WHO WE ARE We are a non-profit organization of motorcycle enthusiasts from all walks of life. We lobby and educate the government and the general public to promote motorcycling in a safe and positive image. We endeavor to enlist the cooperation and participation of all organizations and individuals that share a similar interest in preserving our American tradition of FREEDOM. We promote motorcycle safety, training, & political awareness. We ARE NOT A CLUB OR A GANG. We fund our work through toy runs, poker runs, campouts, and other motorcycle activities. We are your neighbors & friends who work, pay taxes, and get involved with our community. We serve and support our country and believe in freedom. We use all legal means to protect our rights without infringing on the rights of others. OUR GOALS To become a powerful and viable political force in legislative matters concerning the motorcyclist. To promote the safe riding habits without infringing on individual freedoms. To motivate the bikers to write letters to their legislators before, during, and after the legislative session. To furnish our members with a newsletter to keep all bikers informed in regards to upcoming legislation. Presidents report
Hello all,

Another rainy day as I sit here and compose this message. Many changes have been happening with the chapter. We have moved our meeting place to Anthonys on the Boulevard and our first meeting there went well. We have a new Vice President, Burnout Bob Penn, who has stepped up to fill this position. I look forward to working with Burnout as he has been very helpful in keeping the chapter involved with the community and instrumental in signing new advertisers. Thanks Burnout. We continue to sign new members and our chapter is growing again. We won the Chapter with Most Growth for June thanks to the continued efforts of several members who continue to set up tables at bike nights and events around the area. I want to thank Birdie and Smokey for their undying efforts to maintain our MSAP program in the schools. Not only do they teach awareness in the classroom, they also take time to train future instructors. I want to also thank Brett Shea, Heidi Hill and Darrin Kerwin of Caloosahatchee and Burnout Bob Penn for taking the time to come out and attend these classes. Each of these individuals have taught classes and are ready to help promote Motorcycle Safety and Have a good month and stay dry Awareness as we move forward. While Im on Wayne Cerra that subject, I am concerned about our future.

Every day I see or read about someone involved in what some may call an accident when I would refer to what is more a crash. Accidents happen yet crashes can be avoided. More and more I see people riding around texting and talking on cell phones. Every day on my scooter there is a near miss. I am diligent and very aware of my surroundings while operating any type of motor vehicle. I cant say the same for those who share the road with me. ABATE needs your help. As the 4th largest MRO in the country, are we really getting our message out there? We fought to keep helmets off our heads yet we cant pass a stiffer penalties bill. With over 1 million motorcycle endorsements in this state and over 20,000 in Lee County, why is it there are only approximately 7,000 members of ABATE OF FLORIDA? I am asking the sport bike community to band together with us and help keep our roads safe. Not only for us, but for our future generations. We get clobbered by the media and we hate it. Let our voices be heard over our pipes and lets not take this lying down. Help yourself by being heard. An accident can happen, but a crash is due to someones reckless actions, whether its cell phone use, alcohol or drugs or even perhaps a heated argument while driving. Stop the abuse and pay attention to the task at hand. Thats my rant for this month. Let me know how I can help you. If I may quote a wise man and friend, Jay Anderson, Stay Alive, Just Drive. My suggestion this month, save the phone conversation and the texting until you reach your destination and see how much more you get out of talking to someone face to face. Remember when we used to do that?

DEAR FELLOW ABATE MEMBERS


Please Call! Many times, we are finding out, after-thefact, about the accidents, stress factors, crisis situations, deaths, critical incidents, etc... directly involving our fellow ABATE brothers and sisters. Sometimes, we don't hear anything until months after some significant life-altering event has taken place. Sometimes, we will be at a food or drink stop, on a Run. And, someone will come up to us and ask, "Didn't you know that I was involved in a serious accident, three months ago?" Or, "Didn't you know that I was in the hospital?" Or, "Didn't you know that my husband (or wife) died?" All too often, one will assume that someone else contacted us. We really don't know these things, unless

