A student will be allowed to follow module y of which module x is a pre-requisite (PR) provided Grade G or Grade E or above has been achieved in module x. A student will be allowed to follow module y of which module x is a pre-requirement (PQ) provided s/he has followed module x and sat for the examinations in module x.

AIMS

The aim of this course is to enable the students to learn the legal principles which apply to the Law of Torts in Mauritius. 4. OUTLINE SYLLABUS

Introduction la notion de faits juridiques; les obligations ayant pour origine, les dlits, les quasi-dlits et les quasi-contrats, les faits dommageables autrui, les faits avantageables autrui; La notion de quasi-contrats: la gestion daffaire, le paiement de lindu, lenrichissement sans cause et leurs rgimes; La notion de responsabilit civile; La notion de prjudices (catgories et caractristiques): prjudices matriels, prjudices corporels, prjudices moraux, prjudices par ricochet, le quantum du dommage, les dommages-intrts; La notion de causalit et ses principes; Les dlits et quasi-dlits: la responsabilit du fait personnel (Articles 1382 et 1383 CCM), la responsabilit du fait des choses dont on a la garde (choses inanimes:1384 al 1 CCM, choses animes:1385 CCM, btiment en ruine: 1386 CCM), la responsabilit du fait des personnes dont on a la garde (Articles 1384 al 2, 3, 4) et leurs rgimes, la responsabilit en matire dincendies; les causes dexonration: la force majeure, le fait du tiers, le fait/la faute de la victime; les
