Violago, and Sigfrido R. Tinga. THE PRIVILEGE HOUR It being a Monday, on motion of Rep. Ortega (F.), there being no objection, the Body proceeded to the Privilege Hour and the Chair recognized Rep. Ma. Georgina P. De Venecia from the Fourth District of Pangasinan for her speech. PRIVILEGE SPEECH OF REP. DE VENECIA Rep. De Venecia raised the issue of breast cancer in view of the worldwide celebration of Breast Cancer Awareness Month. Initially, she cited statistics on increasing breast cancer cases and enumerated World Health Organization (WHO) detection recommendations such as selfbreast examination and mammography. Subsequently, Rep. De Venecia discussed the physical and financial difficulties suffered by breast cancer patients. Even as she mentioned the pilot program of the Department of Health (DOH) on providing medicine for early-stage breast cancer as well as House legislators breast cancer awareness and prevention program, she then asked the Department to provide cheaper medicines and conduct more information campaigns. She also urged the Body to push for the adoption of a national health agenda for breast cancer and the expansion of said DOH program.

REFERRAL OF REP. DE VENECIAS PRIVILEGE SPEECH On motion of Rep. Ortega (F.), there being no objection, the Body referred Rep. De Venecias speech to the appropriate Committee. PRIVILEGE SPEECH OF REP. TINGA On motion of Rep. Ortega (F.), the Chair next recognized Rep. Tinga who cited incidents in Taguig City where the local government blocked the implementation of infrastructure projects of the national government as well as of private individuals. He stressed that he supported the devolution of local governments but that a checkand-balance system must be in place to ensure responsible governance. At this point, Speaker Belmonte relinquished the Chair to Deputy Speaker Maria Isabelle Beng G. Climaco. REFERRAL OF REP. TINGAS PRIVILEGE SPEECH On motion of Rep. APPROVAL ON SECOND READING OF CERTAIN HOUSE BILLS AND HOUSE JOINT RESOLUTION On successive motions of Rep. Ortega (F.), there being no objection, the Body considered the following House Bills and House Joint Resolution under the Business for the Day, as contained in various Committee Reports submitted by the Committees concerned; dispensed with the reading of the texts thereof without prejudice to their insertion into the Record of the House; adopted the Explanatory Notes thereof as the sponsorship remarks on the measures; terminated the period of sponsorship and debate thereon; terminated the period of amendments thereon in the absence of Committee and individual amendments; and approved the same on Second Reading: 1. RESUMPTION OF THE PRIVILEGE HOUR On motion of Rep. Ortega (F.), there being no objection, the Body resumed the Privilege Hour and the Chair then recognized Rep. Walden F. Bello from Party-List Akbayan for his privilege speech. PRIVILEGE SPEECH OF REP. BELLO Rep. Bello initially expressed his gratitude to Reps. Elmer E. Panotes, Rafael V. Mariano, Anthony G. Del Rosario, and Agapito H. Guanlao for yielding their allotted time to him so he could deliver his privilege speech regarding the plight of the Philippine Airlines Employees Association (PALEA) whose several members were present in the Session Hall that day. In his speech, Rep. Bello pointed out the PAL managements contravention of its agreement with the PALEA by proceeding with its outsourcing plan even before the September 30, 2011 deadline thereby resulting in the early termination of PALEA workers. He asked the Members to look into, among others, the plight of the PALEA workers and determine the responsibility and accountability of the PAL management over the events which led to the September 27 protest action of PALEA members, the justification behind PALs spin-off plan allegedly due to financial losses, the risk to the physical safety of PAL passengers by managements hiring of unqualified workers, and the adverse effects on the economy of PALs practice of labor contractualization. In closing, Rep. Bello expressed his appeal to the Body to initiate a congressional inquiry into the PAL managements wanton disregard for workers rights, its hiring of unqualified workers to perform tasks that require a certain level of knowledge and competency thereby compromising the physical safety of the passengers of PAL as well as the airlines overall operations, and the complicity of the police and private security forces in the dispersal of PAL workers.

