HSA: The Law of Terror

“We fight terrorism. It threat-
ens our sovereign, democratic, com-
passionate and decent way of life.
Therefore, in the fight against lawless
violence, we must uphold these val-
ues,” Gloria Macapagal-Arroyo said
recently in her seventh State of the
GLORIA’s
SECURITY
Nation Address (sona). However, her
statement deeply contrasts the human
rights situation in the passage of the
Anti-Terrorism Bill, renamed to mask
its horrendous provisions and to make
it sound more pleasing to the ears of
foreign dignitaries, into law on March
6 this year.
The Anti-Terrorism Bill (Senate
Bill No. 2137), whose principal author
was Senator Juan Ponce Enrile, has

been stricken with protests from human
rights activists before it was signed into
law on March 6. The ratification of the
Human Security Act (hsa) of 2007 will
create much more terror and havoc,
through immense human rights viola-
tions, in the entire Philippine citizenry.
Nevertheless, the fascist-imperialist
us-gma regime neglected the tremen-
dous dissent of the people.

GMA’s Wish List
On her seventh State of the Nation Address, Gloria Macapa-
gal-Arroyo merely delivered a litany of her almost impossible
wishes. She spent most of her time talking about infrastructure
programs, as if it will have a direct impact on the lives of mil-
lions of hungry Filipinos. For that, many found the president’s
guarantees lacking.
Gma’s speech tackled mostly of her “achievements” which
she had not done directly, or she didn’t have any participation
at all. Put the case of the students who won in science and math
competitions abroad. Was she part of the triumph? Maybe she

Guidance Fair
The Guidance and Coun-
seling Center (gcc) administered
the first Guidance Fair on July 12,
2007 at the congregating area.

President for Student Personnel
Services (vp-sps), delivered the
opening remarks of the program
and Engr. Severino Pader, Vice
President for Administration and
Student Services (vpass) followed
it with an inspirational talk. The
ribbon cutting was led by Mrs.
Alfonso and Ms. Belen, Head of
Guidance and Counseling Center,
as they formally open the fair.
The event highlighted differ-
ent activities; one of them is “Dear
Guidance” which was promoted for
the students to write their problems
in life and to seek advice from the
counselors. The program was also
packed with fun games such as
banana eating contest and statue
dance. To enliven the audience’s at-
tention, several intermission num-
bers were performed by the Talents
Guild, Student Assistants and Ed-
ucation students, including Irene
Cercado with her song “Hawak

On July 9-11, VOICE had set up
its registration booth for the re-
cruitment of new staffers, at the
Congregating Area with other stu-
dent organizations. Freedom and
caricature walls were also posted
for everyone who wanted to express
their concerns and comment.

The new officers of Supreme
Student Government (SSG) and
Department of Student Govern-
ment (DSG) had their induction
rites at the Congregating Area on
June 29. This year’s induction rite
was themed “Student Leadership,
Making the big difference through
unity, harmony and commitment.”
Dr. Maria Consuelo V. Flora,
Vice President for Academic Af-
fairs (VPAA) gave an opening re-

Mrs. Sonia Penano said that the
objectives of cfs cover the endeavor

that the principle of electing officers
is based on equality. Mrs. Renelyn
Belen, adviser of cfs said that all the
officers must be responsible in or-
der to obtain a peaceful community
among fraternities and sororities.
“We must be united in order
to fulfill our obligations as officers so
that we can promote peace and unity
in our respective group,” Solis said.

conducted a special election on
July 2 at the tipteo office to fill up
vacant positions.
Before the snap election, an
induction of new officers took
place on February in consideration
of the regular election on January.
The resignation of Mr. Oliver Me-
rin, because of not fulfilling certain
requirements as President, leaves
the slot for Presidency unoccu-
pied.

