Open File Policy Discovery Matrix

The Open File Policy Discovery Matrix is based upon the filing date of a
particular case. At the time of filing for the offenses listed in the Intake Division
below, the attachments will be made available prior to the Intake ADA marking
the case ready to file.
The cases listed below for the Trial Division are broken down into two
groups; Non-3G Offenses and 3G and Arson Offenses. In the event separate 3G
and Non-3G offenses are filed based upon the same police documents, Open
File Discovery shall be controlled by the policies for 3G and Arson Offenses. The
Non-3G Offenses shall have the attachments ready for review by the properly
assigned defense counsel no later than the tenth (10th) business day following
the case filing date. For 3G and Arson Offenses the Arrest Warrant and Affidavit
along with any Statements made by the Defendant will be made available
upon the request of the properly assigned defense counsel. Upon request by
the defense counsel, the Court Chief or their designee will make available these
documents in five (5) business days from the date the request is received. The
3G and Arson Offenses shall have the attachments ready for review by the
properly assigned defense counsel no later than the tenth (10th) business day
following the case indictment date. A Division Chief or Court Chief may
authorize the opening of 3G and Arson Offenses before this time if after review
of the file the Chief determines it is in the best interest of this office and its goals
to open the file before indictment.
Cases assigned to the Economic Crimes Division are excluded from the
requirements of this Open File Discovery Matrix.

Division Attachment Availability Date

Intake Division Attachments available prior to case being marked ready to file

Trial Division Non-3G Cases No later than ten (10) business days following date of filing
Cases 3G Cases Upon receipt of a request by defense counsel, the Court
Chief will make warrant, affidavit and statement available
within five (5) business days. The entire file will be
available no later than ten (10) business days following
date of indictment.
