STATE OF OHIO vs. GARY STROUD

Of the October term in the year twenty eleven :

THE JURORS OF THE LAKE COUNTY GRAND JURY of the State of Ohio on their oaths, in the name and by the authority of the State of Ohio, do find and present that:

COUNT 1 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did purposely, and with prior calculation and design, cause the death of Diane Stroud. This act, to-wit: Aggravated Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.01(A) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code. COUNT 2 On or about the 9th day of October, 2011, in Lake County, State of Ohio, one GARY STROUD did purposely cause the death of Diane Stroud while committing, or attempting to commit, or while fleeing immediately after committing or attempting to commit Kidnapping, in violation of R.C. 2905.01(A)(3). This act, to-wit: Aggravated Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.01(B) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code.

COUNT 3 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did purposely cause the death of Diane Stroud, while committing, or attempting to commit, or while fleeing immediately after committing or attempting to commit Kidnapping, in violation of R.C. 2905.01(B)(2). This act, to-wit: Aggravated Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.01(B) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code. COUNT 4 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did purposely cause the death of Diane Stroud. This act, to-wit: Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.02(A) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code. COUNT 5 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did cause the death of Diane Stroud as a proximate result of committing or attempting to commit an offense of violence that is a felony of the first or second degree and that is not a violation of 2903.03 or 2903.04, to wit: Felonious Assault, in violation of R.C. 2903.11(A)(1). This act, to-wit: Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.02(B) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code. COUNT 6 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did cause the death of Diane Stroud as a proximate result of committing or attempting to commit an offense of violence that is a felony of the first or second degree and that is not a violation of 2903.03 or 2903.04, to wit: Felonious Assault, in violation of R.C. 2903.11(A)(2). This act, to-wit: Murder, constitutes a Felony, contrary to and in violation of the Ohio Revised Code, Title 29 2903.02(B) and against the peace and dignity of the State of Ohio, and shall be punished as provided in section 2929.02 of the Revised Code. COUNT 7 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did by force, threat, or deception, remove Diane Stroud from the place where she was found, or restrain the liberty of Diane Stroud, with purpose to terrorize, or inflict serious physical harm on Diane Stroud. The said GARY STROUD did not release Diane Stroud in a safe place unharmed. This act, to-wit: Kidnapping, constitutes a Felony of the First degree, contrary to and in violation of the Ohio Revised Code, Title 29 2905.01(A)(3) and against the peace and dignity of the State of Ohio. COUNT 8 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did, by force, threat, or deception, knowingly, under circumstances creating a substantial risk of serious physical harm to Diane Stroud, restrain Diane Stroud of her liberty. The said GARY STROUD did not release Diane Stroud in a safe place unharmed. This act, to-wit: Kidnapping, constitutes a Felony of the First degree, contrary to and in violation of the Ohio Revised Code, Title 29 2905.01(B)(2) and against the peace and dignity of the State of Ohio. COUNT 9 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did knowingly cause serious physical harm to Diane Stroud. This act, to-wit: Felonious Assault, constitutes a Felony of the Second degree, contrary to and in violation of the Ohio Revised Code, Title 29 2903.11(A)(1) and against the peace and dignity of the State of Ohio. COUNT 10 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD did knowingly cause or attempt to cause physical harm to Diane Stroud by means of a deadly weapon. This act, to-wit: Felonious Assault, constitutes a Felony of the Second degree, contrary to and in violation of the Ohio Revised Code, Title 29 2903.11(A)(2) and against the peace and dignity of the State of Ohio. COUNT 11 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD knowing that an official proceeding or investigation is in progress, or is about to be or likely to be instituted, did alter, destroy, conceal, or remove any record, document, or thing, with purpose to impair its value or availability as evidence in such proceeding or investigation. This act, to-wit: Tampering With Evidence, constitutes a Felony of the Third degree, contrary to and in violation of the Ohio Revised Code, Title 29 2921.12(A)(1) and against the peace and dignity of the State of Ohio. COUNT 12 On or between the 9th day of October, 2011 and the 27th day of November, 2011, in Lake County, State of Ohio, one GARY STROUD, not being authorized by law, did treat a human corpse in a way that would outrage reasonable community sensibilities. This act, to-wit: Gross Abuse of a Corpse, constitutes a Felony of the Fifth degree, contrary to and in violation of the Ohio Revised Code, Title 29 2927.01(B) and against the peace and dignity of the State of Ohio.