INTERPELLATION OF REP. ROMUALDO Recognized by the Chair, Rep. Pedro P. Romualdo expressed his initial reservation that any interpellation pertaining to the legality of certain issues raised by Rep. Bello in his speech would be a violation of the sub judice rule. Rep. Bello however explained that what he had emphasized in his speech was the labor contractualization being practiced by the PAL management to the prejudice of the PALEA members. He also agreed with Rep. Romualdos observation that in accordance with the right to due process and pending the resolution of the cases filed by PALEA in the courts, the PAL management should in the meantime retain the services of PALEA members. INTERPELLATION OF REP. REMULLA Upon recognition by the Chair, Deputy Speaker Jesus Crispin C. Remulla discussed with Rep. Bello several issues hounding PAL which included, among others, the reduction of PAL flights, the protest action called by the PALEA, the illegal lock-out of PALEA members, the contradictory statements of PAL officials regarding the financial crisis besetting PAL and the companys purchase of new aircrafts, and the governments adoption of an open skies policy. Rep. Remulla joined Rep. Bello in denouncing the actions of the PAL management and likewise joined the latter in any action that he would undertake within the confines of the House. MOTION OF REP. APOSTOL Upon recognition by the Chair, Rep. Sergio F. Apostol moved for the adjournment of the session. Cagas took to task certain airline companies for their failure to deliver prompt and reliable services to airline passengers, which he deemed to be a violation of their legislative franchises to operate in

He then informed the Body about his personal experiences with these airlines to emphasize the plight of airline passengers whose flights sometimes get delayed or cancelled without sufficient advisories or notices from the airline companies. He likewise underscored the standard reply of these airlines to these inconveniences and claimed that the affected passengers deserve better services than the token sorry for the inconvenience excuses. Thereupon, Rep. Cagas urged Congress to review the legislated certificates of public convenience and franchises of airline companies and to look into the possibility of lifting airline cabotage laws to promote competition in the airline industry. REMARKS OF REP. ESCUDERO Upon recognition by the Chair, Rep. Salvador H. Escudero III shared the concerns aired by Rep. Cagas and stressed that the airline companies need a lot of improvements. He then relayed the experience of the members of the Committee on Basic Education who conducted a public hearing in Zamboanga City the previous Thursday but whose scheduled Philippine Airlines (PAL) flight back to Manila was cancelled on short notice. He however thanked Air Philippines for accommodating the passengers of PAL and Cebu Pacific. REMARKS OF REP. CAGAS At this point, Rep. Cagas relayed the information of Rep. Carol Jayne B. Lopez that eight Members had authored a resolution calling for an investigation of the airline companies. He then appealed to the House leadership to hasten the action on said measure. Guanlao delved on the sad state of Philippine agriculture and the governments seeming helplessness to respond effectively to the devastation brought by natural calamities as experienced by the country recently with Typhoons Pedring and Quiel

TUESDAY, OCTOBER 4, 2011 which was similar to the destruction caused by Typhoon Ondoy two years ago. He voiced the following concerns whenever the country is hit by natural calamities especially typhoons: 1) the damages caused to the country specifically to the agriculture and fisheries sectors; 2) the proper protocol to be followed when releasing water from dams; and 3) the absence of adequate means to protect the farmers against calamities. Thereupon, Rep. Guanlao recommended, among others, that the Department of Agriculture (DA) restock and redistribute certified seeds and other agricultural inputs to farmers affected by floods and immediately release funds to affected farmers and fisherfolk for production assistance; that the National Food Authority (NFA) procure wet palay from small farmers to help them recover part of their lost incomes; and that the President immediately issue a moratorium on the conversion of agricultural lands. In closing, he stressed the need for leaders to point the way forward and to assure the people that the government will help them. REMARKS OF REP. ESCUDERO Upon recognition by the Chair, Rep. Escudero pointed out that President Benigno S. Aquino III had already ordered the NFA to buy wet palay. He emphasized that the Department of Budget and Management (DBM) must immediately release the budget of the DA which will be used to help the devastated farmers. REMARKS OF REP. GUANLAO Agreeing with Rep. Escudero, Rep. Guanlao said that palay stocks will rot if the NFA has no funds to buy them. REFERRAL OF REP. GUANLAOS SPEECH On motion of Rep. 31 who spoke in Filipino about the 15-year old struggle of farmers in Hacienda Looc in Nasugbu, Batangas against land grabbing, land conversion, and environmental destruction -- all for the sake of eco-tourism. He pointed out that the hacienda was strategically located, had a huge business potential, and was blessed with rich resources. He traced how agrarian reform beneficiaries lost emancipation patents, certificates of land ownership award and certificates of land transfer when the government illegally and anomalously sold the hacienda including those portions covered by land reform under Presidential Decree No. 27 and the Comprehensive Agrarian Reform Program. He then described how real estate firms such as SM Land, Inc. deceived residents and farmers to give up their lands in return for development and modernization, or harassed and violently ejected them with the help of military and police forces. Subsequently, Rep. Mariano stressed that the farmers of Hacienda Looc would not give up their rights despite a President who was himself a hacendero and whose policies, the former alleged, were more protourism and probusiness than profarmer. Tinio spoke in observance of World Teachers Day on the plight of public school teachers specifically with regard to their appeal for an increase in their salary or the socalled chalk allowance, their security of tenure and just working conditions, the regularization of volunteer and contractual teachers, the increase in classrooms and other school facilities, and the prescription of the policy of precarious employment in the education sector.

