Legal, yes . . . but lawful, no. Odd though it may sound to most folks, a growing number of unlawful laws do in fact exist. So then, since it has long been evident that elections alone will not rid Americans of the burden of the bad laws that support unlawful power, what are concerned citizens to do about it? WE the People surely cannot turn to lawyers and career politicians, a disproportionate number of whom are lawyers. Those who wield power and enjoy the wealth and privilege that power provides are unwilling to relinquish any part of it, even when it is clear that a particular power is downright evil. Did not Madison warn of such a development in Federalist Number 10? According to Madison:
By a faction, I understand a number of citizens, whether amounting to a majority or a minority of the whole, who are united and actuated by some common impulse of passion, or of interest, adversed to the rights of other citizens, or to the permanent and aggregate interests of the community.

Sixty-three years later, French economist Frederic Bastiat shared the following dreadful conclusion:
The law perverted! And the police powers of the state perverted along with it! The law, I say, not only turned from its proper purpose but made to follow an entirely contrary purpose! The law become the weapon of every kind of greed! Instead of checking crime, the law itself guilty of the evils it is supposed to punish!

In what is now an America ruled yes, RULED! by statists, and the law becomes more perverted with each succeeding regime yes, REGIME! A significant number of Americans are aware of the general perversion yet they remain willing to acquiesce in, and sometimes actively support, truly dangerous exceptions to sound principles. Unfortunately, an accumulation of exceptions has the power to render sound principles powerless. Exceptions must be handled like a grenade with the pin removed, leaving the striker immobilized only by a firm grip on the spoon. The moment you relax your grip, the striker lights the fuse and Mr. Grenade is no longer your friendly personal servant. And so it is with power in the hands of statists. WE the American People have surely lost our grip. That having been said, what can be done to reestablish control of our own political destiny? If you want to find out, than read on:

An Association for Lawful Government in every jurisdiction in the United States, working in close cooperation with their Informed Grand Jury, and supporting Sui Juris Filings can defend and perpetuate the Organic American Ideal that was approved by Congress assembled in July 1776. The Whigs whipped the Tories back then and Im convinced that future Associations for Lawful Government could whip the statists along with their illegitimate Judicial Industry . . . and keep them whipped.

JUST POWERS
That to secure these Rights, Governments are instituted among Men, deriving their just Powers from the Consent of the Governed . . . Declaration of Independence

Note the qualifying adjective, just. If only just powers are acceptable, it naturally follows that unjust powers ought to be studiously and systematically rejected by principled legislators, chief executives, and judges, as well as the citizens they represent . . . and whose Unalienable Rights they are overpaid to defend. During July 1776 the non-amendable Declaration of Independence was recorded by Congress Assembled. It is the Organic Act that established the United States of America. The Act conferred the powers of government upon a territory. It established the limits of its power, so that all acts beyond the scope of the powers there granted are null and void.
Organic law. The fundamental law, or constitution, of a state or nation, written or unwritten. That law or system of laws or principles which defines and establishes the organization of its government. --Black's Law Dictionary, Sixth Edition Constitutional Supremacy and the Law of the Land This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding. -Article VI, U.S. Constitution

Why then, do WE the People acquiesce in the creation and enforcing of laws that are not made in Pursuance thereof? Why then, do we permit our servants in government to flagrantly violate their oath of office?

Future historians will surely wonder.

SWARMS of OFFICERS Although public opinion is likely to be based on things that could never survive Critical Thinking, I would fight with everything that I have to preserve the right of an Individual to vote. That having been said, and since election results often in time prove disappointing, I urge my fellow Citizens to do much more than vote. The dismissive attitude of Dont blame me, I voted for --------. displayed on bumper stickers is unworthy of persons endowed with the philosophical limitations on government power provided by the Unanimous Declaration. Beginning with the Action at Law that we refer to as the Declaration of Independence, Americans are morally obliged to understand and defend the Principles supporting that incomparable document. (Rarely mentioned and surely left unread and therefore unconsidered is the Bill of Charges against the Crown.) Those Principles are as relevant today as they were in 1776. Consider this studiously powerful accusation that was openly hurled against the Crown:
He has erected a multitude of New Offices and sent hither swarms of Officers to harass our people, and eat out their substance.

Sound familiar somehow? Replace He has with Lawmakers have and the words are as relevant today as they were when Thomas Jefferson wrote them in his incomparable style more than two centuries ago. While awaiting the next election, consider a much deeper involvement in your government by creating and participating in an ALLIANCE FOR LAWFUL GOVERNMENT while keeping in mind that lawful and legal are not synonyms. (There is an ethical element in lawful that is often painfully absent in legal.) It is often said that the road to hell is paved with good intentions. And so it was on August 21, 1878 with the founding of the American Bar Association. On that day the monopolizing of the defense and administration of justice by a faction occurred in Saratoga Springs New York. But Liberty and Justice for all cannot safely be left to Americas Brotherhood of Juris Doctors alone and heres why:
By a faction, I understand a number of citizens, whether amounting to a majority or a minority of the whole, who are united and actuated by some common impulse of passion, or of interest, adversed to the rights of other citizens, or to the permanent and aggregate interests of the community. --James Madison (Federalist No. 10)

If pursuit of the Idea we call The United States of America is to be put back on 13

track WE the People cannot depend on factions and those they favor to do it for us. However, a Sui Juris filing by an Individual with the moral support of an ALLIANCE FOR LAWFUL GOVERNMENT can succeed in this noble endeavor where elections have consistently failed. The final word on Lawful Power often must be spoken and recorded in a court of law if not in the bloody streets. A system of Legal Precedents has occluded the genuine Law of the Land. That insufferable condition can only be intelligently remedied by the will of a substantial number of WE the Individuals. No election can ever do it for us. AMERICAS FORSAKEN PROMISE (A Brief Critical Analysis of the American Ideal) I seldom debate the amendable Constitution, preferring instead to champion the Principles that inspired the non-amendable July 1776 Action of the Second Continental Congress. Largely by way of incremental construction, every level of American government has degenerated into a legal abomination where the rule of lawyers and career politicians encroaches upon, dilutes, and even nullifies the birthright of every American, i.e., the right to Life, Liberty, and the pursuit of Happiness along with other duly acknowledged rights, all of which are derived from the preceding combination. Working Americans endure exhausting labor and stressful responsibility, only to see much of their substance taken by law-wielding predators for the benefit of drones, parasites, and of course, the predators themselves.
Jeffersons Explanation But with respect to our rights, and the acts of the British government contravening those rights, there was but one opinion on this side of the water. All American Whigs thought alike on these subjects. When forced, therefore, to resort to arms for redress, an appeal to the tribunal of the world was deemed proper for our justification. This was the object of the Declaration of Independence. Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject, in terms so plain and firm as to command their assent, and to justify ourselves in the independent stand we are compelled to take. Neither aiming at originality of principle or sentiment, nor yet copied from any particular and previous writing, it was intended to be an expression of the American mind, and to give to that expression the proper tone and spirit called for by the occasion. All its authority rests on the harmonizing sentiments of the day, whether 14

