Overview of 214th Legislative Session


The New Jersey Legislature meets regularly during the two-year legislative session. During the 20102011 Legislative Session, 8,240 bills and resolutions were introduced. Overall, 266 bills and resolutions were enacted, including both fiscal and nonfiscal measures. The Taxpayer Scorecard includes a total of 86 measures, including final passage, resolutions, amendments and Motions to Table (or setting aside of) proposed bills and amendments. Among the 67 measures opposed by AFP, 18 became law. Among the 19 measures supported by AFP, 10 became law. A total of 45 out of the 86 measures in the Taxpayer Scorecard reached Gov. Chris Christies desk. The governor supported AFPs position on 26 of these bills while opposing AFPs position on 19 of the bills, either through signing the measure into law or issuing an absolute or conditional veto.

There is no better barometer by which to measure lawmakers allegiance to fiscal responsibility than to register and evaluate their votes on key fiscal legislation. Simply put, their votes are their record. Of course, no legislative scorecard can take into consideration every bill affecting taxpayers. AFPs Taxpayer Scorecard aims to include the bills and votes that had the most dramatic impact on the states economic condition and the tax burden of every New Jerseyan. Accordingly, we have weighted some votes more heavily than others, depending on the specific vote and how it relates to our mission and legislative priorities.

Spending and Appropriations Measures

According to the latest U.S. Census Bureau statistics, New Jerseys state debt has reached almost $61 billion. This figure does not include debt related to government worker pension and benefit liabilities. The Mercatus Center at George Mason University estimates the states pension liability to be as high as $173 billion! Simply put, the state must take steps to rein in the exorbitant spending and limit the size and scope of the Trenton behemoth before it cripples our finances and our economy. The AFP Taxpayer Scorecard shows that the Legislature has not embarked on a course of fiscal responsibility over the past two years. Spending in Trenton remains far too high, as evidenced by the $28.3 billion FY 2010 budget and the $30.6 billion FY 2011 budget, neither of which represents cuts relative to the last budget passed under former Gov. Jon Corzine. The Democrat-led Legislature also continues to push for significant expenditures to subsidize programs such as NJ FamilyCare (the states version of a public option health insurance plan) and family planning clinic subsidies. Vote 1* FY 2011 Budget AFP Position: NO, Enacted A3000/S3000 AFP conducted a detailed analysis of the FY 2011 budget which revealed a net increase in state spending of 6%. The budget increased the share of school aid dollars going to the 31 Abbott districts at the expense of suburban districts, dozens of which lost their aid entirely. The FY 2011 budget also provided additional funding for governmentfunded nursery schools in the Abbott districts. Approximately $2.5 billion was diverted from the Property Tax Relief Fund at the expense of homeowners across the state. Property tax rebates were eliminated for all homeowners while the revenue source remained intact. The FY 2011 budget also increased funding for NJ FamilyCare and increased food stamp eligibility up to 185% of poverty. A $3 billion pension payment was deferred in order to balance the budget, exacerbating the plight of the states pension system. Vote 2* FY 2011 Budget Amendment (Motion to Table) AFP Position: NO, Defeated A3000/S3000 The McHose Budget Amendment would have eliminated $613 million earmarked for nursery schools in the Abbott districts and restored most of the cuts to the Property Tax Relief Fund. AFP believes state funding of nursery schools is unconstitutional and supports providing a greater share of school aid to non-Abbott districts. Vote 3 Supplemental Appropriation for NJ FamilyCare This supplemental appropriation bill would have included funding for NJ FamilyCare. AFP Position: NO, Absolute Veto A3020/S2134