32 As President Aquino had shown appreciation for the efforts of public school teachers and considering that government employees would soon receive the final installment of the salary increases provided for by the Salary Standardization Law (SSL) III, Rep. Tinio called on the Members to begin to study and deliberate on the new round of salary increases for government employees starting in 2013 to give honor and what is due to public school teachers. After informing his colleagues about his personal battle with cancer, Rep. Del Rosario spoke on the issue of health and well-being of the people which he deemed as the most important aspect of human development. He gave an overview of cancer incidents and other deadly diseases in the Philippines, lamented the pitiful state of the countrys public health care system due to inadequate public health personnel and government budget, and expressed support to governments initiatives, such as expanding the coverage and enhancement of benefit delivery of PhilHealth, improving access to upgraded, quality hospitals and health care facilities through the Health Facility Enhancement Program (HFEP) and attaining health-related Millennium Development Goals (MDGs). Rep. Del Rosario then sought the support of his colleagues to create more significant laws and initiate programs that are beneficial to the health and wellbeing of the people and underscored that health should be their main concern as it is a good investment for nation-building. TUESDAY, OCTOBER 4, 2011 District of Bukidnon informed the Body about a serious electric power problem in Mindanao if the Department of Energy (DOE) would not immediately implement under its National Renewable Energy Program the construction of an initial capacity of 235 megawatts of solar photovoltaic power plants by 2015. He thereafter enumerated several courses of action for the pertinent government agencies to address the development of renewable energy in the country including, among others: 1) the allocation by the DOE of 100 MW to be generated from solar photovoltaic power plants; 2) the immediate resolution and decision by the ERC on hearings regarding feed-in tariff petition before the end of 2011; and 3) the conduct of a congressional inquiry on the reasons why the DOE had reduced to only 50 MW the required initial generation output from solar photovoltaic power plants. He also informed the Body that he had filed House Resolution No. 1758 to address several of these recommendations and another resolution to specifically inquire into the tepid support of the DOE to the National Renewable Energy Program. REMARKS OF REP. GOLEZ (R.) Whereupon, Rep. Roilo S. Golez sought the permission of the Chair to interpellate Rep. Flores. EXTENSION OF REP. FLORES TIME Thereupon, on motion of Rep. Gunigundo, there being no objection, the Body extended the time of Rep. Flores for 10 minutes. INTERPELLATION OF REP. GOLEZ (R.) Rep. Golez initially commended Rep. Flores for his speech regarding the important issue of renewable energy. Both Members thereafter exchanged views regarding the failure of the ERC to render its decision on the petition for feed-in tariff which the former considered as a necessary component to subsidize the initial and temporary high cost of renewable energy. They agreed that the DOE should be made to answer for its alleged inaction and lack of support to the Renewable Energy Act although Rep. Golez expressed hope that Secretary Jose Rene Almendras would be able to steer the DOE towards the direction of harnessing renewable energy. Rep. Flores stated that he had already filed a Resolution calling for a congressional inquiry into the action or inaction of the Department with regard to the implementation of the National Renewable Energy Program.