that person and/or someone else lets us know. We are blessed and honored to be your Chaplains and want to serve you with spiritual care, when asked and/or requested. We are fully licensed Ministers within our denomination and are also, fully endorsed Chaplains. We've been called at 2 or 3 o'clock in the morning by you, when you've been tboned by a cager and have been admitted to the Trauma Unit or have had some serious stitching up to be done in the E.R.. And, we've responded and been there within minutes of the call. We've done funerals at your favorite drinking establishments and even commitment at sea. We've been there for the happier and fun times of marriages, weddings, baby dedications, bike and biker blessings, Biker Bible Cafs, Lee County Church Crashes, and ABATE Chapter and 5 Star events, etc... Our intentions are to be there but, not be intrusive. It's understood that some want nothing to do with members of the clergy. And, we respect that. So, please give us a call. If we are out-oftown and/or unavailable, we can usually locate another clergy member of Messiah's Messengers to respond. Thank you and many blessings,

MEETING MINUTES
Southwest Chapter Abate Meeting Minutes. August 28th 2011 Held at Anthonys on the Boulevard President - Wayne Cerra VP- Gene Vinci Treasurer- Todd (KC) Burns Secretary- Scott Turner (Absent Excused) Sgt, at Arms- (Burnout) Bob Penn tion. It was with a unanimous vote of confidence to request that Bob Burn out Penn step into the Vice President position. We will be working with all SW Chapters and doing our best to attend their meetings and events, as we increase our emails and calendar information and postings. The Chapter birthday party is hosted by Gear Head Tattoo on the 24th of September, see newsletter for flyer. We need judges for the bike show, contact Wayne Cerra to volunteer. We need unwanted items for our Chapter Garage Sale to be held in the coming months. Operation Medicine Cabinet will be held on October 8th, from 10a-2p. We are putting up our safety booth, please see Wayne to volunteer, see flyer in newsletter. We are working on a Saturday night Bike Night ride to Charlotte County Speedway and United Bike Night on Saturday, Feb. 25th 2012. October is Spooks and Scoots followed by State Meeting. See ABATE of Florida, Inc. website for full event flyer. SECRETARYS REPORT: Scott Turner, Secretary, excused absence. Barbara Bardell stepped up to take minutes of Chapter Meeting. Motion to accept the minutes as printed in our monthly newsletter by Rob (Big Bird) Cran second by Frankie Kennedy, motioned passed unanimously. TREASURERS REPORT: Todd KC Burns. Treasurers report Motion to accept by Barbara Babs Bardell and second by Keith Baker, motioned passed unanimously. SERGEANT-AT-ARMS REPORT: Burn Out Bob Penn would like to thank everyone for showing up at the Five Star and also thank Birdie and Smokey for doing a great job at our local high schools. Dylan Baker received a badge of appreciation for all his support of our Chapter. MEMBERSHIP REPORT: Wayne Cerra acting Membership Chair, New members and renewals can be found in membership report in newsletter and thanked our new advertisers, Gendron, Bottles, and Anthonys on the Blvd. LEGISLATIVE REPORT: Ken Teddy Bear Miller, absent and excused. SAFETY: Alberta Birdie Clark, absent and excused. As per Wayne, the high schools in our area have all received a presentation for the first semester of drivers education. Brent, Darrin and Heidi from Caloosahatchee participated in the Mariner High School classes. A round of applause was demonstrated for Birdie, Smokey and Richie for their dedication to this cause.

