March 1, 2012 This is an updated report on the status of preparations for the World Conference on Indigneous Peoples to be held in 2014 (WCIP), at the end of the 2nd International Decade on Indigneous Peoples, as set forth in the General Assemblys March 3, 2011 Resolution. 1 It is being presented to the North American Indigenous Peoples Caucus Meeting in Niagara, Ontario, Canada for consideration and discussion under the agenda item on WCIP to be held on the third day of the Caucus Meeting (March 11, 2012). The contents are the responsibility of Kent Lebsock of Owe Aku International Justice Project with a review by Kenneth Deer.

In preparing for the World Conference on Indigenous Peoples 2014, there must be innovation. Innovation has characterized the participation of Indigenous peoples in the United Nations since we first went to Geneva. The specific proposals about Indigenous

participation have always come from the Indigenous peoples themselves and this is not just about consultations with NGOS [non-governmental organizations], but with Indigenous governance bodies being recognized as such in their participation. The World Conference is an important opportunity in innovation and implementation of the Declaration; seeing those rights realized. 2 These were words spoken by James Anaya in his introductory remarks at the Open-ended Indigneous Peoples Brainsotrming Meeting on the World Conference on Indigenous Peoples 2014. The meeting in Copenhagen, Denmark was held on January 13-14, 2012 and sponsored by the Government of Greenland, the Sami Parliament in Norway and the International Work Group on Indigenous Affairs. It was the first formal meeting3 of an ad hoc group of Indigenous peoples gathered to address WCIP and especially the preparatory process Indigenous peoples would expect for a high-level plenary meeting. (Attachment 1 is the Participants List.) Mr. Anayas words underscore the context in which Indigenous peoples have alway participated in the United Nations: with innovations rooted in our traditions as Indigneous peoples with the right of self-determination, with treaties, with the responsibility to maintain stewardship over our lands and territories, and most importantly to preserve Mother Earth for the generations to come. The model is, of course, the same as participation has always been within the UN with respect to Indigneous participation beginning with the Working Group on Indigenous Peoples: the full and effective participation of all Indigenous peoples, nations, organizations, parliaments, and governance bodies regardless of state recognition or any official NGO status within the United Nations system itself. In Copenhagen, it was agreed that the minimum standards that would be tolerated with respect to participation and outcome would be the Declaration on the Rights of Indigneous Peoples (the Declaration). However, the discussion also included references to other UN documents addressing the rights of Indigneous peoples including the Treaty Study, the Study on Lands and Resources and the Study on the right to participate in decision-making, as guides in the planning and outcome of the Conference. To further ensure an effective ongoing process that keeps Indigneous peoples representatives immersed in the preparation, participation and outcome of WCIP, concrete steps were taken in Copenhagen:

Co-Facilitator In addition to the facilitator that the President of the General Assembly is to appoint for the planning of the Conference, we, the Indigneous peoples, should have a co-facilitator. By consensus, John Henriksen was asked to serve in that role. Global Coordinating Committee A global coordinating committee be established with one representative and one alternate from the seven UN Indigneous regions as well as a youth and womens representative. This group would be responsible for: a. educating Indigenous Peoples so we can make good decisions regarding the WCIP, b. facilitating the right of Indigenous Peoples to participate at all levels of the WCIP process, c. giving feedback to the co-facilitators of the WCIP, d. distributing information about the WCIP in their region to as many peoples, nations and communities as possible, e. sharing and coordinating information with other regional representatives, f. making recommendations for consideration for regional and global Indigenous caucuses regarding the WCIP, g. contacting friendly governments in order to ensure an open line of communication, h. researching strategies for securing adequate funding for Indigenous peoples participation in the WCIP process, and i. communicating input from our peoples to ensure a constant Indigenous presence through every aspect of WCIP. Concept Paper and Guiding Documentation A. Concept Paper In Copenhagen a Draft Concept Paper was presented describing the background of WCIP as well as consideration of modalities to be employed during the preparations for, participation in, and outcome of WCIP. This is an evolving document dependent upon Indigneous peoples input into the Conference and will be a reflection of our recommendations and requirements. To that end a group of volunteer rapporteurs was asked to continue in this work including Tracey Whare (from the Aotearoa Indigenous Rights Trust and who also served as rapporteur of the Copenhagen meeting), Inger Johanne Mudenia (from the Sami Parliament in Norway), Joan Carling (Asia Indigenous Peoples Pact) and Kent Lebsock (Owe Aku International Justice Project of the Lakota Nation). B. Guiding Documentation As work continues on the Concept Paper, the Rapporteurs are also collecting a list of documents to be added as an annex. The documents that will be attached to the Concept Paper are relevant UN documents as well as documents that come from Indigenous Peoples meetings, global/ regional representative indigenous peoples caucuses, specialized meetings, gatherings etc. with content that is relevant to UN WCIP. We are also interested in documents produced by Indigenous Peoples that reflect concerns and issues that they would like WCIP to address for example, the Cochabamba Indigenous Peoples' Agreement on the Rights of Mother Earth. To communicate the importance of our requirements, meetings have already begun to take place with some states and there will also be a meeting with the office of the President of the General Assembly on January 17, 2012. This interface is consistent with the General Assembly resolution and with meeting the goals of Indigenous peoples in preparation of the Conference modalities. D. Resolution A resolution was prepared in Copenhagen setting forth the principles for full and effective participation in WCIP preparation, attendance and outcomes.