TUESDAY, OCTOBER 4, 2011 In ending, Rep. Golez stated that if the House is indeed supportive of solar energy, he proposed that the Members consider the premises of the House of Representatives as a possible site for the construction of a solar power laboratory. EXTENSION OF REP. FLORES TIME On motion of Rep. Gunigundo, there being no objection, the Body extended the time of Rep. Flores for another 10 minutes. INTERPELLATION OF REP. RODRIGUEZ (R.) Upon recognition by the Chair, Rep. Rufus B. Rodriguez underscored his concern with regard to Mindanaos energy reserve for the next two years and why the DOE insisted on allowing only a reserve of 50 MW for the entire country when there were many corporations that have applied to produce 170 MW of renewable energy. He also asked why the National Renewable Energy Board had recommended to limit the number of applicants who intend to produce renewable energy, which he said was in contravention of the Renewable Energy Law enacted by Congress. On further questioning, Rep. Flores mentioned the Resolution he had filed calling for a congressional inquiry into the status of the National Renewable Energy Program and the matter of the solar energy cap. He said that consumers and businessmen from Mindanao are united in their stand in support of solar energy. Thereafter, in view of the urgency to implement the Renewable Energy Law, Rep. Rodriguez urged the Body to immediately discuss the matter and

33 thereafter, joined Rep. Flores in his quest for the immediate implementation of said law and the construction of solar energy systems in Mindanao. EXTENSION OF REP. FLORES TIME On motion of Rep. Defensor, there being no objection, the Body extended Rep. Flores time by another 10 minutes to accommodate the interpellation of Rep. Pedro P. Romualdo who was subsequently recognized by the Chair. 38 QUESTION OF PRIVILEGE OF REP. BATAOIL Rep. Bataoil condemned the continuing attacks by the New Peoples Army (NPA) against business establishments, public facilities, military and police personnel, foreigners and ordinary citizens despite its ongoing peace negotiation with the national government. He cited in particular the recent burning in Tarlac province of 12 buses and a truck owned by Victory Liner, Inc., and which according to the town mayor was the fourth attack perpetuated by members of the NPA against the company. He also mentioned the previous days headline of the Philippine Daily Inquirer on the three mines hit by NPA guerillas in Claver, Surigao del Norte where three security guards were killed, and enumerated other NPA atrocities in areas like Tagum, Surigao, Masbate, Catanduanes, Compostela Valley and Quezon. As he disclosed that the Provincial Bus Operators Association of the Philippines, as well as Malacaang, have condemned the burning of buses and the NPAs acts of violence, he asked his colleagues to study the countrys policies and directives regarding the matter and to refer the same to the appropriate Committee for its immediate action. REFERRAL OF REP. BATAOILS SPEECH On motion of Rep. Gunigundo, there being no objection, the Body referred Rep. Bataoils speech to the appropriate Committee. ACKNOWLEDGMENT OF GUESTS At this point, Rep. Gunigundo acknowledged the presence in the Session Hall of guests of Reps. Danilo Ramon S. Fernandez and Tomas V. Apacible. Thereafter, on motion of Rep. QUESTION OF PRIVILEGE OF REP. PANGANDAMAN (M.) Rep. Pangandaman focused on the Mindanao power crisis that was addressed by former Energy Secretary Angelo Reyes through the procurement of oil-fed generators which, he claimed, was only a temporary solution. He stressed that the root of the crisis could be attributed to the more serious environmental problem of the diminishing water inflow to Lake Lanao due to the destruction of its watershed compounded by the impact of climate change. He thereafter informed his colleagues about the importance of Lake Lanao to national development and the

