SECTION 01000 - GENERAL PROVISIONS


1. DESCRIPTION
The General Specifications shall be applied complementarily to the Conditions of Contract and the Technical Specifications. Approvalor Acceptanceused in this Specifications shall be effective with written documents. Verbal Approval or Acceptance shall be authorized by the written documents later.

2. 2.1

REQUIREMENTS APPLICABLE STANDARDS


(a) The newest versions of currently applicable Vietnamese Standards, codes in technical matters shall prevail to the Specifications. If there are any discrepancies in the requirements and statements in the Specifications, the clarifications and/or the decisions by the Engineer shall prevail in any case of discrepancy, ambiguity or contradiction. Unless otherwise the Specifications, or the Drawings, the standards, codes described on the materials, acceptance tolerance, measurement or payment methods etc., the Engineer shall advise the Contractor appropriate measures for the solutions. If the Contractors proposed materials are produced in compliance with standards other than those specified above, then the Contractor shall submit, for the Engineers review and approval, a detailed construction statement including construction drawings and engineering data, documentation including cross reference that the proposed standards of his materials are, at least, comparable to those specified in the Specifications and are in compliance with equivalent standards which are internationally recognized. During construction period, the Contractor and Supervision Consultants shall comply with Standards applied for Survey and Design of Noi Bai Lao Cai Highway Project, which was approved via Decision No.2223/QDBGTVT dated 17 July, 2007 by Ministry of Transport. List of applicable standards is shown in the Table 2.1 below:

2.2

REQUIREMENTS CLASSIFICATION
Work is paid for directly or indirectly according to each respective Section of work as specified in Sub-section Measurement and Payment of the respective Section, and some of specified items shall be adjusted according to Specification Section 01850 Acceptance of Work. The requirements established in this Specification Section are classified into the following types: The requirements for those items for which measurement for separate payment is not needed because they are deemed included in the rates and prices for other main items, or distributed among all the pay items listed in the Bill of Quantities. The requirements for those items for which a separate payment will be made based on the quantities measured and approved in accordance with this Specification Section. SECTION 01050 - GENERAL WORKS


1. DESCRIPTION
This section consists of the works classified as Indirectly Paid Works.

2. 2.1 2.1.1

REQUIREMENTS MATERIALS, EQUIPMENT AND PLANTS DELIVERY FORECASTS


(a) No later than 30 days after issue of the Letter of Acceptance, the Contractor shall prepare and submit to the Engineer a list of delivery forecasts for each significant material/equipment required for the Project. The listing shall show the target order dates, shipping and receiving dates and quantities of each required material/equipment. Unless otherwise specifically provided in the Contract, all items incorporated in the completed work, such as equipment, materials and other articles, are to be new and the most suitable grade for the purpose intended. Unless otherwise specifically provided in the Contract, reference to any equipment, material, article, or patented process, by trade name, make, or catalogue number, shall be regarded as establishing a standard or quality and shall not be construed as limiting competition, and the Contractor may, at his option, use any equipment, material, article, or process which, in the judgment of the Engineer and Employer, is equal to that named. Unless otherwise specified or instructed, all proprietary materials shall be used in accordance with the Manufacturer's instructions. If materials and equipment to be installed under this contract are likely to be replaced or repaired as a part of future maintenance, the Contractor shall only use materials and equipment, which are readily available in Vietnam or which are compatible with the replacement parts readily available in Vietnam. Where required by the Engineer, the Contractor should submit evidence of his compliance with this requirement. When required by the Engineer, the Contractor, before placing any order for materials or manufactured articles to be incorporated in the Permanent Works, shall submit for approval a complete description of such items, the names of the firms from whom he proposes to obtain them, and a list of such of the items that he proposes the firms should supply. When so directed, the Contractor shall submit samples and certificates for approval. (c) The dates in the list shall be in accordance with the approved Contractors Program and Mobilization Plan (as mentioned in Clause 2.2.2 of Section 1300).

The Contractor shall update this list when preparing the certificate for payment, or at any time required by the Engineer.

2.1.2

RECEIVING, HANDLING & DELIVERY


(a) All equipment, component parts, tools, spare parts shall be suitably packaged against damage or deterioration during transit to and short term storage in Vietnam. Painted surfaces shall be protected against impact, abrasion, discoloration, and other damage. Grease and lubricating oil shall be applied to all bearings and similar items. Articles subject to damage or deterioration shall be repaired or replaced by the Contractor at no expense to the Employer. The Contractor shall provide required information concerning the shipment and delivery. These requirements also apply to any sub-suppliers making direct shipments to the job site or the port of entry into Vietnam. The project name, name of the Contractor, and the name of the Employer must be clearly indicated on the air waybill or bill of lading.

STORAGE

(a)

Storage Facilities: Materials shall be stored so as to ensure preservation of their specified quality and fitness for the work. They shall be placed on a hard, clean surface and, when required, they shall be placed under cover. Stored materials shall be located so as to facilitate prompt inspection. Private property shall not be used for storage purposes without written permission of the owner and lessee and payment to them, if necessary. The Contractor shall provide and maintain storage facilities within the limits of the Site. The Contractor shall submit to the Engineer for review complete details of the type of temporary storage facilities proposed with his Mobilization Program.

(b)

Storage Procedure: Stacked items shall be suitably protected from damage by spacers or load distributing supports that are safely arranged. No metalwork (sheet pilings, reinforcing steel, etc.) shall be stored directly on the ground. Bulk cement shall be stored in silos or bulk cement container cars shutting out moisture.

Packed cement shall be stored in container boxes to keep from moisture, and the Contractor before usage shall check the Quality of cement. Pipe fittings and valves may be stored outdoors but must be placed on wooden blocking and protected from weather. PC tendons, sheath and related parts shall be kept in warehouse in the manner specified by manufacturers. PVC pipe, geotextile membranes, plastic liner and other plastic materials shall be stored off the ground on pallets and protected from direct sunlight. Pumps, motors, electrical equipment, and all equipment with antifriction or sleeve bearings shall be stored in weather-tight structures. Electrical equipment controls, and insulation shall be protected against moisture and water damage. Equipment having moving parts, such as gears, bearings, and seals, shall be stored fully lubricated with oil, grease, etc., unless otherwise instructed by the manufacturer. The Contractor shall carefully follow the manufacturers storage instructions. Off-site storage arrangements shall be subject to the approval by the Engineer for all materials and equipment not incorporated into the Works but included in applications for payments. Such off-site storage arrangements shall be presented in writing, and shall afford adequate and satisfactory security and protection.

2.1.4

SPECIAL LOADS
(a) On the preparation of Traffic Control Plan specified in Section 01600, where Special Loads necessitate the strengthening, altering, protecting and/or improving any bridge, culvert or road, the Contractor shall provide to the Engineer complete details of the Contractors intended procedure. The Contractor shall observe the requirements of Clause 4 of the General Conditions of Contract and is responsible for carrying out any necessary investigations at his own expenses and the obtaining of approvals, licences, escorts and any other necessary facilities in order to enable extraordinary traffic to be moved on the roads in the project area. (b) The above-mentioned details shall include the following: Details of Constructional Plant, Plant and/or Temporary Works to be moved including the total weight of load; The proposed date and time of such movement; The starting location and destination; The proposed route;

The bridge(s), culvert(s) and/or road(s) which require(s) strengthening, altering, protecting and/or improving; Full details of any such strengthening, altering, protecting and/or improving, including any and all necessary design calculations; Traffic safety measures while the load is in transit; and Evidence that the Contractor has liaised with and obtained all necessary permissions, permits and the like from all appropriate authorities.

2.2

PROJECT MEETINGS
The Contractor shall be responsible for making all the necessary arrangements and incidentals for preparing and supporting the meetings for the Project.

2.2.1

PRE-CONSTRUCTION CONFERENCE
(a) A Pre-Construction Conference shall be held at a time and place designated by the Employer, prior to the commencement date specified in Clause 8 of the General Conditions of Contract. The conference shall be attended by: Employers Representative Engineers Representatives Contractors Project Manager Contractors General Superintendent Contractors Project Engineer Contractors Quality Control Manager Contractors Safety Representative Governmental representatives, as appropriate Stakeholders or others, as requested by the Employer, the Engineer, or the Contractor (c) The Contractor shall provide and explain the following at the conference: The construction Program and respective schedule The schedule of values for progress payment purposes The schedule of construction drawings and other submittals (d) The Engineer will, in advance, advise the full agenda of the Conference, will preside it, and will arrange for keeping and distributing the minutes to all attendants.

2.2.2

PROGRESS MEETINGS
(a) The Engineer shall schedule and hold Progress Meetings regularly either monthly, weekly or at any other time as required by the Engineer or the Contractor. The Contractor shall provide sufficient support to the Engineer for organizing such meetings, but not be limited to the following: (I) Weekly Returns At weekly intervals the Contractor shall supply to the Engineer returns of labour, materials and Contractors Equipment, and a schedule of the main work items in each section of the Works showing quantitative progress during the previous week and cumulative progress to date. On the last day of each week the Contractor shall issue to the Engineer details of his intended programs of work for the week ahead. (II) Monthly Returns At monthly intervals, and not later than the last date of the month, the Contractor shall submit to the Engineer progress report documentation for the month, which shall include, but not be limited to the following: a program marked up with any agreed amendments and showing the actual percentage completion of each of the main items of work, so that comparison can be made with the scheduled percentage completion of each item; weather and other conditions, including daily temperature range, humidity, rainfall, wind speed and direction, river levels etc.; summary of staff and labour employed on the Site; schedule of Contractors Equipment on Site with dates of arrival and departure as appropriate; and periods of standby breakdown. schedule of principal material items with dates of placing orders, progress of manufacture, dates of delivery to Site etc.; record of Site safety and environmental protection; record of documentation; photographs and video CDs as described in Clause 01150-Contractors

(b)

Submittals.
The purpose of the meetings is to improve aspects related to coordination, and to review the progress of the Works, monitoring all the approved Programs, plans and schedules for the work, submittals, Quality control, etc. The meetings shall also be held to prepare, update and monitor the problems, or potential problems, that are affecting or could affect the Project. The Engineer will preside the meetings and take care of keeping and distributing the respective minutes.

The Contractors Project Manager, Quality Control Manager, Safety Officer, Scheduler and other key personnel as required by the Engineer or as necessary for presentation of relevant information and data, shall attend the Progress Meetings.

2.2.3

MEETINGS WITH INSTITUTIONS AND ENTITIES CONCERNED


(a) The Contractor shall provide sufficient support to the Engineer for preparing and holding periodic meetings for coordination and reporting with all the Projects stakeholders concerned. The pertinence and necessity of these meetings will be determined by the Engineer at his discretion.

SUBMISSION OF RETURNS/ REPORTS

Three copies (01 original and 02 copy) of all progress returns / reports shall be submitted to the Engineer, and two copies shall be submitted to the Employer. The submission of progress returns / reports shall not relieve the Contractor of any responsibilities in respect of notices, records, particulars, documents, or drawings required by other clauses of the Conditions of Contract and Specifications.

2.3

PROJECT CEREMONIES
The Contractor shall be responsible for making all necessary arrangements and incidentals in preparing and supporting the ceremonies for the Project following his duty as description on Condition of Contract or Specifications.

2.4
(a)

INSURANCE AND WARRANTY


These requirements shall be read and applied complementarily, and without detriment, to the requirements and provisions stated in respective Sub-clauses in relation with the insurances instructed in Clause 11-Defects Liability and Clause 18-Insurance of the Conditions of Contract. or Specifications. The Contractor shall provide evidence of insurance policies prior to the start of work. With each interim payment request, the Contractor shall submit evidence consisting of receipts of payment or other verification as approved by the Engineer that insurance policies are in effect. The Contractor shall be responsible for all costs for and associated with the warranty period of the Works in accordance with the related provisions of the Conditions of Contract.

(a)

PROTECTION OF WORKS
The Contractor shall carefully protect all work and materials from injury by the weather, or by other external action. If the event work defects or injures are detected, these shall be repaired or replaced at the Contractors expense, subject to the Engineers approval. Prior to placing the facilities in any area, all clearing and grubbing operations shall be done to the satisfaction of the Engineer. The ground elevation of all temporary facilities shall be 30 cm in minimum above the adjacent existing ground. The surface shall be adequately sloped to allow rainwater to adequately drain.

(b)

2.6 PROTECTION OF UTILITIES AND EXISTING STRUCTURES


(a) Before commencing construction work the Contractor shall undertake a survey to establish the detailed location of all utilities affected by the Works. Survey results shall be recorded in plan form to the satisfaction of the Engineer and surface pegs fixed on the site to indicate the location of all underground utilities. These pegs shall remain for the duration of the Contract. Where works are to be undertaken by the Contractor in the vicinity of utilities, the Contractor shall provide adequate protective devices and take precautionary measures. The Contractor shall be responsible for locating all existing structures prior to the start of construction. Any delay or extra expense to the Contractor shall not constitute a claim for extra work, not for additional payment, not for time extension, and not for compensation due to damage. The Contractor shall maintain all existing fences until completion of the Work. They shall not be relocated or dismantled, until written permission is obtained from the fence owner. Damage to Existing Property: The Contractor shall be responsible for all damage to streets, roads, railroads, curbs, sidewalks, highways, shoulders, ditches, embankments, culverts, bridges, or other public or private properties. 2.7 MAINTENANCE OF EXISTING WATERWAY


(a) The Contractor shall take all necessary measures to remove water including ground water flows from the area of his work when necessary, and/or as required by the Engineer, to allow satisfactory execution of work in progress or for the protection of completed work. The Contractor shall maintain all of the existing drainage and the irrigation channels entering, crossing or affecting the works that should be relocated or protected. This shall include, where required by the Engineer, the cleaning of upstream and downstream to an extent of 100 m beyond the construction limits and the Right-of-Way. Payment for works specified in Clause 2.7 Section 01050 shall not be paid separately but deemed to be included in other related works in Division 3Earthwork, and Division 4 Drainage System of this Specification. Payment shall be considered to be full compensation for all expenses involved in the work and the Contractor's estimate will be assumed to be based on a thorough study of the work required and shall include, but not be limited to, the provision of pumps, temporary dams, temporary realignment of the flow, the construction of temporary water courses, ditches and drains and shall be deemed to cover the cost of working in any season of the year and for working in flows of both storm water and sewage contaminated flows.The Engineer may at any time withhold payments for maintenance of existing drainage and irrigation channels made by the Contractor if, in the opinion of the Engineer, the requirements of this Specification Section are not duly complied.

2.8 TEMPORARY INSTALLATIONS


(a) Temporary Power: Temporary power consists of the following: Construction Operations: The Contractor shall provide installations for power supply from approved and available power sub-stations. The Contractor shall provide all power for operation of his plant and equipment, or for any other use. If power source is available, the Contractor shall arrange with the utility company to use such source and pay for the service required for power supply and lighting.

Other Temporary Installations: External Lighting: Suitable external lighting shall be provided at the entrance to all buildings. Maintenance: During the performance of the Works the Contractor shall maintain all temporary facilities in a suitable manner to the satisfaction of the Engineer.

Removal: Upon completion of the Works, or as otherwise directed by the Engineer, all plant, temporary facilities and encumbrances used for the Works shall be removed, the area affected properly cleaned and repaired and, if necessary, the property owner paid. (c) Removal: Upon completion of the Works, the Contractor shall remove from the Site all construction plant and equipment provided by the Contractor, any subcontractor or supplier. Employer not Liable for Damage to Plant: The Employer shall not at any time be liable for the loss or damage to any of the constructional plants and equipment provided by the Contractor or any subcontractor or supplier.

SECTION 01100 CONTRACTORS MOBILIZATION AND DEMOBILIZATION


1. DESCRIPTION
This section consists of the general provisions for the mobilization work by the Contractor.

2. 2.1

REQUIREMENTS REFERENCES
These requirements shall be applied complementarily, and without detriment, to the requirements and provisions stated in: Clause 4 The Contractor, Clause 8 Commencement, Delays and Suspension, Clause 10 Employers Taking Over, Clause 11 Defects Liabilityof the Conditions of Contract.

2.2
(a)

MOBILIZATION PROGRAM
The Contractor shall submit to the Engineer, for his review and Approval, a detailed Mobilization Program. This Program shall be submitted as an attachment of the Programme specified in Clause 8- Commencement, Delays and Suspension of the General Conditions of Contract. The Program shall include a schedule noting the anticipated arrival of all construction equipment and facilities as well as the arrival of all key personnel of the Contractor and subcontractors. Moreover, the mobilization Program shall include a layout plan noting the location, size and arrangement of all temporary facilities, including security fencing and entrance and exit gates, sewage and water lines and systems, electrical supply and access and facility roads. The Contractor shall complete the construction of all temporary facilities and the mobilization of all key personnel, equipment and plant no later than 120 days after the date of the Notice to Proceed. This completion date shall be established as a mile stone specified in Section 01300.

The Contractor shall mobilize and keep all the key staff as required in the Prequalification (PQ) Documents, General Conditions of Contract and the Specifications. The Contractor shall not remove his staff from the site without the express written permission of the Engineer. Within fourteen (14) days of any such

The Contractor shall acquire all additional working areas and any additional areas required for construction purposes and access or other uses as stipulated in the Specifications. Before entering the work site, the Contractor shall give written notice to the Engineer. The Contractor shall give separate notices to each owner and occupier or authority having jurisdiction over the work sites. Before entering any additional work areas the Contractor shall obtain, and forward to the Engineer, a copy of the written consent of the owner and occupier or authority having jurisdiction over the land, and shall state the purposes for which such land is to be used. The Contractor shall define the extent and period of occupation for which such consent is granted. The Contractor shall select, arrange for and, if necessary, pay for the use of sites for construction purposes, detours, plant and other uses necessary for the execution of the Works. Before using any land belonging to the Government or to a private landowner for any purposes in connection with the execution of the Works, the Contractor shall get the Engineers Approval for such use. If any utility passing through the temporary site is affected by the Works, the Contractor shall at his own expense, shall provide an appropriate plan for re-alignment or relocation of such utility in full working order to the satisfaction of the owner of the utility and the Engineer, before cutting or removing or relocating the existing utility. On completion of the Contract, or earlier if so directed by the Engineer, all plant, temporary facilities and any other encumbrances shall be removed, the site and land use areas shall be properly cleaned, all damage made good, and, if necessary, the land-owner paid for the use of the land.