expressed in conversation, in letters, printed essays, or the elementary books of public right, as Aristotle, Cicero, Locke, Sidney, etc. The historical documents which you mention in your possession, ought all to be found, and I am persuaded you will find, to be corroborative of the facts and principles advanced in that Declaration. WHEN in the Course of human Events, it becomes necessary for one People to dissolve the Political Bonds which have connected them with another, and to assume among the Powers of the Earth, the separate and equal Station to which the Laws of Nature and of Natures God entitle them, a decent Respect to the Opinions of Mankind requires that they should declare the causes which impel them to the Separation. WE hold these truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of HappinessThat to secure these rights, Governments are instituted among Men, deriving their just Powers from the Consent of the Governed. That whenever any Form of Government becomes destructive to these Ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its Foundation on such Principles and organizing its Powers in such Form, as to them shall seem most likely to effect their Safety and Happiness. But when a long Train of Abuses and Usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their Right, it is their Duty, to throw off such Government, and to provide new Guards for their future Security. Such has been the patient Sufferance of these Colonies; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain [George III] is a history of repeated Injuries and Usurpations, all having in direct Object the Establishment of an absolute Tyranny over these States. To prove this, let Facts be submitted to a candid World.

WE hold these Truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights That which is self-evident is so ingrained in the human psyche that it sparks no debate. Since every individual is an end in himself, with lawful title to himself, every individual is endowed with precisely the same unalienable rights. Unalienable means precisely that, un-alienable. This is the natural law that never changes. An incomparably eloquent expression of the American Ideal, the declaratory judgment referred to as the Declaration of Independence is the lawful wellspring for American jurisprudence. So then, why have Americans so foolishly relinquished their birthright to Life, Liberty, and the pursuit of Happiness? 15

Note how the late Soviet Union a monstrous experiment in ruthlessly enforced socialism eventually imploded into the moral vacuum of its own fundamentally flawed philosophy. Unfortunately for Americans, the collapse of the Soviet Union left the United States burdened with a bloated bureaucracy desperate to justify and perpetuate itself in order to maintain the financial status quo. Those who wield power and covet the wealth that power provides willingly relinquish neither, so, close on the heels of the Soviet collapse, a grossly exaggerated drug danger was repeatedly heralded and the existing phony drug war intensified, allegedly to "rid America of this scourge". It hasnt been successful and it never will be, but crises, whether real or fabricated, always expand a government's power at the expense of liberty and justice. Recklessly responding to 9/11 in 2001, posturing lawmakers granted law enforcers and the judiciary additional legal power to rudely disrespect Individual Rights. That among these are Life, Liberty, and the Pursuit of Happiness The qualifier among implies that there are additional unalienable rights yet to be identified and secured. Beginning at birth, the right to life is the primary right while the right to liberty is the value that makes all other values possible; and how could one rightfully pursue happiness without being alive and at liberty to do so? Rights secured by the Constitution have been effectively lost to unjust statutes, i.e., fundamentally unlawful yet legal power that evil men and well-meaning fools easily put to an evil use. But instead of wisely demanding that bad laws be repealed outright, Americans have fallen into the wishful thinking trap of creating more laws or tweaking existing policies while remaining oblivious to the tragically indisputable fact that it is wise to disarm and remove deadly mines, rather than depend on remembering their location. That to secure these Rights, Governments are instituted among Men, deriving their just Powers from the Consent of the Governed Thomas Jefferson was a peerless wordsmith among wordsmiths, who made his every written word count. What better way is there to secure the blessings of liberty than by creating a government severely limited to acquiring and wielding only just powers from the consent of the governed? The importance of the qualifier just simply cannot be overemphasized. The unalienable rights expressed in the Declaration of Independence were eventually secured by the Constitution, which was created to legally shield the Individual from excesses imposed by the government itself.

That whenever any Form of Government becomes destructive to these ends, it is the Right of the People to alter or abolish it Americas arrogant, greed-driven Judicial Industry is a monster that continues to grow and thrive on an interpretation monopoly and just plain plundering by law. Note for example how the once sensible focus on safety regulation has increasingly shifted to revenue collection. Sadly, virtually every level of American Government has never been more destructive to its founding principles than it is today. Individuals today are bitterly reaping the consequences of inexcusable ignorance and irresponsible acquiescence. And institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness. A human being is an end in himself. Therefore, an uncompromising commitment to the defense and perpetuation of individual rights merits every individuals attention and support. Firmly dedicated to principles acceptable to the very nature of Man, the Framers of the Constitution created historys first moral government but even historys most glorious covenant is irrelevant paper unless a significant number of Citizens have the knowledge and rectitude necessary to defend and enforce it. Although criminal law targets the individual, there is in reality a populations collective consciousness that often supports unlawful power. An extreme example is the lynch mob, although there are much more sophisticated examples that are systematically more deadly. During the Twentieth Century mass murder under color of law was made more efficient than ever before by combining modern technology with savage brutality. Prudence indeed, will dictate that Governments long established should not be changed for light and transient Causes; and accordingly all Experience hath shewn, that Mankind are more disposed to suffer, while Evils are sufferable, than to right themselves by abolishing the Forms to which they are accustomed Governments are armed and dangerous. Governments also have a legal, not to be confused with lawful*, monopoly on the use of force including deadly force. Since bad government can easily become even worse government, one should be patient in the face of transient wrongs however, the systematic wrongs committed by government today are well established and financially predatory rather than merely transient.

