NEPAL ENGINEERING COUNCIL

INTRODUCTION
It can be said that Nepal entered a modern phase in engineering after the political change in the sixties. Engineering activities began to contribute to the development of the country and the engineering profession started to gain respect in the society. The engineering community began to grow in number and was involved in all spheres of national development and engineers were allowed to compete in administrative service also for the post of secretary. Furthermore, the introduction of democracy in 1990 encouraged the growth of engineering colleges in Nepal and the enrolment of students into these engineering colleges was rising very fast. Hence it was expected that nearly 3000 engineers would be graduating from local engineering colleges every year with nearly an equal amount graduating from colleges abroad. So, a need was felt for an organization to manage the engineering profession. Therefore, to make the engineering profession more effective, Nepal Engineering Council was formed under the Nepal Engineering Council Act, 2055 promulgated by His Majesty the King on B.S. 2055/11/27 (11th March, 1999 A.D.). As per the Act, NEC has been vested with the statutory authority for the planning, coordinated development and monitoring of engineering profession and education in the country. NEC Act 2055 gives an outline on the formation of the Council, its tenure and the roles and responsibilities of the Chairman, Vice Chairman and the Registrar. Nepal Engineering Council Rules, 2057 has also been prepared and approved by His Majesty's Government as per the provision of Clause 37 of the Act. It defines the registration of engineers into three categories as well as the formats for application: a) General Registered Engineer b) Professional Engineer c) Non - Nepali Registered Engineer NEC Rules 2057 also lays down the professional code of conduct for engineers registered with the Council. The first Executive Council was formed on Magh 2056 under the chairmanship of Er. Ram Babu Sharma and completed its tenture on Magh 2060.

OBJECTIVES
The objective of Nepal Engineering Council is to make the engineering profession effective by mobilizing it in a more systematic and scientific and also to register the engineers as per their qualifications. Its duties and responsibilities are: To prepare policies, plans and programs for the smooth functioning of the engineering profession and to execute them To set norms and standards for engineering education in Nepal To grant permission and approval to carry out engineering education to those engineering colleges and institutions that meet the required norms and standards and to honor their degrees and certificates To monitor and inspect the quality of engineering education provided by the engineering colleges and institutions To fix the qualification necessary in order to practice engineering profession and to register their name in the Council To remove their name from the registration of the engineering council if found to violate the code of ethics.

FORMATION OF GOVERNING COUNCIL


y y A Chairperson is selected by the Government of Nepal from among the engineers who has taken the engineering liscense from NEC and has been working as an engineer for at least 15 years after the completion of graduation. A Vice-Chairperson is selected by the Government of Nepal from among the engineers who has taken the engineering liscense from NEC and has been working as an engineer for at least 10 years after the completion of graduation. Five Council members are selected from among the engineers working as a professional engineer. The Chairperson of Nepal Engineers Association(NEA) is selected as the member of the Governing Council. Five engineers elected by the NEA is selected as the member of the Council. One Campus Chief from among that of different Engineering colleges is selected by the Government of Nepal as the Council member. A representative from Institute of Engineering, Tribhuvan University is selected as the Council Member. Two Council Members are selected by the Governing Council. The Registrar is the member-secretary.

The five members selected as mentioned in third and fifth clause should include engineers of different engineering sectors. The tenure of the each member of the Governing Council is 4 years but can be re-selected or re-elected. The vacancy of any member of the Governing Council can be fulfilled by selecting or electing for that position. The Governing Council meeting should be held four times a year at and when specified by the Council Chairperson

Duties, Responsibilities And Rights Of The Governing Council


y y y y It can prepare required laws, plans and activities and implement them to facilitate the smooth operation of engineering profession. It can grant registration and provide certification to the engineering colleges. It should define the criteria for eligibility for engineering profession and should also have a provision for the registration of eligible engineers. It should inspect the activities of registered engineers and should penalize those who do not follow the Engineering Code of Conduct as per the provisions.

Registration Of Engineers
y y y y Nobody is allowed to undertake the engineering profession without registering himself to Nepal Engineering Council. Anyone who has an engineering degree and related documents to prove it can be registered to Nepal Engineering Council. The Nepalese citizen will be charged Rs 1500 for the registration process while the foreigner will be charged Rs 5000 for the registration to NEC. The registration is granted for lifetime currently. In case of emergency, an extra charge of Rs 300 is charged and a temporary certificate is issued.

The NEC is planning to conduct examination for the registration process in the future.

Professional Code Of Conduct


The professional Code of Conduct to be followed by the registered Engineers of the council, subject to the provision of the Nepal Engineering Council Act.2055 and the Nepal Engineering Council Regulation,2057 has been published as follows: Discipline and Honesty: The Engineering sevice/profession must be conducted in a disciplined manner with honesty,not contravening professional dignity and well-being. Politeness and Confidentiality: Engineering services for customers should be sealt with in a polite manner and professional information should remain confidential except with written or verbal consent of the customers concerned. This , however ,is not deemed to be a restriction to provide such information to the concerned authority as per the existing laws. Non-discrimination: No discrimination should be made against customers on the grounds of religion, sex, caste or any other things while applying professional knowledge and skills. Professional Work: Individuals should only do professional work in their field or provide recommendation or suggestions only within the area of theri study or obtained knowledge or skills. With regards to the works not falling within the subject of one's profession , such as works should be recommended to be done by an experts of the subject matter. Deeds which may cause harm to the engineering profession: With the exception of salary, allowance, and benefits to be received for services provided, one shall not obtain improper financial gain of any kind of conduct improper activities of any kinds, which would impair the engineering profession. Personal responsibility: All individuals will be personally responsible for all works performed in connection with his/her engineering profession. State name ,designation and registration number: While signing the documents or descriptions such as the design , map , specification and estimates etc ralating to the Engineering profession , the details should include, the name , designation and NEC registration No. and should be stated in a clear and comprehensive manner. No publicity or advertisement must be made which cause unnecessary effects: In connection with the professional activities to be carried out , no publicity or advertisement shall be made so as to cause unnecessary effects upon the customers.