All construction plant and equipment provided by the Contractor shall, when brought on to the Site, be deemed to be exclusively intended for the construction and completion of the Works and the Contractor shall not remove the same or any part thereof without the approval of the Engineer.

2.6

CONTRACTORS SITE OFFICE, SHEDS, STORES AND LIVING QUARTERS


The Contractor shall supply, equip and maintain for the Contract period all his own living accommodation, site offices, sheds and stores necessary for the execution of the Works, and shall make his own arrangements, subject to the approval of the Engineer, with the owner of any land required and, if necessary, pay for its use.

2.7

CONTRACTORS WORKSHOP AND WAREHOUSE


The Contractor shall have on the Site a suitable workshop, adequately equipped and provided with utilities, to allow for repairs of the equipment employed to carry out the Works. He shall also provide a warehouse for the equipment spare parts, mainly for the parts that frequently fail or are difficult to procure. A chief foreman qualified for mechanical repairs, with an adequate labor force shall be assigned for management and operation of the workshop.

2.8 2.8.1

SUBSIDIARY REQUIREMENTS FOR CONTRACTORS FACILITIES TEMPORARY ROAD AND BRIDGE WORKS:
In accordance with his Temporary Roads and Bridges Plan (reviewed and approved by the Engineer) the Contractor shall: Furnish, maintain, and remove on completion of the Works for which they are required, all temporary roads and road works such as staging over roads, access and service roads, temporary crossing structures over channel or unstable soil area for which the work is required. Concurrently, they should be suitable for any means of transport to bring construction manchines to the Site, to make access roads for means of transports of the Contractor or other people, or for whatever purpose. Such temporary road works shall be constructed to the satisfaction of the Engineer in accordance with the actual traffic, and shall be maintained in practical conditions all the times. Make all necessary arrangements, including payment if required, with the public authorities or landowners concerned, for the use of the land, (before constructing the works for temporary roads, and obtaining the Engineers prior approval). The Engineers approval shall depend upon the Engineers satisfaction with the Contractors proposals for items such as paving, signs installation, lighting and riding Quality of the temporary road together with the proposed maintenance arrangements. Such approval will not, however, relieve the Contractor of his responsibilities under the Contract. Upon completion of the Works the Contractor shall clean up and restore the land to the satisfaction of the Engineer. Where temporary traffic ramps are required, or if so requested by the Engineer, the Contractor shall furnish all the labor and materials, construct and maintain such temporary traffic ramps to the satisfaction of the Engineer.

2.8.2

PROJECT INFORMATION SIGNS.


Within the mobilization period, the Contractor shall erect project information signs at locations as required by the Engineer. The size and material of the project information signs and the message thereon, and style of lettering and color, shall be determined by the Engineer. The Contractor shall maintain the signs and remove them upon completion of the construction period.

2.8.3

SECURITY FENCING
Security fencing with at least three (3) strands of barbed wire shall be constructed around all temporary facilities. Fencing shall be at least 1.8 meters high and provided with lockable gates at each entry and exit point.

2.8.4

TEMPORARY LIGHTING FOR ALL BUILDINGS AT SITE


(a) (b) The Contractor shall provide temporary lighting for all buildings at Site, to protect the Works and maintain suitable working conditions. The Contractor shall provide and install circuit and branch wiring, with area distribution boxes located so that power and lighting are available throughout the construction site. Generators with a suitable capacity shall be furnished by the Contractor to cope with the cases of power supply cut-off.

2.8.5

SANITARY FACILITIES
The Contractor shall furnish temporary sanitary facilities at the Site, as provided herein, for the needs of all construction workers and others performing work or furnishing services on the Project. Sanitary facilities shall have reasonable capacity, be properly maintained throughout the construction period, and obscured from public view to the greatest practical extent. If chemically treated type toilets are used, at least one such toilet shall be furnished for every 20 people. The Contractor shall enforce the use of such sanitary facilities by all personnel at the Site.

2.8.6

WATER
(a) All water required for and in connection with the equipment and plant, devices, dust control, for settling of backfill material or for any other use as may be required for proper completion of the Works, shall be provided by and at the expense of the Contractor. In case of shortage of water for use in the construction works, the Contractor shall draw water from a well or wells dug at the Contractors expenses, after Approval by the Engineer.

The Contractor shall provide a sufficient supply of bottled drinking water from an acceptable source to all of the Contractors employees, including all necessary devices for keeping the water in good condition (hot and cold water).

2.8.7

SEWAGES
All sanitary facilities shall be connected to a suitable sewage system.

2.8.8

COMMUNICATION SYSTEM
The Contractor shall make all necessary arrangements and pay all installation and usage charges for the communication system in his offices at the Site.

2.8.9

CONTRACTORS WEIGH-HOUSE AND SCALE


(a) (b) (c) The Contractor shall provide a weigh-house and acceptable scales or other weighing devices, which shall be part of the Constructional Plant. Scale platform shall have a sufficient length to permit simultaneous weighing of all axle loads of each hauling vehicle. Each weighing device shall be accurate within 0.5 percent throughout the range of use, and shall be inspected, tested, and sealed by the Contractors Independent Testing Laboratory, as often as necessary and/or as the Engineer may deem necessary to assure continued accuracy. The Engineer may permit the use of weighing devices for a reasonable period prior to sealing, provided field-testing indicates consistent compliance with the limits of accuracy specified herein. The Contractor shall have on hand not less than ten (10) standard weights of twenty-five (25) kilograms each. The Contractors Independent Laboratory shall be employed for testing the scales as often a necessary and/or as required by the Engineer. Standard scales, certified by the Government, or owned by a responsible local authority, may be used subject to the Approval of the Engineer. Truck platform scales for weighing bituminous products shall be equipped with automatic printing devices to record time and weight, and one copy of each weight ticket shall be kept by the Engineer after each measurement of weight.

FILLING-IN HOLES AND TRENCHES


The Contractor, upon completion of any part of the Works, shall immediately, at no additional cost, fill up all holes and trenches that he may have dug or excavated and are no longer required for the Project, or shall carry out such relevant work as required by the Engineer, and he shall clear away all rubbish and material that are

no longer required for the execution of the Works. All costs related to this requirement shall be deemed included in the Contractors Unit Prices for the applicable work.

3. 3.1

MEASUREMENT AND PAYMENT METHOD OF MEASUREMENT


Mobilization shall not be measured, but shall be paid as a lump sum.

3.2

BASIS OF PAYMENT
Payment for Mobilization shall include: (a) Transport of Construction Plant based on list of equipment and plant which was submited in the Bids or whatsoever additional equipment and plant required, from the port of unloading in Vietnam to the sites of bridges, tunnel and highway in construction process and installation of such equipment and plant; Supply, installation and maintenance of the Contractors vehicles, accommodations, offices, laboratories (but excluding supply of the Contractors Labs Equipments and Contractors Surveying Equipment as described in Section 01750-Laboratory and LABs Equipment), workshops, stores, communication system, facilities, Project Information Signs, etc.; Construction, maintenance and removal of temporary road and bridge works; Dismantling of the work site by the Contractor, with the removal of all the installations, constructional plant and equipment, so that the site is restored to the state it was in before the installations or placing; Protection and restore land acquistion and right of way markers, which have been handed over to the Contractor, in oder to rehanover to the Management Unit. All the works including the costs for all incidentals works necessary to comply satisfactorily with the requirements of this Specification Section.

2.3 2.3.1

CONSTRUCTION PHOTOGRAPHS AND VIDEO RECORDING PHOTOGRAPHS


The Contractor shall be take construction photographs as described below: (a) Photographs of each site location or proper property shall be taken prior to starting the works on site and submission to the Engineer. The same view from the same points shall be taken upon completion of all construction activities and submittals with the Contractors application for final payment. (b) Every month during construction implementation at each time and each location designated by the Engineer, photographs shall be taken and submitted in attachment with monthly report of the Contractor. Each month the Contractor shall select approximately 36 (thirty six) representative photographs to form an album of the months activities. Each photograph in the album shall be standard postcard size and suitably captioned. The Contractor shall supply three colour prints of each of the photographs mounted in an album. The albums shall be of acceptable quality and three copies and the digital file shall be delivered to the Engineer at the start of the following month. (c) Photographs at intervals of no more than 200 meters along the route of the works shall be taken prior staring the work and submitted immediately to the Engineer. The same view from the same points shall be taken upon completion of construction activities for any work section and submitted together with the Contractors Monthly Report or as otherwise specified by the Engineer.

(d) Photographs shall be taken for every structure location with number of photos as specified by the Engineer. (e) The Contractor shall take construction photographs by camera with automatically recorded date-month-year and/or by digital camera so that such photographs can be created on computer. The Contractor shall supply both hard and computerized copies of photographs as required by the Engineer. The Contractor shall provide the necessary software to the Engineer for computerized storage, editing and reproduction of photographs. (f) The use of film camera is not allowed. (g) Each photograph shall be suitably captioned. (h) The Engineer may at any time withhold payments if, in his opinion, the provisions for construction photographs made by the Contractor are not in compliance with these requirements. (i) The photographs and digital originals shall form a part of the records of the Employer and the prints of the same cannot be supplied to anybody else or published without the written permission of the Employer.

SECTION 01200 CONTRACTORS DRAWINGS


1. DESCRIPTION
Based on the Drawing on Tendering (hereafter referred as the Drawings), following drawings (hereafter referred as the Contractors Drawings) shall be prepared and submitted by the Contractor: CONSTRUCTION DRAWINGS These are also called As-Stake Drawings, including Shop Drawings, Working Drawings and any Other Drawings The Contractor shall, prior to the change or deviation, note on the Construction Drawings all changes and deviations from the works shown in the Drawings and the Specifications and the respective Construction Drawings. These shall be reviewed and approved by the Engineer before any work is performed, and shall be available at the Site at all times Upon completion of the Works, the complete set of the Construction Drawings shall be stamped As-Constructed and signed by the Contractors Quality Control Manager, and shall be so arranged to be used as the base for preparation of the AsBuilt Drawings. The final partial payment in Sub-section 01150 shall not be paid until confirmation by the Engineer of the above-mentioned requirement. SHOP DRAWINGS WORKING DRAWINGS These are Construction drawing mainly for the permanent works to facilitate an adequate control of the work. These are drawings mainly for the temporally works, illustrating the construction methods to be applied for the works, such as access ways, cofferdams, false works, temporary support systems, formwork, and for other temporary works, equipment, and any other information. The requirements to complement the submitted Shop Drawings or Working Drawings, with supplemental documents. These Drawings are prepared to show details of the entire work items which are actually constructed (should be in English and Vietnamese).

The Contractor shall submit the Zero-status Documents for all Zero-Status Documents for the project bridges as part of the as-built documents. The ZeroBridges status documents shall include following documents and other documents that the Engineer may request reasonably: a) Zero-status reports; b) As-built bridge profiles, which shows the as-built elevation of substructure, superstructure, bridge deck, asphalt surface, and other important elements; c) Riverbed cross-section at the bridge location at the time of completion; d) Inspection results, monitoring methods, and corrective measures for cracks or any other defects found at the time of completion.

2. 2.1

REQUIREMENTS GENERAL
(a) The requirements herein established shall be applied to the requirements and provisions stated in Clause 1-General Provisions or other Clause of the Conditions of Contract for the Drawings, and to the requirements for the Contractor submittals stated in Specification Section 01150. Based on the Drawings supplied to the Contractor as stated in Clause 6.1 Custody and Supply of Drawings and Documents of the Conditions of Contract, the Contractor shall prepare all drawings required for the execution of the Works as specified herein. The Contractor shall be responsible for the following: Confirmation and correlation of all incorporated information; Accuracy of all dimensions and quantities; Information pertaining to the fabrication and construction method; Handling and conservation of all the drawings in good condition; Delays in the submittals; and Submission to the Engineer only by the Contractor about Constructors Drawings prepared by subcontractors, manufacturers, suppliers or distributors. (d) The Contractor shall provide all the necessary information to substantiate that all materials and/or plants incorporated into the Works, conform to

and meet or exceed the requirements of the Specifications and/or the Drawings. (e) The Contractor shall provide all necessary and/or required drawings, calculations and certifications for all temporary works as required or described in the Specifications. No more than two submittals per item are required, provided however that: If additional submittals are required by actions of the Contractor, any delays shall be the Contractors responsibility. Any additional costs that may be incurred by the Employer or the Engineer due to the review of submittals more than twice shall also be the responsibility of the Contractor. The Employer may at any time, after advising the Contractor of such additional costs for submittal review, recover such costs from money due or money which will be due to the Contractor. (g) Failure of the Contractor to comply with the requirements of this Specification Section shall be considered as a serious default of the Contractor in meeting his contractual obligations, resulting in a delay in work progress. In this case, the Engineer shall withhold the relevant payments until the requirements are satisfactorily met and measures to recover the delays are effectively applied by the Contractor and approved by the Engineer. (h) Unless otherwise specified by the Engineer in accordance with Clause 1General Provisions and Sub-clause 1.9 Delayed Drawings or Instruction of the Conditions of Contract, all time required for review, submittal and approval for the Contractors Drawings shall not be the basis for any claim, neither for a time extension nor for monetary adjustment.

REQUIREMENTS FOR THE CONTRACTORS DRAWING PREPARATION


All the Contractors Drawings shall be prepared using Auto-CAD 2007 in a sheet format previously approved by the Engineer. Notes shall be written in English, and when required, in Vietnamese. All dimensions shall be in the metric system. The format of the Contractors Drawings shall be as shown in Fig 1 and 2: The Contractors Drawings shall be stamped Submitted for Approval for Construction and shall be signed by the Contractors Quality Control Manager. Design notes, calculations, lists, reports, descriptions, catalogue cuts, and other non-drawing submittals shall be submitted on A4 size sheets, in lieu of the size mentioned above.

Unless otherwise specified, each submittal of the Contractors Drawings shall consist of three copies and shall be submitted to the Engineer, one set of which will be returned to the Contractor with revisions, if needed, noted thereon. 2.3 2.3.1

REQUIREMENTS FOR SUBMITTAL AND APPROVAL SUBMITTAL SCHEDULE (THE DRAWINGS SCHEDULE)
(a) The Drawings Schedule shall be prepared in close relation, and showing solid consistence, with the program to be submitted specified in Clause 8Commencement, Delays and Suspension of the Conditions of Contract (hereafter referred as the Program). Incorporating in the Program, the Contractor shall prepare and submit a Submittal Schedule (hereafter referred as the Drawings Schedule), noting all required information and data required for the Contractors Drawings. The Drawings Schedule shall be used as the document for monitoring the submittals, and to register the approvals, throughout the Contract. The Drawings Schedule shall content, but not be limited to, the following: A list of the Contractors Drawings to be submitted in accordance with the main items of the Program. The captioned list shall be classified by type of drawing (i.e. Shop Drawings, Working Drawings, Other Drawings or As-Built Drawings); A bar schedule of the main submittals showing the main work items of the Critical Path as the milestone of each submittal; and A list and schedule of the main tests for materials and trials to be subject to approval by the Engineer for the main work items. This list shall include also the submittals of certifications from the suppliers. (e) The register of each submittal shall content the following: A description of each submittal and its contents including applicable specification identification; Statement if the submittal is for information, or to receive the Engineers consent or approval; The dates of the submittal: date of submittal to the Engineer and the expected date for return of the submittal; In the event that a re-submittal is required, besides the new dates, it shall content the status of the returned submittal (i.e. approved as noted, the comments, or rejected); and In the event that a deviation regarding the requirements shown in the Drawings and the Specifications is detected, it shall be clearly stated by the Contractor in the respective submittal. The Contractor shall include in his Monthly Report, a summary describing the existing condition and the progress of his Drawings Schedule.

2.3.2

REQUIREMENTS AND PROCEDURE FOR THE APPROVAL


(a) Submittals of the Contractors Drawings shall be made in complete packages according to the approved Drawings Schedule, and shall include all necessary information to allow a verification of conformity with the requirements of the Contract, the Drawings and the Specifications. Upon receipt of a submittal package by the Engineer, it will be evaluated for completeness and the Contractor will be notified of any deficiencies therein. The Engineer will review the submitted drawings to determine that general conformity with the design concept and general compliance with the information given in the Drawings and the Specifications have been achieved. Any work done by the Contractor prior to the Engineers review of the submitted drawings shall be at the Contractors sole risk. The Engineer may request additional details and require the Contractor to make changes in the submitted drawings which are necessary to conform to the provisions shown in the Drawings and the Specifications (without additional cost to the Employer). After review, the Engineer will return one set of submitted drawings to the Contractor. Returned drawings will be stamped with the Engineers review stamp to indicate the following:
Approved: Approved as Noted: The submitted Contractors Drawings have been reviewed and do not require re-submittal The submitted Contractors Drawings have been reviewed and the Contractor shall incorporate the comments as noted in the drawings. The reviewed Contractors Drawings do not require re-submittal. The submitted Contractors Drawings require correction or redrawing and shall be resubmitted for review. If the submitted drawings are returned for correction or redrawing, corrections shall be made and the Contractor shall resubmit them in the same manner as the first Submittal. Specific notation shall be made on the resubmitted drawings to indicate the revisions made.

PARTICULAR REQUIREMENTS FOR THE AS-BUILT-DRAWINGS


The requirement established in Sub-section 2.3(4) for completion of the Construction Drawings shall first be satisfied by the Contractor, and approved by the Engineer. Based on the above condition, the Contractor shall prepare in consultation with the Engineer, the final format to be used for preparation of the As-Built Drawings (including related documents such as drawings, completed quantity, back up data etc.). The procedure specified in the Conditions of Contract Clause 10 Employers Taking Over for the issuance of the Taking-Over Certificate, shall be suspended if, within 10 days after the submittal of the Contractors request for the issuance of the said certificate, the Contractor fails to submit the As-Built Drawings prepared as herein specified to the Engineer for his review and approval. The Contractor shall initially submit 2 sets of Quality prints of the As-Build Drawings to the Engineer for review, comment and Approval. For the convenience of the Employer, Authorities Governments and Ministry of Transportation Government to reviews and used, the As-Build Drawings shall be Vietnamese translation attached and Notes shall be translation in Vietnamese. After all corrections or comments as required by the Engineer have been addressed, and the As-Built Drawings have been approved, the Contractor shall submit to the Engineer the following: one (1) original and ten (10) clear photocopies, and one (1) computer disk copy containing the electronic files of all drawings in an editable version by the approved application for the Project.

