The Invisible Minority


he National Statistics Office (NSO) estimates that there are at least 3 million Filipino and Filipino-Americans living and working in the United States. In fact, the US Embassy Manila in Manila is consistently among the 3 busiest consulates worldwide in terms of immigrant visa issuance. The United States remains the preferred immigrant destination of choice and most Filipinos today find it easy to integrate with American society. Culturally, the Philippines is the most Americanized country in Asia and maybe even the world. Unlike most other minorities living in the US, Filipino Americans largely share mainstream American beliefs and values. The steady migration of Filipinos to the US should continue going forward especially in view of the current shortage of health care workers in the United States. The American Medical Association has deemed medical and healthcare education in the Philippines to equal the level of medical and healthcare education in the United States. It is easy for Filipino nationals to enter the American healthcare workforce, inspiring them to settle and seek United States citizenship upon arrival. In fact with the shortage of American nurses created in the 1980s, clinics and hospitals in the United States have been hiring directly from the Philippines offering substantial salaries and immigrant visas. Life in America, however, is not all bliss. There is an issue over pay parity in nonhealthcare professions in the United States. Filipino Americans architects and engineers are paid less than their Latino and African American counterparts. This is also true for those working in the corporate environs and education. The discrimination is found to be worse among Filipino Americans seeking entry-level positions and for those who join the hospitality industry. Even more dishearten-

ing is the treatment Filipino War veterans have received from the US government. During World War II, over 200,000 Filipinos fought in defense of the United States against the Japanese in the Pacific theater of military operations. More than half died. As a commonwealth of the United States before and during the war, Filipinos were legally American nationals. With American nationality, Filipinos were promised all the benefits afforded to those serving in the armed forces of the United States. In 1946, Congress passed the Rescission Act which stripped Filipinos of the benefits they were promised. Of the 66 countries allied with the United States during the war, only Filipinos were denied military benefits. Since the passage of the Rescission Act, Filipinos had migrated to the United States to lobby Congress for the benefits promised to them in lieu of their sacrifices. Over 30,000 of such veterans live in the United States today, most are United States citizens. Sociologists introduced the phrase Second Class Veterans to describe the plight of these Filipino Americans. Since 1993, numerous bills were introduced in Congress to return the benefits taken away from the Filipino American veterans. Each time, the bills died in committee. The struggle continues today. Sociologists also refer to Filipino-Americans as an invisible minority. Unlike migrants from other countries who tend to form close-knit neighborhood communities of their own in the United States (eg. Chinatown), sociological field studies show that Filipino Americans however have a tendency to settle in a more dispersed fashion, settling down or blending in - in communities across the country without a need for establishing ties with other Filipino Americans in a locality. The label of Invisible Minority also extends to the lack of political power and representation of, by and for Filipino Americans. In the year 2000, only 100 Filipino Americans held elected office. All except for one served at the municipal or state legislative level.

here are three principal ways to immigrate to the United States. These are: 1) through a family relationship, 2) through employment, and 3) through investment. In all cases, the immigration process requires a petition to be filed on the migrants behalf. The petition is usually filed in the United States through the Immigration and Naturalization Service (INS) having jurisdiction over the residence or employment area of the petitioner. After the petition is approved, it is forwarded to the consulate or embassy where the beneficiaries reside and where they will submit applications for their immigrant visas. The visas will allow them to enter the United States for permanent residence which will be evidenced by a green card issued by INS. There are numerical limits on the number of immigrant visas that can be issued in a single year. Priorities are based on the type of visa. The applicants place of birth also affects the process, as there are limits to the number of visas that can be issued per country. This means that in some visa categories there are waiting periods before an immigrant visa can be issued. It is also worth pointing out that there are fees associated filing the petition, for processing the application, and for receipt of the immigrant visa. Family Sponsored Immigration American citizens can file petitions on behalf of close family parents, children (under age 21), spouses, siblings, and sons and daughters (regardless of age). These petitions are filed at the Immigration and Naturalization Service (INS) in the United States having jurisdiction over the American citizen petitioners residence. Once INS approves the petition, it will notify the petitioner and forward the approved petition through the State Department to the overseas post where the relative resides. For spouses and fianc(e)s of American citizens, the process is the same; however, if the American petitioner is in the

