Narrative
On 01/29/2012 at approximately 0053 hours I (Ofc. E. Starks) was dispatched to The Pearl Street Pub 1108 Pearl St., City and County of Boulder, State of Colorado reference a disturbance. Ofc. B. Graff was dispatched as cover. Boulder Police Dispatch advised that a male party (William G. Pericak) started a fire inside of the bar and refused to leave. Dispatch further advised that Pericak left the bar, on foot, and was followed by the reporting party/victim (James D. Thompson). Dispatch said that Pericak and Thompson crossed Broadway at Walnut St. Ofc. B. Graff contacted Pericak east of Broadway on Walnut St and I arrived immediately afterwards. I spoke to Thompson, an employee at the Pearl St. Pub, and was informed of the following: Thompson stated that on 01/29/2012 at approximately 0045 hours he observed Pericak lighting a fire inside of the bar. Thompson explained that a metal bucket existed on a table that contained miscellaneous papers and trash. Pericak started the material inside of the metal buck on fire. Thompson observed flames from the fire and feared that it would spread. Thompson extinguished the fire and stated that it did not cause any damage. Thompson told Pericak to leave the bar. Pericak became agitated, refused to leave, and replied "fuck you". Thompson asked Pericak to leave approximately nine additional times, but Pericak would not go. Pericak grew increasingly hostile and walked aggressively toward Thompson. Pericak stated, "Fuck you, you can't throw me out" while standing over Thompson. Thompson said that Pericak then physically contacted him. Thompson described the contact as "a chest bump". Thompson stated that he felt threatened and believed that Pericak was going to fight. Thompson described Pericak as "a big dude" and believed that he would have been injured if they fought. Thompson informed Pericak that he was going to call the police. Pericak replied, "Fuck you, your not calling the police, your texting your friends." Thompson contacted Boulder Police Dispatch and advised them of the situation. Thompson said that when Pericak realized he was speaking to the police he fled the bar. Thompson followed Pericak until he was contacted by the police. Thompson stated that he never lost sight of Pericak. Thompson stated that he was "100% certain" that the Pericak was the same male that caused the disturbance. Thompson wished to pursue charges against Pericak. Pericak appeared to be under the influence of an alcoholic beverage and heavily intoxicated. Pericak's speech was slurred and his eyes were red and watery. Pericak stated that he "had a few beers" and I smelled the strong odor of an alcoholic beverage upon his breath. Pericak originally denied that he was on Pearl St. and stated that he walked to Broadway/Walnut St. from the "hill". Pericak was initially uncooperative upon contact.

While enroute to jail, Pericak spontaneously uttered, "Listen, I had some beers and caused some trouble, but I haven't done anything illegal. I respect what you do. I left the bar."