The History of the present King of Great Britain is a History of repeated Injuries and Usurpations, all having in direct Object the Establishment of an absolute Tyranny over these States. To prove this, let Facts be submitted to a candid World. Today, freedom loving Americans have more to fear from their own secretive, faction and lobby-corrupted government than the Colonists ever had to fear from their King and his Parliament. 18

He has obstructed the administration of Justice. An ordinary Citizen choosing to report a violation of his unalienable rights to the Justice Department by way of its investigative organization, the F.B.I., will quickly discover that the primary concern of government agencies is the maintenance of the imperial status quo. He has made Judges dependent on his Will alone, for the Tenure of their Offices, and the Amount and Payment of their Salaries. In the endless Power versus Liberty struggle, the record of the judges is worse than merely disgraceful some of it is intrinsically criminal. Federal judges and Supreme Court justices serve life terms in office, although some should be banished for life to some remote atoll for the lives theyve unjustly ruined. Ruthlessly creating and imposing bad law upon the common folk, legislators and judges systematically violate the genuine Law of the Land for the financial benefit of themselves and the establishment they serve. Once Americas worsening Legal Holocaust is exposed, informed grand juries ought to issue the Presentments* necessary to order their individual indictments for their systematic crimes against humanity.

He has erected a multitude of New Offices, and sent hither Swarms of Officers to harass our People, and eat out their Substance. Freedom is being incrementally submerged into a political cesspool brimming with regulations, prohibitions, and punishments. The Judicial Industry systematically impoverishes and often imprisons harmless citizens made criminal by legislative license and judicial ukase. For imposing taxes on us without our Consent. With unlimited power to tax* and spend, so-called representatives arrogantly betray the taxpayers among their constituents by squandering huge sums of money on patently unlawful programs.

For depriving us in many Cases, of the Benefits of Trial by Jury. Those arrested are at the mercy of the Judicial Industry, which, by virtue of its usurped control of grand juries and its exclusive license to inflict severe consequences for the disobedience of laws whether good or bad, has monopoly control over justice or the absence of it. Since constitutional due process is an impediment to quick profit, the Judicial Industry dispenses with it whenever possible. Even if an accused has the financial power to defy the threat/bribe of a plea bargain, he will risk a jury that has not been informed of its unalienable right to follow Conscience and vote to acquit in righteous defiance of bad law. In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated Injury. A Prince whose Character is thus marked by every act which may define a Tyrant, is unfit to be the Ruler of a free People. Repeatedly trying to elect away what is essentially a legal problem that should be remediable in a court of law simply wont work. Sadly, few Americans seem aware that the Declaration of Independence is Americas primary judicial source. It is the philosophical bedrock upon which Americas Constitution stands. Any and all power that is repugnant to the principles that inspired the Unanimous Declaration is unlawful and should be eliminated. The worst of the existing unlawful power has been conferred by fraudulent employment of the 20

Constitution's Commerce Clause. If it can be said that the Constitution has an Achilles' heel, it is surely the Commerce Clause. In spite of the philosophical clarity of our Constitution, subsequent judicial interpretations by politicians called judges support and perpetuate the legal fraud that is now being imposed on the Many for the financial benefit of the Few. Since fraud and its consequences are intrinsically criminal, it is unfortunate that peace officers are called upon to participate in judicially approved crime. Compelled by legislative and judicial fraud, the peace officer must face the outraged, and sometimes enraged, victims of unjust laws laws that are created and underwritten by career politicians, legislating lawyers, and judges. These so-called servants of the People systematically violate their oath to defend the Constitution, which is supposed to be the fulfillment of the non-amendable promise known as: The Unanimous Declaration. More than anyone, peace officers should despise the legislating looters and judicial despots who create and underwrite unjust laws. It is the peace officers who must do the dirty work of enforcing each law for better or worse. It is the cop who must be the highly visible bad guy in the public eye. Its the cop who must sometimes put his life on the line while politicians responsible for the perpetuation of many unjust laws safely reap financial benefits far in excess of a policemans modest pay. Its the cop and not the legislators and judges who must face his fellow Citizens with the consequences of the Establishments cruel Utopian Folly. Where are the affluent juris doctors and sweettalking politicians while the lowly cop patrols the killing fields in American cities? Officer, you too are a Citizen subject to the equal protection of the laws. As such, you should carefully consider the incremental increase in unlawful power wielded by the increasingly evil Judicial Industry that you now serve at the expense of ordinary working folksfolks who once trusted you to protect their unalienable right to life, liberty, and the pursuit of happiness and all rights philosophically derived therefrom. A peace officers modest income is usually much less than that of the legislators, judges and other lawyers who are the major beneficiaries of the unjust statutes now ruthlessly imposed on his fellow Citizens. Today, unjust laws support an enormous Judicial Extortion Racket, and it is the police who are required to make and retrieve the kills for the law-privileged parasites to financially devour. THEY prosper by sacrificing YOUR honor, decency and self-respect. PAIN, PROHIBITION, and PLUNDERING Why do adult Americans insist that their Government treat them like children? Following 21

shoulder surgery that was a little more than fifty percent successful, I continue using hydrocodone for pain control. If I choose to replenish my supply legally, I must periodically make a thirty-mile round trip in order to get expensive written permission from a de facto agent of the State called, a doctor. In my case he's a seemingly disinterested pain control expert who has absolutely no way to determine whether or not my pain is real . . . and likely does not care beyond avoiding outrageous legal consequences. The Controlled Substances Act is clearly a contravention of the spirit of the nonamendable Unanimous Declaration and the spirit of the Bill of Rights as well. In addition to effective pain control, the Hydrocodone I ingest actually makes me feel good, a real perk for a weary retired Geezer with a body worn by decades of labor. But I wouldn't divulge that to the doctor since self-medicating to feel good is frowned on in America. In fact, I'm convinced that drug manufacturers deliberately eliminate the feelgood inherent in some drugs to discourage individuals from using them recreationally. Hydrocodone sold in America is unnecessarily adulterated with acetaminophen which does nothing more than introduce unnecessary toxicity. So then, from the prohibitionist's point of view, it's okay to be disease and pain free but it's not okay to feel good while you're doing it. This is considered so important to those who insanely perpetuate the War on Self-medicating and Chemical Self-pleasuring that drug manufacturers are willing to risk a users health by increasing the toxicity of their product(s). Are all the lawyers in America asleep? Cmon guys, initiate those

lawsuits before folks wise up and unite in Justice Fellowships, then file Sui Juris, thereby leaving you out of the financial loop.

Why is an adult American a citizen of what was once considered the most free nation in the world forced to get permission from an agent of the State to purchase that which ought to be honestly labeled and available on the free market at a reasonably competitive price? Why should an outrageous and unnecessary de facto broker's fee, along with prohibition costs, be added to the cost of relief?