Philippines, it is possible to file the petition for a spouse at the American Consulate in Manila. Legal permanent residents of the US, can file petitions for spouses and their children and unmarried sons and daughters. They must file petitions in the United States through the INS. The approved petitions will be forwarded through the Department of State to the Embassy or Consulate where the beneficiaries reside. Employment based Immigration Based on job skills, professional expertise and employment needs in the United States, a US employer can file an employmentbased petition to bring workers and their immediate families permanently to the United States. The employer must file a petition with the INS office having jurisdiction over the place of proposed employment. In addition to obtaining INS approval, certain employment categories requires a certification by the Department of Labor that prevailing wages are met and that the local labor market in the US cannot fill the employment need claimed in the petition. The petition and the certification must be done in the US. Once approved, the petition will be forwarded through the State Department to the Embassy or Consulate where the beneficiaries reside. Investment based Immigration Investing in a business that creates employment is another method of immigrating to the US. Applicants for this visa must invest in a new commercial enterprise which will create full-time employment for at least 10 persons other than the investors spouse and children. The usual minimum investment is US$1 million, but may be as low as US$500,000 if the investment is in a rural or high unemployment area. On the other hand, the required amount can be higher if the investment is made in an area of high employment. A person wanting to immigrate by investment must file a petition with INS office in the US having jurisdiction over the area where the new commercial enterprise will be principally doing business.

he Black Eyed Peas was a crew that sat content with what they did. They simply rocked. But in 2003, will.I.am, Fergie, Taboo and apl.de.ap rocked the whole world! They released Elephunk, their fourth album in their 10-year career. It sold more than 7 million copies. Suddenly, they found themselves playing in front of large crowds like the Superbowl. And the Grammys werent far away too. But, hold on a minute. Is that rap in the background in tagalog? Isnt that chorus a song from Asin? No, your ears dont deceive you. The reason? One of the driving forces of the group is from the Philippines. Black Eyed Peas member apl.de.ap is Filipino. Proudly Filipino. Apl is Allan Pineda Lindo. He called Angeles, Pampanga home when he was young. He rode carabaos and did some farming with his grandfather. He had a father he never met. When he reached 14 years old, it was a whole new world for him. From One Angeles to Another At the age of 14, he was adopted by a family from the US. From Angeles, Pampanga, he made a new home in Los Angeles, California. A new guy in town, apl was shy and barely spoke English. He could have easily joined a gang. But as fate would have it, he met will.I.am. They shared a common interest: dancing. This laid the groundwork for the formation of the Black Eyed Peas.

The Big Apl The Black Eyed Peas is known for songs like Shut Up and Where is the Love. But one song really sticks out, The Apl Song. is actually a tribute to our homeland. According to apl, he wanted to show people a little bit of where hes from. I dedicated that song to my brother who committed suicide in the Philippines, apl.de.ap says sadly in many interviews. In an early interview (Talk It Out with

Jodi Leib, 2003), apl points out the things that motivated and drove him. What drives me is my family, cause Im from Philippines, Im adopted. My whole goal is to bring my family over here, so they can have a better living, cause its hard in the Philippines to have this lifestyle. And what more of his family? My siblings will get a better education. My sister, I put her through Nursing School in the Philippines, but I want her to get a job over here, because, you know, the pay is much better, and, just get my other siblings into a better school so they can be whatever they want to be. How about opportunities? I think for me it comes from where Im from, like when I go back over to Philippines and I see how life is like over there, thats what grounds me. When I come back over here, its like, damn, Ive got opportunities that a lot of people dont have, you know? So I just try to take all that opportunity and work it, you know, cause you never know when its going to end, you know? Hopefully, the opportunity will never end. And apl will keep on working at it. And hopefully, the same thing will happen to other Filipinos.

