HOW TO DEAL WITH FREIGHT FORWARDERS: A GUIDE FOR THE PALESTINIAN TRADER Freight forwarders are intermediaries between companies that deal in international import and export and the various transportation services. They negotiate with their clients the best possible price to move the product along with the most economical route based on the their experience; the best mode of transport (air, sea, road, rail), Customs requirements, packing, insurance, security issues, and the myriad of regulations that apply in both the country of destination and the country of origin. Unfortunately, as a result of the Palestinian Political situation, this area of business is dominated by Israeli companies due to the absence of licensed Palestinian freight forwarders who can conduct such services legally. In order to overcome these obstacles Palestinian sub-customs agents work as agents or brokers to an authorized Israeli freight forwarders or for an international freight forwarder to perform the same duties and provide their clients with the same services. Principles of Freight Forwarding The freight forwarder makes every effort to ensure the success of the transportation process from beginning to end, in the most appropriate time, lowest costs, and with quality service. Using a forwarder can cut costs because they arrange for the transport of huge numbers of consignments; they can consolidate loads going to a single destination to keep freight charges down for individual traders.
How to Deal with Freight Forwarders: A Guide for the Palestinian Trader
Services Offered by Freight Forwarders and Customs Brokers There are a number of important services offered by freight forwarders and customs brokers that Palestinian traders should be aware of. The freight forwarder should help the trader in: Preparing price quotations: The freight forwarder should provide sufficient information related to the total transportation costs of imported or exported goods, as well as the customs duties due on these goods in the country of destination and costs of special documentation. Handling and transportation: Chooses the mode and means of delivery, storage and carrying of goods, carries out financial and legal activities, and is in charge of contracting carriers, port administration, customs administration and insurance companies upon request of his customer, in order to facilitate his function. Regulations: help in understanding relevant regulations. Documentation: The Freight forwarder should advise his customer about the necessary documents in order to clear the goods (packing list, certificate of origin and invoices). In addition, he informs his customer about the procedures of authentication and legalization of these documents. Issues a Bill of lading in which the consignor is the importer/exporter and the consignee is the party authorized to receive the goods from the freight forwarder.
Even when using a freight forwarder, it is the ultimate responsibility of each trader to ensure that correct documentation and procedures are adhered to. Export training in procedures and documentation is recommended for staff involved in the exporting process. The Palestinian Shippers Council provides training for traders on export/import procedures and illustrates the needed documentation for shipping goods. Finding the Right Freight Forwarder Finding the right freight forwarder can be a challenging and important task. Currently, the Palestinian shipping sector is highly influenced by the land-locked status of the occupied Palestinian territory and, as such, is highly dependant on the utilization of neighboring facilities for participation in international trade. Palestinian sub-customs agents perform the same duties as the licensed freight forwarder including arranging the whole process of moving goods by sea, air, and road. The main difference between them is that the Palestinian sub-customs agent cannot issue a Bill of Lading and Airway Bill with their name on it. To overcome this obstacle, they work with a licensed freight forwarder and coordinate issuance of the transport document through the licensed forwarder they represent. See list of Palestinian sub-customs agents (Annex 3) See list of licensed Israeli freight forwards (Annex 4) Getting the Exact and Best Price Offer for the Service Needed To be accurate in calculating freight costs; Palestinian importers/exporters should ask their freight forwarder to provide them with a detailed price quotation for moving their goods from their country of origin to the country of destination. Check annex 1 for the calculation method of the total freight charges. Freight costs are normally quoted on a port to port basis. When calculating your freight costs consider: - Actual weight or volume weight of your consignment (quoted in cubic meters or tons) - Mode of transport - Weight of the pallet used to transport your units - Loading and unloading costs involved in multimode transport - Port or terminal fees - Bill of lading (shipping documentation) fees You may also incur additional charges relating to your terms of trade. These include: - Cost of moving the goods to and from the port - Handling the cargo - Port costs - Documentation - Finance In order to get an accurate price quotation, freight forwarders should provide price quotations on: - Freight costs. - Port charges. The port charges consist of:
o Vessel related charges consisting of port dues, pilotage, berth hire and anchorage charges. o Cargo handling charges consisting of wharfage and storage. o Other charges like the hire charges for the use of port equipments, etc. The port tariff does not include the following: o Charges paid to the transhipper owners for handling iron ores, which usually poses unique handling problems. o Labor paid to the Cargo handling labor. o Charges paid for the services of cargo supervision, hire of machinery and trucks, and other incidental expenses. o Charges paid to shipping agents, custom house agents etc. Cost of special documentation. Insurance costs.
