AFFIDAVIT

I, ERMA J. BALAGTAS, of legal age, married and a resident of Cheey, Busuanga, palawan, after having been duly sworn to in accordance with law, do hereby depose and say, THAT: I. am currently employed as Public School teacher assigned in cheey, Busuanga, Palawan and had served several times during the past elections as member of the Board of Election Inspectors (BEI); 2. I vehemently deny the imputations alluded to by Protestants witnesses that I am a close friend of the proclaimed Mayor of Busuanga, Palawan, Samuel a. de jesus, neither I did work in the municipal government as employee thereof during his previous term as Mayor or of his wife; 3. I am permanent employee of the Department of Education with appointment from the Civil Service Commission based merit and fitness. I did not engage in any partisan political activity during the last election or in the previous elections had; 4. My appointment as Chairman of the BEI was made in accordance with the guidelines set by the Commission on Elections and the Omnibus Election Code. in fact, the Omnibus Election Code itself gives preference on the appointment of public school teachers, which the Local Officer of the COMELEC rightly did; 5. I was not aware on the written protest purportedly filed by a certain Gabrielle Seracarpio with the Municipal Office of the COMELEC, as regards my appointment with the BEI, neither did I furnish a copy of such protest, nor inform of the same by any watcher of the protestee. The minutes of the votes in my precint would clearly show that no much copy of letter protest was filed or ever handed to me or any of the members then assigned in my precint; 6. And who is Gabrielle Seracarpio to say that I am a close friend of proclaimed mayor when she herself, is not a resident of Busuanga and not even familiar with the residents of our town? In fact, it was only her first time to serve as paralegal on the Protestant; 7. The same is true with Eva Weber, Roumelio Bacones and all the rest of the Protestants witnesses, whose testimonies are bias, being admittedly the paralegal of the protestant. I am not personally known to these witnesses as they are not residents of Barangay Cheey, which geographically remote from their residences;

8. All the watchers of different candidates and political parties, including that of the Protestant were duly represented and could freely raised objection in my precint. Again, the minutes of the election would show that no single protest was ever raised in the entire process of election; 9. Be as it may, it is my honest opinion that no member of the BEI could be disqualified by mere reason of friendship or acquaintance (assuming arguendo that I had knowledge on the said letter-Protest at the outset and am a indeed a close friend of the proclaimed Mayor) for the law is clear, emphatic and resolute, only relatives within the fourth degree of consanguinity and affinity are disqualified, which I believe was the legal basis for my appointment as such; 10. Lastly, I would like to reiterated that no irregularities or anomalies ever happened in my precint, for all candidates and political parties were duly represented and observed the process unhampered.

AFFIDAVIT

I, RAFAELA M. MENESES, of local age, married and a resident of Busuanga, Palawan, after having been duly sworn to in accordance with law, do hereby depose and say, THAT: 1. I was informed that a letter-protest was filed Office of the COMELEC by certain Gabrielle Seracarpio (paralegal of the Protestant) but the same was not given due course as it contains hearsay and legally baseless; Thus, my appointment was never revoked considering that the was in accordance with the guidelines of the COMELEC and based on my integrity, honesty and impartiality; While Protestee is admittedly personally known to me, I vehemently deny the imputation of engaging in partisanship. Neither was there an instance that vote was misread to deliberately favor him for voted garnered by another candidate;

All candidates and political parties were duly represented and could in fact attest on how the election was accomplished in our precint; In fact, no one from the candidate raised the challenge of anomaly or irregularity in the entire election proceedings. We treated all candidates with impartiality; I hereby attest that all votes reflected in election documents are true, honest and faithful votes obtained by them during the May 2007 election.

AFFIDAVIT I, SHIELA M. JAGMIS, of local age, single and a resident of Busuanga, Palawan, after having been duly sworn to in accordance with law, do hereby depose and say THAT: 1. My appointment as member of the Board of Election Inspector (BEI) was made in accordance with the guidelines of the COMELEC and based on my qualifications and reputation as a bonafide resident of Busuanga, Palawan; 2. I vehemently and firmly deny the imputation of witnesses that I am a close friend of the Protestee, neither that I am related to him by consanguinity or affinity. There was no instance that I engage in partisan campaign or activity that influences the voters to vote for any candidate; 3. The election was undertaken peacefully, regularly and based on the COMELEC guidelines. There was no instance that a protest or challenge on my qualification or on any irregularly or anomaly was made. In fact, the election documents are bereft of any single indication or entry of such challenge or protest; 4. The watcher themselves, including the Protestants duly signed the election documents, affirming to the faithful, honest and correct entries of the votes garnered by each candidate and political party; 5. There is no way by which fraud or irregularity could be perpetrates as all the candidates were duly represented by their appointed watchers;

6. I attest what reflects in the filled up election documents are the true, honest and correct votes obtained by each candidates; 7. I was not appointed by the protestee in any of the positions in the Local Government in the past while he was serving as a Mayor, or even of his wife.

AFFIDAVIT I, DIONA J. MUED, of legal age, married and a resident of cheey, Busuanga, Palawan, after having been duly sworn to in accordance with law, do hereby depose and say THAT: 1. I was duly appointed as Poll Clerk of the Board of Election Insfector (BEI) on May 2007 election based my qualification and pursuant to yhe guidelines of the COMELEC and the Omnibus Election Code; 2. The Protestants witnesses (who are either paralegals and leader s of the Protestant during the last election) testimonies are hearsay and devoid of any basis. I am not a close friend of the Protestee nor ever appointed as employee of the municipality at any point of time during the Protestees tenure as former Mayor in the past, or of his wife; 3. No candidate or person influenced my appointment as member of the BEI as it was made by the COMELEC according to my qualifications as a Public School teacher; 4. I had served several times during the past elections as BEI untarnished of any imputation of partiality, partisanship or any kind of impropriety. I did not engage in any partisan activity nor was there an instance that I campaign or persuade the voters to vote for any of the candidates;

5. No unsual, irregular or anomalous incident transpired before, during and after the election took place, in so far as precinct #0011a is concerned. We accomplished our tasks and duties honestly and impartially; 6. All candidates and political parties were duly represented in our polling precint. No watcher from either political party raised their objection in any of the stage of proceedings. The records, including the minutes, Election Returns and Certificates of votes would speak for the truth; 7. That poll watchers, including that of the protestant, affirmed (by signing their respective names) that the election was faithfully, fairly and honesty accomplished; 8. There was no instance that ballots were misread to favor a candidate. In fact, the Protestants watchers almost butted the heads of the BEI just to ensure that votes were read correctly; 9. As a legitimate resident of cheey, Busuanga, Palawan, I could very well identify the personal identities of almost all the voters. There was no instance that we allowed a flying voter to vote; 10. I am not personally known to the Protestants witnesses Eva Weberb and Roumelio Bacones, nor they personally known to me too. These two and all the restof the Protestants witnesses never witnessed how the election was undertaken in our polling place. Thus, they have no basis, in fact or in law, to imply any irregularity on us; 11. Lastly, I was not informed of any purported letter-protest filed by a certain Gabrielle Seracarpio. And she had no basis to question my appointment as member of the BEI as it made according to the guidelines of the COMELEC; 12. Seracarpio is not personally known not to me, nor I am personally kwon to her too. She is not a resident of Busuanga and just happened to be in Busuanga on May 2007, I am sure, because she is a paralegal of the Protestant during the last election;

13. We attest that the votes garnered by respective candidates and parties in our polling place, as reflected in the election documents, are true, unpadded and honest voice of the electorates.