DRAWING COPYRIGHTS
The rights for using, copying or reproducing, partly or entirely, all or any of the drawings prepared by the Contractor as herein specified, are reserved and belong to the Employer at any time or in any situation.

SECTION 01300 - PROGRAM OF WORK 1. DESCRIPTION


This Specification Section prescribes the form and contents of the Program of Work (hereafter referred as the Program) by the Contractor in accordance with Clause 8 Commencement, Delays and Suspension and Clause 14 Contract Price and Payment of the Conditions of Contract. The following definitions shall be referred to for proper interpretation of this Specification Section: Program: It shall govern the execution of the whole Works, and shall consist of all the plans, schedules, statements on the methods and procedures for construction, assignments of equipment and personnel, testing and trials, drawings, submittals and the like required or mentioned in the Specifications, or required by any other part of the Contract. The time-schedule that shall be incorporated in the Program to show, describe and monitor the progress, using the Critical Path Method (CPM) presented in the form of bar-chart and showing other data herein specified. The cash flow schedule, in accordance with the requirements of Clause 13 & 14 of the Conditions of Contract, shall consist of a detailed cash flow estimate, in quarterly periods, of all payments to which the Contractor will be entitled under the Contract.

(a) The Program shall incorporate in detail all activities related to the Works from their commencement to their completion, taking into account all the main items introduced in the Bill of Quantities for each component of the Works. The Contractor shall comply satisfactorily with the requirements of Clause 13 Variations and Adjustments and Clause 14 Contract Price and Payment of the Conditions of Contract, and this shall be included as a main part of the Program. The Program shall include, but not be limited to, the following: the Schedule (showing the critical path); the Contractors mobilization and demobilization plan; all submittals and drawings; all plans and schedules; all activities for site investigation; all surveys and laying out; all key and milestone dates (such as the dates for submittals of schedule, the dates for mobilization, the commencement/completion dates for the works of soft soil treatment, bridge construction, sub-base, Engineers accommodation, etc.); all interface dates between the Contractor and sub-contractors for the Works; all activities associated with the procurement, purchase, fabrication and shipment of goods, materials, and equipment to be incorporated into the Works; all public and site holidays; and other activities that the Engineer may require for monitoring.

2.2.2

THE SCHEDULES CONTENTS


(a) The Schedule shall include a narrative statement and a logic breakdown of major activities. The narrative statement shall comprehensively describe the work execution plan, the achievement of milestones and any intermediate dates, the outline method statements for the major work items, temporary works, and the like. It shall fully explain the reasons for the main logic links in the schedule, and shall include particulars on how activity durations are established. The detail and number of activities incorporated in the Schedule shall be sufficient to manage the total Works and to identify restraints, delays and effects on the Works by dependent activities. All the activities shall be organized in a logical work breakdown structure, indicating work stages and phases, and shall have a code number for identification related to the work breakdown structure as well as a unique description. The Schedule shall show activity durations, activity descriptions, early and late start and finish dates (all of them expressed in calendar days), and activity float and activity dependencies, applying the Critical Path Method (CPM) of scheduling with all activities tied to only-one start date and onlyone end date. All activities shall be cost loaded (as appropriate) with schedule costs equating to the Cash Flow. All activities shall be resource loaded (as appropriate), indicating all manpower and/or equipment necessary to accomplish the activity within the given time duration. Any activity having or creating an imposed constraint to the Schedule shall be clearly defined and fully described. The Schedule shall be prepared by using a computer application approved by the Engineer for programming, and that has been provided in software by the Contractor for each package of the Project, with relevant licenses for both the Contractor and the Engineer.

In addition, an activity report, generated by the schedule computer Program, shall be attached as an appendix to the Contractors Monthly Report. a) The requirements established in this Specification Section shall supplement the requirements and provisions stated in Clause 46.1 Rate of Progress of the Conditions of Contract, and the Specification Sections 01000 General Provisions, 01200 Contractors Drawings, 01300 Program of Work and the like included in the Contract regarding the reporting requirements. b) Before the fifth calendar day of each month, the Contractor shall submit to the Engineer the Report in 1 original and 5 copies. The Report shall describe all works performed up to and including the last day of the preceding month. c) The Report constitutes the fundamental document for the procedure of each progress payment; therefore, the reviewed and approved Report shall be attached to each certificate for progress payment. d) Failure of the Contractor to comply with the requirements of this Specification Section shall be considered as a serious default of the Contractor in meeting his contractual obligations. In this case, the Engineer will suspend the procedure for issue of any payment certificate if the relevant Report does not meet the requirements specified herein.

SECTION 01500 - PROJECT SAFETY


1. DESCRIPTION
This section consists of the requirements for planning, implementing and maintaining the safety measures to be applied by the Contractor for the Project during the execution of the Works. The following definitions shall be referred to for proper interpretation of this Specification Section: Contractors Safety Plan: - The document that shall be prepared and submitted by the Contractor in compliance with the Contract (hereafter referred as the Safety Plan). - It shall consist of a complete plan for implementation and monitoring of safety measures applied in the Project comprehending the Site and all the related areas such as the construction plants, quarries, roads for material transportation, etc.

- Within 28 (twenty-eight) days of the date of the Notice to Commence, the Contractor shall submit his Project Safety Plan (PSP). The Contractor shall cooperate and comply with Engineers instruction to have PSP approved by Engineer before the start of site works.
- The Contractor shall comply with the approved PSP and Engineers instruction on safety. - If the Contractor proposes to change, he shall notify the Engineer in writing at least seven (7) calendar days prior to any proposed change. Proposed changes are subject to the Engineers approval. If the Engineer makes any subsequent recommendation or instructions on the PSP in writing, the Contractor shall revise the PSP accordingly. - The finalities of PSP Engineer approval shall be a Vietnamese translation attached. Program and the Schedule: As defined in Specification Section 01300 Program of Work

2. 2.1

REQUIREMENTS GENERAL
a) The Safety Plan shall be considered as one of the key-plans composing the Program prepared, submitted and monitored as described in Specification Section 01300 Program of Work.

Failure of the Contractor to comply with the requirements of this Specification Section shall be considered as a serious default of the Contractor in meeting his contractual obligations, resulting in delay in the work progress. In this case, the Engineer will suspend the procedure for progress payments until the Contractor corrects the defects, recover the delays, and secures normality in the compliance with the said requirements. Defaults on complying with these requirements by the Contractor will also be taken into account by the Engineer in estimating the respective compensations that will be determined in accordance with the applicable statements of Clauses 1; Clause 4; Clause 6; Clause 11; Clause 17; and Clause 18 of the Conditions of Contract. The Contractor shall, as a priority in all his activities, undertakings and endeavors, ensure continuity of the safety measures for the public and all persons directly or indirectly associated with the Works. The Contractor shall instruct and require the Project Manager, Safety Manager and his Site representative responsible for the Contract execution to be directly accountable in all matters concerning safety. The Contractor shall comply with all safety and industrial health legislation including, without limitation to, the Rules and Regulation of the Socialist Republic of Vietnam and the authorities having jurisdiction on safety.

CONTRACTORS SAFETY PLAN (THE SAFETY PLAN)


a) Incorporating in the Program, the Contractor shall prepare and submit to the Engineer for review and approval, the Safety Plan that shall be implemented during the work execution, and shall be monitored on a daily basis. The Safety Plan shall include, but not be limited to, the following: Safety Organizational Structure: The organization classified into subdivisions that can be technically and effectively managed, and described in a Safety Organizational Chart identifying the subdivisions, responsibilities and tasks of the personnel and supporting staff, all of them engaged solely and specifically for safety issues (including the Contractors Safety Manager who will be responsible for all safety issues in the Site). Moreover, the criteria for appointment of principal staff shall also be described. Lines of Communication: The organizational structure shall show direct lines of communication and reporting among the Safety Manager, Contractors Project Manager, and the Contractors Site representative responsible for the Contract execution. Safety Table: A table showing the names, addresses, e-mail addresses, and telephone/facsimile numbers of all the personnel named in the Safety Organization Chart (this Safety Table shall further be shown in all the Project offices, and distributed among all the Project personnel). Interaction and Communication Procedures: The procedures defining the communication system between the Contractors construction personnel and the safety assurance staff, including radio communication facilities, regular communication and reporting system. Moreover, the frequency, coverage and intent of site safety meetings shall also be clarified. Safety Training: The methods for promoting awareness of site safety and industrial health amongst all persons directly or indirectly associated with the Works. This shall include a program for site publicity and training courses for the workmen on the Site and at all levels of supervision and management, incentive schemes for the promotion of compliance with safety measures and other similar measures. The said program shall be discussed with the Engineer, and shall be applied in a practical and reasonable way that will not affect the normal progress of the work. This shall also include the powers vested in the safety staff which would enable them to take urgent and appropriate and direct action to make safe the Site and prevent unsafe working practices or other infringements on the safety, or statutory regulations. Subcontractors Safety Plan: The means by which safety and industrial health matters and requirements will be communicated to subcontractors

of all tiers and their due compliance with safety and all relevant statutory regulations is ensured. This shall also include the procedure for reviewing the safety plan proposed by subcontractors, confirming that it is prepared in due compliance with the statutory regulations and in accordance with the Safety Plan requirements, and the method to incorporate the subcontractors safety plans into the general Safety Plan. Safety Equipment and Clothing: The safety equipment, rescue apparatus and protective clothing which will be required for the Works, including the quantity, source, standards of manufacture, storage provisions and means of ensuring proper utilization by all workmen and staff employed directly or Engineers staff, unauthorized visitors to the site (including the people of vicinity) or indirectly by the Contractor, and repair to or replacement of damaged equipment. Such equipment shall include, but not be limited to, goggles and other eye protectors, hearing protectors, safety harnesses, safety equipment for working underground and in confined spaces (e.g. sewers, drains, etc), rescue equipment, fire extinguishers, first aid equipment, ropes, hard hats and, where appropriate, associated shock absorbers, chest harnesses. Safety Inspections: The means by which safety equipment, scaffolds, guardrails, working platforms, hoists, ladders and other means of access, lifting, lighting, signing, and guarding equipment shall be regularly inspected, tested and maintained and the standards below which such items shall be removed from the Site and replaced. Supervision and Auditing: The means by which the established safety system will be supervised, monitored and audited by the Safety Manager to ensure due compliance with the principles and objectives of the Safety Plan at all levels of construction. This shall also include the procedure for updating the Safety Plan. Records: To be prepared and maintained by the Safety Manager and the staff for safety, and the communication procedures to be adopted by the Safety Manager such that the Engineer, and others associated with the Works (e.g. subcontractors), are kept fully informed throughout the period of the Contract on matters relating to site safety and industrial health regulations. First Aid and Rescue: A description of the operation and equipment of the specified first aid base, the emergency and rescue procedures and their associated equipment. In addition, the method for protection of visitors to the Site shall be stated. The means by which all hazards associated with working on, adjacent to and above tidal water shall be accommodated including but not limited to details of proposed rescue boats, safety nets, warning and navigation

signs/lights, search procedures, life saving equipment, watching for persons entering the water and any other appropriate equipment or procedure. Health Hazards: An appreciation of the industrial health hazards likely to be associated with the Works and proposals for minimization of the risks associated with such hazards. The means of minimization of the effects of climatic exposure (heat, wind and moisture) and an exposure to noxious substances. Safety regarding Construction Methods: Proposals to ensure that construction methods do not compromise the Contractors commitment to the Safety Plan or his compliance with statutory regulations. First Aid Base: A description of the First Aid Base to be established in the Site and maintained until completion of the Work. This shall include a description of the measures to be taken for First Aid and medical services. Others: In addition, the following items shall also be included: A description of the security norms to be applied in the offices, shops, construction plant, etc., A description of the hygiene measures in eateries, cafeterias, work areas, etc.

2.3

SAFETY MANAGER
a) The Contractor shall appoint a Safety Manager, one per each Package of Contract, whose duties throughout the period of the Contract shall be entirely connected with the Safety activities on the Site. The Safety Manager shall be bilingual (Vietnamese/English) and shall be a suitably qualified and experienced person who shall prepare, supervise and monitor the Safety Plan, and shall, in particular but without limitation, carry out auditing of the operation of the Safety Plan in accordance with a rolling program to be submitted, from time to time, to the Engineer for his consent and accepted by Employer. The appointment and designation of the Safety Manager shall be subject to the Engineers approval and accepted by Employer. Unless specifically agreed in writing by the Engineer, the Contractor shall not undertake any work on the Site until the Safety Manager has commenced duties on Site. The Contractor shall not remove the Safety Manager from the Site without the express written permission of the Engineer. Within fourteen (14) days of any such removal, or notice of intent of removal, the Contractor shall nominate a replacement Safety Manager for the Engineers approval.

The Contractor shall provide the Safety Manager with enough supporting staff in accordance with the staffing levels set out in the Safety Plan. The supporting staff shall include at least one (1) Deputy Safety Manager whose appointment shall be subject to the Engineers approval. The Deputy Safety Manager shall be capable of assuming the duties and functions of the Safety Manager as contained in the Site Safety Plan whenever necessary. The Contractor shall empower the Safety Manager and his staff to instruct employees of the Contractor, or of its Subcontractors, of any tiers to cease operations and take urgent and appropriate action to make safe the Site and prevent unsafe working practices or other infringements on the Safety Plan or the statutory regulations. The Contractor shall ensure that the Safety Manager maintains a daily site diary, comprehensively recording all relevant matters concerning site safety inspections and audits, related incidents and the like. The site diary shall be available at all times for inspection by the Engineer.

2.4

SPECIAL REQUIREMENTS FOR SAFETY


The Contractor shall duly comply with the following special requirements: a) Safety of Public: The Contractor shall be responsible for the safety of the public passing through the Site. All excavations, plant or items of potential danger to the public must be barricaded and sign-posted to the satisfaction of the Engineer, and the Contractor must provide sufficient watchmen to ensure the safety of the public at all times. All existing pedestrian routes shall be maintained in a safe condition unless an alternative route is provided to the satisfaction of the Engineer. Temporary roads in the Construction site: The traffic lanes shall be clearly marked by safety cone, barricade, lighting system and guide signs to prevent accidents and to ensure quality control of constructing roads. Safety of above tidal water: Contractor shall be supply rescue boats following the Safety Plan approved. Availability of Safety-Related Documents: The Contractor shall comply with the Engineers requirements insofar as displaying in each of its site offices, workshops and canteens a copy of such safety and industrial health posters and keeping on the Site copies of safety and industrial health regulations and documents. The minimum regulations and most important documents (selected by the Engineer from the approved Safety Plan) shall be translated into languages which are understood by the operators engaged by the Contractor or subcontractors, and such translations shall be displayed or kept alongside those in Vietnamese and English languages.

Safety Reports: The Contractor shall submit regular Safety Reports to the Engineer as a requirement of the Safety Plan. A summary of this report shall be included in each Monthly Progress Report. Safety reports shall comprehensively address all relevant aspects of site safety and industrial health regulations and, in particular, shall report on all site safety audits undertaken during the period covered by the report. Safety Information: The Contractor shall ensure that safety, rescue and industrial health matters are given a high degree of publicity to all persons regularly or occasionally on the Site. Posters, in both Vietnamese and English, drawing attention to site safety, rescue and industrial health regulations shall be made or obtained from the appropriate sources and shall be displayed prominently in relevant areas of the Site. Safety Meetings: The Safety Manager of the Contractor shall perform regular safety meetings in accordance with the Safety Plan, with the participation of the Engineer (or a representative delegated by him for the purpose), and representatives of Subcontractors if so requested by the Engineer. All Safety Meetings shall be notified to the Engineer at least 3 days in advance. Minutes of all Safety Meetings shall be taken and sent to the Engineer within three (3) days after the meeting. Fire Extinguishers: In supplement to the safety equipment stated in the Safety Plan, the Contractor shall provide in particular wall-mounted hand fire extinguishers of all-purpose, nitrogen-pressured, dry chemical type. Moreover, fire extinguishers shall be provided at each Site Offices and the Engineers offices and accommodations, during the execution of the Works. Individual fire extinguishers shall also be provided in all the vehicles being used in the Project. First Aid Base: The Contractor shall, at his own expenses, establish and maintain a fully equipped First Aid Base as described in the approved Safety Plan, one per each Package of Contract, and satisfying the following conditions: The First Aid Base shall be located at the Contractors principal work area and shall consist of a treatment room fitted with a hand wash basin, two treatment couches and sterilizing equipment and lockable cupboards to contain sufficient medical supplies for the Contractors workforce, the Engineers site supervisory staff and any visitors to the Site. In addition, six stretchers shall be stored, available for instant use. The first aid base shall contain a recovery room that shall be furnished with six chairs and six footrests. The First Aid post shall be air-conditioned, with cooling capability sufficient to maintain the temperature of the inside of the building at 20 C.

A qualified nurse and nurses aid shall be in attendance at the First Aid Base during all times when work is being undertaken on the Site, including work by any Subcontractor and periods when only emergency activities are being undertaken, such as during periods of inclement weather. All the costs for First Aid shall be considered as a part of the unit price of the bid, and no additional payment will be made for it. i) j) Qualified Personnel: Suitably qualified personnel shall operate Construction Plant and equipment used on or around the Site. all

Notification of Accidents: The Contractor shall notify the Engineer immediately when any accident occurs whether on site or off site in which the Contractor, his personnel or construction plant, or those of his Subcontractors are directly or indirectly involved and which result in any injuries to any persons. Such initial notification may be verbal and shall be followed by a written comprehensive report within 24 hours after the occurrence of the accident. Assistance to the Engineer: The Contractor shall provide the Engineer with full co-operation and assistance in all safety surveillance carried out by the Engineer or the Employer.