am thinking of setting up a recruitment agency. Can I ask what permits I need to get and what government agencies I need to ask and coordinate with so that I can start my agency? The Philippine Overseas Employment Agency (POEA) is the principal regulatory agency in matters of overseas employment, and is likewise the agency authorized to issue licenses to operate a land-based recruitment agency to all qualified applicants. Primarily, under the Labor Code of the Philippines, only Filipino citizens or corporations, partnerships, or entities at least seventy-five percent (75%) of the authorized and voting capital stock of which is owned and controlled by Filipino citizens shall be permitted to participate in the recruitment and placement of workers. Documentary Requirements and Filing Fee The POEA may issue a license to operate a recruitment agency valid for four (4) years to all qualified applicants, subject to compliance with the following documentary requirements: 1. Submission of written application for issuance of license (POEA-LRO Application Form); 2. Proof of registration with the Securities and Exchange Commission, in case of corporations and partnerships (i.e., certified true copy of Articles of Incorporation or Partnership), or Department of Trade and Industry, in case of sole proprietorships (i.e., certified true copy of Certificate of Registration); 3. Proof of financial capacity consisting of the following: Minimum capitalization of PhP2,000,000.00; Bank certificate showing an account balance of not less than PhP500,000.00; Authority for POEA to examine bank deposit(s);

Verified income tax returns (ITRs) of the proprietor/corporation/partnership and partners for the past two years. In case of newlyformed corporations/partnerships, the verified ITRs of the stockholders/partners for the past two years are required; 4. Proof of marketing capability, which consists of the following: Duly executed Special Power of Attorney and/or duly concluded Recruitment Agreement authenticated by the Philippine Embassy nearest the prospective employer and verified by the Philippine Overseas Labor Office nearest the jobsite; Manpower request or visa certification from new employers for not less than 100 workers, duly verified by the Philippine Overseas Labor Office nearest the jobsite; and Certification from the POEA Pre-Employment Services Office (PSO) on the existence of a new market; 5. Duly notarized undertaking by the proprietor/ president (in case of corporations)/managing partner (in case of partnership) stating, among others, that the applicant company shall: select only medically and technically qualified recruits; assume full and complete responsibility for all liabilities which may arise in connection with the use of the license; assume solidary liability with the employer for all liabilities which may arise in connection with the implementation of the employment contract; guarantee compliance with labor laws of the Philippines and of the country of employment of the recruited workers; assume full responsibility for all acts of its officials, employees, and representatives; negotiate for the best terms and conditions of employment; disclose the full terms of employment to the applicant (Full Disclosure Policy); deploy at least 100 workers to the new market within one year from the issuance of its license; provide orientation on re-

cruitment procedures, terms and conditions, and other relevant information to its workers; repatriate the deployed workers and his personal belongings when the need arises; 6. In case of a partnership or corporation, a duly notarized undertaking by the partner/corporate officers and directors that they will be solidarily liable with the company over claims arising out of the employeremployee relationship; 7. Proof of possession by the proprietor/president (or chief executive officer [CEO])/partners of a bachelors degree, as well as three years business experience; 8. List of all officers and personnel involved in the recruitment and placement, together with their respective appointments (Secretarys Certificate in case directors), resume, and two (2) passportsize photos; 9. NBI clearance issued not earlier than six (6) months prior to filing of the application for a license, and clearance from POEA AntiIllegal Recruitment Branch of the proprietor/partners/ directors, as well as all officers and employees of the company who will be involved in recruitment and placement activities (foreign directors or partners shall submit clearance from their country of origin in lieu of the NBI clearance); 10. Contract of lease or proof of building/unit ownership, indicating the office address and an office space of at least 100 square meters; 11. Proof of publication in a newspaper of general circulation on the notice of the application with the name of the proprietor, partners, incorporators, and officers of the applicant company; and 12. Certificate of attendance of the proprietor, partners, president (or CEO) in a Pre-Licensing Orientation Seminar for Executive Officers conducted by the POEA. A filing fee of PhP10,000.00 is required to be paid upon submission of the above documentary requirements. Only those applications submitted with complete requirements as

Perhaps, this is how your boyfriend feels. He is afraid that with the distance and your going away will somewhat diminish the love that you currently have. It is a natural reaction from someone who is deeply in love. I noticed that you have been going steady for four years already. It is normally a sign that you guys are preparing yourselves for a long-term commitment. In fact, you mentioned that you are saving money for your wedding. However, your answer ultimately can be found within you. You will have to ask yourself the following questions. Are you ready (knowing that you will be far away) to take on the responsibilities that marriage requires. When you look into your future, what vision do you see? Does it include your boyfriend?

