Chief Justice Michael Bender, Ex Officio Chair Supreme Court Nominating Commission 101 West Colfax Avenue, Suite 800 Denver, CO 80202 Dear Members of the Nominating Commission: 1 write this letter to highly recommend Frederick T. Martinez for the appointment of Justice of the Colorado Supreme Court. After having worked with Mr. Martinez for nearly 18 years, 1 firmly believe that he possesses the unique qualities and intellect that an individual deserving of such an honorable appointment must have. Mr. Martinez is an individual of the highest integrity. What makes Mr. Martinez different than most candidates is his legal experience. In fact, Mr. Martinez's legal experience is somewhat rare in today's legal profession. Most lawyers specialize in either Criminal Law or Civil Law and to find someone with experience in both Criminal and Civil, along with his experience as Regulation Counsel, makes him an ideal candidate for the Colorado Supreme Court. Some may argue that Mr. Martinez has no experience as a Judge, however, that fact actually makes him a better candidate. What Mr. Martinez brings to the table is actual trial experience. The practice of law has evolved over the past 24 years and Mr. Martinez knows exactly what today's litigation process is all about. Not only does Mr. Martinez conduct his own legal research, he writes his own Motions and Briefs. Mr. Martinez prepares Jury Instructions which are often times issues on appeal. When his cases go up on appeal, Mr. Martinez does the briefing and the oral arguments. Mr. Martinez honed his writing skills at Colorado College and the University of Colorado, School of Law. Mr. Martinez did not come from a privileged background. Instead, he has succeeded based on his intellect and hard work. In terms of his work ethic, you won't find any other candidate who works harder than Mr. Martinez. When he is not working, he is spending time with his wife of 25 years and his two children. Mr. Martinez believes in our legal system. Part of his professional life has been spent serving the public sector as a Public Defender. Part of his professional life has been spent prosecuting attorneys who violated their ethical obligations. Part of his professional life has been spent representing businesses, not only in Colorado but also in Nebraska and Wyoming where he holds law licenses.

Throughout the course of his career, Mr. Martinez has learned how to communicate with people from every social strata. One of Mr. Martinez's attributes is the ability to listen. One of the attributes I like best about Mr. Martinez is his calm and courteous demeanor. You won't hear him interrupt the speaker and you won't hear him be disrespectful in Court. In short, he already has the Judicial Demeanor one would expect from a Justice of the Colorado Supreme Court. Having tried cases with Mr. Martinez, it is clear that he has respect of the District Judges. Upon the completion of any case, Mr. Martinez immediately shakes the hand of his opponents, win or lose. Without question, he is a gentleman who takes his job seriously, whether he is representing a District AttornllY before the Ethics Committee, or representing an indigent person in need of legal services, or representing businesses. At Hall & Evans, L.L.C., Mr. Martinez has earned the respect of his partners. Not only does he help train the young lawyers, he chaired the Firm's pro-bono committee. If you are looking for someone who is politically connected, Mr. Martinez is not the right candidate. I have never seen Mr. Martinez base any decision on politics or what is politically correct. Rather, he appears to carefully analyze the issue and render his decisions based upon reason and logic. If you are looking for someone to research the law, analyze the issue, and arrive at a fair and impartial decision, then Mr. Martinez is the right person for the job.