WEDNESDAY, OCTOBER 5, 2011 various laws which were enacted to manage and protect the lake but which the mandated agencies had neglected to enforce effectively to prevent the environmental degradation of Lake Lanao and to address the socio-economic rehabilitation of the people and communities affected by the impact of damming the Lake. He thereafter proposed the enactment of a law creating the Ranao Development Authority (RDA) which would require no additional government expenses but only the realignment of the resources already provided for under the Local Government Code of 1991 and the Electric Power Industry Reform Act. REFERRAL OF REP. PANGANDAMANS (M.) SPEECH On motion of Rep. Gunigundo, there being no objection, the Body referred the speech of Rep. Pangandaman (M.) to the appropriate Committee. ACKNOWLEDGMENT OF GUESTS Rep. Gunigundo thereafter acknowledged the presence in the Session Hall of guests of Reps. Hermilando I. Mandanas and Ma. Amelita A. CalimbasVillarosa. QUESTION OF PRIVILEGE OF REP. BAGATSING Recognized by the Chair on motion of Rep. Gunigundo, Rep. Amado S. Bagatsing from the Fifth District of Manila informed the Body about a scam allegedly perpetuated by some personnel of the accounting and pharmacy departments of the Philippine General Hospital (PGH) who had misused his Priority Development Assistance Fund (PDAF) which he has been allocating to the PGH to meet the health and medical needs of indigent patients from his district. He called for a congressional investigation on said anomaly and proposed that PGH Director Dr. Jose Gonzales and his cohorts be meted a temporary preventive suspension order. Whereupon, Rep. Bagatsing advised his colleagues to check on their respective PDAF allocations in the different public hospitals to determine any anomaly in the use of these funds. He thereafter proposed to have his speech referred to the Committee on Good Government for the immediate investigation of the alleged PDAF scam in the PGH. EXTENSION OF TIME OF REP. BAGATSING On motion of Rep. Gunigundo, there being no objection, the Body approved to extend the time of Rep. Bagatsing for 10 minutes.

WEDNESDAY, OCTOBER 5, 2011 MANIFESTATION OF REP. ROMUALDO Recognized by the Chair, Rep. Pedro P. Romualdo manifested his intent to extend the time of Rep. Bagatsing for another five minutes. The Chair however remarked that the time of Rep. Bagatsing was already extended for 10 minutes and any further extension later would be acted upon accordingly by the Body. Thereafter, the Chair recognized Rep. Orlando B. Fua for his interpellation. REP. FUAS AMENDMENT TO REP. BAGATSINGS MOTION With regard to the previous motion of Rep. Bagatsing to have his speech immediately acted upon by the Committee on Good Government, Rep. Fua proposed to amend said motion for the Body to adopt instead a Resolution recommending that the President himself suspend the aforementioned PGH director, including the hospitals chief accountant, disbursement officer, and treasurer. Romualdos amendment to his motion and said that despite information reaching him that the PGH director had agreed to honor all his guarantee letters, he had to take a stand against the anomaly because it might be replicated in other public hospitals which are recipients of PDAF allocations from Members of Congress. SECONDING MOTION OF REP. CRISOLOGO Whereupon, Rep. Vincent P. Crisologo seconded the motion of Rep. Bagatsing, as amended by Rep. Fua. REMARKS OF THE CHAIR The Chair informed the Body that it will have to take action on the pending motion after all the interpellations on the speech of Rep. Bagatsing had been completed. MANIFESTATION OF REP. CRISOLOGO Whereupon, Rep. Crisologo manifested his desire to interpellate Rep. Bagatsing but the Chair informed the former that he would be recognized after the turn of Rep. He informed the Body that he had been forewarned by the officials of the PGH regarding the shenanigans involved in the use of congressional funds for medical assistance and that he should exercise caution in the issuance of guarantee letters by observing safeguards thereon. The Chair noted the manifestation of Rep. Kho. INTERPELLATION OF REP. CRISOLOGO Upon recognition by the Chair, Rep. Crisologo informed the Body of his own personal experience regarding the anomalous use of his PDAF allocation in the PGH. He thereafter agreed with the motion of Rep. Bagatsing that an investigation be conducted by the House on the PDAF anomaly in the PGH and the immediate suspension of the aforementioned PGH director. MANIFESTATION OF REP. PADILLA Recognized by the Chair, Rep. Carlos M. Padilla expressed his concurrence with the motion of Rep. Bagatsing. The Chair noted the manifestation. INTERPELLATION OF REP. TUGNA Upon recognition by the Chair, Rep. Sherwin N. Tugna discussed with Rep. Bagatsing the system of checks and balances instituted by the PGH regarding the disbursement of PDAF funds, with the latter mentioning the safeguards provided for under the Memorandum of Agreement (MOA) that he entered into together with the PGH. Rep. Tugna underscored that inasmuch as the required checks and balances had not been observed with regard to the use of Rep. Bagatsings guarantee letters and PDAF allocations in the PGH, he encouraged Congress to provide the appropriate safeguards in the disbursement of PDAF funds as well as to allocate funds that would take the place of the three percent administrative fee usually charged by public hospitals against PDAF allocations. MANIFESTATION OF REP. ESCUDERO Upon recognition by the Chair, Rep. Salvador H. Escudero III pointed out that because of the seriousness of the allegations of Rep. Bagatsing, he suggested that the Committee on Good Government expedite its hearings on the issues raised by Rep. Bagatsing to be able to arrive at a decision before the

