FORUM: General Assembly QUESTION OF: Implementing on the Convention on the prohibition of the use of stockpiling, production and

transfer of anti-personnel mines and on their destruction MAIN SUBMITTED BY: France CO-SUBMITTED BY: United Kingdom, Greece, Australia, Nigeria, Germany, Switzerland, Italy, Japan, Ireland, Argentina, Afghanistan, Norway, Canada THE GENERAL ASSEMBLY, Condemning the indiscriminate nature of anti-personnel mines and their potential to cause the loss of life and limb towards innocent civilians, Recognizing the adverse economic and social consequences that arise as a result of the use of antipersonnel mines, Believing in the need for international cooperation and dialogue on the question of the destruction and prohibition of anti-personnel mines, Recognizing and reaffirming the principles laid out in the Mine Ban Treaty (1997), 1. Urges member states that have not yet ratified the Mine Ban Treaty and/or have not already done the following to: a. declare any and all stockpiles of anti-personnel mines they have in their possession to the Secretary General in addition to: i. allowing the United Nations to inspect any stockpiles of anti-personnel mines (APMs) that they may have, ii. destroying all stockpiles of APMs as soon as possible, with the exception of a small amount kept for training purposes, iii. prohibiting the future production, import, export, and other transfer of anti-personnel mines, iv. providing the Secretary General with a roadmap regarding details of how the aforementioned actions will be carried out, b. immediately refuse to use anti-personnel mines in all future conflicts, c. providing information to the UN that will aid future de-mining operations, including but not limited to any available maps of known mined areas; Invites all non-signatories to the Mine Ban Treaty to accede to it without delay; Calls on member states to renew the Mine Ban Treaty and to debate, discuss and revise all its contents, while still keeping its original intents and principles intact; Approves of member states using temporary, limited stockpiles of APMs to protect their borders and for military training exercises provided relevant member states are: a. allowing all minefields and stockpiles of anti-personnel mines to be inspected by the UN, b. protecting civilians from mine-related injuries by: i. providing maps to civilians of the location of mine fields, ii. clearly marking mined areas with warning signs, iii. placing all minefields at least 50 kilometres away from any civilian settlement, iv. keeping maps of the exact location of all planted mines in order to facilitate removal at a later date, where the publication of such data is under the jurisdiction of the incumbent government, c. setting a timeframe to be remove all APMs that have been planted,

d. avoiding APMs that have been planted for such purposes from being neglected by: i. using bio-degradable anti-personnel mines, with the duration of decomposition being made available to the public, ii. using anti-personnel mines that can be remotely detonated and informing the public when doing so; 5. Requests the formation of a UN Land Mine Fund contributed to by all UN member nations in order to coordinate efforts in raising funds for mine removal, in which: c. annual fundraising goals are set, d. percentage of the fund contributed to by a nation is determined by the nations gross domestic product (GDP), e. funds are allocated to nations in need for mine-related issues, f. a board of representatives from all member states convenes annually to discuss the above matters; Urges nations with sufficient technological capabilities with regard to APMs to provide technological assistance to cooperative member states that require help in destroying their APM stockpiles Calls upon nations to work actively with non-governmental organizations (NGOs), to: c. clear known mined areas as soon as possible, d. create amputee rehabilitation centers with a prosthetic limb provision service e. provide education to civilians who live near potential minefields, regarding the: i. recognition of landmines and potentially mined areas, ii. safe removal of mines, iii. reporting of the presence of APLs to the appropriate authorities; Recommends the Security Council to strengthen role of the Department of Peacekeeping Operations in their efforts to conduct demining operations in affected member states through Mine Action, including but not limited to: c. training additional UN personnel to defuse and dispose of anti-personnel mines, d. collaborating with NGOs to carry out the aforementioned peacekeeping and humanitarian actions; 9. Asks the International Court of Justice to submit an advisory opinion of the legality of the use of anti-personnel mines in future conflicts, with reference to relevant international and humanitarian law pertaining to the protection of civilian populations and the prohibition of indiscriminate attacks; 10. Decides to remain seized of the matter.
