What international norms or international laws are at stake with respect to the resolution of the Taiwan issue?

The major International Laws at stake with respect to the resolution in dealing with Taiwan issue are sovereignty, economic and military. The question surrounding Taiwans sovereignty is tenuous and ambiguous. United States always sees Taiwan as sovereign part of China but finds it strategically damaging to its interests to allow the Communists to integrate Taiwan into mainland China (Romberg et al., 2002, p.1). Both Taipei and Beijing also shared the same view that Taiwan had been returned to Chinese sovereignty in 1945, but their only difference being over which of them was the legitimate government (p.3). This is also reflected in United States oneChina, but peaceful settlement of the Taiwan sovereignty by Chinese themselves (p.5). Peoples Republic of China (PRC) took over the Republic of China (ROC) seat at the United Nations in 1971, after it had held the seat; representing the whole China, for more than two decades. According Professor Miskels week three notes, Taiwan is an economic powerhouse and its gross domestic product (GPD) is among the top 25 largest economies in the world. Chinas GDP is the second largest in the world behind United States. Whereas China is the second largest US trading partner, Taiwan falls 12th, thus making both China and Taiwan economic powers and important trading partners of United States. It is therefore the interest of both China and United States to see the stability and peace in the Taiwan Strait. Economic prosperity between China and Taiwan would also make Taiwan reliance on China, which would eventually, integrate Taiwan into China. Moreover, with globalization and interdependence across the strait, both sides have more to gain and neither wants to be seen as mismanaging cross- Strait relations (Romberg et al., 2002, p.12) Both United States and China had used military exercise might as deterrent to pursue their political and economic objectives. For example, the deployment of the Seventh Fleet to the region which helped deflated the 1958 crises between China and Taiwan. Even though both China and United States wants peace but not war, any military miscalculation and misconception could lead to large military conflicts; destabilizing the whole region. Diplomatic maneuvers between United States and China has played greater role in reducing tensions between China and Taiwan. It is pertinent for these countries to utilize all diplomatic avenues constantly to integrate both PRC and ROC as a sovereign state through peaceful resolution. Reference: Romberg et al., (2002).
