Vyas Chairperson Maharashtra State Human rights commission 9, Hajrimal Somani Marg, Opp.Chhatrapati Shivaji Terminus (VT), Mumbai, 400001 INDIA E-mail: v.kshitij@yahoo.com Re: INDIA: Pune police trapped a young girl and falsely accused her of prostitution Dear Chairperson, I am deeply concern about the facts that Pune police had trapped a young girl and falsely accused her of prostitution and intentionally disclosed her identity public. Due to the disclosure of the identity of the victim, it was widely published by different media both nationally and internationally by different media including the corporate media NDTV, Deccan Herald, Daily Bhaskar and Zee News. The media has published the identity of the victim in public, even some of them have published the picture and name and age of the victim. As the media reports are available in the interment, the life of the victim has now been under threat. Her social integrity has challenged not only in India but also all over the world. The news reports are: 1. Tamil actress arrested for alleged prostitution NDTV published with the picture of the

victim dated on February 05, 2012 15:57 IST 2. Tamil actress arrested from Chennai for soliciting in Pune- Deccan Herald published the name and identity of the victim with picture date on Feb 5 2012 3. Tamil actress arrested in prostitution case in Pune Z news published the identity of the victim with picture dated on February 05, 2012
The intentional disclosure of the identity of victim who is also a woman is serious a violations of human rights. From reliable sources I have got information that the Pune police has mentally tortured her during the arrest and abused her verbally and physically. I want to share that in this specific case the victim who is a very promising Tamil film actress was victim of the irresponsible acts of police officers. Women are prostituted precisely in order to be degraded and subjected to cruel and brutal treatment without human limits. In this it was Pune police who had plotted a pre planed game to ruin the life of a promising artist. The police intentionally disclosed the identity of the victim and forced her to face a media trail rather than allow the honorable judiciary to allow the victim to have proper justice within the frame work of fair trail process.

Security of the person is fundamental to society by disclosing the identity of the victim and let the photo of the victim available in the public sphere the Pune police had threaten the security of the victim. It is obviously clear that the security of the victim is in danger. Due to the acts of the pune police and ongoing exposure of the victims identity and pictures in the media, now there is a mere chance that the victim in near future will be able to get back to normal life and live a free and life. Liberty is a primary civil right; the Pune police had questioned the liberty of the victim by heinous acts. The right to privacy is included among civil rights. The police had violated the civil rights that is granted in the constitution of India by disclosing the identity of the victim in public. Freedom from arbitrary arrest is also a civil right; the Pune police had plotted an arbitrary arrest by plotting a much preplanned intentional game. Equality is also a civil right, both equal humanity in substance and formal equality before the law is essential, the approach of the Pune police in the arbitrary arrest was anti women. The Pune police was very anti women in approach and their pre planned game had ended in victimizing a very promising actress. The Pune police had denied the right of victim of equal protection and benefit of the law without discrimination. In this case the Pune police adjudicated the right to equal protection and showed the sexdiscriminatory enforcement of laws. In this case Police had send man police to impersonate tricks in order to arrest the innocent victim who is a young promising girl. The trap game of the Pune police is not surprising; there are precedents that many more women than men are arrested in this way. The Pune police may claim that this is not intentional sex discrimination but a good faith effort by the state to get at "the sellers of sex. But it is very clear Pune police officials had misused the power and position in the mentioned case. The intentional disclosure of the identity of the victims in public by the police is clearly violations the domestic law referring to section 228A of the Indian penal code 1860. And the heinous act of Pune police is also punishable under section 500 of the Indian penal code. It should be mentioned that keeping all the provision of the law in mind with in fair trail process the victim may awarded a damages in due process of law. I urge you to investigate the heinous acts of the Pune police and take proper action on the above mentioned case as early as possible.
