DOCTRINE OF WAIVER
( Does Right to life includes Right to die? ) K.Remruatfela K.L.E. Law College The family of a construction worker, which met with an accident that paralysed him, is no longer able to afford the treatment that will keep him healthy. In desperation, they ask the government to intervene...by killing him. Elsewhere, a young girl who has just been dumped by her boyfriend, decides its not worth living any longer and hangs herself. Right to life includes Right to die...? IPC Sec. 309, which deals about the punishment for those who attempt to commit suicide should be repealed or not as well as the issue of whether euthanasia should be legalized or not, is a very hot and burning topic nowadays. It provokes a lot of debate and discussion. In order to know the true nature of this let us first see what Doctrine of Waiver really is? Doctrine of Waiver : The Doctrine of Waiver speaks about the voluntary relinquishment or abandonment of an existing legal right or privilege. Now the question is, whether such right of waiver extends to fundamental rights. In other words, whether a person has a choice to waive his fundamental rights/whether the doctrine of waiver is applicable to fundamental rights also. The supporters of this doctrine strengthen their points by saying that Art. 21 of our Constitution quarantees Right to life and personal liberty. So this liberty is to be without any restriction. If the government interferes too much in the personal life of citizens, they cannot enjoy the privileges of this Art 21 which the Constitution gives to the citizens. What the Court says: The Supreme Court answers this question negatively by declaring that the fundamental rights are not absolute and are subject to certain restrictions. As we look in Muthiah vs. CIT AIR 1956 SC. 269, the Court held that, it is not open to a citizen to waive any of the fundamental rights conferred by Part III of the Constitution. These rights are not merely for the benefit of an individual but as a matter of public policy for the benefit of the general public. Therefore, an individual cannot waive his fundamental rights. In other words, the doctrine of waiver is not applicable to fundamental rights. So, it means that the right to die is not a fundamental right within the meaning of Article 21 and hence Sec. 309 of Indian Penal Code is not unconstitutional. Why not? I quess we may ask ourselves why the Court answers in the negative term. Why not in positive terms? There can be various answers. It is because life is the most precious

thing that exists in the world. The right to life is totally the opposite of the right to die. In short, the right to life is about the absence of death. The right to life essentially is the idea that nobody has the right to take someone elses life. This cleary depicts that the Right to die is the anti-thesis of the right to life. To kill a human (including himself) is an offence. At all times, we need to remember that Euthanasia (Mercy killing) devalues human . life as life is a gift from God. Birth and death are a part of the life processes which God has created, so we ought to respect them. Therefore, no human being has the authority to take the life of any innocent person, even if that person wants to die. Conclusion : From the above, we can see that Right to life does not include Right to die. Therefore, a citizen cannot waive his fundamental rights.