“Quest for Excellence…Dif-
ferent Students, Different Organ-
izations, One Shared Goal!” was
the theme of this year’s student
membership drive, as different
academic and non-academic or-
ganizations, and fraternities gath-
ered at the Congregating Area
with their recruitment booths on
July 9-11.
Mrs. Veronica Alfonso (Di-
rector, Student Personnel Serv-
ices) introduced 40 organizations,
which participated at the activity
and invited students to join the
organizations, in her opening re-
marks.
Furthermore, different repre-
sentatives from each organization
performed to give entertainment
and to promote their respective
clubs. Organization of Industrial
Engineering Students (orients)
won the first place for the Booth
Competition. Junior Philippine
Institute of Architects (jrpia)
bagged the second place, and
Mountaineering Club (mc) took
home the third slot.

Another glaring feature of the
enactment of this law is that it was
passed into law ahead of more im-
portant and urgent pieces of legisla-
tion such as the P125 wage increase
and the compensation bill for Mar-
cos human rights violations.
The [F]Law’s Terrorist Nature
Sen. Enrile, who has not been
repentant for his violation of human
rights during the Martial Law, has
successfully forced a draconian meas-
ure that will tread on the civil and
political rights of the people. He had
effectively taken out the command of
his imperialist master gma without a
whimper from any oppositionists in
the Senate, except for the active op-
position of Sen. Jamby Madrigal and
Sen. Aquilino Pimentel, Jr.
In reality, the whole title of the
hsa is: “an act to secure the state
and protect our people from ter-
rorism.” The primary goal of this
law is to fight against what the au-
thors have vaguely-defined “terror-
ism.” In contrast, this law was really
just a license, given to the us-gma
regime, to eliminate the anti-impe-
rialists and oppositionists.
Prior to the hsa, us President
George W. Bush had made the Pa-
triot Act of 2005 and the Military
Commissions Act of 2006. He had
also dictated his “allies” in different
countries to create such laws to crush
the anti-imperialist struggle and for
him to control as many as possible.
Among the laws passed were in
Denmark, Spain, France, and other
countries “allied” to the US. Bush’s
systematic control of other states
through legislation of such vague
laws installs fascism and urges the
masses to continue their struggle for
national democracy.
Colossal Human Rights
Violations
The hsa clearly violates pro-
visions of the Bill of Rights in the
1987 Philippine Constitution and
international human rights and hu-
manitarian law conferences. It also
contradicts the principles of democ-
racy and violates every Filipino citi-
zen’s civil rights, especially in re-
voking a person his right to undergo
the due process of the law.
As progressive and nationalist
organizations, which expresses their
extreme opposition to the govern-
ment, slowly deteriorates in number,
hsa tags these groups as “terrorist”
groups. Further, this law aims for
the state to thoroughly violate civil
rights, whereas stated in the Consti-
tution: “The State shall encourage
non-governmental, community-

tests against the government. Even
without the declaration of Martial
Law, the act suppresses the people’s
movement for national liberation
and democracy, and the opposition-
ists of the us-gma regime.
Evasive, Dangerous Definition
The act defines terrorism as
“sowing and creating a condition
of widespread and extraordinary
fear and panic among the populace,
in order to coerce the government
to give in to an unlawful demand.”
Therefore, rallies or mobilizations
are considered by Arroyo as “desta-
bilization plots” and “conspiracies
to commit rebellion.” Further, mass
organizations are defined as those
“coercing the government to give
in to an unlawful demand.” Also,
workers strikes are categorized as
“terroristic” and deemed as an eco-
nomic sabotage.
There is hitherto no interna-
tionally accepted definition of ter-
rorism. The term has been used by
the imperialist states and their allies
during the Cold War era to demonize
and delegitimize national liberation
movements waging armed revolu-
tion against colonialism and neo-
colonization.
Revolutionary armed move-
ments like the Communist Party
of the Philippines-New People’s
Army-National Democratic Front
(cpp-npa-ndf) may now be tagged by
the Arroyo government as terrorist
organizations. Also in the verge of
being tagged as terrorists are what
the government call “communist
front organizations” or “enemies of
the state.” These include legal and
legitimate people’s organizations
that are already facing various forms
of harassment under the present
system long before the act was ap-
proved by gma.
The act also provides for Justice

zations before any Regional Trial
Court (rtc) as stated in Section 17:
Delgado; “Ilay-Gandangan” by

