BAC Resolution No.

_022 Series of 2011 BIDS AND AWARDS COMMITTEE RESOLUTION ON THE AWAR FOR PR#11-08-528 (SUPPLY OF LABOR, MATERIALS, EQUIPMENT, CHEMICAL OF VARIOUS TYPES AND OTHER CONCOMITANT ITEMS FOR THE TOTAL QUALITY PEST CONTROL AT THE SENATE OFFICES AND AREAS FOR CY 2012 TO2014) WHEREAS, the Senate is in need of a qualified provider for the Supply of Labor, materials, Equipment, chemicals of various types and other concomitant items for the Total Quality Pest Control at the Senate Offices and Areas for CY 2012 to 2014; WHEREAS, On June 29, 2011, the Bids Awards Committee held the PreProcurement Conference for the said undertaking; WHEREAS, on August 18, 2011, the project was among the undertaking advertised in the Philippine Daily Inquirer, a newspaper with general nationwide circulation. The same was likewise advertised in the Philippine Government Electronic Procurement System (PhilGEPS) for seven (7) calendar days posted in the Senate bulletin board for the same period; WHEREAS, four (4) bidders purchased the bidding documents and signified their interest to join the bidding; WHEREAS, on September 5, 2011 the Pre-Bidding Conference was held and four (4) bidders attended; WHEREAS, on September 14, 2011 the BAC issued a Bid Bulletin informing prospective bidders that date of the Submission and Opening of Bids for the aforementioned undertakings is re-scheduled from September 19, 2011 to September 21, 2011 (Wednesday) 10:00 AM due to some clarifications on the Scope of Work; WHEREAS, on September 21, 2011, the Senate Bids Award Committee (BAC) proceeded with the bidding for the aforementioned service contract. Power House Pest Control Services, Ultimate Care Janitorial and Allied Services Q and L Pest Control Services submitted their bids; WHEREAS, in the same meeting, the BAC opened the first enveloped submitted by the Power House Pest Control Services and Ultimate Care Janitorial and Allied Services and they were declared eligible submitting complete eligibility and technical documents, subject to Post-qualification;

WHEREAS, in the same meeting, the BAC opened the first envelope submitted by Q and L Pest Control Services and it was declared ineligible for failure to submit its Tax Clearance as required under item 12 of the List Document Requirements; WHEREAS, in the same meeting, the BAC verbally notified Q and L Pest Control Services of the BAC and was informed of its right to file a Motion for Reconsideration within seven (7) days from notice. Q and L Pest Control Services manifested its waiver file a motion for Reconsideration; WHEREAS, in the same meeting, the BAC proceeded to open the second envelope of the Power House Pest Control Services and Ultimate Care Janitorial and Allied Services containing their bids which was recorded in the attached Abstract of Bids and properly transcribed, subject to Post-qualification. The bidding documents of Ultimate Care Janitorial and Allied Services as the lowest bidder submitted to the General Services (GS) for evaluation; WHEREAS, on October, 2011, the BAC was in receipt of the evaluation report submitted by the General Services (GS) for evaluation; WHEREAS, on October 12, 2011 upon verification, evaluation and review of all its documents, the BAC resolved to declare Ultimate Janitorial and Allied Services Post-disqualified. The Committee took note that the case for forfeiture, the Senate could not claim the Bid Security submitted in favor of Ultimate Care Janitorial Services. Further more, the BAC was in the option that the documents submitted were documents of two (2) different entities. Therefore, the documents submitted were incomplete; WHEREAS, in the same meeting, the BAC resolved that the bidding documents of Power House Pest control Services (GS) for evaluation; WHEREAS, after the meeting, the BAC sent a written notice in the case Ultimate Care Janitorial and Allied Services of the decision of the BAC and its right to file a Motion for Reconsideration within three (3) days from the receipt of notice; WHEREAS, on the same day, the BAC also received the Motion for Reconsideration of ultimate Care Janitorial and Allied Services for Failure to submit the required which was issued after the change of Business name Bid Security and Certificate from the National Committee on Urban Pest Control; WHEREAS, after the meeting, the BAC sent a written notice to in case Ultimate Care Janitorial and Allied Services of the decision of the BAC and its right to file a verified Position Paper / Protest within seven (7) days from receipt of notice and payment of Protest Fee in the amount of four Thousand Five Hundred Pesos (Php 4,500.00) only;

WHEREAS, on November 23, 2011, after expiration of Ultimate Care Janitorial and Allied Services right to file a verified Position Paper and the PostQualification and evaluation of the proposal of Power House Pest Control Services and finding latter documents in order, the BAC resolved to award the said project to the bidder with the lowest calculated and responsive bid; WHERFORE, the BAC recommends the awards to:

POWER HOUSE PEST CONTROL SERVICES With the lowest calculated and responsive bid in the amount of: THREE HUNDRED THIRTY SEVEN THOUSAND PESOS only (Php 337,000.00) for CY 2012-2014. November 23, 2011, Pasay City.