Vote 4* FY 2012 Budget AFP Position: NO, Enacted, Line-Item Veto A4200/S4000 Appropriated $30.6 billion in state funds and $12.1 billion in federal funds for the FY 20112012 state budget. Gov. Christie used his line-item veto power to strike approximately $900 million from the appropriations. AFP views the FY 2012 budget as inadequate in addressing the states serious fiscal problems despite the governors line-item veto. The budget does nothing to rein in the Trenton bureaucracy, limit the size and scope of state government, stem the tide of ever-increasing debt or ease the states worst-in-the-nation tax burden. Vote 5* FY 2012 Budget Supplemental and Amended Appropriations AFP Position: NO, Enacted, Line-Item Veto A4201/S4001 The supplemental appropriations bill called for an additional $913.8 million in spending, while reducing enacted appropriations by $20 million. AFP opposed the efforts to restore almost $900 million in spending back into the FY 2012 budget. Vote 6 Restore Family Planning Funding (2010) AFP Position: NO, Absolute Veto A3019/S2139 Made FY 2011 supplemental appropriation of $7.4 million in subsidies to the states family planning clinics, a primary source for supplying taxpayer-funded abortions. Vote 7 Supplemental Appropriations for Family Planning Services (2011) AFP Position: NO, Passed Senate A4092/S2899 Supplemental appropriation to the Department of Health and Senior Services (DHSS) for $7.4 million for family planning services, and requires filing of State Plan Amendment to extend Medicaid coverage for family planning services to persons with incomes up to 200% of federal poverty level. Vote 8 Expansion of Family Planning under Medicaid AFP Position: NO, Absolute Veto A3273/S2393 Amended FY 2011 annual appropriations act in order to expand the availability of family planning services under the Medicaid program in FY 2011 to individuals with incomes of up to 200% of the federal poverty level. Vote 9* Supplemental Appropriations to Restore Various Budget Cuts AFP Position: NO, Absolute Veto, Failed Override A20/S20 The purpose of this bill was to restore $618.74 million in cuts proposed by Gov. Christie to the Pharmaceutical Assistance to the Aged and Disabled Program, the Senior Gold Prescription Discount Program and the Homestead Property Tax Rebate/Credit program. Vote 10* Supplemental School Aid Appropriation AFP Position: NO, Absolute Veto A4203/S2970 This bill called for a supplemental school aid appropriation of $412 million for non-Abbott districts. The bill would only take effect upon passage of the so-called Millionaires Tax (A4202). While AFP supports a more equitable distribution of school aid, we oppose the effort to increase spending in non-Abbotts by tying it to increasing the already high top-end income tax rate. Vote 11 Back to Work Job Training AFP Position: NO, Absolute Veto Appropriated $3 million for workplace training to certain eligible Unemployment Insurance (UI) beneficiaries. A4332/S3080

Vote 12* Transitional Aid to Localities AFP Position: NO, Conditional Veto Accepted A4373/S3118 Appropriated $140.5 million to the Department of Community Affairs for transitional aid to localities and administrative costs. More funding for New Jerseys urban money pits. Vote 13 $100 Million Bond Issue AFP Position: NO, Passed Senate A $100 million bond issue for storm-ravaged areas. AFP opposes legislation that would amass more state debt. A4269/S3099

Vote 14 Fair School Funding Amendment AFP Position: YES, Proposed ACR197/SCR162 A proposed amendment to the state constitution calling for school aid to be appropriated equally to every New Jersey student. The amendment would result in significant property tax relief for homeowners in 85% of New Jersey towns. AFP strongly supports this measure, which would combat the Abbott decisions handed down by our activist state Supreme Court over the past 40 years. Vote 15 Establishes a New Jersey Closing Fund AFP Position: NO, Absolute Veto, Failed Override A3353/S2545 Established a closing fund to provide financial resources for certain economic development projects. More government meddling in the free market!

Tax and Regulatory Measures

According to the Tax Foundation, New Jersey has the highest property taxes per capita and the highest state and local tax burden in the nation. As of November 2011, unemployment in New Jersey is above the national average (9.1%) and higher than all of our neighboring states, including New York (8.0%) and Pennsylvania (7.9%). (Source: http://www.taxfoundation.org/research/topic/44.html) New Jerseys suffocating tax climate is the primary reason for the malaise that plagues our state. In order to put New Jersey back on a course to prosperity, a pro-growth strategy must be adopted, which includes lowering tax rates across the board on both individuals and businesses. During the 214th Legislative Session, however, very little was accomplished to address our states worst-in-the-nation tax climate. Although several bills were enacted to reduce the burden on business, this legislative session witnessed the passage of taxes on health insurance premiums, hospital beds, unemployment insurance and others. Meanwhile, the Legislature failed to prevent a 50% toll increase on the New Jersey Turnpike and Garden State Parkway, initially passed to fund the now cancelled ARC Tunnel project. To his credit, Gov. Christie twice vetoed efforts to pass a Millionaires Tax (top-end rate of 10.75%), a measure that would further damage the states struggling economy. Vote 16 Tax on Health Insurance Premiums AFP Position: NO, Enacted A3005/S2096 Concerned certain taxes and assessments dedicated to the administrative costs of the Department of Banking and Insurance. This bill levied a tax on New Jerseys already high insurance premiums. Vote 17 Escheating Gift Cards AFP Position: NO, Enacted A3002/S2112 This bill allowed the state to confiscate unused gift cards after a period of two years. One judge already found this legislation unconstitutional, and it begs the question: when does taxation become outright piracy? Page 4