SECTION 01600 - MAINTENANCE AND PROTECTION OF TRAFFIC 1. DESCRIPTION


This section consists of the requirements for planning, implementing and monitoring the necessary measures to maintain, control and protect the traffic in and adjacent to the Project area during the execution of the Works. This section also consists of the requirements for furnishing, maintaining, relocating, and removing temporary traffic control devices and services as ordered for the control and protection of public traffic through the Project site. The following definitions shall be referred to for proper interpretation of this Specification Section: Traffic Control Plan: The Plan shall be prepared and submitted by the Contractor in compliance with the Contract (hereafter referred as the Traffic Control Plan). The Plan shall consist of a complete plan for implementation and monitoring of the necessary measures that the Contractor shall perform for the maintenance and protection of public traffic, including traffic due to the construction, in the Project area and adjacent area that is being affected during the execution of the Works. The Project area shall be understood as the area encompassing the Site and all the Projects related areas such as the plants, quarries, roads for material transportation, etc. The plan shall be prepared for existing roads which will be used to transport construction materials and equipment of the works. This plan shall be considered as a key component of the main Traffic Control Plan. 2. 2.1

REQUIREMENTS GENERAL
a) b) The Traffic Control Plan shall be considered as one of the key-plans as described in Specification Section 01300 Program of Work. The Contractor shall thoroughly acquaint himself with existing traffic conditions and understand the importance of maintaining traffic safety and avoiding excessive traffic delay. The Contractor shall co-operate with the pertinent agencies regarding traffic control and all details will be subject to the Engineers approval. The Contractor shall take necessary care at all times during the execution of the Works to ensure the existing convenience, environmental protection and safety of residents along and adjacent to the roads, and any public highways or other facilities that may be affected by the Works. The Contractor shall be responsible for carrying out any necessary investigations and obtaining approvals, licenses, escorts and any other necessary facilities in order to enable extraordinary traffic to be moved on the roads in the Project area. Before the application of the measures for traffic maintenance and protection contained in the Traffic Control Plan described below, the Contractor shall investigate and clarify sufficiently the details and regulations established by local authorities and pertinent divisions of the Vietnam Road and Railroad Traffic Police Department. The technical requirements specified in the Vietnamese Standards 22-TCN-23701 Road Signs and Signaling Regulations or National Specifications QCKT / 01 / 2008 / BGTVT shall be applied as the specifications for the work items contained in this Specification Section. The requirements established in this Specification Section shall supplement, without detriment to, the requirements and provisions stated in the following clauses of the Conditions of Contract and Specifications: Clause 1 General Provisions; Clause 4 The Contractor; Clause 7 Plant, Materials and Workmanship; Clause 14 Contract Price and Payment. Specification Section 01700 Environmental Control and Protection h) Failure of the Contractor to comply with the requirements of this Specification Section shall be considered as a serious default of the Contractor in meeting his contractual obligations. In this case, the Engineer will suspend the procedure for progress payments until the Contractor corrects the defects, restores the traffic, and secures normality in the compliance with the said requirements. In the event that the Contractors failure to meet these requirements persists, it will entitle the Engineer to carry out such works as he deems necessary, and to charge the Contractor with the full cost thereof plus respective incidental and administrative costs, which amount shall be deducted from any money due, or which may become due, to the Contractor under the Contract.

TRAFFIC CONTROL PLAN


Incorporating in the Program, and supplementing the Safety Plan, the Contractor shall prepare, and submit to the Engineer for review and approval, the Traffic Control Plan that shall be implemented during the work execution, and shall be monitored on a daily basis. The Traffic Control Plan shall include, but not be limited to, the following: Traffic Control Organizational Structure: The organization classified into subdivisions that can be technically and effectively managed, and described in a Traffic Control Organizational Chart identifying the subdivisions, responsibilities and tasks of the personnel and supporting staff, all of them engaged solely and specifically for traffic control issues (including the Contractors Traffic Supervisor who will be responsible for all traffic control issues in the Site). Moreover, the criteria for appointment of principal staff shall be also described. Lines of Communication: The organizational structure shall show direct lines of communication and reporting among the Traffic Supervisor, Contractors Project Manager, and the Contractors Director responsible for the Contract. Interaction and Communication Procedures: Procedures defining the communication system between the Contractors construction personnel working in areas where the traffic is being affected, and the traffic control staff, including radio communication facilities, regular communication and reporting system. Moreover, the frequency, coverage and intent of site meetings for traffic coordination shall also be clarified. Subcontractors Traffic Control Plan: The means by which the Traffic Control Plan will be communicated to Subcontractors (if any), including also the procedure for reviewing the plan for traffic control proposed by

Subcontractors, and the method to incorporate the Subcontractors traffic control plans into the Projects Traffic Control Plan. Inventory of the Affected Traffic: A detailed inventory of the road sections on which traffic will be affected by the Works, in accordance with the Program prepared by the Contractor. Existing Road Traffic Plan: An appropriate plan shall be prepared for remedying and improving the existing roads to serve construction work in accordance with the Plan. This Plan shall include a detailed time schedule for use of the existing transport roads. Methods, Equipment and Supporting Staff for Traffic Control: A detailed and consistent description of the methods, equipment and supporting staff to be applied for traffic control, including details for each stage considered during the construction of the Works. The methodology described in the Traffic Control Plan shall cover all the items herein specified, and all applicable requirements of the Vietnamese standards or the like for traffic control. Traffic Control Schedules: Time-bar schedules prepared for each case of traffic control necessity identified in the above-mentioned inventory, including a description of all the main activities for traffic control, dates for commencement and completion of each activity, critical items of the schedule, all the traffic control means, etc. Traffic Control Inspections: The procedure and schedule for inspection of the Traffic Control equipment, instruments and devices. Supervision and Auditing: The means by which the established Traffic Control System will be supervised, monitored and audited by the Traffic Supervisor to ensure its due compliance with the principles and objectives of the Traffic Control Plan. This shall also include the procedure for updating the Traffic Control Plan. Records: To be prepared and maintained by the Traffic Supervisor and the staff for traffic control, and the communication procedures to be adopted by the Traffic Supervisor such that the Engineer, and others associated with the Works, are kept fully informed throughout the period of the Contract on matters relating to traffic regulations.

TRAFFIC SUPERVISOR
The Contractor shall appoint a Traffic Supervisor, one per each Package of Contract, whose duties throughout the period of the Contract shall be entirely connected with the Traffic Control activities on the Site. The Traffic Supervisor shall be bilingual (Vietnamese/English) and shall be a suitably qualified and experienced person who shall prepare, supervise and monitor the Traffic Control Plan, and shall, in particular but without

limitation, carry out auditing of the operation of the Traffic Control Plan in accordance with a rolling program to be submitted, from time to time, to the Engineer for his consent. c) d) The appointment and designation of the Traffic Supervisor shall be subject to the Engineers approval. If so requested by the Contractor, the duties designated for the Traffic Supervisor could be covered by the Safety Manager designated as established in Specification Section 01500 Project Safety and upon the Engineers approval on the Curriculum Vitae and records of the proposed person for this item. The evaluation of the proposed staff shall include an interview performed by the Engineer. Unless specifically agreed in writing by the Engineer, the Contractor shall not undertake any work on the Site, which may affect the traffic, until the Traffic Supervisor has commenced duties on Site and the Traffic Control Plan has been approved by the Engineer. The Contractor shall not remove the Traffic Supervisor from the Site without the express written permission of the Engineer. Within fourteen (14) days of any such removal, or notice of intent of removal, the Contractor shall nominate a replacement Traffic Supervisor for the Engineers approval. The Contractor shall provide the Traffic Supervisor with enough supporting staff in accordance with the staffing levels set out in the Traffic Control Plan. The supporting staff shall include at least one (1) Deputy Traffic Supervisor (per each Package of Contract) whose appointment shall be subject to the Engineers approval. The Deputy Traffic Supervisor shall be capable of assuming the duties and functions of the Traffic Supervisor as contained in the Traffic Control Plan whenever necessary. The Contractor shall ensure that the Traffic Supervisor maintains a daily site diary, comprehensively recording all relevant matters concerning site safety inspections and audits, related incidents and the like. The site diary shall be available at all times for inspection by the Engineer.

2.4

SPECIAL REQUIREMENTS FOR TRAFFIC CONTROL


The Contractors requirements for maintenance and protection of traffic shall include, but not be limited to, remedy and improvement of existing local road, which has been damaged due to transportation of construction materials and equipment, traffic control devices and services for the control and protection of traffic through areas of construction. 2.4.1

WORKS FOR TRAFFIC CONTROL


Prior to the start of construction operations, based on his approved Traffic Control Plan, the Contractor shall furnish, erect and maintain (at prescribed points) warning and guide signs, barricades or barriers, temporary fences (2.0 m height), and other traffic control devices as established in the approved Traffic Control Plan, the Vietnamese Standards, these specifications or directed by the Engineer. As necessary for proper control of traffic, or when/where directed by the Engineer, the Contractor shall furnish and station competent flagmen whose sole duties shall consist of directing the movement of traffic through or around the Works.

2.4.2

MATERIALS FOR TRAFFIC CONTROL DEVICES


Retro-reflective Material: Unless otherwise specified in the Contract, sign panels, barricades, cones, vertical panels, and flagged paddles shall have retro-reflective sheeting meeting the minimum requirements for retroreflective material noted in Specification Section 08400 Road Signs of the Technical Specifications. Sign Panels: Sign panels shall conform to Specification Section 08400 Road Signs of the Technical Specifications and shall be in orange color with black legend unless otherwise required. Sign Posts: Sign posts shall be fabricated from untreated softwood, metal, or other materials acceptable to the Engineer. Signs shall be capable of remaining in position during normal traffic flow and wind conditions. Barricades: Barricades shall be constructed of wood, metal or plastic. Cones: Cones shall be in accordance with the Vietnamese Standards for Roads Sign and Signaling Regulations (Article 91) with a minimum of 60 cm in height and a broadened base and shall be capable of withstanding impact without damage to the cones or vehicles. All cones shall be orange/white colored and highly visible both in daylight and darkness. Cones shall be capable of remaining bright and in position during normal traffic flow and wind conditions in the area where they are used. Lamps for cones shall be suitable for the purpose. Temporary Fence: Temporary fence shall be fabricated in panels with timber framework and galvanized metal panels. The panel face towards the traffic shall be painted. Vertical Panels: Vertical panels shall be constructed of wood, metal or plastic.

Warning Lights (flashing or steady): Warning lights shall be of low intensity flashing type, high intensity flashing type, or steady burn type as approved by the Engineer.

2.4.3

MAINTENANCE OF EQUIPMENT AND DEVICES FOR TRAFFIC CONTROL


The equipment and devices provided to satisfy the requirements of this Specification Section shall be maintained and kept in good condition of operation all the time. Any equipment or devices that are lost, stolen, destroyed, or deemed unacceptable while their use is required on the Project, shall be replaced by at the Contractor expense. Devices for traffic control shall be operated only when necessary.

2.4.4

TRAFFIC CONTROL DURING NON-WORKING HOURS


During non-working hours and following the completion of a particular construction operation, all warning signs, except those necessary for the safety of the public, shall be removed or entirely covered with either metal or plywood sheeting so that the sign panel will not be visible.

2.4.5

TRAFFIC CONTROL DURING NIGHTTIME


Nighttime operation shall be illuminated by a lighting system approved by the Engineer. The lighting system shall be positioned and operated to preclude glare. Incandescent lights will not be permitted. Retro-reflective sheeting on signs, barricades, and other devices shall be kept clean and in good condition. The Contractor shall promptly correct stretches, rips, and tears in the sheeting. Retro-reflective sheeting shall have a maintained retro-reflection. When applicable, street lighting shall be relocated as necessary to maintain the same standard of lighting in the course of the Works until new lighting facilities are put into operation.

2.4.6

TRAFFIC CONTROL CONSERVING EXISTING TRAFFIC


When the construction is going to affect an existing road (feeder roads or others) where traffic closing is not permissible, the Contractor shall keep that open to traffic during the execution of the Works, provided that when approved by the Engineer the Contractor may bypass traffic over a detour. The Contractor shall at all times keep roads and footpaths, affected by his operations, free from soil and material spillage and properly repaired at his expense if the road is damaged by those operations.

The Contractor shall keep the length of the Project construction areas in such condition that traffic will be accommodated safely. Traffic control devices and services shall be provided and maintained both inside and outside the Project limits as needed to facilitate traffic guidance should this be necessary.

2.4.7

PASSING OF OTHER CONTRACTORS


When applicable, the Contractor shall make all the necessary arrangements to permit the passage along the road section relating to this Contract of the constructional plant, materials and employees belonging to other contractors engaged in the construction of contiguous stretches of road. For this purpose the Contractor and the contractors engaged in the construction of the stretches contiguous to those through which they must pass shall, when necessary and with at least 15 days notice, request the Engineer for permission to pass and submit a schedule for such passage. After the Engineer has granted such permission and approved the schedule submitted, both the Contractor permitting the passage and those requesting it shall undertake to observe the schedule approved by the Engineer for the passage along the site without having any right to extra payment in consequence of the restrictions on passage or the necessary temporary suspension of work due to the aforesaid schedule.

2.4.8

NUMBER OF LANES FOR TRAFFIC CONTROL


The existing number of traffic lanes of the roads that may be affected by the Project must be maintained at all times during the work execution and if diversions are provided these must be of the same traffic capacity as the original road. Notwithstanding the above, the Engineer may give approval to reductions in traffic capacity if the Contractor can show that these will not cause excessive delay to traffic. If such approval is given, the Engineer may specify the hours during the day when the reduction in capacity may be applied and it should be anticipated that these hours may not include the peak period for the traffic movement under consideration.

2.4.9

HALF-WIDTH CONSTRUCTION
The Contractor shall include in his Traffic Control Plan and his proposed method for construction described in the Program, pertinent details of the construction method to be applied where a detour is not feasible and the construction on existing public roads should be undertaken only over a half of the full width of the roadway.

The following aspects shall be considered for this purpose: The length of such half-width construction shall be kept as short as possible. Work on culverts must be commenced and completed in the dry season and the embankments adjacent to them must be reinstated so that at least half the full width will be available for use by the public throughout the next rainy season. A single lane at least 3.5 m wide shall be kept open to traffic. The Contractor shall conduct his operations in such a manner as to cause the least possible obstruction, inconvenience, and delay to traffic and shall be responsible for adequate control of the traffic using such lengths of single lane.

2.4.10

VERTICAL CLEARANCE
In general any temporary works placed over roads or diversions used by public traffic should have a vertical clearance specified by the Vietnamese Standards TCVN5729-97, TCVN4054-85, 22TCN210-92, TCVN5729-97 and 22TCN210-92, as follows: Expressways and Highways Class I, II and III Highways Class IV, V and VI Rural Roads Class A Rural Roads Class B at least 4.75 m at least 4.50 m at least 3.20 m at least 2.70 m

Where required by the Engineer, the Contractor shall erect and maintain suitable approved check-gates, fitted with warning signs indicating the vertical clearance.

3. 3.1

MEASUREMENT AND PAYMENT METHOD OF MEASUREMENT


All the costs related to the implementation of requirements in Section 01600 Maintenance and Protection of Traffic and be paid for from Provisional Sum.

3.2

BASIS OF PAYMENT
a) Payment shall include all costs necessary and required for the proper implementation of the Traffic Control Plan fully in accordance with the requirements of this Specification Section, including all update and submittals, supervision, materials, equipment, apparatuses and devices, labor, construction of work required in Section 01600 and any incidental costs,

except for the work mentioned in Clause 3.2.(b) below. With respect to the work items which are mentioned in this Clause and can be applied with available unit price in Bill of Quantities, it shall be applied with available unit price in Bill of Quantities. b) Neither measurement nor payment will be made for furnishing, installing, and maintaining traffic control devices, including temporary fences, services, road works required by the Contract for the control and protection of traffic. With respect to temporary roads and new detour roads for assurance of public traffic and means of transport, as well as transportation of Contractors equipment, this cost shall not be measured and paid for in Section 01600. All the costs for this work shall be deemed to include in Section 01100 Constructions Mobilization and Demobilization All traffic control devices prepared by the Contractor shall remain the property of the Contractor, and shall be removed upon completion of the Contract. The Engineer may at any time withhold payment if, in his opinion, the Maintenance and Protection of Traffic have not been provided in due compliance with the requirements and procedures of this Specification Section.

1. DESCRIPTION
This section consists of the requirements for planning, implementing and monitoring the necessary measures that the Contractor shall perform to maintain, control and protect the environment in, adjacent to, or related to the Project during the execution of the Works. The following definitions shall be referred to for proper interpretation of this Specification Section: Environmental Control Plan (ECP): The Contractors Plan for Environmental Control and Protection in compliance with the Contract (hereafter referred as the Environmental Control Plan). The Plan shall consist of a complete plan for implementation and monitoring of the necessary measures that the Contractor shall perform to control and protect the environment in the Project area, and any other area that is affected by the execution of the Works. In this case, the Engineer will suspend the procedure for progress payments until the Contractor corrects the defects, mitigates the environmental impact caused, and secures normality in the compliance with the requirements for environmental control and protection. In the event that the Contractors failure to meet these requirements persists, it will entitle the Engineer to carry out such works as he deems to be necessary, and to charge the Contractor with the full cost thereof plus respective incidental and administrative costs, which amount shall be deducted from any money due, or which may become due, to the Contractor under the Contract.

The requirements and standards shown in Sub-section 2.1 of this Specification Section shall be applied. Moreover, other standards that may be recommended by the Engineer as applicable shall also be used. Before the application of the measures for environmental protection contained in the Environmental Control Plan described below, the Contractor shall investigate and clarify sufficiently the details and regulations established by local authorities (Province or District) and pertinent divisions of the Vietnam Ministry of Natural Resources and Environment (MONRE), and shall also obtain their acceptance for the plan. The Contractor shall be solely responsible for taking the remedy or mitigation measure(s) required to deal with the environment-related effects of any of his construction or construction-related activities. When and if an environmental problem arises (such as environmental damage to property and natural resources, ground subsidence, interruption of groundwater flow, surface/ground water contamination, complaints or legal actions by third parties, etc.), the Contractor shall first immediately notify the Engineer thereof; and then, based on the approved Environmental Control Plan, he shall prepare the countermeasures that shall be applied to solve or mitigate the problem, and shall submit them to the Engineers approval.

CONTRACTORS PLAN FOR ENVIRONMENTAL CONTROL AND PROTECTION (THE ENVIRONMENTAL CONTROL PLAN)
Incorporating in the Program, supplementing the Safety Plan and the Traffic Control Plan, the Contractor shall prepare and submit to the Engineer for review and approval, the Environmental Control Plan that shall be implemented during the work execution, and shall be monitored on a daily basis. The Environmental Control Plan shall include, but not be limited to, the following: Environmental Control Organizational Structure: The organization classified into subdivisions that can be technically and effectively managed, and described in an Environmental Control Organizational Chart identifying the subdivisions, responsibilities and tasks of the personnel and supporting staff, all of them engaged solely and specifically for environmental control issues (including the Contractors Environmental Manager who shall be responsible for all environmental control issues in the Site). Moreover, the criteria for appointment of the principal staff shall also be described.

