PROGRAM RESPONSIBILITY
Development Testing When a fabric or garment is in the development stage, and the item is requested by a designer, Product Manager or Merchandise Manager, Warnaco will be responsible for all testing charges. But the vendor has to pay for all testing charges first, if the product is not adopted, Warnaco will pay back the vendor the development testing charges. Production Testing It is the responsibility of the vendors who supply development and bulk production fabrics and garments to Warnaco, Inc. to pay for all testing charges, including the cost of destroying the fabrics and garments during evaluation. Invoices will be sent directly to the vendors from Bureau Veritas laboratories. The current testing price list can be found on the related performance specifications.
TESTING PROCEDURES
I. WARNACOS RESPONSIBILITY Warnaco will provide the vendor with a copy of the Warnaco Quality Assurance Softlines Program Manual, sample submission requirements and performance standards. When a product fails testing, Warnaco will discuss the situation with the Quality Department, Division Merchandise Manager and the vendor, when necessary, to remedy the deficiency, to determine the disposition as to retest or cancellation of the order. II. VENDORS RESPONSIBILITY Vendors to Warnaco are responsible for all fabric and garment testing of development and bulk production merchandise. Vendors must guarantee that all fabrics and garments pass all tests before production begins and the final product is shipped. The best timing for fabric testing is upon the initial run of production. The best timing for garment testing is upon receipt of our order with the correct samples. It is vendors responsibility to ensure that all the necessary tests are done to meet Warnacos requirements. All tests will be paid by the vendor.

Sample submission to the laboratory: Fabric Testing: For initial testing, a minimum of four (4) square yards must be submitted for full testing in one (1) colorway along with a minimum of two (2) square yard of fabric in each additional colorway. Fabric must be identical in every aspect to bulk production piece goods including color and prints.
Garment Testing: Send three (3) garments in each style with one colorway for complete garment testing. No additional color testing required in garment stage. Production garments must be made on production machinery and must represent bulk production. If additional garments/fabrics are required, the laboratory will immediately contact the vendor.
A completed Warnaco Test Request Form must be submitted with each fabric/garment submission. The laboratory will not accept a sample if the form is incomplete. (See enclosed Test Request Form). Garments must include all trim, accessories and embellishments.
The following outlines the number of samples required of trims, hardware, etc.:
Note: VISUALLY UNSATISFACTORY SAMPLES (stains, tears and missing pieces) WILL NOT BE ACCEPTED FOR TESTING!
Garment Retests: All retests are the vendors responsibility. Note: On production retests, the previous test report number must be referenced on the Test Request Form. If a previous report number is not referenced, the full fabric and garment tests may be performed on the submission. All retest fees are the vendors responsibility.
Ongoing Programs: Products that are purchased on an ongoing basis must be tested in accordance with the appropriate packages at least once every 6 months, or when changes have been made in production.

The approved laboratory will make every effort to complete the requested tests as quickly as possible. There are several levels of service available: Regular Service: 5 business days beginning the day after the laboratory receives the sample(s). The regular fee applies. Priority Service: 3 business days beginning the day after the laboratory receives the sample(s). A 40% surcharge applies. Express Service: 2 business days beginning the days after the laboratory receives the sample(s). A 100% surcharge applies. This service cannot perform complete testing.
For testing requested under the Priority and Express sections, only those tests should be requested that can be completed within the specified time frame. These options should limited in scope and should only be used when absolutely necessary to reduce turn-around time. Note: If the service time will exceed the specified time frame because of the tests required, the laboratory will notify the requestor within 24 hours of receipt of the sample what the completion date will be. Tensile strength (length/width as needed) Tear strength (length/width as needed) Bursting strength (knits as needed) Abrasion Pile retention (plush fabric only) Pilling resistance pH (intimate: all colors / others: white & denim only) Rain test (rainwear / if claimed) Spray test (outerwear/ if claimed)

Note: If fabric weight vary by 10%, shrinkage tests will also be performed. It may also be necessary to conduct fiber content evaluation.
Garment Testing 3 garments are required to submit for testing All production garments are required to be tested in accordance with the Basic Garment Testing Package before the goods are shipped. Every garment style in the correct color must be sent to a Warnaco approved laboratory.
Note: The submitted production garment must be totally complete, containing all trims, hardware and embellishments. If two garments are not furnished, the testing laboratory will contact the requestor for additional garments. Testing cannot proceed until both garments are received.

Basic garment testing includes the following: Shrinkage Seam Slippage Seam Strength Seam Stretchability (including head opening) Side Seam Torque Trim Compatibility Seam Appearance Zipper Performance Snap Performance Cross Staining Embroidery/ Screenprint or pieced garment.
Verification of Care Instructions When a preproduction garment sample is submitted the care instructions are confirmed by evaluation results of garment tests and production fabric tests.
Fiber Content Fiber content is evaluated on representative fabric. When the laboratory finds different fabric construction within the style submitted, additional fiber content analysis may be conducted in order to verify. The actual fiber content label must be verified by the garment, taking into consideration the type and amount of trim, ornamentation and functional components.

