Dear. Mr. Anastos: This is a request for public records to Commissioner Peter Anastos pursuant to the Maine Freedom of Access Act, 1 M.R.S.A. 401 et seq. (FOAA). Your written response to this request is requested within five (5) working days, pursuant to 1 M.R.S.A. 409. We request that Commissioner Anastos make available for inspection and copying, pursuant to 1 M.R.S.A. 408, all public records consisting of electronic (e-mail and text) and written correspondence from January 5, 2011-present which mention, relate to, or concern the subjects of affordable housing, MaineHousing, Maine State Housing Authority, and Dale McCormick, including, but not limited to, all correspondence on these subjects to or from (a) Office of the Maine State Treasurer or Bruce Poliquin; (b) the Office of the Governor or Governor Paul LePage; (c) John Butera; (d) David Bateman; and/or (e) past or present employees of the Maine Heritage Policy Center, including, without limitation, Terrence Bragdon, Leif Parsell and/or Lance Dutson. Please include within your search for responsive information all correspondence by Commissioner Anastos on both maine.gov and on personal e-mail accounts, including, without limitation, panasto1@maine.rr.com. Please note that the FOAA is not limited only to e-mail exchanged on maine.gov e-mail accounts. E-mail in the possession or custody of a public official is a public record within the FOAA so long as the record has been received or prepared in connection with the transaction of public or governmental business or contains information relating to the transaction of public or governmental business. We are requesting a waiver of any fee pursuant to 1 MRS 408(6) because release of the public records requested is in the public interest. Release of the records will significantly contribute to an understanding of the operations or activities of government and is not primarily in the commercial interest of the requester. The requester is a non-profit entity and has no financial interest in the records or the information contained in the records. To the extent that you at one time had possession or custody of public records which are covered by this request, but no longer has possession or custody of those materials, please identify any such public records. If you object to providing any of the requested public records on the basis that they are not subject to the FOAA or otherwise are not subject to disclosure, please specify in writing the nature of the records and the legal basis for that denial within five (5) days, pursuant to 1 M.R.S.A. 409. In addition,

please provide a privilege log for each record that is not disclosed listing the title (or subject line), date, the name of the recipient(s) and author, the general subject matter, and the basis for the Commissioner Anastos's refusal to provide access. For purposes of this request a public record means public record as defined by 1 M.R.S.A. 402(3), (3-A). Production of material stored electronically in its original electronic form is preferred, in those instances where the electronic record is readable by commonly available equipment and software. Commissioner Anastos may provide records on compact discs or other electronic storage devices. In the interest of expediting the production of these records we stand ready to work with you and your staff to identify mutually convenient means of providing access and to define the scope of searches or other retrieval efforts so as to obtain the materials we are seeking with a minimum of burden and delay.