Vote 18 Hospital Bed Tax/Charity Care AFP Position: NO, Enacted A3003/S2143 Removed cap on 0.53% hospital total operating revenue assessment and raised cap on ambulatory care facility gross receipts assessment to increase charity care subsidy monies. Charity care applies to those who do not qualify for a state or federal insurance program. Vote 19 Unemployment Insurance Trust Fund (UI) (2010) AFP Position: NO, Conditional Veto Accepted A2624/S1813 This bill imposed a tax increase on New Jerseys struggling businesses in order to help replenish a drained Unemployment Trust Fund. AFP believes the fund has been historically mismanaged and used as a slush fund for various pet projects. Rather than raising taxes on business, which only hurts the economy, AFP favors reforming what is an unsustainable system. Vote 20 Unemployment Insurance Trust Fund (2011) AFP Position: NO, Enacted A3819/S2730 As in 2010, this bill raised the Unemployment Insurance tax on businesses. The bill limited the amount of the increase otherwise needed to replenish the UI fund but only portended a larger increase in the future barring efforts to fix this broken system. Vote 21* Millionaires Tax (2010) AFP Position: NO, Absolute Veto A10/S10 The Millionaires Tax would have adjusted the income tax rate for those making more than $1 million, from 8.97% to 10.75% for the 2010 tax year. Vote 22* Millionaires Tax (2011) AFP Position: NO, Absolute Veto This was the second attempt during the legislative session to impose a 10.75% top-end income tax rate on income over $1 million. Vote 23 Earned Income Tax Credit (EITC) Expansion AFP Position: NO, Absolute Veto This measure would have restored the state EITC benefit to 25% of the federal EITC. AFP opposes expanding this tax subsidy. A4202/S2969 A4204/S2834

Vote 24* Repeal of ARC Tunnel Toll Hikes AFP Position: YES, Passed Senate A3736/S2636 This bill reduced a scheduled 50% toll hike increase on the New Jersey Turnpike and Garden State Parkway associated with the ARC Tunnel project to Manhattan. Vote 25 Corporate Business Tax Cut Lowered corporate business taxes by adopting a three-to-one fraction formula. AFP Position: YES, Absolute Veto A1676/S1646

Vote 26 Corporate Business Tax Cut AFP Position: YES, Enacted A3869/S2753 Phased-in single-sales fraction for corporation business tax income allocation formula over three years and established airline-specific sales fraction. Vote 27 Corporate Business Tax Cut AFP Position: YES, Enacted Established alternative business calculation under gross income tax to permit consolidation and carryforward of certain business-related losses. Vote 28 Corporate Business Tax Cu AFP Position: YES, Enacted Decreased the minimum corporation business tax on certain New Jersey subchapter S corporations by 25%. Vote 29 Corporate Business Tax Cut AFP Position: YES, Absolute Veto Consolidated certain business-related categories of gross income and provides 20-year carryforward of certain net losses under gross income tax. Vote 31 Temporary Disability Taxes AFP Position: NO, Enacted A3792/S2609 While this bill would have lowered tax rates for temporary disability insurance for employees, it would not have done the same for businesses. The bill would have also allowed for future tax increases without direct legislative approval. Vote 32 Ocean County Stormwater Management System Demonstration Act AFP Position: NO, Absolute Veto This bill raised a tax to fund a stormwater management system demonstration pilot project in Ocean County. Vote 33 Concerns Barnegat Bay Stormwater Runoff AFP Position: NO, Absolute Veto A2606/S1856 This bill raised a tax to pay for the development of a stormwater and nonpoint source pollution management plan for the Barnegat Bay Watershed. Vote 34 Resolution Supporting Federal Regulation of Oil Derivatives (Motion to Table) AFP Position: NO, Bill Tabled AR151 This was a Motion to Table an amendment to the resolution asking the president and Congress to oppose any proposal for a vehicle milestraveled tax. Vote 35 Market Competition and Consumer Choice Act AFP Position: YES, Passed Assembly A3766/S2664 This bill altered state regulation of competitive services provided by telecommunications and cable television companies in New Jersey to ensure that such services are governed like other competitive services provided in the state. AFP favors this move toward easing regulations on the telecommunications sector.

