Getting Married in Indonesia:
Formalities and Procedures:
In accordance with Law No. 1 oI 1974 concerning
marriages in Indonesia (Article 2 (1): "a marriage is
legitimate iI it has been perIormed according to the laws oI
the respective religious belieIs oI the parties concerned."

All couples who marry in Indonesia must declare a
religion.

%he Civil Registry OIIice can record marriages oI persons
oI Islam, Hindu, Buddhist, Christian-Protestant and
Christian-Catholic Iaiths. Marriage partners must have the
same religion, otherwise one partner must make a written
declaration oI change oI religion.

%he Religious Marriage under Islam is perIormed by the
OIIice oI Religious AIIairs (Kantor Urusan Agama) in a
ceremony at a mosque, the home, a restaurant, or any other
place chosen by the couple and is legal immediately aIter
the ceremony.

A Christian, Hindu or Buddhist marriage is usually
perIormed Iirst in a church or temple ceremony. AIter the
religious ceremony, every non-Islamic marriage must be
recorded with the Civil Registry (Kantor Catatan Sipil).

ithout the registration by the Civil Registry these
marriages are not legal.

Recording by Civil Registry oIIicials can be perIormed
directly at the religious ceremony Ior an additional Iee.

Persons oI non-Islamic Iaith are required to Iile with the
Civil Registry OIIice in the Regency where they are
staying Iirst a 'Notice oI Intention to Marry' as well as a
'Letter oI No Impediment' obtained Irom their consular
representatives.

For the issue oI the Letter oI No Impediment to Marriage
by your Consular Representative you will need to present
Ior yourselI and your Iiance(e) your Passport(s) valid Ior
more than 6 months and CertiIied Divorce Decrees
(absolute/Iinal) and/or Death CertiIicates regarding the
termination oI all previous marriages.


For the Notice oI Intention to Marry you have to submit
the Iollowing documents Ior both partners to the Civil
Registry OIIice (show the original and present a
photocopy):

Ior Indonesian citizens;
4 CertiIied birth certiIicate;
4 CertiIied divorce decree (absolute) or death
certiIicates regarding the termination oI all previous
marriages;
4 Four 4x6 cm photos, both partners side by side;
4 Foreign citizens:
4 'Letter oI No Impediment to Marriage' issued by your
Consular Representative Ior Bali or Indonesia;
4 Indonesian citizens:
4 never married: letter Surat Keterangan Belum Kawin
Irom Kepala Desa or Lurah (mayor);
4 Men aged 18-21 and women aged 16-21: parental
letter oI consent, signed across the Rp. 6,000
meterai/tax stamp .

wish to Iile with the Civil Registry a prenuptial
Property Agreement (Surat Pernyataan Harta) which
must be signed beIore a local Notary Public. %his
contract is necessary iI you wish to hold property
separately during the marriage. In the absence oI
such a document, Indonesian marriage law assumes
joint ownership oI property.

Divorce
O One oI the means to dissolve a marriage is by divorce.
O Divorce may only be eIIected based on "suIIicient
reasons". %he reasons Ior a divorce have been regulated in
the Marriage Law, which are, in the event where one oI the
parties:
has committed adultery, is an alcoholic, is addicted to
drugs, is a gambler or other vices which are diIIicult to
cure;
has leIt the other spouse Ior two consecutive years,
without consent and without legitimate reasons or the
absence oI reasons beyond his control;
has been sentenced to imprisonment Ior Iive years or a
longer period;
has resorted to cruelty or severe ill-treatment,
endangering the liIe oI the other spouse;
has developed a disability or disease, preventing Irom
IulIilling the duties oI husband or wiIe; or
irreconcilable diIIerences.

O Divorce can only be obtained by a judgement oI the court
oI law, aIter the court has tried unsuccessIully to reconcile
the parties. %here are two ways to eIIect divorce:
4 divorce by "talak"
4 divorce by judgement oI the court oI law.

O Divorce by "talak" is applicable to Moslem spouses.
Divorce by court oI law judgement is applicable to
Moslem as well as non-Moslem spouses.

Alimony

O Payment oI alimony may be decided by the Court as the
obligation oI the husband. However, the Court may also
determine a certain obligation on the part oI the Iormer
wiIe. %here are no deIinite criteria to determine the
duration or the amount oI alimony payment. In practice,
the Court will decide a reasonable alimony amount to be
paid by the husband.
Custody and child support

O Both oI the divorced spouses are responsible Ior the
protection and education oI their children.In case oI
minor children, the Court will usually award custody oI
such children to the mother, unless the mother is the one
who is at Iault or there is prooI oI her incompetence to
take care oI the children.


Marital property

O %he division oI joint marital property will be dealt with
according to the respective laws oI the spouse. %he laws
may be their respective religious laws, customary law and
other laws. %he joint property is usually divided equally
between the spouses.

relation to the right to visitation and matters related to
child support and rights to property
