NOTICE OF INTENT TO IMPEACH WITNESSES PURS UANT TO FEDERAL RULE OF EVIDENCE 609 (B) COMES NOW, the Defendant, Clinton Lewis, by and throug h his attorneys of record James A. Simmons, C. Anne Tipton, and Howard B. Manis pursuant to Federal Rule of Evidence 609(b) and gives the Government notice pursuant to Federal Rule of Evidence 609(b) of its intention to impeach by prior convic tion the following anticipated witnesses of the Government. (The Government has not provid ed a witness list to counsel, therefore, this notice may be amended and/or supple mented as witnesses are summoned during trial.) Additionally, Defendant will impeac h called witnesses with other convictions not subject to F.R.E. 609 (b), which do not require specific pretrial notice to the opposing party. Each conviction, as to each witness as set forth below, has signifi cant probative value in the impeachment of each witness. These prior convic tions are for drug related offense, crimes of dishonesty, fraud, or show indicia of untruth fulness or deceit. Furthermore, the alleged indictment in this matter asserts the RICO conspiracy began on or about the year 1995, approximately 17 years ago. Theref ore the criminal activities of
