Dear Partners, Please find below the information/requirements for the new European Customs regulation (based on Information

available as per 13/12/2010): Changes to the existing European Union Customs Code Regulation will take effect from 1st January 2011 for all shipments to the European Union and or transshipped in an EU port to non EU destination, or remaining on board the vessel (FROB) during ports of call in the EU with a destination outside the EU. This is hereafter referred to as the European 24 Hour Advanced Manifest Rule (or EU24) This means, that for Import cargo moving from a non EU country to any EU member state, there will be a requirement for an Entry Summary Declaration (ENS) to be submitted to Customs at the first EU port of call latest 24 (48 ) hours BEFORE the vessel commences loading at the non EU loading port. This ENS has to be sent electronically (= via EDI) by the Ocean Carriers to European Customs. The original ENS plus any subsequent amendments and replies, such as the Movement Reference Number (MRN), from EU Customs will be managed by EDI through the Manifest system. Information required from our Customers for the ENS submission is almost identical to the Details required in the present Shipping Instruction (SI). The main differences are a requirement for greater accuracy in addresses, cargo descriptions and any code numbers provided. The following details are the additional information which is required: Full name and address, including Zip code, of Consignee Notify Party including Zip code (mandatory for To Order B/L) Acceptable goods description (general terms such as Freight All Kinds/FAK and general cargo are not accepted) Economic Operation Registration and Identification Number (EORI Number); if available! Code for the type of packages Number of packages Shipping marks for packaged goods (not necessary for containerized goods) Container Number Seal Number In minimum 4 digit HS code some Carriers advise that they will require the full 6 digit HS Code! Cargo Gross weight (kg) UN code for dangerous goods Transport charges method of payment code (to be provided only where available)

Based on the ENS the Customs Office at the first EU entry Port will decide on one of the following risk categories : - RISK A - RISK B - Loading of cargo refused at POL ( Do not load message DNL) - Risk handled at the first EU port ( Hold at (EU) entry Port = unloading for example, irrespectively if this shpt was due to be discharged at another the port) - Risk handled at the intended port of discharge (Hold at (EU) discharge Port)

If customers/shippers cannot submit the required information on time, the carrier will not be able to declare ENS and is not allowed to load the cargo on board.

Charges : the Entry Summary Declaration (ENS) Fee will be US$ 25 per Bill of lading for cargo bound for the EU. It will be applicable for all shipments from non EU Countries with final discharge port in the EU The ENS Amendment Fee for ENS already filed previously for cargo from Asia will be set at US$ 40 per Bill of lading. Note: Fees & charges are subject to change as per Carrier Announcement! As a general Rule: Bookings must be made latest 48 hours prior CY Closing = late Bookings/last Minute shipments will not be possible anymore! However: most Carriers seem to implement a ENS closing time this ENS closing time varies from Carrier to Carrier as well as POL to POL! Therefore it is very important that the shippers check locally the respective ENS closing times as they may vary from 48 to up to 96 hour prior published CY Closing!
