AFFIDAVIT OF LOSS
I, ERNESTO C. BATERBONIA, Filipino, of legal age and a resident of the City of Koronadal, South Cotabato, after having been duly sworn to in accordance with law, hereby depose and say; 1. That I am one of the accused in Crim. Cases Nos. 3719-25 & 3740-25 both entitled People of the Philippines vs. Abdulfarid R. Maglangit, Alfredo C. Mapanao, Inocente R. Carcel and Ernesto C. Baterbonia (for: Violation of Sec. 3 (e) of R.A. 3019 and Violation of Sec. 3 (g) of R.A. 3019, respectively). In an Order dated 25 April 2011, the said cases were dismissed by the Regional Trial Court Branch 25, Koronadal City, South Cotabato; I acted as my own bondsman in the subject cases by posting the cash bond in the amount of P11,200.00 under Official Receipt No. 4960795 dated February 22, 1996 and which fact is duly noted by the Court in its Order of 25 April 2011. Due to the passage of time since I posted the said cash bond, I could no longer remember if where did I keep the Official Receipt for the said cash bond. Despite earnest efforts on my part to locate or retrieve the said Official Receipt I still failed to find the same. Official Receipt No. 4960795 dated February 22, 1996 should therefore be considered lost for all intents and purposes. That I am executing this affidavit to attest to the truth of the above facts and circumstances and for whatever legal purpose it may serve best.

Malaya, Banga, South Cotabato, after having been duly sworn to in accordance with law, hereby depose and say; That I am holder of a Check issued by PCI Bank (Koronadal Branch), City of Koronadal, South Cotabato with Check No. 0000595664 dated November 2, 2008; That the said Check issued to me was lost and could no longer be found, despite due and deligent search made and undertaken, hence the same is already beyond recovery; That I am executing this affidavit to attest to the truth of the above facts and circumstances and for whatever legal purpose it may serve best.
