Refunds are limited to $600 per designated item (tax included), and $2,500 annually per Enrollee (tax included). Partial refunds will be granted at the customers requests for items that exceed the per item cap of $600 or the maximum annual limit of $2,500. In the case of refund or partial refund the item will not be returned to the customer. The item must be in "like new" condition (not visibly used or worn) and in working order to be eligible. If the condition or eligibility of the item is misrepresented, we reserve the right to refuse to grant a refund and shipping reimbursement. Repeat claims on the same item will not be allowed. Eligible items must be purchased on a credit, debit or charge card in the name of the enrollee or an American Express Prepaid Card. Eligible items must be purchased after enrollment in Premium Return Protection and your enrollment must be current and in good standing at the time you purchase the item. If your Premium Return Protection enrollment is in current and good standing at the time you purchase an eligible item but expires within the 180 day period after purchasing such item, your refund request will be honored through the 180 day period as long as the item is not otherwise excluded under the terms and conditions. An item is eligible if it may not be returned by the Enrollee to the merchant from which it was originally purchased. Any item purchased from a merchant that has an established return/satisfaction guarantee program which is greater than or equal to the terms of Premium Return Protection, and provides coverage for claim, will not be eligible for a Premium Return Protection Refund. Store credits offered by the merchant will be considered a refund, making the purchase ineligible for a Premium Return Protection Refund. Product rebates, discounts or money received from lowest price comparison programs will be deducted from the original cost of the item. The maximum you will be compensated will not exceed the manufacturer's suggested retail price. Items not eligible for a refund are: animals and living plants; one-of-a kind items (including antiques, artwork, and furs); limited edition items; going-out-of-business sale items; consumable or perishable items with limited life spans (such as perfume, light bulbs, non-rechargeable batteries); some jewelry (including, but not limited to loose gems and pearls); services and additional costs (such as installation charges, warranties, shipping, or memberships); rare and precious coins; used, altered, rebuilt and refurbished items; custom-built items, textbooks of any kind; downloadable purchases (including
software, music, books, newspapers, magazines, movies), health care items (such as blood pressure machines and diabetes equipment), wedding wear, tickets of any kind; motorized vehicles (such as cars, trucks, motorcycles, boats, or airplanes) and their parts; land and buildings; firearms; ammunition; negotiable instruments (such as promissory notes, stamps and travelers checks); cash and its equivalent; and items permanently affixed to home, office or vehicles (such as garage door openers, car alarms), Adult videos, equipment and related paraphernalia. This service is an enhancement of the Return Protection benefit offered by American Express on select cards. For Cardmembers who have the Return Protection benefit as well as Premium Return Protection, you will be able to use both your Return Protection and your Premium Return Protection coverage allowance each year. Return Requests will be processed and assigned to one plan or the other based on eligibility and dollar value. Membership Fee You have ordered an ongoing membership on an annual basis. You authorize American Express to bill your designated charge, credit, or debit card (or the related checking account) each year at the then current rate, unless you call American Express to cancel. You have the right to terminate your enrollment in Premium Return Protection at any time. Your annual enrollment is eligible for a prorated refund of the unused portion of your enrollment rate upon cancellation. If American Express determines it is unable to bill the membership rate due hereunder to your designated billing source, American Express shall have the right to terminate the enrollment in which event you will no longer have access to any of the Premium Return Protection services. Renewals To ensure continuous membership, your Premium Return Protection membership will be renewed annually at the then current rate unless you call American Express to cancel. You will be notified of any price increase and may cancel your membership if you do not want to continue to be billed at the new price. Modification of Terms, Service American Express reserves the right to change or modify the terms and conditions of this Agreement, the Premium Return Protection services, or a portion thereof at any time without notice, and you agree to comply with such changes or modifications. American Express may cancel this Agreement upon written notice. You agree that neither American Express nor Provider will be liable to you or any third party for any modification of discontinuance of any of the service or benefits.
Governing Law This Agreement is governed by the laws of the State of New York, exclusive of its choice of law principles. Arbitration Any claim, action, dispute or controversy ("Claim") arising out of this Agreement or the Premium Return Protection membership shall be resolved, upon the election by You or American Express (or any other party to the Claim), by binding arbitration pursuant to this Arbitration Provision and the code of procedures of the national arbitration organization to which the Claim is referred in effect at the time the Claim is filed (the "Code"), except to the extent the Code conflicts with this Agreement. Claims shall be referred to either JAMS ("JAMS") or the American Arbitration Association ("AAA"), as selected by the party electing to use arbitration. If a selection by American Express (or any other party to the Claim) of either of these two organizations is unacceptable to You, You shall have the right within 30 days after You receive notice of the election to select the other organization listed to serve as arbitration administrator. In addition to the arbitration organizations listed above, a Claim may be referred to any other arbitration organization that is mutually agreed upon in writing by You and us (and all other parties to the Claim), or to an arbitration organization or arbitrator(s) appointed pursuant to section 5 of the Federal Arbitration Act, 9 U.S.C. sections 1-16, provided that any such arbitration organization and arbitrator(s) will enforce all of the arbitration terms set forth herein. Any party, however, may seek interim injunctive relief in a court of competent jurisdiction or seek to resolve the Claim by proceeding in small claims court (so long as the Claim is individual and pending only in that court). Neither You nor American Express (or any other party to the Claim) shall be entitled to join or consolidate claims in arbitration by or against other consumers or arbitrate any claim as a representative or member of a class or in a private attorney general capacity. If any party elects to resolve a Claim by arbitration, that Claim shall be arbitrated on an individual basis. The parties voluntarily and knowingly waive any right they have to a jury trial. The parties also acknowledge and agree that they shall not have the right to participate in a representative capacity or as a member of any class of claimants pertaining to any Claim subject to arbitration. You will be responsible for paying your share, if any, of the arbitration fees (including filing, administrative, hearing and/or other fees) provided by the Code, to the extent that such fees do not exceed the amount of the filing fees You would have incurred if the Claim had been brought in the state or federal court closest to your billing address that would have jurisdiction over the Claim. The payment of the remainder of any arbitration fees shall be paid by the other parties to the Claim. At your written request, the other parties to the Claim will consider in good faith making a temporary advance of all or part of your share of the arbitration fees for any Claim You initiate as to which you or American Express (and any other party to the Claim) seek arbitration. You will not be assessed any arbitration fees in excess of your share if you do not prevail in any arbitration. The terms of this Section shall survive any termination, cancellation or expiration of this Agreement.
