Publicada Providencia que establece las normas para el Registro Nacional de Bienes y Servicios

En la Gaceta Oficial N 39.805 de fecha 22 de noviembre de 2011, fue publicada la Providencia Administrativa N 006, emanada de la Superintendencia Nacional de Costos y Precios, que establece las Normas Generales relativas al funcionamiento del Registro Nacional de Precios de Bienes y Servicios (RNPBS) Establece la referida Providencia que aquellos sujetos de aplicacin de la Ley de Costos y Precios Justos, tramitarn su inscripcin ante el RNPBS de conformidad con las normas de la Providencia, siguiendo las etapas y fases descritas en dicho instrumento. La Providencia define como pequeos establecimientos: (i) aquellos dedicados a la comercializacin de productos cuya nmina no exceda de cinco (05) personas; (ii) afronten problemas de estructura tecnolgica para tramitar su inscripcin ante el RNPBS; y (iii) hayan declarado en el ejercicio inmediatamente anterior ingresos brutos inferiores a mil quinientas Unidades Tributarias (1500 UT). Con respecto a los sujetos calificados como pequeos establecimientos, indica la Providencia que tramitarn su inscripcin ante el RNPBS, a travs de los procedimientos que establecer la Superintendencia Nacional de Costos y Precios en atencin a su condicin especial. Se indica que la Superintendencia Nacional de Costos y Precios seleccionar los productos sobre los que se determinarn las etapas del RNPBS, dichas etapas, estarn compuestas por las siguientes fases: (i) Notificacin de Precios; (ii) Notificacin de Costos; (iii) Anlisis de la informacin suministrada y; (iv) determinacin del precio. Cada una de las etapas del RNPBS ser regulada a travs de Providencias Administrativas emitidas por la Superintendencia Nacional de Costos y Precios, pudiendo el Poder Popular, previa coordinacin y a requerimiento de la Superintendencia, participar en los procedimientos de inspeccin y fiscalizacin desarrollados para la obtencin de la informacin, verificacin del cumplimiento de precios, identificar problemas de distribucin de productos as como recomendar polticas de produccin, distribucin y de intercambio. Notificacin de Precios: La Superintendencia Nacional de Costos y Precios determinar a travs de providencias administrativas, los productos y servicios que los sujetos de aplicacin debern tramitar ante el RNPBS.

Publication of Order providing for the norms of the National Registry of Goods and Services
Administrative Order N006, issued by the National Office of the Costs and Prices Superintendent was published in Official Gazette No.39,805 of November 22, 2011. Such Order provides for the general norms ruling the operation of the National Registry of Good and Service Prices (RNPBS) Such Order establishes that individuals and entities subject to the Law of Fair Costs and Prices, shall complete their registration with the RNPBS in accordance with the norms provided therein, following the phases and stages described therein. Small establishments are defined as (i) those engaged in the sale of products with payroll not exceeding five (05) workers, (ii) those facing issues related to obtain technology structure for purposes of their registration with the RNPBS ;and (iii) those that have declared in the immediately preceding year gross revenues of less than one thousand five hundred tax units (1500 TU). Individuals or entities categorized as small establishments shall complete their registration with the RNPBS through the procedures to be established by the National Office of the Costs and Prices Superintendent in accordance with their special status. The National Office of The Costs and Prices Superintendent shall select the goods for which the RNPBS stages shall be determined. They will consist of the following : (i) Price Notification, (ii) Cost Notification, (iii) Analysis of the information provided; and, (iv) Pricing. All of the RNPBS stages shall be ruled through Administrative Orders issued by the National Office of the Costs and Prices Superintendent, with the Popular Power being enabled, prior coordination and at the Superintendents discretion, to partake in the inspection and enforcement procedures to obtain information, verification of price compliance, identification of problems with goods distribution and recommendation of production, distribution and trading policies . Price Notification: The National Office of the Costs and Prices Superintendent shall determine through administrative orders, the products and services of the individuals and entities subject to the Law that shall be registered with the RNPBS.

Los sujetos de aplicacin suministrarn a travs del Sistema Automatizado de Administracin de Precios , la informacin requerida en el plazo determinado por la Superintendencia Nacional de Precios y Costos , la cual emitir una vez finalizado el proceso de notificacin de precios, el respectivo Certificado Electrnico de Registro, el cual podr ser revocado de conformidad con los supuestos establecidos en la norma. Notificacin de Costos: Culminada la primera fase de Notificacin de Precios, los sujetos de aplicacin debern en la oportunidad y condiciones sealados por la superintendencia nacional de Costos y Precios suministrar la siguiente informacin: (i) Datos Contables, Financieros y Mercantiles; (ii) Datos de Empresas Relacionadas, Agencias y Sucursales; (iii) Datos del Inventario y; (iv) Datos referidos a Transferencia de Tecnologa. Finalmente establece la Providencia que los integrantes del Sistema Nacional integrado de Administracin de Costos y Precios podrn ejecutar inspecciones y fiscalizaciones a los fines de obtener y/o verificar la veracidad de la informacin suministrada por parte de los sujetos de aplicacin, los cuales debern tener actualizados sus registros contables, administrativos y financieros a tales fines. Aquellos sujetos que incumplan con la obligacin de inscribirse ante el RNPBS, se nieguen a notificar los precios e informar los costos o suministren informacin insuficiente o inoportuna, estarn sujetos a las sanciones establecidas en la Ley de Costos y Precios Justos. La fijacin de precios de los productos que determine la Superintendencia Nacional de Costos y Precios, se har a travs de Providencias Administrativas que sern publicadas en la Gaceta Oficial de la Repblica Bolivariana de Venezuela. La incorporacin de nuevos bienes y servicios por parte de los sujetos de aplicacin o la solicitud de ajuste o modificacin de precios, sern tramitadas en las condiciones que establezca la Superintendencia Nacional de Costos y Precios a travs de Providencia Administrativa. La Providencia entrar en vigencia a partir del veintids (22) de noviembre de 2011.

Individuals and entities subject to this Law shall provide through the Automated System of Price Administration, the information required within the term established by the National Office of the Costs and Prices Superintendent, which shall issue, upon completion of the price notification process, the corresponding Electronic Certificate of Registration. Such Certificate may be revoked in accordance with the provisions set forth in the norms. Cost Notification: Upon completion of the first Price Notification stage, individuals and entities subject to this Law shall supply, within the timeframe and conditions specified by the National Office of the Costs and Prices Superintendent, the following information (i) Accounting, Financial and Commercial Information, (ii) Details of Related Companies , Agencies and Branches, (iii) Inventory Data (iv) Technology Transfer Information. The Order establishes that the members of the National Integrated System of Costs and Prices Administration may conduct audits and inspections for the purpose of obtaining and/or verifying the accuracy of the information provided, and must keep the entitys accounting, financial and administrative records up-to-date for such purposes. Individuals or entities that fail to comply with the obligation of registering with the RNPBS, or refuse to notify and report prices and costs, or that provide insufficient or inappropriate information, shall be subject to the penalties described in the Law of Fair Costs and Prices. Goods pricing by the National Office of the Costs and Prices Superintendent shall be processed through Administrative Orders to be published in Official Gazette of the Bolivarian Republic of Venezuela. The incorporation of new goods and services by individuals and entities subject to this Law, or any requests for price adjustment or modification, shall be processed under the conditions established by the National Office of the Costs and Prices Superintendent through Administrative Orders. This Order shall take effect from November 22, 2011.