Cui bono?
Indeed, who benefits? When subjected to critical thinking, it becomes clear that the stupidly Utopian War on Drugs has degenerated into an institution that does nothing more than provide political distraction and financial fodder for opportunists and parasites on both sides of the law. Frederic Bastiats term Plunder by Law fits the Drug War perfectly. The Drug War is fueled with exaggerations, sensationalism, half-truths, lies, and unfounded fears. Adult Americans would be wise to muster the resolve necessary to 22

disabuse themselves of this dreadful precedent for unlawful government power. EVIL-CREEP (Choosing to be Ruled by a Lesser Evil) Half-measures avail us nothing but disappointment and suffering in the end. Philosophically, when faced with two evils it is probably best to choose neither. When faced with two good things, whenever possible choose both. Human nature being what it is, a winning candidate for office will not consider himself an elected lesser evil; instead, if he even bothers to care he will conduct himself as though those who elected him support his agenda, however unlawful it might be. Regardless of the possibility of gaining some temporary advantage for myself, I cannot violate my own conscience by encouraging those who are intellectually dishonest or downright wicked. The lesser-of-evils vote has resulted in the two major parties becoming virtually indistinguishable in their actions - they are in fact near-identical factions seeking control of an enormous economic turf. Once they are in office, they sleep with the enemy by routinely engaging in what is referred to euphemistically as "bipartisanship". The lesser evil is still evil. Consider the cumulative effect of choosing the lesser evil for half a century and a dozen presidential elections. In the very early days of car making, when automobiles were fabricated and assembled by hand, there was a problem called error-creep. As the machine was assembled, the fabricate-'em-as-you-assemble-'em method never quite resulted in parts that fit uniformly, so, they had to be modified. The modifying continued until there was an increasingly serious misalignment of modified parts that had to be laboriously dealt with in order to complete the assembly. Like the semi-cobbled cars with their awful error creep, American regimes du jour, and the factions that they serve, suffer from evil-creep. So severe is evil-creep today, that it has all but nullified the Bill of Rights . . . unpardonably alienating certain unalienable rights. The consequences of evil-creep have become so dreadfully un-American, that it is unlikely that anything less than a Philosophical Renaissance or a bloody revolution can restore America to it's former philosophical righteousness. For me to vote for what I know to be merely a lesser evil is an insult to my common sense, and my hard earned critical thinking skill as well. Faced with such a dilemma, I'm 23

convinced that it is simply best not to vote. Perhaps someday None Of The Above will appear on every ballot, thereby making it possible for one who is politically disenchanted to vote his conscience. ALLIANCE for GOOD GOVERNMENT? A so-called Alliance for Good Government is rarely very good for the lawfully selfsufficient, tax-paying lay folk. I submit that any alliance concerning good government must be an Alliance for Lawful Government. And a lawful government must never initiate and support any violation or contravention of the Principles supporting the Declaration of Independence with its Bill of Charges Against the Crown. A dedicated Alliance for Lawful Government in every jurisdiction in America could reduce corruption to a manageable trickle and put the United States back on the lawful Philosophical Course chartered by the Founders. Lawfully self-sufficient lay folk would be wise to display solidarity in disabusing America of the illegitimate Legal System that has supplanted the legitimate Law of the Land. In spite of their diplomas and credentials, the Officers of the Court, i.e., lawyers, along with Career Office Holders, a disproportionate number of whom are lawyers, know nothing that any literate adult is incapable of knowing. Furthermore, the "equal protection of the laws" clause in the Fourteenth Amendment brooks no exception. And even further, they wield no lawful power not possessed by every other Citizen. Is an Officer of the Court a public sector person or is s/he a private sector person? According to attorney Michael H. Brown, "The law is the weapon, the courtroom the battlefield, the judge your enemy and your lawyer is an enemy spy." So then, whose side are attorneys really on? I submit that they are on their own side as they profitably cooperate within their de facto Brotherhood of Juris Doctors. The Unanimous Declaration became Americas organic law through the July 1776 action of the Second Continental Congress. No Power that violates or contravenes the Principles that inspired that incomparable Action has Lawful Authority.

Elections alone cannot salvage respect for the American Ideal that is so eloquently expressed in the second paragraph of the Unanimous Declaration. Fortunately, the tools exist for the self-sufficient taxpaying lay folk to take the Law of the Land into 24

By so doing they can disabuse America of the illegitimate System of Precedents and Interpretive Violence that continues to wreak havoc with Liberty and Justice. To fix our broken America, a sufficient number of lay folk need only claim their Lawful Power and display solidarity in wielding that power. Should that come to pass, the individuals now doing vile things under the color of laws that are intrinsically criminal will be squirming like fat caterpillars that have fallen into a campfire. THE STATUTE RACKET (Fueled by Drug Hysteria) Why do so many Americans continue to speak of America as a free country when it obviously isnt? The Founders of the Constitutional American Republic would surely be disgusted with the Statute Racket that is engulfing the magnificently unique nation they created. Drug Hysteria Although drug hysteria has recently subsided a bit, media and political inertia continues to fuel the statutory abomination known as the Drug War. Why statutes have no sunset clause simply makes no sense.
I maintain that drug abuse and the War on Drugs are both transitory modes pretexts for scapegoating deviants and strengthening the state. Our official understanding of the drug problem rests on a fallacious scapegoat-type imagery and a correspondingly erroneous approach to remedying it. For example, we conceptualize self-medication say, with marijuana as self-poisoning rather than as self-pleasuring, and then rely on this image of the drug as poison to justify using state power to punish people who possess marijuana. Sadly, the electorate rarely generates collective passion strong enough to cause a persistent demand for the repeal of an unlawful statute. In time such statutes become so firmly embedded in the electorates collective consciousness that they become all but immutably acceptable because, that's-just-the-way-thingsare-and-you-cant-fight-city-hall. However, a sunset clause would overcome such awful inertia the way a hurricane extinguishes a marsh fire. OFF THE STREET Drug Prohibition ought to be repealed so that adult Americans can safely purchase their properly labeled drugs of choice from licensed sellers at a reasonable price. After decades of waging the so-called War on Drugs, drug agents still try to justify their outrageously expensive criminal existence by boasting that they "Get the drugs off the street". But of course thats utter nonsense. They surely know that Drug Prohibition is what drove much of the drug market to the street in the first place. A real crime must involve force or fraud. It has been painfully obvious for decades that prohibition inflated prices actually generate such crimes. Prohibition is in fact a color of law racket that does nothing more than create financial opportunity for parasites on both sides of the law. It's the money that generates most so-called drug related crimes, not the physiological effect of the drugs themselves. Why do Americans today tolerate the incremental re-imposition of abusive Government Power, something from which Americans have supposedly fought to be free since 1776? I suggest returning to American Basics by keeping a copy of the second paragraph of the Declaration of Independence handy at all times. By repeatedly subjecting it to Critical Thinking, an individual willing to do so just might eventually evolve into a philosophically competent human being. 26

