Pursuant to the New YQrk State Freedom of Information Law, Public Officers Law
84 etseq., we hereby request that the New York City Office of Management and Budget
("OMB") produce or make available for copying and inspection the following documents
believed to be in the possession, custody or control of OMB.
I. All applications, proposals, plans, responses to RFPs or other documents,
including electronic documents or emails, submitted (i) the Bowery Residents' Committee,
Inc., a not-for-profit organization ("BRC"), (ii) any of BRC's subsidiaries or affiliates,
including, but not limited to, Continuing Day Treatment, Food Service Program, Fred Cooper
Substance Abuse Services Center, Home-Based Case Management or Reception Center
(collectively, "BRC Affiliates"), (iii) Dan Shavolian, the owner of West 25th Street,
BIN# 1015006, Block 801, Lot 21, or (iv) any of Mr. Shavolian's companies, including, but
not limited to, 127 West 25th Street LLC or Foremost Real Estate LLC, for, or in any way
related to, the establishment, operation or construction of facilities at, or relocation of
existing BRC or BRC Affiliate facilities to, 127-131 West 25th Street (the "Proposed
Facility"). '
2, All documents, including, but not limited to, RFPs, RFP responses, RFP
decisions, awards,. draft or final contracts, proposals, letters of intent, memoranda of
understanding, applications, plans, forms, approvals, denials, modifications, certifications,
authorizations, licenses, operating certificates, correspondence, memoranda, letters, e-mails,
facsimiles or electronic documents, related to the Proposed Facility.

3. All communications related to the Proposed Facility, including all
attachments or documents related thereto, between or among OMB and BRC or any BRC
Affiliate.
4. All communications related to the Proposed Facility, including all attachments
or documents related thereto, between or among OMB and Dan Shavolian or any of Mr.
Shavolian's companies.
5. All communications related to the Proposed Facility, including all attachments
or documents related thereto, between or among OMB and any New York City or New York
State department, agency, office, community board, elected or appointed representative or
official.
6. All internal OMB rules, policies or guidelines related to the authorizing,
contracting, auditing, reviewing, invoicing or paying for services provided by a non-profit or
for profit entity, including, but not limited to, an entity such as BRC, such services having
been ordered, authorized or commissioned by an agency of the City of New York.