Snap Fasteners All snaps must be applied using only the snap suppliers recommended/brand-compatible attaching dies using a semi or fully automated pneumatic or electric press. No manually operated hand, foot or flywheel presses may be used to apply light duty snaps to any merchandise. Garment manufacturers are required to contact the snap suppliers application laboratories for assistance in selecting the appropriate snap components (prong lengths) for each new application. Buttons All buttons must be attached using a locking stitch machine, sewn with a minimum of 7 needle passes using polyester or polyester core cotton-wrapped thread. Warnaco Swim recommends that no 100% cotton thread should be used to attach buttons. Four-hole configuration buttons must be sewn in a cross-stitch pattern, using a locking stitch machine. All buttons must pass the standard attachment strength test of Adults: 15 lbs or Infants/Children: 17.0 lbs for 10 seconds (USA/Canada) in accordance with BV S1023. Total Lead Content In accordance with 16 CFR 1303, Total Lead Content test should be done for any component with printed, coated or pained surface. No more than 0.06% (600ppm) lead content based on the weight of the dried paint or coating film should be investigated.

Wash Durability All trim components will be subject to the AATCC 135 Home Laundering Test and must show no signs of detachment, discoloration, distortion or removal of any protective coatings. All metal trim components will be subjected to the corrosion resistance test, and must show no signs of corrosion, oxidation or discoloration.
Sharp Points and Edges (All Ages) No sharp points or edges may exist on any product, packaging, or hardware, tested in accordance with ASTM F 963/16 CFR 1500.
Velcro Adhesive Fastenings (All Ages) No Velcro, or hook and loop, fastening tape with sharp corners may be applied to any merchandise. All tape edges must be radiused (die-cut or hand trimmed) to prevent scratching.
Cords, Ties, and Sashes Drawcord - Defined as a string or cord inserted into a garment usually through buttonholes or eyelets for use in closing or controlling the fullness of the garment. Ties and Sashes (Functional) - Defined as a ribbon, cord or band of fabric permanently attached to the garment and usually worn about the waist as an accessory for the purpose of fastening and drawing closed in addition to knotting to form a bow. Faux Drawcord Ties and Sashes (artificial, fake, non-functional) Defined as a tacked ribbon, string or cord, which is NOT used in closing or controlling the fullness of the garment. Decorative Attachments Rosettes, Satin bows, Plush, Non-metal Novelty Zipper Pull (Textile / Leather). Belts - Defined as a separate continuous band of flexible material, usually worn around the waist and fastened at the ends with a buckle.

Monofilament Thread (All Ages) No monofilament thread may be used in assembly of any product. Polyester or polyester-cotton wrapped threads are preferred.
Flammability (All Ages) All textile products must meet general wearing apparel flammability test 16 CFR 1610 with Class 1 rating, without a timed surface flash. A surface flash is defined as the complete burning of the time cord, without causing the burning of the base fabric.