SEVERELY LIMITED POWER No Power that contravenes the Principles underpinning the July 1776 Action of the Second Continental Congress has Lawful Authority. Such Powers should be systematically repealed because they should never have been created in the first place. Lawful and Legal are not synonyms. The legal absurdities they support have emasculated the Bill of Rights. The interpretive removal of Bill of Rights protection for the Individual is a moral abomination. The Supreme Courts numerous split decisions prove beyond a reasonable doubt that they serve a political agenda and that they surely know precisely what they are doing. Compounding their legal treachery, when their posturing concerning probable cause demanded by the Fourth Amendment was exposed, they constructed the good faith exception to the exclusionary rule, thereby giving police a virtual Writ of Intrusion*. These elitist criminals are as spiritually alien to the common folk as were antiquity's worst despots.
*Writ of Intrusion originated with the author and is fictitious. It was inspired by the Writ of Assistance which was instrumental in bringing about the American Revolution. Drug agents routinely trample the Bill of Rights and then cover their crime by TESTILYING when necessary.

The systematic nullification of the Bill of Rights today is essentially a product of unlawful prohibition. This witch-hunt; this fabricated crisis; this monstrous now institutionalized instrument of unbridled police power and judicial extortion has cost Americas taxpayers billions, while costing some unfortunates their lives as well. Government creates crises to justify its excesses while urging folks to surrender their liberties for the sake of "our" children. But the Drug War is only a politics and profit motivated persecution of persons who choose self prescribing and/or recreational alternatives to alcohol. Like prostitutes, theyre an easy target. The horrible excesses of America's legal system only make sense when the system is recognized to be the color of law racket that it really is. THE JUDICIAL INDUSTRY The Judicial Industry will continue to grow and its excesses will remain unchecked as long as Americans depend on nothing more than the ballot for control and accountability. The ballot alone will afford the People precious little of either. Beginning with the Controlled Substances Act and unjust statutes derived therefrom, all power that contravenes the principles underpinning the Unanimous Declaration should be repealed outright. Timidly begging for the so-called legalization of marijuana merely concedes to government the unlawful power to prohibit selfmedicating and chemical self-pleasuring with alternatives to ethyl alcohol. Philosophically, the Legalizers actually do more harm than good. If marijuana prohibition were repealed, I wonder how many of the Marijuana Legalizers would continue to acquiesce in the persecution of persons who use other drugs. Even worse, considering the human capacity for hypocrisy, I wonder how many would actively support it?

THE LAW PERVERTED The law perverted! And the police powers of the state perverted along with it! Bastiat's powerfully enlightening work, THE LAW can be downloaded free. Every concerned American would be wise to have a copy among his study and reference works. At this stage of American history, candidates should be asked which laws they intend to repeal. They must somehow be made to publicly commit to it. When it comes to making new law, the first law that should be ratified is a law requiring an expiration date for statutes involving arrest for nonviolent offenses. Office holders could simply let sumptuary laws expire unchallenged with little or no political risk. Elections alone will never disabuse Americans of bad law. Folks would be wise to show solidarity by creating and supporting Justice Fellowships. Ideally, every adult American would possess knowledge sufficient to seek redress by filing sui juris while his local Justice Fellowship and Grand Jury backs him to the hilt. With enough public pressure, even the Mainstream Media could be forced to come to its senses and routinely conduct itself in an honorable fashion. Since half-truths are often more dangerous than whole lies, half-truths and deliberate deception must be avoided if the trust the Founders put into the First Amendment is to be respected. SEVER the JUGULAR Since 1913, the relationship between the Individual American and his Government has degenerated into something that the Founding Fathers would surely never condone. And nowhere is this more obvious than with Drug Prohibition. The War on Drugs is a legal abomination that has supplied the Power Precedent that is proving instrumental in the destruction of Constitutional American Liberty.

Speculation that thirty-million Americans use recreational alternatives to ethyl alcohol is of no legal concern to me or my government. The relative few who are substance dependent must find their own way out if they wish to do so. If they desire to do so, those who have found their comfort level should be left alone to maintain it. They alone must bear the personal consequences of their choice. Interestingly, withdrawal for both heroin dependence and alcohol caused delirium tremens both peak in 72 hours. Although it seems an eternity to the sufferer, 72 hours is a very short time. (The 21 years* that Ive been alcohol free have been more than worth my own torment-wracked 72 hour** investment.) At least three formerly dependent heroin and alcohol users have told me that for them derilium tremens was much worse than symptoms experienced during heroin withdrawal. So then, if youre hooked, tough it out for three days** and then make a daily commitment thereafter and eventually you can comfortably keep the beast at bay by simply not using. A bit of advice is relevant here: If one wishes to recover, hanging out with those who have long succeeded is the smartest thing one can do.

If there is ever to be an end to the growing tyranny facilitated by the evil Judicial Industry and career office holders, it must be accomplished by an enforced respect for the legitimate Law of the Land. Deliberate violations of the Fourth Amendment should be dealt with by grand jury Presentments**, ordering the indictment of those who systematically violate the Law of the Land under color of law.

Petit jury members should always vote to acquit citizens who are accused of violating unjust laws. A person who has done nothing intrinsically criminal should not have been arrested in the first place because unjust laws should not exist in the first place. In addition to the acquittal of the victim of an unjust law, justice demands remedy for his injury at the hands of government. Searches and seizures based upon laws and judicial interpretations repugnant to the 32

spirit of the Declaration of Independence are morally illegitimate; therefore, they are unreasonable; therefore, they cannot rightly be constitutional. They are in fact, criminal. The all but forgotten precedent established by the Nuremberg War Crimes Trials and the lesser known Trial of the Judges should be applied in order to hold agent predators and judicial parasites accountable for the injury they've inflicted upon individuals by systematically violating the Bill of Rights under color of law. The systematic misuse of police power in America is sanctioned by statutes and supported by statists. Jurors should recognize the moral legitimacy of self and property defense, and acquit defendants accordingly. Should persons who force their way into a harmless person's abode for the purpose of depriving him of his lawful existence be shot dead by their intended victim, acquittal is in order. Better yet, the grand jury should refuse to indict in such cases of obvious self-defense. A person's effects might reveal his harmless personal peculiarities as well as other information that has nothing whatever to do with probable cause or justice. Today, Drug War victims go to jail while their papers and effects lead to the arrest and persecution of others. Then, their papers and effects can lead to the arrest and persecution of others . . . then . . . damn! Where does it end? Cui bono?! No conspiracy or so-called pusher is necessary to sell drugs because drugs sell themselves. Drugs promote healing and otherwise reduce suffering while recreational drugs simply make a person feel good and enhance fun. To think that persons ingest alcohol hoping to develop cirrhosis and smoke cigarettes hoping for cancer is absurd. If most drug experiences were unpleasant, there would be no demand for drugs.