Lines of Communication: The organizational structure shall show direct lines of communication and reporting among the Environmental Manager, Contractors Project Manager, and the Contractors Director responsible for the Contract. Interaction and Communication Procedures: Communication between the Contractors construction personnel working in areas where the environment will be or is being affected, and the environmental control staff, including regular communication and reporting system. Moreover, the procedures shall also specify the frequency, coverage and intent of site meetings for coordination. Subcontractors Environmental Control Plan: The means by which the Environmental Control Plan will be communicated to Subcontractors (if any), including also the procedure for reviewing the plan for environmental control proposed by Subcontractors, and the method to incorporate the Subcontractors environmental control plans into the Projects Environmental Control Plan. Inventory of Environmental Impacts: A detailed inventory of the identified environmental impacts that will be caused by executing the Works in accordance with the construction Program prepared by the Contractor. Methods, Equipment and Supporting Staff for Environmental Control: A detailed and consistent description of the methods to be applied and the equipment and supporting staff to be provided for environmental control, including details for each stage considered during the construction of the Works. The methodology described in the Environmental Control Plan shall cover all the items herein specified, and all applicable requirements of the Vietnamese standards or the like regarding environmental control. Environmental Control Schedules: Time-bar schedules prepared for each case of environmental control necessity identified in the above- mentioned inventory, including a description of all the main activities for environmental control, dates for commencement and completion of each activity, critical items of the schedule, etc. Environmental Control Inspections: The procedure and schedule for inspections of the environmental control equipment, the compliance of methods, and the performance of the supporting staff. Supervision and Auditing: The means by which the established Environmental Control System will be supervised, monitored and audited by the Environmental Manager to ensure due compliance with the principles and objectives of the Environmental Control Plan. This shall also include the procedure for updating the Environmental Control Plan.

Records: to be prepared and maintained by the Environmental Manager and the staff for environmental control, and the communication procedures to be adopted by the Environmental Manager such that the Engineer, and others associated with the Works, are kept fully informed throughout the period of the Contract on matters relating to traffic regulations.

ENVIRONMENTAL MANAGER
The Contractor shall appoint an Environmental Manager, one for each Contract Package, whose duties throughout the period of the Contract shall be entirely connected with the Environmental Control activities on the Site. The Environmental Manager shall be bilingual (Vietnamese/English) and shall be a suitably qualified and experienced person who shall prepare, supervise and monitor the Environmental Control Plan, and shall, in particular but without limitation, carry out auditing of the operation of the Environmental Control Plan in accordance with a rolling Program to be submitted, from time to time, to the Engineer for his consent. The appointment and designation of the Environmental Manager shall be subject to the Engineers approval and Employer accepted. Unless specifically agreed in writing by the Engineer, the Contractor shall not undertake any work on the Site, which may affect the environment, until the Environmental Manager has commenced duties on Site and the Environmental Control Plan has been approved by the Engineer. The Contractor shall not remove the Environmental Manager from the site without the express written permission of the Engineer. Within fourteen (14) days of any such removal, or notice of intent of removal, the Contractor shall nominate a replacement Environmental Manager for the Engineers approval and Employer accepted. The Contractor shall provide the Environmental Manager with enough supporting staff in accordance with the staffing levels set out in the Environmental Control Plan. The supporting staff shall include at least one (1) Deputy Environmental Manager (for each Contract Package) whose appointment shall be subject to the Engineers approval. The Deputy Environmental Manager shall be capable of assuming the duties and functions of the Environmental Manager as contained in the Environmental Control Plan whenever necessary. The Contractor shall ensure that the Environmental Manager maintains a daily site diary comprehensively recording all relevant matters concerning site safety inspections and audits, related incidents and the like. The site diary shall be available at all times for inspection by the Engineer.

AIR QUALITY AND DUST


Control of Air Pollution and Dust Emission

The Contractor shall take necessary action at all times to prevent dust nuisance as a result of his activities. An air pollution control system shall be installed and shall be operated whenever the equipment and the plant are in operation. a) Law and Regulations: The Contractor shall not install any furnaces, boilers or other similar plant or equipment using any fuel that may produce air pollutants in accordance with the Vietnams National Law on Protection of Environment (NLEP) and other relevant legislation. Dust Suppression Measures on the Site: The Contractor shall implement dust suppression measures that shall include, but not be limited to, the following: Cells for Stockpiling: Stockpile of sand and aggregate for use in concrete manufacture shall be made accordingly with the applicable Vietnamese regulations. Surfacing of Approaches: The areas within the Site where there is a regular movement of vehicles shall have an acceptable hard surface and be kept clear of loose surface material. Conveyor Belts: Conveyor belts shall be fitted with wind-boards, and conveyor transfer points and hopper discharge areas shall be enclosed to minimize dust emission. All conveyors carrying materials that have the potential to create dust shall be totally enclosed and fitted with belt cleaners. Silos: Cement and other such fine-grained materials delivered in bulk shall be stored in closed silos fitted with a high-level alarm indicator. The highlevel alarm indicators shall be interlocked with the filling line such that in the event of the hopper approaching an overfull condition, an audible alarm will operate, and the pneumatic line to the filling tanker will close.

Filters or Air Cleaning: - All air vents on cement silos shall be fitted with suitable fabric filters provided with either shaking or pulse-air cleaning mechanism. - The fabric filter area shall be determined using an air-cloth ratio (filtering velocity) in accordance with standards. - Weigh hoppers shall be vented to a suitable filter. - The filter bags in the cement silo dust collector must be thoroughly shaken after cement is blown into the silo to ensure adequate dust collection for subsequent loading.

Dust Suppression by Water Spraying: - Effective water sprays shall be used during the delivery and handling of all raw sand and aggregate, and other similar materials, when dust is likely to be created and to dampen all stored materials during dry and windy weather. - Installation of an adequate dust suppression plant including water sprayers. - Areas of reclamation shall be completed, including final compaction, as quickly as possible and in conformity with good practice to limit the creation of wind blown dust. - All the roads within the Projects Site and all related areas for construction shall be sprayed at least twice a day, and more if necessary to control dust to the satisfaction of the Engineer.

Tire Cleaning: All vehicles shall be properly cleaned (bodies and tires are free of sand and mud) prior to leaving the site areas. For this purpose, necessary cleaning facilities (such as water pool style, or steel ramp with grid or angle bar surface) shall be provided in the Site, and the Contractor shall ensure that no water or debris from such cleaning operations is deposited off-site. Truck Covers: All trucks used for transporting materials to and from the Site shall definitively be covered with canvas tarpaulins, or other acceptable type of cover (which shall be properly secured) to prevent debris and/or materials from falling from or being blown off the vehicle(s). Wall Protection against Wind: Where necessary, and when instructed by the Engineer, walls shall be constructed to avoid the effect of strong winds that could cause the blowing of dust and debris.

Dust Suppression at Concrete Batching Plant or Crushing Plant: - Where dusty materials are being discharged to vehicles from a conveying system at a fixed transfer point, a three-sided roofed enclosure with a flexible curtain across the entry shall be provided. Exhaust fans shall be provided for this enclosure and vented to a suitable fabric filter system. - Any vehicles with an open load carrying area used for moving potentially dust-producing materials shall have properly fitted sides and tailboards. Materials having the potential to create dust shall not be loaded to a level higher than the sides and tail boards, and shall be covered by a clean tarpaulin in good condition. The tarpaulin shall be properly secured and shall extend at least 300 millimeters, or more if necessary, over the edges of the sides and tailboards. - The Contractor shall frequently clean and water the concrete batching plant and crushing plant sites and ancillary areas to minimize any dust emission. - Dry mix batching shall be carried out in a totally enclosed area with exhaust to suitable fabric filters.

c)

Air Pollution Reduction on the Site: The Contractor shall not burn debris or other materials on the Site. The Contractor shall require that all vehicles, while parked on the site have their engines turned off. The Contractor shall check all equipment and machinery on the Site at least weekly and make all necessary corrections and/or repairs to ensure compliance with safety and air pollution requirements.

(2)

Monitoring of Dust Levels The Contractor shall carry out dust impact monitoring at all work areas throughout the construction period and in accordance with the approved Environmental Control Plan.

The activities for Monitoring of Dust Levels shall include, but not be limited to, the following: a) Air Samples and Equipment for Air Quality Control: Within two weeks after the date of issue of the Engineers approval of the Environmental Control Plan, the Contractor shall provide the following:

Air samplers and associated equipment and shelters in accordance with the requirements stated in TCVN 5067-1995 Weight method for determination of suspended dust content. A direct reading dust meter capable of reading 1 hour TSP in the range 0.1 - 100 mg/m3. b) Monitoring Stations: Monitoring stations shall be installed at each location determined in the Environmental Control Plan, as approved by the Engineer, and shall be free from local obstructions or sheltering; All the Monitoring Stations shall be provided with suitable access, paved and hard standing, and with a galvanized wire fence and gate. The exact location and direction of the monitoring equipment at each monitoring station shall be agreed with the Engineer. c) Measurements of Dust Levels: The dust levels shall be measured by method established in TCVN 50671995. All samples collected as part of the monitoring Program shall be analyzed in accordance with the standards and current regulations. d) Baseline Monitoring: Immediately after the issue of the Engineers approval of the Monitoring Stations and the methods for dust level measurement, the Contractor shall carry out the baseline monitoring to determine and agree with the Engineers on ambient dust levels at each specified monitoring station. The baseline monitoring shall be carried out for a period established in the ECP approved by the Engineer, with measurements to be taken every day at each monitoring station. Monitoring During Work Execution: Impact monitoring in the course of work execution shall normally be carried at each monitoring station in a frequency established in the ECP approved by the Engineer. In the event that the records of monitored dust levels indicate an impact on the air Quality evidencing a deteriorating situation, the Engineer, simultaneously with his instructions for improving the dust suppression measures, may require the Contractor to undertake daily impact monitoring at any one or more of the monitoring stations until the results indicate an improving and acceptable level of air Quality. Monitoring results shall be submitted to the Engineer within one week after completion of the monitoring period.

Monthly reports shall be analytical and shall provide explanations for any anomaly and problems encountered. Actions taken in response to the monitoring results shall also be required. (3) a) Action on Construction Dust Levels Where the Engineer determines that the recorded dust levels are significantly greater than the levels established in the baseline survey, the Engineer may direct the Contractor to take effective remedial measures including, but not limited to, reviewing dust sources and modifying working procedures. The Contractor shall inform the Engineer of all steps taken. Written reports and proposals for action shall be passed by the Contractor to the Engineer whenever the Engineer determines that air Quality monitoring shows that the recorded dust levels are significantly greater than the levels established in the baseline survey.

WATER QUALITY
Water Quality Monitoring Law and Regulations: The Contractor shall comply with the Vietnamese legislation and other regulations currently applied in Vietnam insofar as they relate to water pollution control and monitoring. Protection of Existing Watercourses: The Contractor shall ensure that no tools or machinery are washed in any water sources or areas that drain into an existing watercourse, stream, or canal. The Contractor shall ensure that run-off from the construction sites is not deposited directly into any watercourse, stream, or canal. The Contractor shall ensure that chemicals and concrete agitator washings are not deposited in the watercourses. The Contractor shall ensure that all temporary construction facilities are located at least 50 meters away from any water course, stream, or canal. c) Weekly Inspection: The Contractor shall weekly check all equipment for prevention of oil and/or lubrication leaks and ensure that all equipment oil and lubrication replacements are performed only in maintenance and repair areas. Water Quality Monitoring Baseline Monitoring: The Contractor shall perform the activities for monitoring of water Quality included in the Baseline Survey prepared the Consultant in previous stage before tendering.

Monitoring During Work Execution: Routine instrumented monitoring of water Quality and runoff from set areas, construction camps, staging areas, labor camps, etc. shall be conducted at least once every month and shall include the above referred parameters. Monitoring results for SS, DO, BOD5, COD and conductivity shall be submitted to the Engineer within two working days after their tests. Other monitoring results shall be submitted within eight (8) working days after the tests. Monthly reports shall be analytical and shall provide explanations regarding any anomaly or problem encountered. The actions taken in response to the monitoring results shall also be described.

VIBRATION AND NOISE


Control of Emission of Vibration and Noise Law and Regulations: The Contractor shall abide by the provisions of the Conditions of Contract regarding environmental protection and Vietnams National Law on Protection of Environment (NLEP), as well as other relevant legislation. Basic Requirements: The Contractor shall consider noise and vibration as environmental constraints in his design, planning and execution of the Works. The Contractor shall at his own expense take all appropriate measures to ensure that works carried out by the Contractor and by his Subcontractors, whether in or off the Site, will not cause any unnecessary or excessive noise which may disturb local inhabitants. The Contractor shall be responsible for repairing any damage caused as a result of vibrations generated from or by the use of his equipment, plant. Percussive piling will not be permitted without the express permission of the Engineer. Without prejudice to the generality of the foregoing, noise level reduction measures shall include, but not be limited to, the following: All powered mechanical equipment used in the Works shall be effectively sound reduced using the best techniques available in Vietnam in accordance with the current standards.

Acoustic screens or enclosures shall be provided around any part of the Works located in sensitive areas where according to the ECP from which excessive noise may be generated. In general, the equipment shall be selected with due consideration for having lowest noise levels, and ensuring that all equipment is regularly maintained to keep such levels. All equipment, engines and motors shall be equipped with proper mufflers. c) Submittal of Noise Statement: The Contractor shall submit to the Engineer, for review and approval, a Noise Statement including full and comprehensive details of all powered mechanical equipment which he proposes to use during the hours of darkness and of his proposed working methods and noise level reduction measures. The Noise Statement shall include detailed noise calculations to demonstrate the noise generation anticipated by the Contractor. The Statement shall also include safety protection measures against noise such as the use of ear muffs in noisy areas and rotation and/or working hour limitation for the personnel continuously working in areas of high noise where the permissible noise limit established by the Vietnamese standards is being exceeded. The Noise Statement shall be submitted at least fourteen (14) days before the planned start of any work to be undertaken during the hours of darkness. No work shall be carried out during the hours of darkness until the Engineer has notified the Contractor in writing of his consent based on the Noise Statement submitted in relation to such work. Such consent of the Engineer shall not in any event relieve the Contractor of his obligations under the Contract, nor fetter, nor limit neither restrict the Engineers power to give instructions in accordance with the Contract. d) Special Condition for Noise Control during Darkness Hours: The Contractor shall ensure that noise generated by work carried out by the Contractor and his Subcontractors during hours of darkness does not exceed the maximum permissible noise limits accepted by the Engineer (the same may be varied from time to time by, and at the sole discretion of, the Engineer), whether continuously or intermittently. In the event of a breach of this requirement, the Contractor shall immediately re-deploy or adjust the relevant equipment or take other appropriate measures to reduce the noise levels and thereafter maintain them at levels which do not exceed the said limits.

Such measures may include, without limitation, the temporary or permanent cessation of use of certain items of equipment. (2) a) Vibration and Noise Monitoring Vibration Control and Monitoring: Vibration Control: The Contractor shall select, use and maintain his plant and equipment, and adopt such methods for construction that the maximum vibration levels, measured on any building or structure outside or within the Site limits, do not exceed the permitted levels specified in TCVN 6962-2001. The above are limits for transient vibrations. For continuous or sustained periods of vibrations, the permissible peak particle velocity shall be equal to two thirds of the value given above. Vibration Monitoring System: The Contractor shall establish a system for monitoring vibrations in accordance with the requirements stated in TCVN 7211-2002. Baseline Monitoring: The Contractor shall perform the activities for monitoring of vibration Quality included in the Baseline Survey prepared the Consultant in previous stage before tendering. Monitoring during Work Execution: During piling, or any other activity likely to be a source of significant vibration designated by the Engineer, the Contractor shall record vibration levels at locations agreed with the Engineer, at least twice daily. The Engineer may relax the frequency of monitoring if it can be shown that vibration levels are consistent and within specified levels. Theses shall be done at times during the active use of the equipment likely to be source of vibration. The Contractor shall allow for a minimum of six locations to be monitored. b) Noise Monitoring: Baseline Monitoring: The Contractor shall perform the activities for monitoring of noise Quality included in the Baseline Survey prepared the Consultant in previous stage before tendering. Monitoring Points: The Contractor shall carry out noise monitoring at such points within the Site, or outside the Site, and at times as shall be determined in the Environmental Control Plan. Methodology: The noise monitoring methodology adopted shall conform to the Vietnamese Standards TCVN 5964/5-1995. c) Reports and Others: Reports: The results of all monitoring shall be reported to the Engineer within 48 hours of any set of readings. In addition the Contractor shall

establish detailed records for all sets of vibration and noise monitoring undertaken in the course of work execution. These shall be available for inspection by the Engineer and his representatives at any time during working hours. Other Notes: The Contractor shall also note and record the condition of the structure being monitored and any change in condition from the time of the previous round of monitoring.

2.5.5

WASTE AND SOIL CONTAMINATION


In order to avoid and to prevent soil contamination by the Works, the Contractor shall: a) Ensure that no earth, rock or debris is deposited on public or private right-ofway as a result of his operations, including any deposits arising from the movement of construction plant or vehicles; Provide a wash pit, or a wheel washing and/or vehicle cleaning facility, at the exits from the Site whence excavated material is hauled; Provide the entire Site with properly designed temporary drainage system to collect, remove and dispose from the Site all kinds of unnecessary water and waste products found on the Site, including any water, silt or debris washed down from the works by flooding, at a location and in a manner that will not cause pollution or nuisance, and shall not be deposited on land adjacent to the Site.

OTHER ENVIRONMENTAL ASPECTS


Reduction of Construction Operation Impact on Land Communication

The Contractor shall conduct his construction operations to minimize their impact on land communications in and around the areas of construction. Measures to accomplish this requirement shall include, but not be limited to, the following: a) The loading of all trucks used for transporting materials and equipment shall not exceed the legal limits as stipulated by the Department of Transportation, under the Vietnamese Road Administration Bureau. The speed for all trucks used for transporting materials and equipment shall not exceed 60 km/hr on highways. The transportation of materials and equipment shall be in accordance with all the relevant requirements and regulations. Loading and transportation of materials and equipment during rush hours shall be avoided so as not to aggravate the traffic condition on roads in the construction area.