Freight forwarders operate on a fee basis paid by the importer/exporter. Their fees consist of an agreed upon amount, plus documentation charges. They also collect a percentage of the freight costs from the carrier. Legal framework to Protect Customers When Dealing with Freight Forwarders Important Legal Aspects In western countries, freight forwarders offer their services under legally approved sets of standard trading conditions which limit their liabilities. In Israel, such standard trading conditions have not been approved by the courts. Therefore, under certain conditions, freight forwarders in Israel are subjected to unlimited liability. Because of this, freight forwarders in Israeli are recommended to have good insurance coverage that protects their interests vis--vis clients, overseas agents, as well as other service providers: shipping companies, airlines and other freight forwarders. SOLUTION: Therefore, the total freight charges for a 20 foot container from Antwerp to Ashdod would be calculated as follows: First, we calculate the collection fees under the local port charges = 0.03% * 900 = 2.7 USD. Since the amount is less than 10 USD, we must use the 10 USD minimum in our calculation. Next, to calculate total charges: $900 (freight) + $627 (Surcharges) + $133 ( Local Port Charges) = $ 1660 (Total Charges) Note: There may be no Captains Mail charges; this depends on the shipping company. Agent fees may vary depending on the agent. There may be Privacy risk charges; the amount depends on the shipping company, the country and the vessel.

ANNEX FIVE: Terminology

The Import or export business requires a good knowledge of related terms in order to remove the uncertainties of different interpretations. It is very important for Palestinian Importers/exporters to make every effort to cover all necessary terminology before entering a contract to make sure that everything is clear for them; this will help in resolve many disputed interpretations. The following terms are terms would be encountered while dealing with a freight forwarder. Freight: goods or products transported, generally for commercial gain, by ship, aircraft, train, van or truck. Freight Forwarder: are intermediaries between companies that deal in international import and export and the various transportation services. They provide the service of moving freight from one international destination to another and handle the considerable logistics task for their client, guaranteeing the arrival of the products to the proper destination upon the agreed time and in good condition. Shipping Line: is a business that operates ships that it may or may not own. Or any person who owns or charters a ship and includes an enterprise which operates or manages the business of shipping. Customs Broker: are private individuals, partnerships, associations or corporations licensed, regulated and empowered Customs to assist importers and exporters in meeting requirements governing imports and exports. Brokers submit necessary information and appropriate payments on behalf of their clients and charge them a fee for this service. Customs brokerage: Is a profession that involves the 'clearing' of goods through customs barriers for importers and exporters (usually businesses). Bill Of Lading: is a document issued by a carrier to a shipper, acknowledging that specified goods have been received on board as cargo for conveyance to a named place for delivery to the consignee who is usually identified. There are different types of Bill of lading which are: _Order bill of lading: This bill uses express words to make the bill negotiable, e.g. it states that delivery is to be made to the further order of the consignee using words such as "delivery to A Ltd. or to order or assigns". Consequently, it can be endorsed by A Ltd. or the right to take delivery can be transferred by physical delivery of the bill accompanied by adequate evidence of A Ltd.'s intention to transfer.
_Bearer bill of lading: This bill states that delivery shall be made to whosoever holds the bill. Such bill may be created explicitly or it is an order bill that fails to nominate the consignee whether in its original form or through an endorsement in blank. A bearer bill can be negotiated by physical delivery. _ Surrender bill of lading: Under a term import documentary credit the bank releases the documents on receipt from the negotiating bank but the importer does not pay the bank until the maturity of the draft under the relative credit. This direct liability is called Surrender Bill of Lading (SBL), i.e. when we hand over the bill of lading we surrender title to the goods and our power of sale over the goods. Invoice: An invoice or bill is a commercial document issued by a seller to the buyer, indicating the products, quantities, and agreed prices for products or services the seller has provided the buyer. Certificate of Origin: is a document used in international trade which states from what country the shipped goods originate or the country where their goods are actually made. Packing List: is a shipping document that accompanies delivery packages, usually inside an attached shipping pouch or inside the package itself. It commonly includes an itemized detail of the package contents and may or may not include customer pricing. It serves to inform all parties, including transport agencies, government authorities, and customers, about the contents of the package. It helps them deal with the package accordingly. Incoterms: or international commercial terms are a series of international sales terms, published by International Chamber of Commerce (ICC) and widely used in international commercial transactions.