21 Members 5 Visitor Meeting called to order at 10:13AM with Pledge of Allegiance and a moment of silence. Pastor Tom gave the blessing. PRESIDENTS REPORT: Introduce guest speaker, James Jim Scollen with the organization Missing in America. Jim spoke on behalf of the Missing in America Project and their mission locating, identifying and interment to the unclaimed cremated remains of American veterans through the joint efforts of private, state and federal organizations. To provide honor, respect and dignity to those who have served this country by securing a final resting place for these forgotten heroes. Jim requests community service, traffic safety assistance with local events. www.miap.us Veteran Recovery Program James Scollen, Area Coordinator 239-693-8050 jpachiva@aol.com 5 Star Events, Southwest Chapter won the Attendance Trophy and win the center spot of the celebratory shirts for next years event. Special thanks to the ten plus members who stepped up as volunteers to represent Southwest Chapter at the Five Star Event, Gene Vinci, Frankie Kennedy, Ken Teddy Bear Miller, Bob Burn out Penn, Ken Coon, Pastor Tom Provenzano, Gator, Keith and Dylan Baker. There were events shirts given to each president and these shirts were presented to our Chapter volunteers. Our final donation to Chapter for this event has not been established at this point We have moved our Chapter meetings to Anthonys on the Boulevard on Del Prado in Cape Coral, just South of Viscaya on the east side of Del Prado. They are open for business and offer a Sunday Buffet to the public, so come early and get a great breakfast. 6 Members showed interest in attending a CPR class. Lee County Injury Prevention Coalition is allowing the Chapter a booth for exposure and safety education. After careful deliberation and keeping our Chapter active and current our Vice President Gene Vinci, has decided to step down and gain more knowledge about our organiza-

Chapter Members have made special requests for specific types of shirts and they are in, so please make an effort to attend our next meeting or a bike night to purchase your chapter shirt. STATE DELEGATE: Frankie Kennedy, on this day in 1945, the Japanese offered an unconditional surrender. Be sure newsletter is up to par on all advertisers ad content to ensure accuracy of our state name. Not to have periods in between the letter of ABATE. Please be prepared for the Tally (Tallahassee) Trip for the ride on the Capital coming in the beginning of 2012. This event is to be held the second week of February. State is purchasing all products, made in America, for ABATE members to purchase. Lets try to get in touch with

our local universities, colleges for MSAP classes. NEWSLETTER: Barbara Babs Bardell, we are trying to gain as much information for our calendar as possible. Any events you are aware of that would serve our community or our chapter in a positive way, please send information to my email @ Babsie67@comcast.net. OLD BUSINESS: Bike Tickets to be turned in at January Chapter meeting for return to State at the February State Meeting. Kati and Tom are home and recovering. Sunsports vendors donated their profits to Kati and Tom from the recent bike night. We would like to see our members support the Anniversary Party for SE Chapter of ABATE of Florida, inc., being held at Beef O Bradys. An email will be sent with details. Patches for our Chapter with our updated logo will need to be ordered prior to receiving to reduce the cost to all members. NEW BUSINESS: New meeting place, Anthonys on the Boulevard, thank you to Anthonys and Staff. We are moving forward to unite our Southwest Florida Chapters. Christmas Run Discussions: Kathy Provenzano: Would like to move forward with a Christmas Run details. Kelly Smith: Would like to mention Wounded Warriors Donations to the Vets. Donation jars have been set up across our area. ORANGE: WAIT ON LAWMAKERS BEFORE ADD RED LIGHT CAMERAS Officials in Orange County plan to wait to see what the Legislature does on red light cameras next year before moving forward with a plan to add as many as 80 new cameras in the county, the Orlando Sentinel reported Wednesday. The county, which includes Orlando, has 10 cameras in place and county commissioners want to add 40 more a year for the next two years. But there's been a push in the Legislature to repeal the state law allowing them.

HR 2715, sponsored by Mary Bono-Mack (R-CA), takes aim at reforming the issue of banning youth products due to lead content percentages. Also known as the Consumer Product Safety Commission Improvement Act (CPSCIA), this bill addresses a number of issues; but first and foremost is the language to fix the lead law.

"They have a great group of people to chose from. This gave me a chance to see how they think," said resident Chuck Hostetler. He said he was undecided about who he'll vote for and he wants to hear more about the city's utilities expansion program from the candidates. Candidates were given a series of questions by the Cape Coral Civic Association at the Cape Coral Yacht Club. Sixteen of the 18 candidates attended. Incumbent District 2 Councilman Pete Brandt and District 2 opponent Dan Sheppard did not participate. District 2 contenders John Carioscia and Joe Coviello differed on the use of incentive pay. "Incentives need be created for work above and beyond the call of duty," Coviello said. They should not be used to reward performance for a core job responsibility, he said. "I am totally against incentive pay," Carioscia said. "The job and the pay is the incentive. Incentive pay has no space in government employment." In District 3, the candidates were asked about the state of code enforcement. "This city isn't as neat as it used to be. I'm seeing a lot of lots that have been going unmowed for a long time. Your appearance has an affect on people who visit this city," Alan Sheppard said. Maybe the police department should take over code enforcement, he said. "They are understaffed," Councilman Bill Deile said. But the police should focus on core police duties, Deile said. The public underestimates what code enforcement does for the city and the agency