Proper and sufficient traffic signs shall be installed. Drivers shall be properly supervised to ensure their awareness and adherence to regulations. Drivers shall be controlled to prevent them from using alcohol and drugs. The Contractor shall stipulate that such usage shall be grounds for termination of employment on the Works. Construction materials shall be properly stored.

h)

Sub-sections 2.2(d) and (e) of this Specification Section shall be applied in the event of any default to the above-mentioned requirements. The Contractor shall be responsible for the following: All road damage that may occur from the transportation of materials and equipment to and from the Works. Coordination with the Ministry of Transport for implementing all necessary repairs and/or restorations. Repair of any damage to the satisfaction of the Engineer and at no cost to the Employer. (2) Others

The Contractor shall also comply with all current environmental laws and regulations related to the following: solid waste disposal; liquid waste disposal; storage of liquid materials and toxic materials; sanitary conditions (water supply, sewerage, etc.); sanitary facilities referred to in Sub-section 2.85 of Specification Section 01100 Contractors Mobilization; and use of explosives, etc.

MEASUREMENT AND PAYMENT 3.1 METHOD OF MEASUREMENT


All costs to comply with the requirements of this Section 01700 Environmental Control & Protection (including conduct of measurement, monitoring) shall not be measured for payment or made for submittal and claims, except for the permanent works to ensure noise mitigation measures as described in Section 01700-3.2(e).

Payment shall include all costs necessary and required for the proper implementation of the Environmental Control Plan in fully accordance with the requirements of this Specification Section, including all update and submittals, supervision, materials, equipment, apparatuses and devices, labor, and any other incidental costs. Neither measurement nor payment will be made for furnishing, installing, and maintaining the equipment, instruments, or devices, including any other incidentals necessary for control and protection of the environment. All environmental control devices provided by the Contractor shall remain the property of the Contractor, and shall be removed from the Site upon completion of the Contract. The Environmental Control & Protection work shall be deem including in or distributed among all the rates and prices entered for the unit prices of the Bill of Quantities; Separate payment shall not be made for these submittals and claims base on miss-consideration of the same shall be rejected, except for environmental protection method for noise mitigation purpose as regulated in Clause 3.2 (e) below. 1. DESCRIPTION
This section consists of the requirements and procedures to establish, furnish, staff, and maintain the Contractors Laboratory and the equipment that the Contractor shall provide to the Engineer under the Contract. The following definitions shall be referred to for proper interpretation of this Specification Section: Laboratory: The services of an Independent Testing Laboratory that the Contractor shall procure and provide for performing all the necessary testing for Quality control. The Laboratory shall have fully furnished and equipped facilities installed and operated by the Contractor, and shall consist of a Central Laboratory and Site Laboratories (one for each Contract Package), or others as may be requested by the Engineer for Quality control during the execution of the Works. GENERAL
a) The regulations stipulated by the Vietnamese law, Decision No. 2496/QDKHKT promulgated on 24th September 1997 by the Ministry of Transport for establishment and operation of laboratories for Quality control of civil works, shall govern the basic procedure for establishing and operating the Laboratory for the Project. In the event of any discrepancy or ambiguity between the above referred regulations and these Specifications, the Contractor shall timely request for a clarification to be made by the Engineer in consultation with pertinent regulating local authorities. b) The provision of the Contractors Laboratory and equipment for the Engineers use shall be considered as a primordial condition for due compliance with the requirements of the following Specification Sections:

In the event that the Contractors failure to meet these requirements persists, the Engineer will be entitled to proceed with the following countermeasures: To count and register the period of time while the default by the Contractor is persisting, and take it into account as a delay to apply the statements of Clause 11 Defects Liability, Clause 13 Variations and Adjustments and Clause 14 Contract Price and Payment of the Conditions of Contract, at the time of taking-over the Works.

To establish the revised total amount that shall be applied for calculation of the remaining payment installments stated in Sub-section 3.2 (d) by deducting proportionally the amount due in the respective defaulting period (i.e. the period for which a deducting adjustment factor is applied in accordance with Sub-section 2.2(e), or in which the Contractor does not obtain the Certificate of Satisfactory Laboratory Operation from the Engineer), from the original total amount introduced in the Pay Item 01750-1 Laboratory and Contractors Equipment. To carry out such works as he deems necessary and charge the full cost thereof to the Contractor (including related incidentals and administrative costs), which amount shall be deducted from any money due, or which may become due, to the Contractor under the Contract. g) The Engineer reserves the right to require the Contractor to provide additional laboratory testing materials or instruments, as necessary or adequate, to provide necessary technical support for Quality Control specified in the Contract.

2.3 2.3.1

SPECIAL REQUIREMENTS SPECIAL REQUIREMENTS FOR THE LABORATORY


a) The Contractor shall procure, provide and maintain the services of an Independent Testing Laboratory (the Laboratory) complete with all utility services, furniture, equipment, apparatuses and fittings for performing all the necessary testing for Quality control in the Project. The Laboratory proposed by the Contractor shall be noted in the QCP described in Specification Section 01800 Contractors Quality Control, including all information and data necessary to evaluate its qualifications and adequacy. Moreover, a list of the tests that he Contractor proposes to be accomplished off-site by the Laboratory, or by other laboratories, shall also be described. The Laboratory shall consist of fully furnished and equipped facilities, fittings and equipment installed and operated by the Contractor all the times throughout the Contract period until the issuance of the Taking-Over Certificate, and shall be composed by the following installations: One Central Laboratory (located preferably near Hanoi City), Two site laboratories (one for each Contract Package); located near the Engineers Offices established in accordance with the Specification Section 01100 Engineers Facilities, Accommodations and Services. Others as may be requested by the Engineer.

Incorporating in the Program to be submitted as described in Specification Section 01300 Program of Work, the Contractor shall prepare and submit to the Engineer, for review and comments, the following: Design drawings of the Laboratory facilities prepared by experienced professional staff and reviewed by the QC Manager in accordance with the QCP, Detailed list of the Laboratorys equipment, instruments, materials and devices for testing that shall be mobilized, installed and maintained during the Contract period. A detailed list of the Engineers equipment that shall be mobilized and maintained during the Contract period.

f)

The requirements specified in Specification Section 01800 Contractors Quality Control regarding the Quality Control Plan shall also govern the Laboratorys operation, organization, management and administration, etc. The Laboratory shall be properly installed and shall operate to the Engineers satisfaction, at least 56 calendar days from the date of issuance of the Notice to Proceed, or before the start of any work requiring its use, whichever earlier. The Laboratory shall work independently, but under the jurisdiction of the QC Manager (one at each Contract Package). The Central Laboratory shall be administrated by the Contractor while respecting independence of each Site Laboratory managed by each QC Manager. Materials, equipment and instruments in the Laboratory, and those used for field testing shall be maintained by the Contractor and kept ready in good operating condition at all times. The Contractor shall provide all technicians, supporting staff, labor, etc. in the number deemed necessary to operate the Laboratory as required by the approved QCP, to work under the supervision of each QC Manager. Personnel once assigned to the Laboratory shall not be removed without the prior written approval by the Engineer. The Laboratory shall be provided with a main and standby electric power supply system. Enough outlets with ground connections shall be provided to accommodate the required testing equipment. Adequate lighting shall be provided all to the satisfaction and approval of the Engineer. Adequate storage of water and pressure supply shall be maintained for normal testing together with necessary sinks including taps. The floor of the building shall be rigid and adequate to support operating test equipment without vibration and undue noise. In addition, the Laboratory shall be provided with the following:

Enough quantity and well dimensioned work benches with tops covered with approved plastic laminate or tin sheet and containing adjustable shelves and drawers constructed of 19 mm plywood. Sufficiently sized cupboards constructed approximately 600 mm above the work benches provided with doors. Pools and wet rooms for curing of concrete samples, saturating of CBRs test samples, etc., sufficiently designed in size and capacity in accordance with the QCP. Exhaust ceiling fans in enough quantity and capacity, windows with blinds. Double entrance doors wide enough to unload materials from site vehicles into the Laboratory. A minimum clear opening of 2 meters shall be provided. Others as required by the Engineer. p) Modifications to the Laboratorys structural organization and operation will not be allowed, unless otherwise requested by the Engineer based on the actual necessities for improvements of testing performance, or in the event of introducing new items due to the application of some variation orders in accordance with Clause 51.1 Variations of the Conditions of Contract. At the completion of the Contract, the Laboratory and all the furniture, equipment, apparatuses and fittings provided by the Contractor shall be reverted to the Contractor.

2.3.2

EQUIPMENT AND INSTRUMENTS FOR THE LABORATORY


a) The Laboratory shall be furnished and maintained with all equipment, apparatuses and supplies necessary to permit the proper execution of all standard tests required by these Specifications under the Contract and relevant to the materials and construction methods to be used on the Works. The Contractor shall provide all the equipment needed for the correct execution of tests according to the Contract and the equipment shall be of an acceptable Quality, new and of models and brands approved by the QC Manager, and calibrated in accordance with the requirements of international standards and testing specifications. The list of laboratory equipment described hereto is intended as a reference for the Contractor and should neither be construed as a binding list nor as a recommendation to purchase from a specific manufacturer. Many of the items are easily broken or otherwise rendered unusable, therefore their replacements shall be readily available so that the testing is not interrupted.

Since the Contractor is solely and fully responsible for implementing and assuring the Quality Control for the Works, all the activities related to the implementation, furnishing, maintenance and operation of the Laboratory, as well as all the provision and administration of all testing results shall also be at the full responsibility of the Contractor. However, the respective analysis and application of the results obtained by the Laboratory, shall be completely at the sole responsibility of the Engineer. At the completion of the Contract, all furniture, equipment, apparatuses and supplies provided by the Contractor, except for the portion mentioned below, shall be reverted to the Contractor. The Contractor shall supply, equip and maintain for the duration of the Contract, an approved fixed or mobile laboratorys with facilities, furniture, equipment, personnel, apparatus, transportation (Pick-up type car) and installations for his own use and that of the Engineer. The laboratorys will be operated by the Contractor under the supervision of the Engineer or his staff.

Contractors Office in the Laboratory The Laboratory shall include one office of 25 m2 (one at Site Laboratory and one at the Central Laboratory) within the Laboratory room to serve finalization of testing and inspection documents of the Engineer. The Office will be furnished and fully equipped with one computer, one inkjet printer, all necessary office supplies, and connected to the Laboratorys network. Templates and Straightedges: Sufficient metal templates shall be supplied by the Contractor for use by the Contractor or the Engineer to check the finished surface of the pavement structure. These templates shall be submitted to the Engineer for his approval. The templates used to control the work shall be maintained at all times in a condition to produce the correct crosssectional profile, and shall be checked at intervals and, if necessary, repaired or adjusted as directed by the Engineer. LABORATORY CHECK BY THE ENGINEER


a) Rights to Check Testing Laboratories: The Engineer shall at all times have full right and power to check laboratory equipment for verifying their due compliance with the Specifications, and to confirm the adequacy of the laboratory technicians testing procedures and techniques. b) Engineers Access and use of Laboratory Facilities: The Engineer shall at all times have full right and power to access to the Laboratory and respective laboratory records related to the Project. The Engineer may at any time use the Laboratory facilities to conduct independent testing, or require the laboratory personnel employed by, to conduct such testing. c) The Contractor shall be responsible for the staffing and operating of the laboratory. He shall provide a suitably qualified and experienced laboratory supervisor and sufficient technicians and assistants to meet the testing requirements. Details of the contractors proposed staffing shall be submitted to the Engineer for approval and he shall be entitled to ask the Contractor to remove or replace any member of the laboratory staff who demonstrates incompetence, whether previously approved or not.

d) The Contractor shall be responsible for supplying, preparing and testing specimens. All the costs incurred due to the test (including travel cost, accommodation for Engineer or his staffs if the sampling work requires overnight stay and outside project) shall be borne by the Contractor. e) All equipment used for testing shall be of standard type and approved by the Engineer and properly housed by the Contractor. An adequate supply of water and electric power shall be provided at all times. Other than the laboratory prescribed in this Section 01750, a field laboratory shall be provided by the Contractor at the location designated by the Engineer in order that the Engineer can control and supervise the material used for bituminous pavements and operations of bituminous mixing plants, concrete mixing plant as provided in DIVISION 5 & 6 of these Specifications. In any case where material or workmanship is specified by one of the above tests, and alternative test methods are allowed, the method used to determine compliance with the Specifications will be at the absolute discretion of the Engineer. The Engineer's decision will be final and claims on the basis of the Engineer's selection of a particular allowable test method will be rejected.

All survey and testing equipment shall be supplied with miscellaneous tools, necessary tripods, extra batteries and battery chargers (for electrically operated equipment), mountings, carrying and storage cases and all necessary accessories. Survey and testing equipment will be utilized by the Engineer and will be repaired or replaced by the Contractor as required by the Engineer; however, the equipment will remain property of the Contractor at the completion of the Contract. Any marks or survey staking made by the Engineer, or by the Contractor if so required by the Engineer, shall be carefully preserved and, if disturbed or destroyed, shall be immediately replaced by the Contractor at his own expense and to the satisfaction of the Engineer. No work shall be carried out in any section until the Engineer has approved the necessary setting out.

MEASUREMENT AND PAYMENT BASIS OF PAYMENT


All costs incurred to complete all work items as mentioned in the Section 01750 Laboratory and Equipment including furnishing and maintenance of laboratories, equipment and survey staffing, providing the Engineer with survey equipment and staff for his inspection and check, if necessary, and all other related costs shall not be paid separately, but shall be considered to be subsidiary obligations of the Contractor and covered by his expenses as specified in the related items in the Bill of Quantity. SECTION 01800 - CONTRACTORS QUALITY CONTROL


1. DESCRIPTION
This Specification Section consists of the requirements and procedures to establish, implement, and maintain the Quality Control Program by the Contractor. Quality Control procedures and Acceptance Test procedures have different purpose as principal. Quality Control shall be conducted by the Contractor to produce good works as their duties under his responsibility. Acceptance Test shall be conducted to receive the Acceptance of the Work. However, the Data of Quality Control Procedures will be used also as the data for the acceptance of the work. Typical example is the strength test of concrete. The following definitions shall be referred to for proper interpretation of this Specification Section: Quality Control Plan (QCP): The Contractors Plan for Quality Control that shall be prepared and submitted by the Contractor in compliance with the Contract. It shall consist of a complete plan for implementation and monitoring of the necessary measures to be performed by the Contractor to control the Works Quality, assuring that the services and work supplied comply satisfactorily with the standards and the requirements of the Contract. 2. 2.1

REQUIREMENTS REFERENCE STANDARDS


Supplementing the currently applicable Vietnamese regulations for Quality Control, the following Standards in their latest edition shall be particularly used as applicable. AASHTO and ASTM Standards for Quality Control and Quality Assurance for Construction of Civil Works; Japan Highway Public Corporation (Nihon Doro Kodan): Manual for Supervision of Civil Works; Japan Road Association: Manual for Asphalt and Concrete Pavements; Japan Civil Engineering Association: Standard Specifications for Concrete; and U.S. Department of Transportation, Federal Highways Administration; Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects: FP-2003 (Metric Units).

2.2

GENERAL
a) The regulations stipulated by the Vietnamese law, Decree No. 209/2004/NDCP promulgated on 16th December 2004 by the Government of Vietnam for Quality control on construction of civil works, shall govern the basic procedure for establishing and monitoring the QCP for the Project. In the event of any discrepancy or ambiguity between the above referred regulations and these Specifications, the Contractor shall timely request for a clarification to be made by the Engineer in consultation with pertinent regulating local authorities. b) The Contractor shall be solely and fully responsible for the application of measures, methods and procedures for testing and handling the testing results, for correction of defects on the Works, and for any eventual work performed to assure the Quality of the Works. However, the respective analysis and application of the results obtained by the activities for Quality Control will be performed by the Engineer in accordance with the Specification Section 01850 Acceptance of Work. The Quality Control Plan shall be considered as one of the key-plans composing the Program to be prepared, submitted and monitored as described in Specification Section 01300 Program of Work.

In this case, the Engineer will take note and record the default, and notify the Contractor for applying pertinent measures to secure normality in the compliance with the requirements for Quality control. Moreover, the Payment Factor for deduction to be applied to some defined items under the Specification Section 01850 Acceptance of Work, for preparing the payment certificate, shall be determined at the Engineers discretion based on the actual work performed by the Contractor for QC. g) In the event that the Contractors failure to meet these requirements persists, the Engineer will be entitled to proceed with the following countermeasures:

Count and register the period of time while the default by the Contractor is persisting, and take it into account as a delay to be applied in accordance with Clause 8 Commencement, Delay and Suspension of the Conditions of Contract, at the time of taking-over of the Works. To determine the revised total amount that shall be applied for calculation of the remaining payment instalments under Sub-section 3.2 (e) by deducting proportionally the amount due in the corresponding defaulting period (i.e. the period for which a deducting adjustment factor was applied in accordance with Sub-section 2.2(f), or during which the Contractor did not obtain the Certificate of Satisfactory Quality Control from the Engineer), from the original total amount introduced in the pay item 018001 Contractors Quality Control. To carry out such works as he deems necessary and charge the full cost thereof to the Contractor (including relevant incidentals and administrative costs), which amount shall be deducted from any money due, or which may become due, to the Contractor under the Contract.

