Who Must Act?

When to Act?
File1 and post within 15 Days after Contractor physically commences work on the project. Provide to any potential lien claimant within 10 days after written request. O.C.G.A. 44-14-361.5(b). "File, Filed, or Filing means filing with the clerk of the superior court of the county in which the property (project) is located. Serve means delivery by registered or certified mail or statutory overnight delivery. Statutory overnight delivery" means next-business day delivery by the USPS or a commercial delivery firm with a signed receipt acknowledging receipt. O.C.G.A. 9-10-12(b) 3 Lien Action means a lawsuit, proof of claim in bankruptcy or binding arbitration against the contractor or subcontractor owing money for labor, services, or materials procured from the lien claimant. 4 Lien Enforcement Action means an action to enforce the lien brought directly against the owner when the contractor or subcontractor owing money for labor, services, or materials procured from the lien claimant has absconded, died, left the state, filed bankruptcy or is protected by a pay-if-paid clause.