The second and third part

Moreover, an indefinite number
of alleged conspirators, accomplices

associated to the commission of the
crime would be easily arrested and
detained. Members of an already
proscribed organization can be easi-
ly subjected to rigorous surveillance
and punitive sanctions as stated in
Section 7. This makes the law a bill
of attainder which criminalizes and
punishes individuals or groups on
the basis of guilt by association. It
violates Section 22, Article III of the
Constitution which states that “No
ex post facto law or bill of attainder
be enacted.”
The Terror Council
The formation of the Anti-
Terrorism Council (atc), who will
enact the provisions in hsa, is pro-
vided in Section 53 of the law. It
includes the Executive Secretary,
National Security Adviser, and the
secretaries of the Departments of
Justice, Defense, Foreign Affairs,
Interior and Local Government,
and Finance. The National Intelli-
gence Coordination Agency (nica)
will serve as the atc’s secretariat.
Several notorious agencies
under Arroyo’s cabinet, such as the
National Bureau of Investigation
(nbi), Intelligence Service of the
Armed Forces of the Philippines
(isafp), and the Philippine National
Police (pnp), will also serve as sup-
port agencies of the atc.
Majority of the members of
the atc are part of the villainous
cabinet for the gma’s administra-
tion’s security, the Cabinet Over-
sight Committee for Internal Se-
curity (cocis), which consists of
Eduardo Ermita, Raul Gonzales,
Norberto Gonzales. These persons
are all behind repressive measures
such as Oplan Bantay Laya, Presi-
dential Proclamation 1017 (State
of National Emergency), Calibrat-
ed Pre-emptive Response (cpr) and
Executive Order 464. The cocis is
also behind extrajudicial and po-
litical killings, and numerous ab-
ductions.

leged “terrorist,” the law already
makes him a criminal through retali-
atory punishments. Among these are
warrant-less arrests, unlimited time
of detention, communication and
travel restrictions, surveillance and
wiretapping, and sequestration or
freezing of bank accounts. Howev-
er, these unlawful acts by the us-gma
regime were already in action prior
to the approval of the law.
Under Section 18, an alleged
terrorist will be detained for three
days without warrant of arrest. Fur-
ther, in Section 19, the period of de-
tention will be extended for another
three days “in the event of an actual
or imminent terrorist attack.” This
undoubtedly violates Section 18, Ar-
ticle VII of the Constitution which
states that “During the suspension of
the privilege of the writ, any person
thus arrested or detained shall be ju-
dicially charged within three days,
otherwise he shall be released.”
The intervention to a person’s
privacy was also legalized by the
law. Surveillance and wiretapping
of alleged terrorists or terrorist
groups were allowed as provided in
Section 7. Authorities, with the ap-
proval of any competent rtc, may
intercept and record all communica-
tion of terror suspects and their al-
leged conspirators.
The right to travel is also lim-
ited on Section 26, “Restriction on
the Right to Travel: …the court, upon
application by the prosecutor, shall
limit the right of travel of the accused
to within the municipality or city
where he resides or where the case
is pending…” After he has bailed,
he will still be limited of his right to
travel. He may also be held under
house arrest. Under which, he will be
restricted of the use of telephone, cel-