BIAZON Upon recognition by the Chair, Rep. Rodolfo G. Biazon aired his concern on the possibility of amending the Constitution specifically on the economic provisions. He asked that the leadership inform the Members if there was a serious move by both Houses of Congress so they would know how to reply to their constituents if they were questioned about Charter change. In reply to Rep. Biazons concerns and to put the subject matter in its correct perspective, Rep. Gonzales (N.) informed the Members that the Speaker of the House thought it wise to have a legislative summit between the House of Representatives and the Senate to come up with a common legislative agenda that could possibly expedite the approval of priority measures. Rep. Gonzales (N.) pointed out that during the First Legislative Summit, both Houses of Congress had arrived at a common legislative agenda including those which have already been identified as priority by the Legislative-Executive Development Advisory Council (LEDAC), and that during said summit, no

MOTION TO REFER THE SPEECH OF REP. BAGATSING Thereupon, Rep. Gunigundo moved to refer the speech of Rep. Bagatsing and the interpellations and manifestations thereon to the Committee on Rules. REMARKS OF THE CHAIR Whereupon, the Chair directed the chairperson of the Committee on Rules to immediately act on the matter, specifically on the amendment of Rep. Fua to the motion of Rep. Bagatsing, and which motion had been duly seconded; and likewise, on the motion of Rep. Escudero. He maintained that the Body has to act on all these matters before the House goes on recess. PARLIAMENTARY INQUIRY OF REP. BAGATSING Upon recognition by the Chair, Rep. Bagatsing inquired whether the Body had approved the amendment of Rep. Fua to his motion regarding the filing of a Resolution recommending to the President the temporary suspension of the director of the PGH and his accomplices pending investigation of the anomaly. MANIFESTATION OF REP. ESCUDERO Upon recognition by the Chair, Rep. Escudero manifested that there was no need to bother President Aquino regarding the particular matter considering that the President of the University of the Philippines (UP) System can so order the preventive suspension of the aforementioned PGH director. REMARKS OF THE CHAIR The Chair concurred with the statement of Rep. Escudero and enjoined the Members of the Committee on Rules to act on the matter with dispatch inasmuch as most of the Members have PDAF funds allocated to the PGH for the medical needs of their constituents.

