16TH Circuit Court JACKSON COUNTY, MISSOURI Details of Commissioner Sherrill Rosens misconduct include: 1) Commissioner Rosen formed a personal bias and prejudice against Petitioner Robert Jackson during the initial case filed to declare paternity and institute child support for the child Evan Crawford in 1998. During the course of the trial Petitioner was informed by the mother, Dana Crawford, that the child was not his on numerous occasions. Based on the information Petitioner requested his lawyer drop the case and dismiss all claims for paternity. Petitioner believed the case had been dismissed and was never informed by the court of any further proceedings by the court. The court and Commissioner Rosen intentionally withheld information from Petitioner Robert Jackson by delivering further correspondence to an incorrect address. All correspondence had been delivered to the correct address listed on case documents until the final hearing and resulting Judgment of Paternity, Custody and Support dated July 20th 1999 rendered by Commissioner Sherrill Rosen. Commissioner Rosen intentionally withheld case details, hearing dates and judgment from Petitioner Robert Jackson by delivering correspondence to the incorrect address of: Robert M Jackson 9207 Jackson Kansas City, MO 64114 The correct address on file with petition and previous court correspondence is: Robert M Jackson 9207 Central Kansas City, MO 64114 2) When Petitioner Robert M Jackson learned of the judgment entered against him from a phone call from the Respondent Dana Crawford in January 2007 the Petitioner Robert Jackson retained counsel and filed a Motion to Modify with the court. Commissioner Rosen once again showed her personal bias, prejudice and lack of impartiality when she held Petitioner Robert Jackson in contempt of court and imputed him income of $70,000 to justify her improper prior judgment without any legal basis. Petitioner was not in contempt of court since he had no previous notice of the court Judgment. 3) Commissioner Rosen permitted external influences to sway her opinion and conduct within the court by meeting with Respondents legal counsel multiple times outside of court where she permitted Respondent to present false information, hearsay and evidence.

Proof of this is shown through Commissioner Rosens determination and biased personal opinion she shared in court that Respondent was a Con Man although no evidence of any prior or current illegal activities or cons had been presented in court. 4) Commissioner Sherrill Rosen intentionally and with malice false arrested Petitioner Robert M Jackson for contempt of court during Petitioners Motion to Modify hearing on 8/22/2007. Petitioner Robert M Jackson was remanded to Jackson County Department of Corrections with no bond or court date. Court records clearly indicate that notice of judgment and hearings was never delivered to Petitioner Robert M Jackson. When Petitioner Robert M Jackson and legal counsel Allen Russell informed the court that Petitioner had no prior notice of Judgment from the court; Commissioner Sherrill Rosen became verbally abusive, intimidating and threatening to Petitioner. With personal bias and prejudice, Commissioner Sherrill Rosen took it upon herself to produce and present unverified evidence. Commissioner Rosen personally located and presented at the hearing an unsigned fax sent to Jackson County from an unknown party dated 01.01.1999 from fax number 111-111-1111 as her personal opinion that that Petitioner may have sent the unverified fax to the court requesting information about the judgment. There was no chain of custody for the evidence Commissioner Rosen presented nor was it appropriate for the presiding judge to present evidence from her personal files at a hearing without first establishing a chain of custody, verification of legitimacy or notification to Petitioner or Respondent. 5) Commissioner Sherrill Rosen has not conducted herself with the demeanor or decorum proper for a judge with impatient, undignified and improper verbal abuse, interruptions, screaming and insults at multiple court hearings. This misconduct has been directed multiple times at lawyers, witnesses and Petitioner. 6) Commissioner Sherrill Rosen intentionally placed her personal opinions and bias above the rule of law when determining judgments. Commissioner Rosen has not been open minded or presented good faith when considering evidence. Respondent presented printed documents from the Internet that was determined to be false and not admitted for the court hearing on 8-22-2007 yet when Commissioner Rosen shared her judgment she specifically referred to the false documents that were not admitted as a basis for her judgment and incarceration of Petitioner without bail or bond. Commissioner Rosen has repeatedly ignored facts and evidence presented at hearings by Petitioner or legal representatives of Petitioner. Commissioner Sherrill Rosen was presented with original documents including income records, social security records showing income per year ever of Petitioner Robert M Jackson, medical, bankruptcy proceedings in progress for Petitioner Robert M Jackson by Judge Charles C. Curry and low income assistance payments from the State to Petitioner Robert M Jackson at Motion to Modify hearing on the 22nd day of August 2007. Commissioner Sherrill Rosen intentionally and maliciously violated the rights of Petitioner Robert M Jackson ignoring

