Information on applications for leave


General Human resource delegations have been implemented that allow most leave requests to be approved at the local level by the applicants manager or principal. This approval is given on the basis that it is believed that the request is genuine, that the leave applied for is appropriate in the circumstances and on the assumption that the applicant has accrued an entitlement to that type of leave. The actual entitlement is verified when the request is applied to the applicants leave records. Principals and managers are advised to refer to the human resources delegations in the on the intranet to determine the categories of leave that they may approve. http://iwww.qed.qld.gov.au/workdept/hr/delegate/deleg ations.htm Types of Leave The types of leave indicated in these guidelines are not exhaustive. Further details of leave entitlements and policies are in the Education Policy and Procedure Register. Long Service Leave A permanent or temporary employee who has completed 7 years of continuous service shall be entitled to long service leave. Long service leave accrues at the rate of 1.3 weeks for each year of continuous service. State school teachers, including classroom teachers and those in classified positions, can access long service leave in periods of no less than one day per week or fortnight provided requested periods of long service leave amount to: five days or more in total to facilitate the engagement of a replacement temporary teacher; or for a lesser period where there is no requirement to utilise the Teacher Relief Scheme (TRS). The granting of leave is subject to departmental convenience. In order to comply with taxation legislation, any payment made during a financial year must be included in that years payment summary. As a result of this requirement, care should be taken when requesting an advance payment for a period of leave that extends over the financial year. Experience has shown that a tax disadvantage can result where officers are advanced for the full period of leave. The options regarding long service leave advances over the financial year are: (a) an advance for the full period of long service leave to be paid prior to the commencement of leave. It should be noted that the full amount of the advance will be included in the particulars of the payment summary issued for the financial year in which the payment is made (b) two (2) advances, the first covering the period from the start of leave to the end of the last pay fortnight in the financial year, the second advance to cover the remaining period of leave for the following financial year. Long Service Leave for a part-time employee accrues on a proportional basis of the entitlement of a full-time employee. Long Service Leave is granted at the employees fraction at the time of commencement of Maternity Leave Applications for Maternity Leave must be submitted at least 10 weeks before the estimated date of confinement. The application must be supported by a certificate from a medical practitioner stating the expected date of birth of the child, and a statement from the applicant advising particulars of any spousal leave to be taken by her spouse in relation to the pregnancy or the child. An employee who is pregnant must commence Maternity Leave at least six weeks prior to the expected date of confinement and must remain on Maternity Leave until at least six weeks after the pregnancy terminates. The six week period may be reduced at the request of the employee and on receipt of a certificate from a medical practitioner certifying that the employee is fit for duty until a specified date or that the employee is fit to resume duty. The period of maternity leave must not normally be more than 104 weeks. Paid Maternity Leave Paid maternity leave covers the first fourteen weeks (28 weeks half pay) of the maternity leave absence for employees with 12 months continuous qualifying service, immediately prior to commencement of maternity leave. Employees have the option of taking all or part of the paid maternity leave period on half pay. The paid maternity leave period is inclusive of public holidays for all employees but exclusive of school vacation periods for teachers. Part-time and long term casual employees are entitled to the provisions of paid maternity leave on a pro-rata basis. Part-time employees are eligible to be granted 14 weeks full pay (28 weeks half pay) at the employees fraction, averaged over the previous 12 months, prior to taking the leave. WorkCover Employees injured at work may apply for WorkCover. The following information should be sent to your district office. Generally two clear terms notice must be given by teaching staff when applying for or changing extended special leave. Extended special leave (without pay) may be granted for teaching staff for a maximum period of seven years for family responsibilities and a maximum of three years for other purposes. The maximum period of extended special leave for other public service officers is three years. General employees are eligible for a maximum period of twelve months extended special leave unless special circumstances apply. All teachers on extended special leave are required to confirm their return date in writing to their relevant district office three months prior to their intended resumption of duty. Application for Leave leave. A part-time employee may access long service leave at fractions that they have previously worked, including full-time. Note: The increase in fraction is for the purposes of Long Service Leave only and does not include an increase in fraction for the mid-year vacations. Provisions relating to payment (cash equivalent of Long Service Leave) on termination after 7 years continuous service apply only if: (a) the employee terminates his or her service because of ill health or incapacity that are significant but does not qualify for ill health retirement; or (b) a domestic or other pressing necessity; or (c) the employer dismisses the employee for a reason other than the employees conduct, capacity or performance; or (d) the employer unfairly dismisses the employee