WEDNESDAY, OCTOBER 5, 2011 question on the issue of Charter change was included so as not to cloud whatever achievement the legislative summit would attain. Rep. Gonzales also maintained that no concrete agreement was reached, even during an informal discussion, as to when an actual process to amend the Constitution would be started. He added that those who were present in the summit agreed that any proposed Charter change would only be for the purpose of amending the economic provisions of the Constitution. MOTION OF REP. GUNIGUNDO Rep. Gunigundo moved to call the Roll, however, before the Body could act on the motion, the Chair recognized Rep. Sergio F. Apostol for a parliamentary inquiry. PARLIAMENTARY INQUIRY OF REP. APOSTOL On Rep. Apostols inquiry, Rep. Gonzales (N.) elaborated that discussing House Bill No. 4244 on the floor was proof that the same had been reported out by the Committee on Rules. With regard to the measure containing several subject matters and alluding that there might be a violation of the Constitution, Rep. Gonzales reminded the former that there was no violation of the Constitution yet since they were still in the process of debating on the measure after which they would be in the process of amending the same. If a violation of the Constitution was committed that a bill should only contain one subject matter in the title thereof, Rep. Gonzales said that this could be corrected during the period of amendments by amending the title of the bill. On whether the draft of House Bill No. 4244 which had been distributed the previous day was sanctioned by the Committee on Rules, Rep. Gonzales stated that said draft was merely a correspondence requested by a Member of the House to be distributed to each Member in plenary and that it remains to be a correspondence and not a bill until such time that the Members would act on it. Binay, there being no objection, the Body resumed consideration on Second Reading of House Bill No. 4244, as contained in Committee Report No. 664 and reported out by the Committee on Population and Family Relations. Upon direction of the Chair, the Secretary General read the title of the Bill, to wit: AN ACT PROVIDING FOR A COMPREHENSIVE POLICY ON RESPONSIBLE PARENTHOOD, REPRODUCTIVE HEALTH, AND POPULATION AND DEVELOPMENT, AND FOR OTHER PURPOSES. Upon Rep. Binays motion, the Chair recognized Reps. Walden F. Bello and Victorino Dennis M. Socrates for sponsorship and interpellation, respectively. INTERPELLATION OF REP. SOCRATES Rep. Socrates asked why the measure contained more than one subject matter which was unconstitutional and sought clarification on its provision against discrimination based on sexual orientation. Rep. Bello stressed that responsible parenthood, reproductive health and population and development were integrally related and were three aspects of one topic. Even as he opined that the term sexual orientation referred to male or female gender, he said that the Committee already accepted the Presidents proposal to remove it from the original version of the Bill. Rep. Socrates opined that House Bill No. 4244 was an immoral measure that cleverly intended to create a contraceptive mentality of needing and buying contraceptives promoted and provided by the government. He said that the experience of other

43 countries showed that the use of contraceptives weakened the family, increased divorce, and adversely affected demography. He also questioned the validity of surveys which allegedly showed that the majority of Filipinos felt that family planning was a private choice and wanted the government to provide them with more access to and information on legal methods. Deputy Speaker Remulla relinquished the Chair to Rep. Rodolfo C. Farias. The Sponsor said that the Bill was not dictatorial but promoted and institutionalized the freedom of informed choice as well as implemented the constitutional mandate to protect and promote the family, women, and children. Promising to provide data such as the methods and statistics used by the surveyors, he opined that nations have declined not because of the so-called demographic winter but because of the failure of economics and politics. Subsequently, Reps. Socrates and Bello discussed the effect of an ageing population and high fertility rates on the economy of a nation. Although the former then held that the Bill was a population control measure, the latter clarified that its focus was reproductive health and responsible parenthood through informed choice and its effect on population was merely incidental. At this point, Rep. Farias relinquished the Chair to Deputy Speaker Remulla. PARLIAMENTARY INQUIRY OF REP. PADILLA Recognized by the Chair, Rep. Padilla inquired whether Rep. Socrates interpellation was subject to the one-hour rule. After the Chair replied that such was the general practice and tradition since 2004, he cited the agreement that the Chamber would allow only one interpellator on the RH Bill on that day. He added that contrary to Rep. Socrates insinuation that it had a hidden agenda, it was not antipopulation and its proponents were not trying to replicate Chinas population policy. Explaining the carrying capacity of a country, he then opined that population had a negative impact on economy, environment, and peace and order. REQUEST OF REP. SOCRATES To the request of Rep. He stressed that malversation of public funds and plunder, which his colleague pointed out were not covered by said conventions and were already subject to the provisions of the Revised Penal Code, were included in the

The two Members proceeded to discuss the Bills coverage of human trafficking and environmental violations as predicate crimes of money laundering; the wording of the definition of money laundering in Section 3; the implementation of resolutions of the United Nations and the UN Security Council and ex parte freezing of assets in Section 4; the determination of probable cause, disposition of forfeited assets, retention from the net proceeds, and sanctions and penalties in Section 8. Rep. Apostol committed to consider Rep. Lagmans amendments in this regard. TERMINATION OF THE PERIOD OF SPONSORSHIP AND DEBATE There being no other interpellations, on motion of Rep. Binay, there being no objection, the Body terminated the period of sponsorship and debate on House Bill No. 4275 and proceeded to the period of amendments. REQUEST OF REP. LAGMAN Rep. Lagman requested time to prepare his amendments after the consideration of the Committee amendments.