Only fear born of ignorance can delay Man's libertarian destiny. Right of assembly must be respected if man is to cross the abyss that separates what he is, from what he is to become. Woodstock failed to discredit the myth of violent, drug-crazed people. Today, alarmist fictions are propagated by the favored factions with more rabid fervor than ever, but one need only follow the money trail to discover why there is a relentless War on Fun. Those unforgettable 60s were a fun-filled reactionary happening that failed because it 33

had neither a philosophical goal nor the strategic focus necessary to achieve that goal. The symptoms of the unlawful government power disease were attacked without isolating the political and financial pathogens responsible for it. Appearing to be protest just for the hell of it, the Youth Rebellion of the Sixties lost its passion for justice when America's Armed Forces left Vietnam. During the Sixties, young Americans stumbled onto America's libertarian roots but they mistakenly believed in the invulnerability of constitutional American liberty. Consequently, they failed to recognize the significance of their discovery. Their failure to convincingly re-secure their unalienable rights left the way clear for encroaching oppression. Sadly, many of today's statists are descendants of Flower Children. Even more sadly, many surviving Flower Children have become hypocrite statists with age. But what about anarchy? When members of the favored factions warn of anarchy, what they are really saying is this: It is better that you continue to acquiesce in the established abuse of power rather than risk the irresponsible abuse of freedom that might follow in its absence. But it is not anarchy per se that the Favored Factions fear. The Favored Factions fear an ignominious end to their profitable status quo. Anarchy is a virtual fiction of the imagination since new government rises quickly from the ashes of old. What should be feared most are the crisis-makers. Crisis-makers are deceivers who manufacture fears in order to profit from the very fears that they themselves have manufactured. Sacrificing principle to expediency always brings government eager to impose profitgenerating excesses. Those who presume to save us from ourselves are systematically alienating our unalienable rights to Life, Liberty, and the pursuit of Happiness. THE LEGALIZERS ERR The Legalizers approach to ending the Drug War is fundamentally flawed. They fail to challenge the lawfulness of what is in fact a persecution of individuals who choose to medicate themselves without paying for written permission from a licensed professional. Today, Americans risk severe punishment by choosing to pleasure themselves with alternatives to ethyl alcohol. Why so few Americans fail to recognize the real criminals in this relationship is truly astonishing. A daily study of the Unanimous Declaration could surely clarify it for them.

No power that is repugnant to the principles underpinning the non-amendable July 1776 Action of the Second Continental Congress has lawful authority. The only legitimate role that government has concerning drug possession and use is in proper labeling and enforcing the substance users personal responsibility for the consequences of his actions. Being intoxicated or stoned is not a crime per se but recklessly endangering others by driving under the influence unarguably is. Sunset Clause Announced in 1972 by President Richard Nixon, the legal train wreck referred to as the War on Drugs has continued on for nearly forty years before a Congressman found the courage to identify it for the record as unconstitutional. Incredibly the media ignored, and continues to ignore Congressman Ron Pauls courageous admission. The insane and enormously expensive Drug War continues while more Americans are arrested and others continue to languish in prison. How can that possibly be? What has happened to cause Americans to spiritually abandon their lawful heritage? There is no more evident reason for a Sunset Clause, i.e., expiration date, being a part of legislation. A bad law could simply be allowed to expire without elected office holders courting disfavor by some of their constituents by initiating the repeal of bad laws. Sumptuary laws generate an abuse of power that is surely criminal. The need for a Sunset Clause is so compelling that it cries out for an amendment to the Constitution making it a mandatory adjunct, especially to sumptuary statutes. Institutions Die Hard The Drug War is in fact a monstrous legal racket that benefits opportunists and parasites on both sides of the law. Financially successful institutions die hard . . . very hard. In the case of the Drug War, political reputations and profits are at risk, so, slaying the unconstitutional monster wont be easy.

Why the Monster Must be Slain The so-called Drug War is actually a legally sanctioned persecution of individuals who choose self-prescribing, and self-medicating over seeking inconvenient and outrageously expensive written permission from a de facto agent of the state who is licensed by the state to practice medicine. Along with those who are actually suffering there are many individuals who choose chemical self-pleasuring with alternatives to ethyl alcohol and they certainly have the natural right to do so. A Dreadful Precedent In America today an illegitimate Constructed System of Precedents has supplanted the legitimate Law of the Land. As long as Americans acquiesce in de facto Drug Prohibition and the unconstitutional Drug War, no serious objection can be made to any laws, existing or proposed, that do not appear to exceed the atrociousness of the laws supporting the Drug War. The Sixteenth Amendment along with lawyer Harrisons infamous Act blew the gate wide open and even paved the way for the eventual construction of a totalitarian American State. Salvaging the American Ideal The American Ideal became a non-amendable matter of record in 1776. Since that time, elections alone have proven incapable of enforcing respect for the American Ideal. So then, what can be done? I suggest that the persons not favored by the regime du jour and the establishment that it serves, show solidarity by creating and supporting an Association for Lawful Government in every jurisdiction in America. In time, with input from critical thinkers, a National Network of Associations could wield enough power to begin serious efforts to salvage the American Ideal. RELIGION, COMPASSION, TOLERANCE, and STATISM How many times have supposedly compassionate American Christians and Jews used statutory power to send harmless Individuals to prison for violating the morally unsupportable drug laws? As their numbers grow, I suppose in time American Muslims will get in on the act. In certain other parts of the world they have already legally murdered traffickers, i.e., providers who at considerable risk to themselves merely sell people something some folks want and are willing to pay prohibition inflated prices to acquire and use.