Marriage is a lifelong commitment that entails sticking with your spouse through thick and thin, sickness and in health, for richer or poorer. If you see yourself as being able to fulfill all of these, then by all means, get married. I am not here to dissuade you from getting married. I am just reminding you of the responsibilities that it entails. Another point that I wish to make is that distance can be a big factor in the success or failure of a relationship. I have seen many a loving relationship falter or even fail because of distance. Because the spouse was away and the loneliness was difficult to bear. These are the times that temptation seem to be at its strongest. Believe me, I have been there. I have seen mothers and fathers with sound moral foundations fall under the call of sin. Ruining lives as they go. I believe that you have come to us for help because you are not sure if marriage is indeed the answer. Ask your boyfriend, if he believes in the strength of your love. Two years is not a long time. If your love can endure all that time, then so much the better for you. You have not only added a solid reason for you to marry him, you have also strengthened your relaionship with him and in effect started on the right path to a fulfilling life of man and wife. Ricardo J. Vidal. He guided us to where we wanted to go. that he was glad that the majority of the concessionaires realized the benefits of the project in terms of job and tourism opportunities. The PTA entered into an agreement with China Oceanis Group Ltd. (COGL), a MalaysianChinese consortium, for the construction of an oceanarium in the Luneta boardwalk. The project amounts to about US$20 million with the COGL paying the government PhP16.5 million per annum in rental fees for the next five years. The oceanarium would give Filipinos and foreign tourists an opportunity to experience a saltwater walk-through aquarium, and a simulated beach fronting the facility for swimmers. The National Police Commission (Napolcom) has announced that of the 18,044 applicants for inclusion in the police force this year, 15,416 or 85.44 percent failed the test. In the qualification exams for promotions, the same thing happened. Of the 18,678 policemen who took the exam, 11,332 or 60.67 percent were also unsuccessful. This passing rate is the lowest since 1999, when only 10.7 percent of examinees passed the eligibility and promotions exams. The Napolcom said the high failing rate was a result of the harder exams they were giving, assuring that this was for improvement of PNP standards.