"My idea is to increase the revenue stream so (the) city can get money coming in from somewhere else besides the taxpayers," Bennie Barnes said. Candidate Rana Erbrick explained the difference between debt for the general fund and for enterprise funds such as utilities. About 25 percent of the city's debt is for the general fund and its size is not bad, Richard Leon said. "You don't buy a house with cash. If we're financing operations with debt that's a problem. That's called California," James McManus said. District 7 candidates tried to carve out different positions on flyovers on Veterans Parkway. Flyovers would injure businesses, incumbent Derrick Donnell said. It was prudent to table them indefinitely. "We're looking for business growth," said Michael Garr. Businesses would lose customers who live in the city, he said. "If it gets to (the) point traffic gets backed up a considerable amount, I'm openminded enough to look at it down the road," David Stokes said. "We don't want to see flyovers impacting businesses negatively," Erica Warren said. "It's important for our city council have open communication with Lee County." Lee County Property Appraiser Ken Wilkinson picked up a Republican primary opponent, as Cape Coral resident Bertrand Pepper filed papers to start raising money for next years election. since 1990, he said he has a lot of ideas and changes for the office, but further discussion of those matters will come later. Wilkinson, who was first elected in 1980, joked he thinks every day about whether to seek re-election, although his plan is to run for another term. But he likely wont file papers until January, he said. Another incumbent whos waiting to file is Lee County School Board member Jeanne Dozier. Dozier also has an early opponent, and theres been confusion between her and board member Jane Kuckel, whos said she will not run. Dozier said she intends to run for reelection to the nonpartisan seat but will wait a few months before initiating the paperwork Another challenger, meanwhile, has filed papers but does not want to talk about it. Joseph Asher Davidow, a Naples attorney and Republican, returned a call this week to say yes, hes serious about running for the post now held by U.S. Rep. Connie Mack IV, RFort Myers. But he refused to answer other

Mike Bennett, R-Bradenton, whose district includes part of Lee County, said this week hes endorsing Mitt Romney as GOP nominee. A bill that requires that juries consider the cause of the accident when determining who to hold responsible for enhanced injuries caused by car defects was signed by Gov. Rick Scott on Thursday. The bill (SB 142) was heavily lobbied for by Ford Motor Co. and other car makers who argued that without it, jurors were not given a full picture of what happened in an accident. But groups like the Florida Justice Association, which represents trial lawyers, said jurors will be swayed by emotional, irrelevant testimony that is unrelated to the enhanced injuries caused by defects in the car. The new law effectively reverses a Florida Supreme Court decision called DAmario v. Ford and was closely watched by the legal community. Scribe's Comments: Recently, my State Senator Garrett Richter, explained this new law in a way that may help us in court when a motorcyclist is killed by the fault of a vehicle driver. Sen. Richter says that in the past the jury

would only hear that "The airbag in Joe's car did not fully deploy when his car hit the telephone pole resulting in Joe's untimely and unnecessary death!" With this new law the jury will be able to get more information and can now hear, "Joe had a blood alcohol level 3 times the legal limit and was traveling at over 90 mph on a two lane winding road at night. Due to his alcohol level and rate of speed Joe crossed the center line forcing an on coming car / motorcycle to swerve into a ditch killing the driver / rider. At that point Joe missed the curve and his car hit the telephone pole with such force that it shattered the pole causing it to land on top of Joe's car and crushing his skull." This law can help us when the driver who hits and kills a motorcyclist is either a repeat offender of running stop signs, failure to yield, or was doing something shortly before that ended up causing the crash.