A statist is a person who knowingly supports such an abomination. The loathing I feel for statists is beyond the capacity of most folks to imagine. I would gladly see them all in hell if there is one rather than tolerate the arrest of even one person for possession or some other statutory nonsense. There are no more hateworthy people than statists. Statists* are truly the scum of the earth, provng beyond a doubt that merely being well dressed with a formal education cannot of itself make a person good. History's millions of dead, maimed, and forcibly impoverished innocents are irrefutable proof of that. Bad law should not be merely avoided, since mere avoidance does nothing to 38

disabuse Americans of unjust government power. Instead, bad law should be openly defied by more citizens than can possibly be arrested, jailed and otherwise lawimpoverished for the benefit of legal parasites. On any given day more on weekends millions of Americans will medicate themselves without legal permission and/or use recreational alternatives to ethyl alcohol. Most of the persons they encounter while under the influence will be none the wiser unless a third party or the harmless Stoner himself chooses to tell them. Nearly all of Americas illicit drug users will continue minding their own business while harmlessly living their lives. They have committed no real crime and it is not within the lawful province of government to treat them as though they had. The Drug War is financial turf for the Judicial Industry along with a multitude of taxsupported parasites and defiant scofflaw opportunists commonly referred to as drug dealers. At least in a spirit of free enterprise the drug dealer gives you something that you want and can enjoy in exchange for your money. STRIKE THE ROOT DAMMIT!

Concerning the growing power of government to interfere and even ruin the Life of an Individual for no morally justifiable reason, and the near total absence of effective opposition to that power, I'm convinced that pitifully few Americans are, even philosophically, actually striking at the root. The most convincing evidence supporting my conclusion is seeing the well meaning Medpotters slavishly, even apologetically, begging for the legalizing of medicinal marijuana when they should be proudly demanding the outright repeal of de facto drug prohibition on the fundamental grounds that it violates the spirit of the non-amendable Unanimous Declaration. Ayn Rand was right on when she referred to the Commerce Clause as the Constitution's Achilles' heel. With that in mind, I submit that the creation and perpetuation of Drug Prohibition is no less an intrinsically criminal violation of Individual Rights than was the Alcohol Prohibition of yesteryear, and it rightfully should be acknowledged as such. A FATAL PHILOSOPHICAL REVERSAL A most shameful, dangerous, and unpardonable philosophical reversal has taken place in the collective psyche of the American People. Most think, talk, write, and act as though virtually every human action must have the State's blessing and permission. This is nonsense since the State can only acknowledge and secure existing rights. It can neither create rights nor does it have the lawful authority to grant them since every human being is born with an equal measure. If folks really understood the uniquely American concept of severely limited government power - and every American is morally obliged to do just that - they would know that, concerning the conduct of the individual human being, Congress has no power to legalize anything, since both lawfully and legally it can only prohibit or repeal. It cannot lawfully invent crimes in the way it has done by the creation of certain sumptuary prohibitions.

BE CAREFUL WHAT YOU WISH FOR (Mistakenly establishing a dreadfully unlawful level of State Authority)

Ignorance is bliss. But only until you are made to pay for it.
Once a level of authority has been established by legal precedent, then anything that equals or does not exceed that level can easily be made legally punishable by law. If X is outlawed, then Y can also be outlawed if it falls within the level of authority previously established by having successfully outlawed X. Since emotions are subjective, individuals who approve of Y generally fail to objectively consider the level of authority whenever they think, say, or write that, "There oughta be a law against X!" So then my Fellow Citizens, if the non-amendable American Ideal, recorded by Congress assembled July 1776 is to resume its progress toward becoming a respected reality, Americans must take first things first. Although financial folly, legal plundering, and insane Utopian meddling are profoundly detestable, it is no less crucial that Americans focus on the growing number of unlawful injuries that the State can now legally inflict upon the Individual. Folks tend to think that when a power is legal, then surely it must be good or at least tolerable . . . but that simply isn't true. Many of those legal powers are actually unlawful because they violate the very principles upon which America is founded. The idea of an unlawful law sounds oxymoronic but contrary to the Founding Principles, many unlawful laws do in fact exist. The expression "Plunder by Law" used by Frederic' Bastiat is as relevant today as it was in 1850 when Bastiat authored his incomparable classic titled: THE LAW. Were I a civics teacher or a law professor, my students would not be permitted to avoid a deep immersion in Bastiats THE LAW. http://bastiat.org/en/the_law.html AMERICAS ECONOMIC TIME BOMB At the expense of fundamentally more important issues, opinionists, especially the overpaid blatherskites among and over us, have tediously mined the Financial Folly issue down to a level of utterly repetitious boredom. at all. If indeed the sky is falling it is taking a very long time for it to crash upon us. So far, intrinsically criminal Inflation* has managed to keep the monster aloft . . . but for how much longer?

Economics, politics, crime, and law are inseparable. Fortunately, habitual criminals among the Layfolk are a relatively small and manageable minority. With this in mind, I am convinced that once the lawful relationship between the State and the Individual is legally secured and enforced, the economic folly plaguing America today will naturally disappear much more rapidly than it took for it to evolve by a gradual construction. STATE v INDIVIDUAL A strategic private sector move to strategically destroy in detail the unlawful power relationship that has long existed between the Individual and government is decades overdue. Overdue for nearly a century in fact, since no such unlawful power should have been tolerated by the Layfolk and their representatives in the first place. Now more than ever, righting the relationship is simply the right thing to do. Interestingly, if those lawful principles that should determine the legal relationship between the Sovereign Individual and the Servant State were passionately respected and systematically defended, then the financial folly and systematic plundering so sickeningly routine today simply could not continue. WE hold these Truths . . . ANARCHY Words like anarchy suffer from the absence of a generally agreed upon understanding of their meaning. Anarchy is a popular buzzword employed by persons on the profitable side of the Establishment Curtain, which is the major bifurcation in American Society that separates the privileged from the hoi polloi. It is used in response to expressions of disenchantment from persons on the non-favored side of the curtain, i.e., the private sector working folks who pay the bills. Those on the profitable side quite naturally prefer that the status quo be perpetuated indefinitely. The very nature of Man is intolerant of anarchy. Thugs, opportunists, and even baboons will never allow a state of no rule to endure. 42