Regional Greenhouse Gas Initiative Cap-and-Trade Measures

One of AFPs major initiatives during 20102011 was our effort to convince Gov. Christie to withdraw New Jersey from the 10-state Regional Greenhouse Gas Initiative (RGGI) cap-and-trade program and put an end to this job-destroying electricity tax. This major success was the result of a year-long grassroots effort, including rallies, seminars and press events, along with an effective TV and radio media campaign. As of January 1, 2012, New Jersey is no longer a participant in this Obama-style cap-and-trade scheme. Vote 36* RGGI Cap-and-Trade Repeal AFP Position: YES, Proposed A3147/S2250 Repealed the Global Warming Response Act of 2007 and related sections of the RGGI implementing law, thus withdrawing New Jersey from the 10-state cap-and-trade scheme. Vote 37* RGGI Cap-and-Trade Bill AFP Position: NO, Absolute Veto This bill was a countereffort by RGGI cap-and-trade supporters to compel the governor to keep New Jersey in the program. Vote 38 RGGI Cap-and-Trade Resolution AFP Position: NO, Passed Both Houses A resolution that declared Gov. Christies decision to withdraw from the RGGI cap-and-trade program to be inconsistent with legislative intent. A4108/S2946 ACR195/SCR164

Environmental Measures

During the recent legislative session, a slew of bills were introduced aimed at pushing a far-left environmental agenda. Various mandates, taxpayer subsidies and tax credits were proposed to steer and hasten the state toward increased reliance on solar and wind power. These alternative sources, however, are known to be both less cost-efficient and less reliable than traditional sources such as nuclear, hydroelectric, coal or natural gas. In fact, AFP commissioned a study by the Beacon Hill Institute to examine the economic impacts of one of the bills passed by the New Jersey Legislature, the Offshore Wind Economic Development Act, or OWED. The Beacon Hill analysis revealed that this $100 million taxpayer-subsidized boondoggle would cost the state as much as $4 billion, while raising electricity rates and destroying jobs in New Jersey. Bailout Measures

The Legislature passed measures aimed at bailing out two failed private sector initiatives: the Revel Casino in Atlantic City and the Xanadu Mall project in the Meadowlands. AFP opposes the state government using hundreds of millions in taxpayer subsidies to pick winners and losers in the free market. The Legislature also passed a bill giving the state authority over the development of an Atlantic City Tourism District. AFP opposes state micromanagement and central planning of Atlantic City, which has a historic record of failure. The 214th Legislative Session also saw a number of measures brought forth to plant the roots of a government takeover of health care in New Jersey. Without saying, AFP opposes any effort by the New Jersey Legislature to advance the federal takeover and infringe on our constitutional rights to make our own health care choices. Page 7

Government Worker Pension and Benefit Measures

A series of bills aimed at reining in government worker pension and benefit costs was enacted during the 214th Legislative Session. Issues addressed by these bills included increasing employee contributions to the pension and health care system, limiting eligibility and curbing sick pay and vacation pay abuses. While AFP believes much more can and should be done with respect to government worker pensions and benefits, including moving to a 401(k)-style defined contribution plan for new hires, we favor these measures as steps in the right direction for the state. Vote 60 Concerns Funding of States Pension Obligation AFP Position: NO, Passed Senate ACR115/SCR1 This proposed constitutional amendment, which would require voter approval, aimed to fully fund the states pension obligation by 2017. However, careful analysis of the bill reveals that this plan would blow a hole in the states budgetlikely costing the state more than $10 billion a year by 2017, a figure in excess of the revenue generated by the states sales tax. This legislation could result in savings to [local government entities and boards of education] of $314 million in State Fiscal Year 2011, $324 million in Fiscal Year 2012, and $333 million in Fiscal Year 2013. Vote 67 Sick Leave and Vacation Pay (Motion to Table) AFP Position: NO, Vote Tabled A3392/S2220 The Motion to Table was an effort to preclude a vote to agree to the terms of the governors conditional veto. The conditional veto sought to further limit sick leave and vacation payouts upon a state workers retirement.

Social Engineering Measures

The Democrat-led Legislature continues to manipulate the levers of legislative power to try to advance a liberal social agenda. This includes efforts to transfer wealth to the states urban centers, to interfere in the free market to prop up industry in these areas or to push for affirmative action programs that single people out based on their race or gender. Once again, Americans for Prosperity opposes this type of interference in the free market and believes each citizen should achieve based on his or her ability and effort, not ethnicity or gender. As concerns the Council on Affordable Housing (COAH), AFP rejects the entire notion of forcing taxpayer-subsidized, high-density, low-income housing into each and every town across the state and stands opposed to the series of unconstitutional Mt. Measures Impacting Local Government

Whether its binding arbitration, prevailing wage laws or civil service statutes, mandates from Trenton on our towns and municipalities make it more and more difficult for local elected officials to keep costs in check and taxes low. As such, AFP supports the series of bills proposed in the so-called Tool Kit introduced by Gov. Christie as a good start in reining in Trentons long arm. Regrettably, all of these proposals were blocked from a vote in the Assembly, mostly along partisan grounds, using Motions to Table, a move AFP opposed.
