Hon'ble Chief Justice of India, New Delhi

Respected Sir,

Your kind attention is invited to the media news placed below.

In the light of the above, I find that the action of the high level Union Govt functionaries to investigate into the complaint against Shri K G Balakrishnan is highly discretionary, ill-intentioned and simply atrocious when:

1.

Govt is knowingly not investigating into the serious allegations against other 6 Chief Justice of India for the reasons best known to Dr Manmohan Singh PM of UPA-II Govt, Shri Pranab Mukherjee Union FM and Shri P Chidambaram Union HM. Dr Manmohan Singh as PM & Shri Arun Jaitely and Smt Sushma Swaraj as other Committee Members with full knowledge about Shri K G Balakrishnan background selected him as NHRC Chairperson. However, no action is taken against the PM and the Opposition Leaders in the Parliament for committing the blunder.

2.

3.

In the light of the foregoing, in larger public interest of stopping illegal, unethical and corrupt practices of the UPA Govt functionaries with main Opposition in the Parliament maintaining silence and thereby giving tacit approval, I hereby pray the Chief Justice of India to:

1.

Take Suo Moto action to restrain Union Govt & its instrumentalities from any investigation only against Shri K G Balakrishnan till the time the case filed

by Shri Shanti Bhushan, reportedly joined by his son Shri Prashant Bhushan, with the contention "8 Chief Justice of India out 16 corrupt", is finalised by the Hon'ble Supreme Court.
2.

Take Suo Moto action to seek explanation of the PM, HM & FM of UPAII Govt for knowingly acting in partisan manner.
Any other relief as deemed fit in the interest of justice and to control the criminal abuse of discretionary power by the PM,

3.

HM & FM of UPA-II Govt to single out and harass one CJI after appointing him as NHRC Head.

Submitted.

Finance min asked to probe former CJIs assets

TIMES NEWS NETWORK New Delhi: The home ministry has asked the finance ministry to conduct a probe into the assets of former Chief Justice of India, K G Balakrishnan, in what could possibly lead to action against him for allegedly possessing wealth disproportionate to his income. Sources said the ministry has written to the revenue secretary, asking him to institute an inquiry through the Central Board of Direct Taxes. The inquiry would be the basis of deciding whether there is a case for giving sanction to prosecute Balakrishnan, who is currently chairperson of the National Human Rights Commission, a source said. The action follows petition received by the home ministry alleging that Balakrishnan had acquired assets disproportionate to his known sources of income, and that some of these properties were purchased in the name of his close relatives. A petition was received in the ministry containing some allegations against him (Balakrishnan) and his relatives. Since most of the allegations pertained to under-reporting of income etc, the petition has been forwarded to the revenue secretary for inquiry and necessary action, said a home ministry spokesperson. The petition listed income and properties of Balakrishnan and his relatives, with documents showing property purchases. It demanded investigations by CBDT. Since the CBDT has the expertise to probe into anyones income and disproportionate assets, the task has been given to it. If the allegations against Balakrishnan are found to be true, the ministry will go to the President seeking sanction to prosecute him and also remove him from the NHRC post, said an official.

8 Chief Justices of India corrupt, says former Law Minister

Indo-Asian News Service, Updated: September 16, 2010 17:11 IST

8 Chief Justices of India corrupt, says former Law Minister: Former Union Law Minister Shanti Bhushan Thursday told the Supreme Court that at least eight of the 16 chief justices of India (CJIs) were "definitely corrupt". In an affidavit filed Thursday, senior counsel Shanti Bhushan said that six of the CJIs were "definitely honest" and he could not comment on the remaining two judges. The senior counsel sought to be impleaded in a case in which his son Prashant Bhushan is facing contempt proceedings. Shanti Bhushan in his affidavit said that two former CJIs had personally told him that their immediate predecessors and immediate successors were corrupt judges. He said that the names of those four CJIs were included in the list of eight corrupt CJIs.
