I am an elector registered to vote Georgia House of Representatives district 94. My address is and am registered to vote at this address. Pursuant to O.C.G.A. 21-2-5(b), I hereby challenge the qualifications of Vernon Jones to seek and hold the office of state Representatives from the 94th district. On information and belief, and in support of this challenge to Mr. Jones qualifications, I respectfully show as follows: ( 1 ) On Friday, May 25, 2012, Vernon Jones had his name placed on the July 31st General Primary ballot for state Representative from the 94th district; ( 2 ) Records on file with the Office of the Secretary of State of Georgia indicate that Vernon Jones is registered to vote at 5560 Mayfair Crossing Drive, Lithonia, Georgia, 30038 (See Attachment A); ( 3 ) Records on file with the Office of the Secretary of State of Georgia indicate that Vernon Jones cast a ballot in the March 6, 2012 Presidential Preference Primary using the address described in Paragraph ( 2 ) as his address for voting purposes (See Attachment A); ( 4 ) Records on file with the Office of the Secretary of State of Georgia indicate that the address Vernon Jones used as his address for voting purposes is not part of the territory embraced within the 94th state House district (Attachment A); and ( 5 ) Such additional evidence as may be shown at the hearing of this case. _________________________________. RE: Complaint Challenging the Qualifications of Vernon Jones It therefore appears that Vernon Jones does not meet the constitutional and statutory requirements for seeking and holding the office of state Representative from the 94th district because: ( a ) Vernon Jones is not a resident of the district he seeks to represent, as required by O.C.G.A. 28-2-1(b); and ( b ) Vernon Jones will not have been a legal resident of the territory embraced within the 94th state House district for at least one (1) year immediately preceding the date of his election, November 6, 2012, as required by Article III, Section II, Paragraph III(b) of the Constitution of the State of Georgia and by O.C.G.A. 28-2-1(b). Accordingly, I challenge Vernon Jones qualifications to seek and hold the office of state Representative from the 94th district on each of these two separate grounds. I respectfully request that you notify Vernon Jones of this challenge and that you are requesting a hearing before a judge of the Office of State Administrative Hearings.