50, any person unproven of being a
terrorist, “…shall be entitled to the
payment of damages in the amount
of Five Hundred Thousand Pesos
(P500,000.00) every day that he or

as a result of such an accusation…”
The amount of which will be given
to the person shall be deducted to the
appropriations of the agencies of the
Anti-Terrorism Council, primarily
the Philippine National Police. Hu-
man rights advocates had stated that
it would be impossible for the pnp to
create such amount, and promptly
give to the persons accused within
fifteen (15) days from the date of the
acquittal.
Beyond doubt, with the repres-
sive provisions of the hsa, the fas-
cist and imperialist us-gma regime
will benefit a lot from it. This serves
as gma’s weapon to prolong her
despotic rule. In the context of the
recent elections, where there were
overwhelming votes against the
Arroyo administration, the hsa will
assure the support of the us and the
silencing of its critics.
The hsa is a legal attack against
groups and individuals who struggle
for an alternative for the inhumane
Arroyo regime, and for the crisis of
capitalist system of economy. Under
the hsa, the unclear discourse of “hu-
man security” was made clear: “You
are a terrorist, if we say you are!”

matter how hard I try to get rid of it. I can’t
think normally when I know I still have
plenty of time to do a certain thing. But I
learned one important thing when I tried
to stare at the clock for about ten minutes.
I realized that every second I waste won’t
bring any better to the task I should ac-
complish, it becomes history and I can’t
take it back. So, maybe next time I won’t
be spending a week making something I
can finish in a day.

Some people have their own prin-
ciples in life. We often see them on the
television carrying banners fighting for
something they believe is right. We can
never question them on their fearless acts.
They may appear to be right in some ways
but if we look better on both sides we can
say that they’re not always fighting for the
benefit of many.
I, myself witnessed incidents that
brought outrageous effects to many in-
nocent people. We really have the right to
express ourselves but we should always
remember that every right we have has
an equivalent responsibility. It hurts to
see some of your colleagues deviate from
what is known to be right. Ever since they
were exposed to militant ideas, they began
to formulate things to bite the hands of the
one feeding them. They started to throw
fearless accusations to an institution that
existed for decades without even knowing
the outcome of their advocacies.
I do understand that they have many
principles to express but they should also
know their limitations on how to convey
those principles to others. I do respect
them as a person but I only hope they also
respect the principles of the people work-
ing with them.

I believe in the saying, you can’t please
everybody. Some may love you, some
may hate you. But whatever they say, you
should act as yourself. I won’t deny that
I do act as myself and why should I care
with what others would say if I’m living my
life well? I don’t want to pretend as some-
one I’m not and act absurdly just to please
people around me. I don’t want to live my
life under somebody else’s shadow either.
I have a life to live here. To those people
who can’t help themselves to chitchat
somebody else’s flaws, I do have to tell
you to mind your own business. You don’t
exist in this world to intervene to others’
lives; you have to live your own life. Al-
ways remember, it’s better to be hated for
what you are, than to be loved for what
you are not.
Many things popped in my head on
what topic will I enlighten on this space. I
have thought of academic, political, person-
al and even spiritual matters. Among those
ideas, it was hard for me to choose one. Un-
til these past few days, many incidents hap-
pened that made me realized the essence of
what I want to share with you.

To love and be loved is the greatest
happiness of every man’s existence. It is
the fire; the force that ignites everyone and
binds them together. Love is the best thing
each of us can have. --- This is the belief of
other people and maybe including you. But
for me, love alone cannot suffice a certain
relationship to work. Other ingredient than
this is much more essential. It is considered
to be the very glue that holds the bond to-
gether… TRUST.
“Deciding whether or not to trust a per-
son is like deciding whether or not to climb
a tree, because you might get a wonderful
view from the highest branch, or you might
simply get covered in sap, and for this rea-
son many people choose to spend their
time alone and indoors, where it is harder to
get a splinter“ (from Lemony Snicket). This
thought proved that trusting someone is a
tough decision. You will never know what
will happen next. But once you’ve trust oth-
ers, it seems like you are embarking a jour-
ney on a smooth road. You’ll have a serene
life, no doubts, no uncertainties.
You can trust your friend that she/he
will keep your greatest secrets. You can also
trust your special loved ones to be faithful to
you no matter what. Trust your family that
they will be there to support you in all your
endeavors. But the most important of all,
trust God that He will lead you on the right
path and it’s up to you if you’ll take it or not.
But trust is not easily given up. Trust-
ing others means allowing any risks to hap-
pen. Sometimes you may be deceived if you
trust too much. That’s why I can say, trust is
a fragile thing. It takes only suspicion, not proof
to take it all away. And if there is no trust, any
relationship is a nightmare.
In my case, I can trust anyone, the thing
is, I just can’t trust the darker side of a person
that can ruin anything. For me, you can love
anybody but you can only trust few people.
To be trusted is a greater compliment than
to be loved.