CONDITIONS OF TESTING
At the request of the submitter (Client) of a test request form (Test Request Form), Bureau Veritas Consumer Products Services, Inc. (BVCPS), a Massachusetts corporation, or a subsidiary or affiliate of it, as identified in a written report (the Test Report) issued by BVCPS or such subsidiary or affiliate (BVCPS or such subsidiary or affiliate being referred to herein as the Company"), has conducted the tests specified in the Test Report in accordance with, and subject to, the following terms and conditions: 1. The Test Report is issued solely by the Company, is intended for the exclusive use of client and shall not be published, used for advertising purposes, copied or replicated for distribution to any other person or entity or otherwise publicly disclosed without the prior written consent of the Company. The Company shall not be liable for any loss or damage whatsoever resulting from the failure of the Company to provide its services within any time period for completion estimated by the Company. If Client anticipates using the Test Report in any legal proceeding, arbitration, dispute resolution forum or other proceeding, it shall so notify the Company prior to submitting the sample for testing. The names, service marks, trademarks and copyrights of the Company and its affiliates, including the names BUREAU VERITAS, BUREAU VERITAS CONSUMER PRODUCTS SERVICES, VERITAS and BVCPS, (collectively, the Marks) are and shall remain the sole property of the Company or its affiliates and shall not be used by Client except solely to the extent that client obtains the prior written approval of the Company and then only in the manner prescribed by the Company. Client shall not contest the validity of the Marks or take any action that might impair the value or goodwill associated with the Marks or the image or reputation of the Company or its affiliates. The Test Report sets forth the findings of the Company solely with respect to the test samples identified therein and, unless specifically and expressly indicated in the Test Report, the results set forth in such Test Report are not indicative or representative of the quality or characteristics of the lot from which a test sample has been taken. The Test Report reflects the findings of the Company at the time of testing only, and the Company shall have no obligation to update the Test Report after its issuance. The Test Report sets forth the results of the tests performed by the Company based upon the written information provided to the Company as set forth in, or attached to, the Test Request Form. The Test Report represents the entire understanding of the parties hereto with respect to the subject matter of the Test Report and no modification, variance, extrapolation or conclusion with respect thereto shall be permitted without the prior written consent of the Company. The Company may, in its sole discretion, destroy samples which have been furnished to the Company for testing and which have not been destroyed in the course of testing. The Company may delegate the performance of all or a portion of the services contemplated hereunder to an affiliate, agent or subcontractor of the Company, and client consents to such delegation. Unless a shorter period is provided for in the Test Report, payment in full for the Test Report shall be due 30 days after the date of invoice. Client shall pay interest on any overdue amount from the due date until paid at an interest rate of 1.5% per month or, if less, the maximum rate permitted by law. The Company reserves the right, at any time and from time to time, to revoke any credit extended to client. Client shall reimburse the Company for any costs it incurs in collecting past due amounts, including court costs and fees and expenses of attorneys and collection agencies. The Test Report may not be used or relied upon by client if and for so long as client fails to pay when due any invoice issued by the Company or any affiliate of it to Client or any affiliate or subsidiary of client together with interest and penalties, if any, accrued thereon. The Company may, from time to time, permit Client to access the Test Request Form, the Test Report and other communications by means of e-mail transmissions with the Company. Client acknowledges that any such transmission will not be encrypted and, hence, will not be confidential, that such transmissions may be read and intercepted by third parties and that the electronic version of a Test Request Form, Test Report or other communication could be modified inadvertently. The Company disclaims any and all responsibility or liability arising out of or in connection with e-mail transmissions of such information. The Company represents and warrants solely to Client that the Test Report is free of any material error or omission caused by the negligence of the Company. If Client desires to assert a claim for breach of the foregoing warranty, it must submit a claim to the Company within 60 days after the date of issuance of the Test Report to Client in a writing that sets forth with particularity the basis for such claim. If the Company determines that the claim is timely and that a breach of the foregoing warranty has occurred, then the Company, at its option, may either (a) re-perform the deficient test, without charge to client, or (b) refund to Client, without interest, the fee paid to the Company for such Test Report. Client waives any and all claims for breach of the foregoing warranty, including, without limitation, claims that the Test Report is inaccurate, incomplete or misleading or that additional or different testing is required, unless and then only to the extent that Client submits a written claim to the Company within such 60-day period. The Company shall, to the extent of the limitation of liability set forth in Section 9, indemnify Client against third party claims asserting a loss arising exclusively from the negligence of the Company, but only if Client (a) notifies the Company of the assertion of such claim immediately upon its being notified and (b) provides to the Company the option to assume the defense of such claim or participate in such defense. EXCEPT TO THE EXTENT OF THE LIMITED WARRANTY SET FORTH IN SECTION 7 OR AS MAY OTHERWISE BE AGREED TO IN WRITING BY THE COMPANY AND NOTWITHSTANDING ANY PROVISION TO THE CONTRARY CONTAINED HEREIN OR IN ANY TEST REQUEST FORM, NO WARRANTY OR GUARANTEE, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, IS MADE. IN NO EVENT WHATSOEVER SHALL THE COMPANY BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF THE SERVICES PROVIDED BY THE COMPANY HEREUNDER, INCLUDING WITHOUT LIMITATION LOSS OF OR DAMAGE TO PROPERTY, LOSS OF INCOME, PROFIT OR USE, OR CLAIMS OR DEMANDS MADE AGAINST CLIENT OR ANY OTHER PERSON BY ANY THIRD PARTY IN CONNECTION WITH OR ARISING OUT OF THE SERVICES PROVIDED BY THE COMPANY HEREUNDER. NOTWITHSTANDING ANY PROVISION TO THE CONTRARY CONTAINED HEREIN, UNDER NO CIRCUMSTANCES WHATSOEVER SHALL THE LIABILITY OF THE COMPANY IN RESPECT OF ANY CLAIM FOR LOSS, DAMAGE OR EXPENSE, OF WHATEVER NATURE OR MAGNITUDE, AND HOWEVER ARISING, EXCEED AN AMOUNT EQUAL TO THE AMOUNT OF THE FEES PAID TO THE COMPANY FOR THE SPECIFIC SERVICES WHICH GAVE RISE TO SUCH CLAIM. These Conditions of Testing shall be governed by, and construed in accordance with, the local laws of the country where the Company performs the tests or, in the case of tests performed in the United States of America, the laws of the Commonwealth of Massachusetts. Client waives the right to interpose any counterclaim or setoffs of any nature in any litigation arising hereunder. Any proceeding related to the subject matter hereof shall be brought, if at all, in the courts of the country where the Company performs the tests or, in the case of tests performed in the United States of America, in the courts of the Commonwealth of Massachusetts. If there is a discrepancy between the terms and conditions set forth in these Conditions of Testing and the terms and conditions set forth (a) in the Test Report, (b) in the Test Request Form or (c) in any other writing other than a master agreement which expressly (i) provides that its terms and conditions shall take precedence over these Conditions of Testing and (ii) cross-references this Section 11 or the equivalent section in the Test Request Form, the Conditions of Testing set forth at this website shall govern and any inconsistent provision of the Test Request Form, the Test Report or other writing, as applicable, shall be disregarded.