2.3

CONTRACTORS PLAN FOR QUALITY CONTROL (QCP)


a) Incorporating in the Program, the Contractor shall prepare and submit to the Engineer for review and comments, the QCP that shall be implemented during the work execution, and shall be monitored on a daily basis. Thereafter, the Contractor shall revise his QCP by introducing the Engineers comments and review it as necessary, and shall re-submit it to the Engineer for its use in the Project as the Revised QCP. The Quality Control Plan shall include, but not be limited to, the following: Quality Control Organizational Structure: The organization classified into subdivisions that can be technically and effectively managed, and described in a Quality Control Organizational Chart identifying the subdivisions, responsibilities and tasks of the personnel and supporting staff, all of them engaged solely and specifically for Quality control issues (including the Contractors Quality Control Manager who will be responsible for all Quality control issues in the Site). Moreover, the criteria for appointment of principal staff shall also be described. Lines of Communication: The organizational structure shall show direct lines of communication and reporting among the Quality Control Manager, Contractors Project Manager, and the Contractors Director responsible for the Contract execution. Interaction and Communication Procedures: The procedures defining the communication system between the Contractors construction personnel working where Quality control is required, and the Quality control staff, including regular communication and reporting system. frequency, coverage and intent of site meetings for coordination shall also be specified. Subcontractors Quality Control Plan: The means by which the QCP will be communicated to Subcontractors (if any), including also the procedure for reviewing the plan for Quality control proposed by subcontractors, and the method to incorporate the subcontractors Quality control plans into the Projects QCP. Methods, Equipment and Supporting Staff for Quality Control: A detailed and consistent description of the methodology, techniques to be applied and equipment (including laboratory) and supporting staff to be provided for Quality control, including details for each stage considered during the construction of the Works. A consistent cross-reference among the methods applied in the QCP, these Specifications, and all applicable requirements of the Vietnamese standards or the like regarding Quality control. Testing List: A list of tests to be performed throughout the Contract period. The list shall give the test name, frequency, specification section and paragraph containing the test requirements, the personnel and laboratory responsible for each type of test, and an estimate of the number of tests required. On-Site and Off-Site Testing: A list and brief description of all on-site and off-site testing to be performed by the Laboratory. Moreover, a list of other testing that the Contractor proposes to be accomplished by other laboratories. Quality Control Schedules: Time-bar schedules prepared for each case of Quality control necessity identified in the above-mentioned inventory, including a description of all the main activities for Quality control, dates for commencement and completion of each activity, critical items of the schedule, certification, management submittals, etc. Quality Control Inspections: The procedure and schedule for: Quality control inspections,; Verification of due compliance of the methods and materials; and Supervision of the performance of the supporting staff. A complete set of the forms to be used for the inspections shall also be included.

Forms for Testing, Reporting and other Submittals: All the forms to be used for testing, testing summary reports, Quality control monthly report, and other submittals. Tracking of Defects: The procedure for tracking construction deficiencies from its identification through acceptable corrective actions. This shall also include the method to verify that the identified deficiencies have been properly corrected. Supervision and Auditing: The means by which the established Quality Control System is supervised, monitored and audited by the Quality Control Manager to ensure due compliance with the principles and objectives of the Quality Control Plan. This shall also include the procedure for updating the Quality Control Plan. Records: to be prepared and maintained by the Quality Control Manager and the staff for Quality control, and the communication procedures to be adopted by the Quality Control Manager such that the Engineer, and others associated with the Works, are kept fully informed throughout the period of the Contract on matters relating to traffic regulations. c) Before the start of construction, and prior to the approval by the Engineer of the QCP, the Contractor shall make a full and detailed presentation of the QCP and his proposed Quality control system prescribed therein. Minutes of the meeting shall be prepared by the Contractor, and shall be signed by the Contractor and the Engineer. The minutes shall become a part of the contractual documents. Modifications to the Revised QCP shall not be allowed without previous consultation with the Engineer, unless otherwise requested by the Engineer based on the actual necessities for improving the Quality control in the Project, or in the event of the introduction of new items due to the application of some variation orders in accordance with Clause 13 Variations and Adjustments of the Conditions of Contract.. The final Quality Control Plan approved by the Engineer shall be translated into Vietnamese and submitted to the Employer.

2.4

QUALITY CONTROL MANAGER (THE QC MANAGER)


a) The Contractor shall appoint a Quality Control Manager (hereafter referred as the QC Manager), one for each Contract Package, whose duties throughout the period of the Contract shall be solely and entirely connected with the Quality Control activities on the Site. The QC Manager shall be bilingual (Vietnamese/English) and shall be a suitably qualified and experienced person who shall prepare, supervise and monitor the Quality Control Plan, and shall, in particular but without limitation, carry out auditing of the operation of the Quality Control Plan in accordance with a rolling Program to be submitted, from time to time, to the Engineer for his consent. The appointment and designation of the QC Manager shall be subject to the Engineers approval and Employer accepted. Unless specifically agreed in writing by the Engineer, the Contractor shall not undertake any work on the Site, which may require Quality control for his work acceptance, until the QC Manager has commenced duties on Site and the Revised QCP has been received and consent by the Engineer. The Contractor shall not remove the QC Manager from the Site without the express written permission of the Engineer. Within fourteen (14) days of any such removal, or notice of intent of removal, the Contractor shall nominate a replacement QC Manager for the Engineers approval. The Contractor shall provide the QC Manager with enough authority on all aspects relating to Quality control within the Contractors main organization. The Contractor shall provide the QC Manager with at least one (1) Deputy Quality Control Manager (for each Contract Package) whose appointment shall be subject to the Engineers approval. The Deputy Quality Control Manager shall be capable of assuming the duties and functions of the QC Manager as contained in the Quality Control Plan whenever necessary. The Contractor shall provide the QC Manager with enough supporting staff in accordance with the staffing levels set out in the Quality Control Plan. The supporting staff shall be fully qualified in terms of experience and technical training to perform their responsibilities for Quality Control, and shall have excellent understanding regarding the contents and objectives of the Quality Control Plan. The Contractor shall ensure that the QC Manager maintains a daily site diary, comprehensively recording all relevant matters concerning site safety inspections and audits, related incidents, and the like. The site diary shall be available at all times for inspection by the Engineer.

SPECIAL REQUIREMENTS FOR QUALITY CONTROL LABORATORY, TESTING INSPECTION, SAMPLING AND TESTING PROCEDURES
Laboratory General: The Contractor shall procure and provide the services of the Laboratory in accordance with the requirements and provisions of Specification Section 01750 Laboratory and Contractors Equipment. Administration: The Laboratory shall work independently, but under the jurisdiction of the QC Manager (in each Contract Package). Laboratory Check by the Engineer: The rights and power of the Engineer to check the Laboratory are as described in Specification Section 01750 Laboratory and Contractors Equipment. Inspections and Testing Categories: Testing inspections to be performed regularly by the Contractor, in the presence of the Engineer, are divided into the following two categories: Job-Site Testing Inspection: The inspection of all on-site testing, including its respective procedures, facilities and results to confirm complete and due compliance with the Contract. Off-Site Testing Inspection: Off-site or factory inspection consisting of: Inspection at the point of manufacture or production of the various products or materials to be shipped to the Site; and Inspection of the equipment and materials identified in the Specifications. b) Notice to the Engineer: The Contractor shall give appropriate written notice to the Engineer not less than 28 days before off-site inspection services are required, and shall provide for the producer, manufacturer, or fabricator to furnish safe access and proper facilities, and to cooperate with the inspecting personnel in the performance of their duties. If the Engineer does not attend on the date agreed, the Contractor may, unless otherwise instructed by the Engineer, proceed with the tests. The absence of the Engineer at the tests does not relieve the Contractor from his obligations. The Acceptance of the tests results, or the respective work, shall be made only by the Engineer in accordance with Specification Section 01850 Acceptance of Work.

Expenses: The Contractor shall pay all the expenses required for the inspection, testing and the attendance of the Engineer. Off-Site Testing and Inspections By Specialized Laboratory: In the case of foreign equipment and materials, an independent specialized laboratory approved by the Engineer shall certify the off-site testing and inspections. The related expense shall be borne by the Contractor. All off-site testing and inspections shall be completed to the satisfaction of the Engineer prior to the shipment of the products concerned from the factory to the Site.

Final Inspection: Prior to the commencement of the procedure for taking-over of the Works in accordance with the requirements of Clause 48.1 Taking-Over Certificate of the Conditions of Contract, or any increment thereof, and before inspection by the Engineer, the QC Manager shall conduct an inspection of the Works and shall prepare a list of items which do not conform to the plans and specifications. The list of deficiencies shall be included as a part of the Quality control documentation, and shall include the estimated date by which the deficiencies will be corrected. Further, the QC Manager shall make a second inspection to ascertain that all deficiencies have been corrected and so notify the Engineer. After completion of deficiency correction as identified by the Quality control inspection, the Contractor may proceed with his application for taking-over as stated in the above referred Clause 48.1.

Sampling Standards: Where required by the Specifications (General and Technical), for any work item, sampling shall be made in due accordance with the Vietnamese current standards for sampling, supplemented by the like of AASHTO, ASTM, JIS or other standards recommended by the Engineer as applicable. Samples: Any material that appears defective or inconsistent with similar material being produced shall be sampled, unless such material is voluntarily removed and replaced or corrected by the Contractor at his own expense.

Procedure: The procedure for sampling shall be defined and scheduled in the QCP, by using random number methods, and defining sets, lots or sections for monitoring the tests procedure until the issuance of the respective acceptance of Work. Splits of samples shall be performed when required, and they shall be delivered to the Engineer in an acceptable container. Witness by the Engineer: The sampling procedure shall provide to the Engineer the opportunity to witness all sampling, immediately perform splits when required. Instruct the Contractor to deliver the Governments portion of the sample or split sample in an acceptable container suitable for shipment. Labeling of Samples: Labels of samples shall contain the following information: Project number; Source of material; Pay item number; Sample number; Date sampled; Time sampled; Location where sample taken; Name of person sampling; Name of person witnessing sampling; and Type of test required on sample.

Testing Procedures Scope of Tests: The Contractor shall perform the tests specified or required to verify that control measures are adequate to provide a product that conforms to the requirements of the Contract and/or Specifications. Testing includes operation and/or acceptance tests when specified or required. Required Data: The QC Manager shall perform the following activities, and shall provide the following data for approval by the Engineer: Verify that the testing procedures comply with the standards referred to in the Specifications. Verify that the facilities and testing equipment are available and comply with testing standards. Check the test instrument calibration data against certified standards. Verify that the recording forms and test identification control number system, including all of the test documentation requirements, have been prepared.

Results Report: Results of all tests taken, both passing and failing tests, shall be recorded on the Quality control report for the date taken. Specification paragraph reference, location where tests were taken, and the sequential control number identifying the test shall be given. Actual test reports may be submitted later, if allowed by the Engineer, with a reference to the test number and date taken. The Contractor shall provide directly to the Engineer an information copy of tests performed by an off-site or commercial test facility. Failure to submit timely test reports, as stated, and/or disapproval of the test facility, may result in non-payment for the related work performed.

2.5.2

CERTIFIED LABORATORY TESTS AND MANUFACTURERS CERTIFICATION


a) Certified Laboratory Tests: Laboratory test may consist also of certified test made by an authorized agency for testing of materials and equipment that will be incorporated into the Works under the Contract. Certified tests on materials to be incorporated into the structures will be accepted provided that the tests are performed by the manufacturer or by authorized agencies or laboratories and show that the materials conform to the Specifications. b) Manufacturers Certification: Manufacturers certification may be furnished by the Contractor on items of materials and equipment to be provided only when this method will assure, to the satisfaction of the Engineer, their full compliance with the provisions of the Contract. Pre-printed certifications will not be accepted. All certifications shall be submitted to the Engineer. All certifications by manufacturers or independent laboratories shall name the appropriate item of equipment and material, specifications, standards or other document specified as controlling the Quality of that item, and shall be accompanied by certified copies of test reports upon which the certifications are based.

QUALITY CONTROLS RECORDS AND REPORTS


Quality Control Records Current records of all Quality control operations, activities, and tests performed, including those performed by Subcontractors and/or suppliers shall be maintained in the way and format prescribed in the QCP. The above-mentioned records shall be made on a daily report form reviewed by the Engineer, and shall include actual evidences that specified Quality control activities and/or tests have been properly performed in accordance with the standards referred in the Specifications. The records shall include, but not be limited, to the following: Work performed, giving location, description, and the names of technical staff in charge of the control. Type and number of control activities and tests involved. Results of control activities or tests. Deficiencies noted, including in a first instance, the proposed remedial or corrective action. Quality control activities performed with results and references to specifications and/or drawings requirements. (2) a) Quality Control Reports Written reports of tests and engineering data furnished by the Contractor for the Engineers review of materials and equipment proposed to be used in the Works shall be submitted as specified and detailed in the Revised QCP. The Laboratory shall furnish three copies of a written report on each test performed by the Contractors QC staff, or by the Engineer when necessary. (Two copies shall be distributed to the Engineer and one copy to the Contractor). The submittal shall be done within three (3) days after a test is completed. Laboratory submittal procedures and requirements shall be detailed in the Revised QCP. Monthly Summary Complying with the requirements of Specification Section 01400 Monthly Progress Report, the QC Manager shall summarize all the main activities, all relevant tests and results obtained in the activities performed during the month. Moreover, all the problems occurred in the course of execution of the activities for Quality control, and outstanding deficiencies, shall also be included in the summary. Tabulated and graphic form should preferably be applied.

2.6 2.6.1

ACCEPTANCE AND NOTIFICATION OF NON-COMPLIANCE ACCEPTANCE


a) If the Engineer determines that the testing and Quality control, implemented by the Contractor in executing the Works for the Project, is ineffective or contains defects, the Contractor shall make immediate improvements to correct these inadequacies. The results obtained by the application of the system established by the QCP of this Specification Section shall be evaluated for specified pay items under Specification Section 01850 Acceptance of Work based on the criteria for acceptance established for the Project.

2.6.2

NOTIFICATION OF NON-COMPLIANCE
a) The Contractor shall, immediately after receipt of a notice regarding any noncompliance with the foregoing requirements, detected by the Engineer or by his staff, take prompt corrective actions. Such notice, when delivered to the Contractor at the site of the work, shall be deemed sufficient for the purpose of notification. If the Contractor fails or refuses to comply promptly with this requirement, the Engineer will be entitled to issue an order for stopping all or part of the Works until satisfactory corrective actions are taken. No part of the time lost due to such stop-orders will be accepted as the subject of a claim by the Contractor for extension of time or for additional costs or damages. However, instead of that, the procedure established in Sub-section 2.2 (f) and (g) of this Specification Section shall be applied.

CERTIFICATE OF SATISFACTORY QUALITY CONTROL


This certificate will be issued by the Engineer, on a monthly basis, upon the Contractors due compliance with the following conditions: a) No failures in the compliance with the requirements of this Specification Section have been observed by the Engineer, and the QCP has been properly implemented to the Engineers satisfaction in accordance with the consented QC schedules and contents; The Certificate of Satisfactory Laboratory Operation required in Specification Section 01750 Laboratory and Contractors Equipment has been issued by the Engineer; The Certificate of Satisfactory Control of Materials required in Specification Section 01900 Control of Materials has been issued by the Engineer; and The QC Records and Reports, including the Monthly Summary have been timely submitted to the Engineer.

SECTION 01850 - ACCEPTANCE OF WORK


1. DESCRIPTION
The completed portion of the Works shall be measured, accepted and paid periodically for in accordance with the Specifications. Acceptance of the Works will be divided to the 3 categories as bellow: 1) Items of which requirement shall be definitely kept 2) Items of which Acceptance Quality is difficult to specify clearly and will be judged by the Engineer based on the Quality control procedures. 3) Items of which finishing quality may be variable even the Quality Controls were executed well Fabricated products Small size independent products such as Catch Basin, Manhole Cast in place piles Pavement surface, Slope finishing Concrete products on site Some of precasted products

The statistical Quality control method shall be introduced for the pay items of which Quality will affect to the function and/or aesthetic view, in order to execute consistent, economical and expedite the Works, and to minimize such disputes between the Contractor and the Employer. In this sub-Section 01850, the payments adjust methods for the above 3rd category is defined. Payment methods for other pay items shall be as same as the past conventional methods as specified in each subsection.

This section will demonstrate the evaluation procedure for the work executed at Site based on a statistical methodology regarding Acceptance of the Works, to recommend appropriate Quality Control system is beneficial for both the Contractor and the Employer

Required standards in the Specifications are, usually, composed from Required Mean Value (XR), Minimum allowable value (QLL) and Maximum allowable value (QUL). The relation between average of quality (XM) and standard deviation () will be shown in the right Figure. The evaluation will be executed based on the average (XM) or minimum requirement (QLL) of the results by test or measured, however the results have dispersion, as expressed, by standard deviation ().

In the conventional Specifications, if average (XM) falls under the minimum requirement (QLL) or out of allowable limit, the part of completed structure would be rejected, and would be ordered to be remedied or replaced, then the Contractor shall bear the additional cost. In case of Concrete Materials, to avoid such risk, the Contractor would increase the cement to ensure target strength far over the (XM). However, this tendency would not be desirous to the Employer either because excessive strength concrete would result in cracks, increase in dead load or thermal stress inside of the structure. The right figure shows another the examples of the relation between the Required Value (XR) and the Dispersion of the test results. Even the average value (XM) is within the tolerance range, the actual Quality has different meaning according to the value of their dispersion.

3.1

REFERENCE STANDARDS
a) The evaluation criteria applied in this Specification section are based on the criteria applied in the method for evaluation for work acceptance shown in the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects - FP-2003 of the FHWA, and the absolute method of AASHTO R11, but modified as described here below. The procedure herein established shall prevail in any case of discrepancy with other standards. b) a) The standards referred to in Specification Sections 01750, 01800 and 01900 shall apply also for this Specification Section. The requirements established in this Specification Section shall supplement, without detriment to, the requirements and provisions stated in the following clauses of the Conditions of Contract. The requirements established in this Specification Section shall also supplement the requirements and provisions stated in the following sections of the General Specifications:

The above default will entitle the Engineer to proceed with the following countermeasures: Instruct the Contractor to suspend temporarily the procedure for any interim payment until the compliance with the requirements for Acceptance of Work is satisfactorily normalized and secured by the Contractor. Count and register the period of time of default by the Contractor, and take it into account as a delay to be applied in accordance with Clause 8 Commencement, Delays and Suspension of the Conditions of Contract, at the time of taking-over the Works. Calculate the amount to be deducted in the monthly (interim) Payment Certificate as a Deduction for Quality Assurance by applying an

additional deduction to each payment factor determined for the Quality levels evaluated by visual inspection of the work subjected to acceptance related to the interim (monthly) payment certificate during which the default has been recorded.

3.2

OBJECT TO THE ACCEPTANCE


Object for the acceptance specified in this section is not for whole of project. It shall be Lot and they shall be tested, evaluated and studied for the possibility of acceptance by Lot by Lot. Lot means followings: (a) Based on the Specification of 01800 Contractors Quality Control, and 01900 Control of Materials, Lot means the part of Project proposed by the Contractor based on his Quality Control Plan Normally one Lot shall be a work of a day (length, area, volume or weight etc) with same characteristic feature. Lot size described in each subsection is recommendable one for the quality control. The Engineer may request to the Contractor to revise the size of Lot after the study of submitted Quality Control plan, Construction Program, Conditions of issuance of Acceptance Certificate, prior to the commencement of the works, referring to the relevant clause of Specifications and Contract Documents. The Contractor shall, in this case, revise the submitted document or plan on the discussion with the Engineer.