It’s inevitable that a problem or misun-
derstanding will sprout in any relationship
or even in an organization or institution. TIP
Voice also experienced a certain predicament
which affected every staff. After months of
confusion, finally a resolution was made and
most of us were happy if not, contented with
the decision. Not because it favors me, but
because the argument between us has been
put to an end. I hope that the new line-up of
TIP Voice staff will create a new image to the
TIP community in a positive manner.

It seems that something “fishy”
is going on in the admin’s cabinet. I
am quite surprised and aghast when I
have read a news article in PDI (Inquir-
er) regarding Romulo Neri’s [former

thority (NEDA) chair] assumption of
the Commission on Higher Education
(CHEd) chairmanship. This was due
to GMA’s “reshuffling” of her Cabi-
net. If that would be so, what would
happen to the regulatory agency for
higher education? Now that the newly
appointed commissioner is an econo-

symphony
This is the first column that will be
written under my name that’s why I’m
so excited about it. I’ve been thinking
of what topic I would like to discuss be-
cause I want my readers to gain some-
thing good from me.
While making this article, I’m listen-
ing to the song of Savage Garden titled
“Crash and Burn”. A part of the lyrics
made me realized how life can be a bit-
ter-sweet symphony, “Coz there is al-
ways been heartaches and pain, when
it’s over you’ll breathe again…”
If you’re going to listen to the whole
song, it shows how life is so bitter. All
sorts of problems are there. You don’t
know where to run to if you have difficul-
ties and will drive you crazy. Why am I
saying this? Let me share a story.
Five years ago, when I was in high
school, I’m enjoying all sorts of comfort
in life. I don’t need to burn my hands so
that I can eat or I don’t have to get tired
to wear clean clothes. I have a nanny to
attend to my needs and when it comes
to financial matters, I can ask my mom
for it.
Things change all of a sudden. When
I entered college, I dealt with challenges
that I never thought I would encounter.

IT Departments. Others say that it will
be an auditorium or another gym or
swimming pool for MarE students.
One thing’s for sure: whatever it will
be, I’m sure we’ll benefit from it.

you cry or sympathized with me but to
make you see that challenges could be
hard, but in the end it is beneficial to
you.
It is meant to be faced with all the
courage you have. It may drain all your
physical strength but it will never crush
your spirit.
The challenges that I’ve encoun-
tered made me realized that I need to
grow up. I need to be matured so that
when time comes, challenges are just
mere quizzes to see how much I grew.

With all I’ve said these past is-
sues, you’re telling me that I am an ac-
tivist and violates school rules? May-
be some just don’t understand what
is “critical thinking,” “objectiveness,”
and others. And maybe, you’re not fit
to enter college without the knowl-
edge of all those. And mind you, do
you really know what an activist is?
If I’m not mistaken, every school
wants to improve the critical thinking
of the students. I just don’t get it when
somebody says, “You’re an activist,”
when you just want to express your
thoughts. Isn’t it stated in Section 4
of the Bill of Rights of the 1987 Philip-
pine Constitution that: “No law shall
be passed abridging the freedom of
speech, of expression, or of the press,
or the right of the people peaceably to
assemble and petition the government
for redress of grievances.”? If there’s
no law to be passed restraining the
freedom of expression, it just follows
that it is the prerogative of every per-
son to speak out what is in him. And I
know that it has limitations.
Now, I don’t want to get this more
legally, for some people out there
don’t want to hear these things. They
might say, “Ano ba yan? Pa-section-
section, article ka pa diyan!” Whoever
you are, I’m telling you (or all of you),
get real. Every Filipino citizen must
have knowledge of his rights. That’s
where the inclusion of the course Phil-
ippine Constitution and Government
in our curriculum enters. We all have
a choice. It’s all up to us if we want to
remain silent all the time. But, I must
remind you, as I have said last time,
“be vigilant...Our silence is used as a
weapon in violating our civil rights as
students and as citizens.”