documented facts to impute income to the Petitioner in the amount of $70,000 per year based on past earnings and lifestyle of Petitioner. Past earnings records were presented in court showing no more than $24,000 from any single job or past employment which, in no way, supports an income of $70,000 as imputed by Commissioner Sherrill Rosen. Transcripts from Modification Hearing 22nd day of August 2007 are clear that Petitioner Robert M Jackson had no income, the home Respondent lived in with his family was foreclosed in 2005 and Petitioner never owned any of the vehicles Respondent Dana Boyle (formerly Crawford) expressed she had seen the Petitioner around. Judgment rendered by Commissioner Sherrill Rosen is in violation of Missouri Law with clear bias; prejudice intended to violate the civil rights of Petitioner Robert M Jackson. 7) Commissioner Sherrill Rosen again used her personal bias and prejudice against Petitioner Robert Jackson in accepting and adopting false INCOME AND EXPENSE STATEMENT OF RESPONDENT, Dana Crawford (now Boyle) to court on 22nd August 2007 showing personal monthly expenses of $4,644 INCLUDING child support paid by unrelated parties as an expense while excluding Social Security Income for Evan Crawford of $588 per month. Respondent Dana Crawford testified in court that Respondent had a room in her home rented to an unrelated party but did not include the income on the form. Respondent Dana Crawford completed the INCOME AND EXPENSE STATEMENT claiming a total household income of $1500.00 for husband and $583.00 for a total of $2,583.00 while listing monthly expenses of $4,644. Respondent testified she is current on all bills and expenses. There is no explanation or possibility that the INCOME AND EXPENSE STATEMENT submitted by Respondent Dana Crawford is clearly accurate based upon the testimony of Respondent at the court hearing. Commissioner Sherrill Rosen intentionally and willfully accepted false testimony and facts from Respondent towards purpose of intentionally and willfully violating the rights and cause financial difficulty to Petitioner Robert M Jackson. 8) On the 4th day of October 2007 Petitioner appeared in the court of Commissioner Sherrill Rosen having paid 100% of his income towards child support since release from incarceration on September 6th 2007. Commissioner Sherrill Rosen again conducted herself in a manner unbecoming the court becoming abusive with violent shouting at Petitioner and legal counsel for Petitioner from McKee & Ireland sharing her personal opinion that Petitioner Robert M Jackson is a con-man, shouting to the open court room that Petitioner Robert M Jackson is a liar and intimidating counsel representing Petitioner Robert M Jackson prohibiting counsel from presenting evidence. At the second hearing on October 4th, 2007 Commissioner Rosen continued her conduct unbecoming to a judge or the court subjecting Respondents legal counsel to additional screams and verbal abuse in open court. Commissioner Sherrill Rosen shouted, yelled insults about Petitioner Robert M Jackson and once again choose to use her personal prejudice against Petitioner as basis for her judgment issuing a warrant for the arrest of Petitioner Robert M Jackson with terms that Petitioner would be incarcerated with no bond with no future court date unless $95,543.00 was paid.

9) The Judgment entered on the 4th day of October 2007 by Commissioner Sherrill Rosen equates to Debtors Prison in violation of Missouri Law prohibiting more than 50% of income to be withheld for child support. Commissioner Sherrill Rosen has continued to show malice, intentional bias, prejudice against Petitioner in violation of the laws and guidelines of Missouri. Commissioner Sherrill Rosen continues to intimidate witnesses, legal counsel and Petitioner based upon personal prejudice and bias instead of basing judgments on facts. 10) January 28th 2010 Commissioner Sherrill Rosen issued a Judgment listing numerous false statements and information that had never been presented as evidence in court. Commissioner Rosen continues to permit external influences, meetings with Respondent and Respondents legal counsel outside of court and her personal prejudice against Petitioner to determine judgments. Items # 8 and #10 in the judgment are personal biased opinions of Commissioner Rosen with no factual basis presented in court by any party. 11) January 5, 2012 Petitioner established on record at the court hearing, through testimony of Respondent Dana Boyle and Missouri Division of Family Services child support payment records that 100% of all child support payments had been made in 2011 as directed by the court. A period of more than 12 months had passed with compliance with court orders. Petitioner was determined to be in continued Contempt of Court and ordered to pay an additional $2250 by Commissioner Sherrill Rosen despite all parties agreeing that 100% of the child support required to be paid had been paid. Commissioner Rosen clearly shows through the judgment and continuation of contempt hearings that she lacks integrity, impartiality of the judiciary with a clear appearance of impropriety. Commissioner Sherrill Rosen holds her personal bias and prejudice above Missouri Law when making judgments and conducting hearings in Missouri Courts. Commissioner Sherrill Rosen is incompetent and through her incompetency continues to use her personal bias, prejudice, external influences ignoring Missouri Law while conducting herself as a representative of Jackson County, The State of Missouri and Division 42 Courts. Commissioner Rosen has the clear indication of impropriety, evident violations of judicial ethics, ignores the Laws of The State of Missouri and should be recused from the case and all further proceedings. I believe my rights have been violated and I am unable to attend any further court hearings with Commissioner Sherrill Rosen due to her impartiality, personal bias, prejudice and conduct unbecoming to the courts.