A RUDE AWAKENING Like most White Southerners born in 1936, I grew up navely believing that Americans are the only truly free people in the world. Like countless others who enlisted in the Armed Forces in the early 1950s and later watched Perry Mason on black and white television, I was comfortable just knowing that since I was harmless, I was safe. In those days, in the absence of informed perception and critical thinking skill, I could not have imagined that institutionalized injustice and Plunder by Law would eventually reign in what I had always believed to be the most just of all nations. After all, we Americans do have a Constitution to protect us, dont we? And its free, isnt it? Sadly, my smug repose was shaken long before my fortieth birthday. Reflecting on my past navet, I wonder just what I expected my Constitution a covenant that I irresponsibly neglected to study prior to 1992 at the age of 56 to do for me? Did I think that if I were unjustly arrested, an all-wise and learned judge would ponder the issue and then perhaps say, The statute that you have allegedly violated is unconstitutional, Mr. Sammons. Case dismissed! Oh, and by the way, would you like charges to be filed against those who conspired to have you arrested in violation of your unalienable rights? Strike One! Many years ago, I was shocked while reading an article in Readers Digest titled: The Fingerprint That Lied. According to the article, thirteen witnesses testified that the defendant in question was working from a catering vehicle while the robbery he was later convicted of was occurring across town. I naturally wondered why, if a single witness can cause a conviction, then why can thirteen not cause an acquittal? Whatever happened to Common Sense? Id sure like to see a copy of the judge's instruction to that jury. Where were Matlock and Perry Mason when they were so desperately needed? In spite of those thirteen exculpatory witnesses, a single fingerprint lifted at the scene was enough to cause the jury to convict the unfortunate defendant. How could such an overwhelmingly illogical conclusion possibly have prevailed? How could twelve presumably sane jurors even marginally capable of critical thinking have failed to vote for an acquittal? And with years of a mans freedom at stake, why did such a glaring contradiction fail to generate a subsequent investigation as well? Fortunately, the victim of the wrongful conviction and imprisonment was freed two and 43

a half years later when his tenacious defense lawyer discovered that the fingerprint expert had altered the print to enhance his own reputation as an expert. I never found out what, if anything at all, eventually happened to the expert. Strike Two! Years later my son-in-law was arrested for an armed robbery that occurred while he was a mile away from the crime scene having coffee with me and two other reputable citizens. The sheriffs deputies refused to take our statements, so, poor Jim spent five fearful days in jail before the real culprit was arrested. Had it not been for an experienced investigator, moneyless Jim would likely have accepted a plea bargain, i.e., a legal threat/bribe, and gone to prison. Strike Three! In 1992, my son was the victim of a serendipity setup contrived to assist his politically influential in-laws in gaining an advantage during a child visitation controversy where accusations of drug use are suspiciously common. Probable cause for the armed intrusion and arrest was a statement made by a surely nonexistent confidential informer. How does one challenge the very existence of an accuser when the unlawful Confidential Informer Doctrine nullifies the Sixth Amendment protection of the right to face ones accuser? Whatever happened to the due process guaranteed by the Bill of Rights and the Fourteenth Amendment? Americas legal system has apparently become Domestic Enemy Number One, a monster to be feared by every person who is neither armed with wealth nor favored by the regime. And when the judge and your ex-mother-in-law were classmates in high school, it is all but certain that you arent going to get a fair shake in court. The heinous crime of having two blue valium tablets left by an overnight female guest and discovered on my sons dresser cost us dearly at the time. It also cost two little boys a relationship with their father for two long years. KNOW YOUR ENEMY Americas most crucial problem today is essentially a legal problem. Unfortunately, the Democrat/Republican election pendulum will fix nothing; rather, like Edgar Allen Poes terrifying pendulum, their legal transgressions will continue descending with each dreadful election cycle, eventually severing the last vestige of freedom from the lives of most Americans. The two major political parties are but factions seeking control of the nations financial 44

turf, which will continue being harrowed, sown, and the crops harvested by Americas neo-peasantry, i.e., the self-sufficient private sector working folks who are the one indispensable element in the health of the nations economy. UNLAWFUL POWER

The qualifier among implies that there are additional unalienable rights yet to be identified and secured. Beginning at birth, the right to life is the primary right while liberty is the value that makes all other values possible. And how could one pursue happiness without being alive and at liberty to do so? Much of our freedom is now lost to unjust laws; laws that evil men and well-meaning fools will always put to an evil use. Instead of repealing the bad laws outright, Americans have fallen into the wishful-thinking trap of creating more laws to modify or nullify bad laws. However, it is much smarter to disarm and remove mines than it is to count on remembering their location. Unlawful power must be eliminated by the outright repeal of the laws that support it. As half-hearted public outrage grows concerning unlawful government power, it becomes increasingly time consuming to examine examples of it on the Internet. In an effort to cope with the problem, I apply a simple test to determine whether or not the author is truly serious about respecting unalienable rights. My go-for-the-jugular litmus test consists of a single question: Do you support the repeal of de facto drug prohibition? If the answer is an outright yes, you know that you have encountered an individual who has done his homework and takes unalienable rights seriously . . . as well as one who has the courage to express his convictions.

may never be reached, We the People can surely get much closer to it than we are today. PLEA BARGAINS A plea bargain is a threat/bribe. As such it contravenes the Bill of Rights and the practice should be abolished. An informed jury could and should nullify bad law and counter all support for injustice. No power that contravenes the Unanimous Declaration has Lawful Authority. The real criminals in the Drug War are those who created it and those who perpetuate it for political and financial advantage. Self-medicating and chemical self-pleasuring are not real crimes. Associations for Lawful Government could free Americans from being wrongfully ruled by lawyers and career politicians. REMEMBER NUREMBERG Signs of domestic tyranny have been incrementally accumulating in America for more than ninety years. Consider the Eighteenth Amendment, along with lawyer Harrison's infamous Act. Beginning with laws that contravene unalienable rights, all laws that are repugnant to the July 1776 Action of the Second Continental Congress should be eliminated. Those who created them and those who have perpetuated them should live in infamy while some surely ought to be indicted for Crimes Against Humanity. Remember Nuremberg! Americans today have greater lawful cause for rebellion than did the Colonists in 1776. PAIN and SUFFERING (A Lesson in Simple Logic) Using threat or force to interfere with a persons effort to relieve his pain and suffering is morally equivalent to inflicting the pain and suffering. That makes it a crime simply because deliberately inflicting pain and suffering is intrinsically criminal. 46

Punishing a person for possessing the means to relieve his pain and suffering is intrinsically criminal thereby making the Nuremberg War Crimes Precedent morally applicable to the Drug War along with those who persist in conducting what is truly a political/puritanical abomination. In present day America the lunatics remain firmly in control of the asylum. Will Americas good people ever tire of the absurdity? ACCOUNTABILITY There is no substitute for consistent Personal Accountability and simply losing an election is as ineffective as flatulence in a hurricane. Absent personal accountability, America will continue being governed by statist criminals. Unfortunately, the ballot alone will never salvage the non-amendable American Ideal recorded July 1776 by the Second Continental Congress.