Exodus, according to our religious be-
liefs is the mass departure of people from
the slavery of the Pharaoh in Egypt. It was
the servant name Moses who once became
the master of the slave, later followed the
word of God and believes to his inner con-
science that leading the people towards
prosperity is much important.
The answer is LISTEN, Sometimes it
is very difficult for us to do this that it may
not be so important but the thing is every
little detail we neglect to or pass to may
be relevant in our very life. They say, “You
cannot be a leader if you are not a good
follower” that is true if as a subordinate or
member we value the power that is given
then maybe tomorrow you are left stand-
ing. LISTEN! Everyone is qualified to lead
but there is so-called a unique factor to be
recognize as leader. We can choose or ap-
point but do we know what we are leaning
on to? Or they are only leading us to much
problems and failures. LISTEN! Our future
is at stake.
The challenge is in us as a student
to listen to those people that surround us
though we think they are not influential or
significant but the good lesson we can get
from those persons is important, and then
begin to encourage and share the most with

Astig. This is the famous tag line of the
most prestigious basketball association in the
country. Both men and women are fanatics
of this sport. Throughout the years, our very
own national team brought milestones to the
Philippines’ sports history specially, through
international competitions. Let’s have a clos-
er look at the most sought after sports in the
country.
The Rise and fall of the
National Team
The Philippine national team is one of
the most dominant basketball teams in Asia
since the 1920s. The Philippines dominated
the Far Eastern Games and the Southeast
Asian Games but only partially dominate the
Asian Games and fiba Asia Championship
with rivals like Israel, South Korea, Lebanon,
Japan and especially China.
In the 1950s-1960s, the Philippines
was among the best in the world, producing
world-class players like Carlos Loyzaga, Lau-
ro Mumar, Mariano Tolentino and Edgardo
Ocampo. Loyzaga was even a part of the
1954 fiba World Championship Mythical
Team selection, where the Philippines won
the Bronze medal.
The country lost its Asian basketball
supremacy, when Asia’s first and the world’s
second professional basketball league, the
Philippine Basketball Association (pba), was
founded on April 1975. Slowly, the country
lost its best players to the league with fiba
restrictions of professional players in the na-
tional teams.
After 1975, the Philippines only man-
aged to win the 1986 Asian Basketball Con-
federation (the national team qualified to the
1986 fiba World Championship in Spain
but the team disbanded and failed to partici-
pate due to the political crisis in the Philip-
pines) and a bronze medal in the 1986 Asian
Games. Both teams were bannered by future
pbastars Allan Caidic, Samboy Lim and
Hector Calma. In 1990, the Philippines sent
and all-pro national team, coached by Robert
Jaworski, to regain the country’s basketball
supremacy in the Asian Games but the team
lost in the final against China and settled for
a silver medal. The team includes 1990 pba
Most Valuable Player Allan Caidic, Alvin
Patrimonio and Samboy Lim (who was se-
lected for the Asian Games Mythical Team
selection).
In 1998, the pba formed the cel-
ebrated Philippine Centennial Team that
captured the 21st William Jones Cup cham-
pionship but finished with the bronze medal
in the Asian Games. While in 1994 and
2002, the pba-backed national team only
managed fourth placed finishes.

In 1963, fiba suspended the Philippines
for its failure to stage the 1963 fiba World
Championship after President Diosdado

goslavia and other communist countries to
enter the country. Later, the Philippines, de-
spite being the Asian champion, was forced
to play in a pre-Olympic tournament in order