3.3

EVALUATION OF LOT
Each Lot shall be checked and evaluated based on the test or measurement results of the samples taken from the Lot. Sample means some test pieces or measurement location to get the data on the at random designation by the Engineer. Data means, normally, the simple average of the test results of the specimen or measurement results of some locations. All of above size or number of Lot, Sample and Data shall be analyzed based on the Quality Control Plan and Construction Program which shall be submitted by the Contractor and approved by the Engineer prior to the commencement of the Work. Desirable number of Sample is 5 or more and it shall be minimum 3. Generally speaking, smaller number of sample will cause the higher risk to the Contractor and the Client. The Contractor may request the increasing of number of samples,

if he considered necessary to avoid the risk, minimum 14 days before the commencement of the work (or producing of materials). However, it will not accepted by the Engineer after commencing the work. Measurement methods shall be followed to the description of Specification relevant to the Works.

3.4

DECISION TO ACCEPT OR REJECT


Acceptable work shall have two kinds of properties as shown in Table-1. Average value of a Sample shall be within the specified tolerance, and Quality shall be even with appropriate dispersion. Revision of QLL, XR, QUL or proposal of new value will be acceptable through the Contractors Quality Control Plan submitted and approved prior to the works as specified in Subsection 01800. The Engineer has sole authority of the acceptance criteria, when the maximum allowance is specified or considered to be necessary. In case of Category 6 and Category 7 in Table-1, the Engineer also has sole authority to decide to accept with conditions or to reject, if the Work will not satisfy the lowest allowable value (Xm < QLL). The Contractor could not claim about this decision.

DISPERSION RANGE OF THE WORK


The Work will be considered, generally, to be even and stable, if the of the data of the Sample is smaller. However, desirable value of will be varied depend on the relation of XM with maximum allowable value (QUL) and minimum allowable value (QLL) as shown in the Figure 1. If there is no definition about the allowable range in the Specifications, it shall be 5 of the required value of the Specification, or it shall be normal range shown on the catalogue of the manufacturer with the prior approval of the Engineer. The boundary line between Category 1 and Category 2: 2QUL - XM. The boundary line between Category 1 and Category 3: 2XM +QLL The Sample on the line will be judged to belong to the higher Rank.

3.6

ACCEPTANCE WITH AWARD


The Contractors duty is to handover the Works which has stable Quality within the specified range. Award is prepared specially to encourage this duty for the completion of the duty of the Specifications on very good Quality works.

3.7

PAYMENT FACTOR (PF)


Payment shall be calculated and be disbursed multiplying the Payment factors shown on the Table 01850-2 to the BQ unit price of the Contract, according to the each Rank of completed Lot, as the assurance cost of the Quality control. Table-2 : Payment Factors for Each Categories

THE MONITORING SCHEDULE FOR ACCEPTANCE OF WORK


This schedule shall incorporate, in a brief and consistent way, a time-schedule for monitoring the acceptance of the performed work, including a summary of all the relevant data related to Quality control, testing, inspections and materials control. This schedule shall be submitted with the Program, or incorporated into the Schedule described in Specification Section 01300 Program of Work, and shall be supported by the plan and schedules stipulated in Specification Sections 01750, 01800, and 01900. Revisions and update of this schedule shall be made in accordance with the actual progress at least 28 days prior to its application in the work execution. Similarly to the main Schedule, all the items included in the Monitoring Schedule for Acceptance of Work, shall be organized in a work breakdown structure, indicating work stages and phases, with a code number for identification related to the work breakdown structure as well as a unique description. The monitoring schedule shall show the tentative dates for the Contractors request for the issuance of the Acceptance of Work by the Engineer. The actual date for the request shall be monitored in accordance with the progress of each respective item throughout the Contract period. This schedule shall include, but not be limited to, the following: the list of items to be monitored by this schedule; the tentative dates for acceptance (request and issuance); the control points or indispensable requirements to be checked by the Specifications as a basis for acceptance of the corresponding work item; the methods and forms for recording and registering the acceptance and rejection, including the measures for correction of defects; and others that the Engineer may require for monitoring.

3.10

SPECIAL REQUIREMENTS FOR ACCEPTANCE OF WORK


a) Conformity with Contract Requirements: Plan dimensions and contract specifications values are the values to be strived for and complied with as the design values from which any deviations are allowed. The Contractor shall therefore, perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons. The Engineer may inspect, or instruct the Contractor for sampling, or testing of any part of the Works, at any time before final acceptance of the Project. The Contractor shall, at his own expense, remove and replace any parts of the Works that do not conform to the Contract. As an alternative to removal and replacement, the Contractor may submit a written request for: Work acceptance, recognizing and accepting the calculated deductions for Quality Assurance included in the monthly (interim) Payment Certificate; or Permission to perform corrective measures to bring the work into conformity at his expense and without time extension. In which case the deductions for Quality Assurance, evaluated by the Engineer based on the factors herein defined, will be lower.

The request must contain supporting rationale and documentation. It shall include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, Quality, aesthetics, and other tangible engineering aspects. The Engineer will determine disposition of the non-conforming work. When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted. b) Certification: For materials manufactured off-site, the use of an effective testing and inspection system shall be required. A manufacturer with an ISO 9000 certification or other recognized certification in Vietnam is highly recommended. One of the following certifications may be required:

Production Certificate: Material requiring a production certificate is identified in the acceptance Subsection of each Section. The Contractor shall require the manufacturer to furnish a production certificate for each material to be shipped. Each production certificate shall include the following : Date and place of manufacture; Lot number or other means of cross-referencing to the manufacturers inspection and testing system; and Substantiating evidence that the material conforms to the contract Quality requirements, including all of the following: Test results on material from the same lot and documentation of the inspection and testing system; A statement from the manufacturer that the material complies with all contract requirements; and Manufacturers signature or other means of demonstrating accountability for the certification.

Commercial Certificate: When a certificate other than the production certificate is required, one commercial certificate for all similar materials from the same manufacturer shall be furnished. A commercial certificate is a manufacturers or Contractors confirmation that the material complies with all contract requirements. The confirmation may be by labels, catalogue, data, stamped specification standards, or suppliers certifications indicating the material is produced to a commercial standard or specifications. c) Temporary and Final Acceptance: The Contractor shall maintain the Works during the construction and until the Project is accepted. Damage caused by the Contractor prior to the final acceptance of the entire Project shall be repaired at the Contractors expense. Temporary Acceptance: The issuance of the Acceptance of Work in accordance with this Specification Section shall not relieve the Contractor from his responsibilities for the Contract, and shall not contradict the requirements of the Conditions of Contract or the related Specifications, or the like in the Contract.

Therefore, the acceptances issued by this Specification Section shall be considered as temporary. Final acceptance shall depend upon the final inspection and procedure established in the Contract for the issuance of the Taking-over Certificate and Defects Liability Certificate. The Deductions (or Premium) for Quality Assurance introduced in each interim Payment Certificate for the corresponding accepted work are not refundable or modifiable, unless the relevant work is replaced voluntarily by the Contractor (at his expense and without time extension), upon the consent of the Engineer, in order to return the defective Quality Level to higher levels or to the original level intended in the Specifications, in which case the Contractor shall timely request in writing to do so providing a complete plan and construction statement. The Engineer will thereafter evaluate the replaced work by the system established herein. Final Acceptance: The final acceptance of the Works shall consist of the approval and issuance of relevant documents of the Contract regarding the Taking over Certificate and Defects Liability Certificate.

CERTIFICATE OF ACCEPTANCE OF WORK


This certificate will be issued by the Engineer, for each Payment Certificate, upon due compliance by the Contractor with the following conditions: a) No failures of the Contractor in complying with the requirements of this Specification Section have been observed by the Engineer, and the Monitoring Schedule for Acceptance of Work has been properly implemented to the Engineers satisfaction, The Records and Reports on Acceptance of Work have been timely submitted to the Engineer.

1. DESCRIPTION
This Section consists of the requirements and procedures to establish, implement, and maintain a systematic procedure for Control of Materials by the Contractor. The following definitions shall be referred to for proper interpretation of this Specification Section: Schedule of Materials: The schedule prepared for the Program to show, describe and monitor the proper, adequate and well balanced use of materials for construction of the Works, illustrated by Shop/Working Drawings, summary barschedules, quantity tables or diagrams and other as required and in accordance with the Program. As defined in Specification Section 01300 Program of Work. REQUIREMENTS REFERENCE STANDARDS


a) Supplementing the currently applicable Vietnamese regulations referred to in Specification Sections 01750 and 01800, the following Standards in their latest edition shall be particularly used as applicable. Guide Specifications for Highway Construction, AASHTO, 1998. Japan Highway Public Corporation (Nihon Doro Kodan) Manual for Supervision of Civil Works. U.S. Department of Transportation, Federal Highways Administration; Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects - FP-2003 (Metric Units). Unless otherwise designated, when reference is made in the Specifications to standards or test methods such as AASHTO, ASTM, or others, the reference shall mean the specification, standard or test method which is in effect until 28 days before the date of submission of bids.

GENERAL
a) b) The Contractor shall be fully responsible for all located sources, including established commercial sources, which are related to the Project. Regardless the origin of the source, all materials to be incorporated into the Works shall comply satisfactorily with all the requirements herein specified, and shall have the Engineers acceptance issued based on Quality control and testing results submitted by the Contractor. All materials shall be subject to inspection, sampling, testing, re-testing, and rejection at any time prior to the acceptance of the Works. The stipulated Vietnamese regulations for Quality Control and for the Laboratory referred to in Specification Sections 01750 and 01800 shall also govern the basic procedures for establishment, implementation, and maintenance for Control of Materials for the Project, as applicable. The requirements established in this Specification Section shall supplement, without detriment to, the requirements and provisions stated in the following clauses of the Conditions of Contract. The requirements established in this Specification Section shall also supplement the requirements and provisions stated in the following sections of the General Specifications: Section 01000 Section 01300 General Provisions; Program of Work;

and the like regarding Control of Materials in the General and Technical Specifications, or other sections of the Contract. g) Failure of the Contractor to comply with the requirements of this Specification Section will be considered as a part of the defaults to be regulated as specified in Specification Section 01800 Contractors Quality Control, Sub-section 2.2 paras. (f) and (g).

THE SCHEDULE OF MATERIALS


a) The Schedule of Materials shall incorporate in detail all activities related to the Control of Materials to be implemented in the Project taking into account all the requirements described in the General and Technical Specifications, the schedules in the Program, the material sources/delivery to the Project, the procedures for testing and acceptance, and other aspects that the Contractor plans to introduce in the Program, or the Engineer may instruct. The general Schedule of Materials shall be submitted along with the Program, and shall be considered as one of the key schedules for the Project. Revisions during the construction period will be allowed if required by the Engineer, or if proposed by the Contractor based on the actual conditions, provided that a plan be properly prepared and submitted to the Engineer for his review and approval, at least 28 days prior to its application in the work execution. The Schedule of Materials shall include, but not be limited to, the following: the list of materials to be controlled by the Schedule of Materials; the sources (location, capacity, technical properties and characteristics, testing results, providers or suppliers references, etc.); the Contractors material inspection system (supplementing the QCP specified in Specification Section 01800 Contractors Quality Control); all the details, working drawings, etc. describing the location or item where the material is intended to be used; all the supplementary schedules required for proper monitoring (time schedule, manning schedule, testing and Quality control schedules, equipment, etc.); all activities associated with the procurement, purchase, fabrication and shipment of materials provided from local or international sources; and

others that the Engineer may require for monitoring.

SPECIAL REQUIREMENTS FOR THE CONTROL OF MATERIALS


Source of Supply and Quality Requirements The Contractor shall: perform and fulfill all the requirements and procedures for Quality control, testing and approval of materials as stipulated in the Specifications; select sources and provide acceptable materials; notify the Engineer of all proposed sources before delivery of materials to the Site, to expedite material inspection and testing; and not incorporate material requiring submittal into the work until approved. b) c) The material may be approved at the source of supply before delivery to the Project. Achieving satisfactory testing results does not constitute acceptance by the Engineer. The Engineer reserves the right to issue his acceptance based on the test results, actual conditions, and actual necessities or requirements for the Works. If an approved source does not continue to supply acceptable materials during the Projects execution, further use of that source will be denied, and the Contractor shall furnish materials from other sources. Material Sources Local Material Sources: Except for commercially operated sources, no work shall be performed within a source until the Engineer approves the Schedule of Materials which shall include a detailed plan of operations for development of the source. Contractor-located Sources: For the use of this kind of source, the Contractor shall: be fully responsible for all matters related to the source; use sources that fulfil entirely and satisfactorily the contract requirements with regard to quantity and Quality; determine the quantity and type of equipment and work necessary to select and produce acceptable materials; secure all permits and clearances for use of the source and provide copies of the documents to the Engineer;

bear all costs related thereto, including those needed for development, exploitation, erosion control, restoration, hauling and any other incidental cost; provide laboratory test reports and available historical performance data indicating that acceptable material is available from the source; not use materials from a source that is unacceptable to the Engineer; and dispose of unacceptable materials and locate other sources at his expense, and without having right to time extension to recover delays due to this matter. (3) Material Source Management

The Contractor shall: a) b) notify the Engineer, at least 28 days, before starting pit operations; develop and operate within a material source according to the plan of operation included in the accepted Schedule of Materials or Engineers written acceptance for developing the source; if any or if applicable, before developing a material source, measure the sediment content of water bodies adjacent to the work area that will receive drainage from the work area; control erosion so that the sediment levels in the water bodies within the drainage area of the work area do not increase; and control erosion so that sediment does not leave the work area. (4) a) Storage and Handling of Materials All materials shall be handled in such a manner as to preserve their Quality and fitness for the Works. Aggregates shall be transported from the storage site to the Works in tight vehicles so constructed as to prevent loss or segregation of materials after loading and measurement. The Contractor shall: store and handle materials to preserve their Quality and fitness for the Works. Upon the Engineers decision, stored material approved before storage may again be inspected before use in the Works; locate stored materials in such a way and place that prompt inspection is facilitated; place the stored materials on a hard and clean surface and, when required, place them under cover; use only approved portions of the right-of-way for storing materials and placing plant and equipment;

provide all additional space needed; not use private property for storage without written permission of the owner or lessee; furnish the Engineer with copies of all agreements for such use; restore all the provided storage sites to their original condition, after completion of the Works, in a manner acceptable to the Engineer and at no cost to the Employer; and be responsible for the security of all stored materials. (5) a) b) c) (6) a) Stockpiling Material stockpiles shall be prepared by clearing and levelling as directed by the Engineer. The centre of all aggregate stockpile areas shall be raised and sloped to the sides as required so as to provide proper drainage of excess moisture. The materials shall be stored in such a manner as to prevent segregation and to ensure proper gradation and moisture content. Use of Materials Found in the Work Materials, such as rock, stone, gravel, or sand, found in the excavation for the roadway, structures, or channel relocation may be used for another pay item when acceptable. When there is an acceptable material found in the work, which is suitable for another item, the Contractor shall prepare a plan for the use of such material and it shall be included in the Schedule for Materials herein described. If the Contractor produces or processes materials found in the Site in excess of the quantities required for the Contract, the Engineer may: Determine and direct the use of the excess material, and determine the amount of payment to the Contractor including only the cost of production; or Direct the removal of the material and restoration of the land to a satisfactory condition at no cost to the Employer. Unless otherwise specifically provided in this Contract, all items incorporated in the completed Works, such as equipment, materials and other articles shall be new and of the most suitable grade for the purpose intended. (8) Control of Materials Records and Reports

Control, Sub-section 2.5.3 Quality Controls Records and Reports, and shall be incorporated into the QC reports. (9) a) Certification of Compliance When a certification is required under the Contract and or the Specifications, a Certificate of Compliance in which the lot is clearly identified shall accompany each lot of such materials delivered to the work. (refer to definitions included in Specification Section 01850 Acceptance of Work) When sampling and testing of materials are required under the Contract, the Engineer may permit such materials to be incorporated into the work prior to sampling and testing, provided that they are accompanied by the Certificate of Compliance stating that the materials fully comply with the requirements of the Contract. Certificates initiated by the manufacturer and, when required, supported by tests performed by the manufacturer shall accompany commercially manufactured materials. Copies of such test results shall be furnished to the Engineer. A Production Certificate shall be provided for each material to be transported to the Site and shall identify the date and place of manufacture, as well as the lot number or other means of cross referencing in the inspection and testing system. The Contractor shall furnish specific test results on materials from the same lot upon request by the Engineer.

2.5 2.5.1

ACCEPTANCE AND NOTIFICATION OF NON-COMPLIANCE ACCEPTANCE


a) The results obtained by the application of the system established in this Specification Section for the Control of Materials shall be evaluated under the Specification Section 01850 Acceptance of Work based on the criteria for acceptance established for the Project. If the Engineer determines that the Control of Materials implemented by the Contractor in executing the Works is ineffective or contains defects, the Contractor shall make immediate improvements to correct these inadequacies.

2.5.2

NOTIFICATION OF NON-COMPLIANCE
The notification of non-compliance with the requirements for Control of Materials herein specified shall be made in accordance with the procedure established in Specification Section 01800 Contractors Quality Control, Sub-section 2.6.2 Notification of Non-Compliance.

2.5.3

CERTIFICATE OF SATISFACTORY CONTROL OF MATERIALS


This certificate will be issued by the Engineer, on a monthly basis, upon due compliance by the Contractor with the following conditions: a) No failures in complying with the requirements for this Specification Section have been reported by the Engineer, and the Schedule of Materials has been properly implemented to the Engineers satisfaction; and The Control of Materials Records and Reports, including the Monthly Summary have been timely submitted to the Engineer.

b)

This certificate constitutes the fundamental condition for payment of the work specified in Clause 7Plant, Materials and Workmanship, Clause 8 Commencement, Delays and Suspension, Clause 12 Measurement and Evaluation, Clause 14 Contract Price and Payment of the Conditions of Contract. Therefore, the payment procedure, for the Works or any part thereof, will not be continued if the Certificate of Satisfactory Control of Materials is not obtained by the Engineer.

3.

MEASUREMENT AND PAYMENT


All the costs related to the Control of Materials shall neither be measured nor paid separately. All the Contractors unit prices shall include the cost associated with the Control of Materials. No payment will be made in this regard and no claims will be permitted in connection with any such cost or costs.