Last June 11, to commemorate the 107th anniversary of the Declaration of Philippine Independence the following day, the Cultural Center of the Philippines together with the Department of Tourism played host to Salinlahi 2005, a cultural showcase which pays tribute to the heroes who fought for the countrys independence, as well as to overseas Filipino workers (OFWs), todays modern day heroes. This years celebration had the theme Kalayaan: Isang Pilipinas! Bayan Ko, Mahal Ko! They have been performing and choreographing for cultural festivals in Mindanao and abroad, winning many awards and acclaim in a short period of time. For in Candy Corner, bubble gum resembles a yard stick, worms are edible gummi worms, and chocolate is disguised as a pirates treasure in rocks and gold coins! Candy Corner President Ricky Andres says he and his wife, Rosemarie, both come from a family of entrepreneurs. The kids sector during the early 90s was largely an untapped market. They had an existing toy business and would travel regularly to trade shows in the U.S. where they met suppliers for candies as well. Apparently, we share the same market. Robert Tarongoy was released by the Iraqi militants who held him captive for 7 months. At long last, Robert Tarongoy is on his way home after being gone for a long time, President Gloria Macapagal-Arroyo announced while on a visit to Cebu. The 31-year-old Tarongoy, was working as an accountant for a Saudi firm based in Baghdad, when he was seized from his workplace along with an American colleague in November last year. It was an anniversary gift of sorts for Tarongoy as the day of his release was also his third wedding anniversary. The three overseas Filipino workers (OFWs) who were held hostage were united for the first time in Malacaang. President Arroyo hosted a simple thanksgiving mass for the three hostage survivors: Robert Tarongoy, Angelo de la Cruz and Angelito Nayan. Nayan and de la Cruz advised Tarongoy on how to move on like they did. Prayer and working immediately are what you need to forget your harrowing experience, they both said. Its a long process. Thats because Candy Corner is a bit selective in looking for business partners. We dont like someone whos all (about) money. Magkano ba kinikita? Makakabili ba ako ng kotse niyan? Wed rather have franchisees who feel gusto niyang palakihin. Natutuwa siyang pumunta sa tindahan. Natutuwa siya sa mga candies. We dont want people who are, minsan, napilitan lang ng magulang. Ito ang negosyo. Patakbuhin mo. We look for someone who really likes the concept. Today, 99 % of Candy Corners products are sourced abroad. There are around 300 varieties of candies in stock with access to additional 2,000 other varieties of confectionery. Shelf life of the candies average 2-3 years but the turn over rate is such that it is rare for the candies to even stay a month in the store. Ricky says, We give suggestions on whats good selling or fast selling. It would be nice if the franchisees know what they are buying. In terms of purchasing, involved siya. Ricky also encourages their franchisees to build their business. He gives a concrete example, Lets say, you earn PhP 15,000 net a month in a single outlet. Its good, yes. But its not enough to put your child through college. But if you own four outlets, thats PhP 60,000 a month. It suddenly makes your life better. It makes sense. Ang effort naman is all the same, whether you own 1 or 4 branches. It would seem ironic but Candy Corner asserts itself as a viable business even in an economic slump. Their website claims that business grew most during the economic turmoil of 1997 and 1998 with growths over 300% both in volume and in sales. Ricky articulates, Whats great about the concept is that its a very wide market - meaning iyong age group, mga bata, mga matanda. Also income bracket. Anybody can afford PhP 10 lollipops, up to the chocolates. So its a very wide market in terms of attracting customers. Other than that, were hitting our 10 th year next year. Its really proven. So in terms of risk of joining us, I think the track record will speak (for us).

Talaga, promise. Halatang gumaan ang dibdib ng binata sa pagtanggap niya ang paghingi nito ng paumanhin. Walang imik ang dalaga. Para siyang robot nang inihatid niya si Bajie sa labas. Hanggang sa nakalayo na ang sasakyan nitoy nakatayo pa rin siya sa harapan ng gate. Nakatingin sa malayo. Kung kanina ay may naramdaman siyang katuwaan sa biglang pagdating ni Bajie; ngayoy tulala na siya. Paulit-ulit niyang iniisip ang nangyari sa buong araw. Akala ko pa naman na-miss niya ko. MADAM AMINA AL-JASSIM - ALKHOBAR KSA Our Foreign Employer is in need of workers to fill up the following positions: PRODUCTION MANAGER - Male, between 20 to 30 yrs old - Somebody who has knowledge in cutting tailoring & has managerial ability to manage - Must have exp.working in a tailoring shop or factory & must have know how to production time, organize work, plan sched, & distribute task - Basic knowledge/skills in computer (excel & work) INTERIOR DESIGNER - Male & Female - Somebody who can work on wedding projects - Somebody who can plan a wedding, design the weeding stage for the bride & groom - Can draw on the computer and by hand the prospective - They will be managing & directing the people that are executing the design - They will b doing part of the project themselves. HE MECHANICS
- At least 21-45 years old, least high school graduate or relevant industrial/vocational courses; - Preferably with experience in the general repairs of mobile/telescopic cranes , as well as other vehicle and mobile equipment; - Working knowledge with repair and maintenance of diesel or gasoline fed engines and hydraulic, transmission and electrical systems; - Ability to perform routine maintenance checks on diesel/gasoline engines and on fuel, brake, and transmission systems to ensure peak performance, safety and longevity of the equipment. - Working knowledge or experience in handling hydraulic powered equipment, including but not limited to problem solving, assembly and dismantling of engines; - Ability to use a variety of tools in their work, including power tools, such as pneumatic wrenches, to remove bolts quickly; machine tools, such as lathes and grinding machines, to rebuild brakes; welding and flame-cutting equipment; - Acceptable familiarity with common handtoolsscrewdrivers, pliers and wrenches, etc. - Know how and knowledge of electronic and computer-controlled components is desirable but not required.