Open-ended Indigenous Peoples Brainstorming Meeting on the World Conference on Indigenous Peoples 2014
Copenhagen, Denmark, 13-14 January 2012 The participants at the open-ended Indigenous Peoples Brainstorming Meeting on the World Conference on Indigenous Peoples 2014, held in Copenhagen, Denmark, 13 14 January 2012 (the meeting) decide by consensus 4 on the following arrangements which must be adopted for the purpose of ensuring the full and effective participation of Indigenous Peoples in the World Conference on Indigenous Peoples 2014 (the World Conference) as established by resolution A/C.3/65/L.22/rev.1 of the United Nations General Assembly.In making this decision we affirm that the World Conference must be consistent with the standards established by the United Nations for acknowledging and respecting the rights of the Indigenous Peoples of the world, and being no less than the standards established in the United Nations Declaration on the Rights of Indigenous Peoples.We set out the following requirements which we believe are the minimum terms for the full and effective participation of Indigenous Peoples in the World Conference. 1. An indigenous nominated co-facilitator be appointed alongside the facilitator that the President of the General Assembly will appoint to work on the modalities of the World Conference. The meeting nominated John Henriksen, the Representative of the Smi Parliamentarian Council, to be appointed as the indigenous co-facilitator. 2. An indigenous global coordinating group of nine members has been established comprising Indigenous representatives from each of the seven Indigenous regions being Africa, Arctic, Asia, Latin America, North America, Pacific and Russia plus one Indigenous woman and one Indigenous youth. 3. Indigenous Peoples delegations must be able to fairly achieve accreditation to the World Conference and any of the relevant preparatory meetings. 4. Indigenous Peoples governing institutions, including nations, councils, parliaments and governments, including traditional governments, should be acknowledged as governments and accredited to participate as peers with States. 5. Where Indigenous Peoples decide to convene local, national, regional and global preparatory processes leading up to the World Conference then those meetings should be officially recognized as part of the preparatory process of the World Conference.We call upon States and agencies of the United Nations to provide funds for the full and effective participation of Indigenous Peoples in the World Conference, taking due account of the preparatory processes.

Post-Copenhagen Developments
A meeting with the Chief of the Cabinet of the President of the General Assembly was held on Tuesday, January 17, 2012, in New York City. A copy of the Copenhagen Resolution was submitted to him for delivery to the President of the General Assembly. Meeting with the Chef du Cabinet Although the meeting with the Chef du Cabinet did not result in any outcome of particular significance, our leaders expressed little concern. Critical to the process is to continue to engage with those states who seem to support Indigenous-defined modalities. Our co-facilitator, Mr. John Henriksen, has been meeting with some state representatives in New York for initial informal discussions about the Copenhagen resolution. So far Mexico, Denmark and Norway have indicated an interest to meet informally to exchange views on the issues at hand. The positions of Mexico and Bolivia will be crucial because of their importance within the United Nations GRULAC group (Group of Latin American and Carribbean Countries). Additional support is coming from countries like Norway and Denmark. Members of Indigenous peoples groups from Latin America have also been talking with representatives of the government of Peru. With continued interaction, education and diplomacy, we will hopefully succeed in securing the principles for WCIP set forth in the Resolution. Global Coordinating Committee Meeting Our most recent information indicates that the discussion in the General Assembly on WCIP modalities are not likely to start until after the session of the Commission on the Status of Women (ending more or less on March 14, 2012). The Global Coordinating Committee (GCC) has already scheduled a meeting for March 22nd and 23rd in New York. Since Indigenous representatives will be in New York for both events, this is seen as an opportunity to dialogue with states while they are working on the text. It appears that the General Assembly still aims at adopting WCIP modalities before the start of the Permanent Forum on Indigenous Issues in May, so this will be a critical time to engage states.
