AllestablishmentscoveredundertheOSHActaresubjecttoinspectionbyOSHAcompliance safetyandhealthofficers.Nearlyallinspectionsareconductedwithoutadvancenotice. However,whenadvancenoticeofaninspectionisgiven,theemployermustinformemployee representativesorarrangeforOSHAtodoso. DuringthecourseoftheinspectiontheCSHOwillpointoutanyunsafeorunhealthfulworking conditionsobserved.Then,attheClosingConference,theCSHOdiscussesthese,suggested abatementmethods,andtimeperiodsforabatement,indicatingallapparentviolationsfor whichacitationmaybeissuedorrecommended. AftertheOSHAComplianceOfficerreportsfindingstohisorheroffice,theAreaDirector determineswhatcitations,ifany,willbeissuedandwhatpenaltieswillbeproposed. Consequently,anycitationsmustbepostedforthreeworkingdaysoruntiltheviolationis corrected,andmustbeatorneartheplacewhereeachviolationoccurred. TheOSHActprohibitsemploymentretaliationagainstanemployeewhocomplainstoan employer,andincertaincircumstances,anemployeemayrefusetoworkunderseriously threateninghealthorsafetyconditions.TheActuniformlygivesworkerstherighttoseeksafe andhealthfulconditionsonthejobwithoutbeingdisciplinedorfired.