NEPAL ENGINEERS' ASSOCIATION


INTRODUCTION
Nepal Engineers' Association is an independent nonprofit organization of Nepalese engineers. It was established in 1968. Today, it represents more than 7500 engineers. Nepal Engineers Association office is located at Pulchowk behind UNDP building. NEA is governed by an executive body of 15 members elected by members of the association. As the democratically elected representative body of the profession, the Executive Council, supported by its various 17 committees decides major policy issues and NEA's overall direction. Members are encouraged to participate in the affairs of the association. Today NEA represents more than 7500 engineers nationwide. NEA during 1968-1989 was successful in establishing this very organization. The organizing of the World Engineering Congress along with first three national conventions were major milestones in this period. NEA during 1990-1999 was successful in membership drive. Similarly the organizing of the interaction program among the four Ps (Press, Public, Professional and Politician) was a major step achieved by NEA in promoting the profession and in improving the image of its fellow members. NEA was successful in expansion of in-country NEA centers, conversion of existing ones to Regional Centers as well as establishment of an international wing, NEA-Bangkok Center during the last decade. During the past decade, NEA broadened its activities by expanding its relation with international Engineering societies. NEA became member of World Federation of Engineering Organizations (WFEO) and was successful to establish Federation of Engineering Institute of South and Central Asia (FEISCA). During the past decade, NEA has been successful in construction of its own building at Pulchowk. The finished two floors have been rented out to Nepal Telecommunications Corporation. The NEA office at Jamal has been shifted to ground floor of NEA building at Pulchowk following demolition of the historic building housing NEA building during December 2001. The engineering community and well wishers donated funds to complete the ground floor and basement of the existing NEA building. The basement has been hired out to Nepal Telecom. The ground floor is fully used by NEA. Rent revenue thus generated now goes directly in paying construction loans. The Jamal office has also been rented out. In the recent past, NEA has successfully promoted the enactment of Nepal Engineering Council Act. Today NEA has prepared a draft five-year strategy plan, which aims at upgrading current membership to internationally recognized standards. In this connection, a study on strengthening NEA is currently underway with support of Institution of Civil Engineers, UK and DFID.

To promote fellowship goodwill and cooperation assistance among the Nepalese engineers and safeguard their rights and interests. By utilizing, to the highest extent possible, the participation of the national engineering manpower of the country in the national development activities of Nepal, make effort towards ending foreign dependency in this regard. To continuously enhance the highest professional ideals among the members and widen it. To develop relations, fellowship and goodwill with international engineering associations and institutions.

Publish journals, Manuals, articles and newsletters on various fields of Engineering. Organize conferences, workshop and paper presentation programs to foster interaction of engineers of various fields. Conduct major talk programs form highly acclaimed professionals on engineering issues. Recognize and award distinguished professionals for their contribution. Enhance safeguard of professional right of engineers Cooperate and organize joint activities with foreign and domestic professional organizations.

EXECUTIVE BODY
Nepal Engineers' Association (NEA), a non-profit professional organization, was founded by a group of young enthusiastic engineers in 1968 with a noble aim of developing engineering professionals to promote the development process by application of engineering sciences and technologies and at the same time increasing the interaction, goodwill and cooperation among engineers in Nepal and protect their professional rights. The Executive Council of Nepal Engineerion Association (NEA) comprises of the following officials and members for the operation of the functions and promotion of the Association. The Council may, if it deems appropriate, appoint one member as the Deputy Treasure from amongst the members. The meeting of the Executive Council is ordinarily held once in every month. Provided that the meeting many be held upon giving a 24-hour notice in special circumstances.

ELECTION
The election of the officials and members of the Executive Council and Executive Committee is held through the majority decision by way of secret ballot on the basis of one-man one vote for every post out of the members of the Association. An official who, as an officials and members of the Executive Committee, has completed the three consecutive term in the same post, shall not be allowed to be a candidate in the election for the consecutive fourth term of the same post. This restriction is not applied for becoming a member of the Council or executive committee.

Voting rights and qualifications:


a) A member may be a candidate for the post of official and members of the Council and to vote for every post on the basis of one man one vote.

b) A member intending to be a candidate in the election of the Council must have paid up all the fees and other amounts owing to the Association prior to his candidacy, c) One must not be disqualified under any article of this Statute to be a candidate and vote in the election.

Election process:
a) The Council shall prior to at least 75 days of the expiry of its term of office constitute an election committee consisting of at least 3 persons.

b) The election committee shall within 7 days of its Statute publish election program and commence election process. c) A member intending to be a candidate shall have to fill up the prescribed candidacy form and submit it to the election committee within the time limit prescribed by the election committee.

Term of office:
The term of office of the executive Council is ordinary of two years. Provided that:a) The term shall be deemed to be continued pending the election of the new successor.

b) Notwithstanding anything contained elsewhere in this statute, the term of office of the Council prevailing in the year of the commencement of this amendment shall expire on the last day of Bhadra (16 Sept.) of the coming year, at the last.

Income Source and audit income source:


The income source of the Association is as follows: a) Membership fees b) Grant received from His Majesty's Government and other person, Association etc. c) Other Source

Audit
The incomes, and expenses and accounts of the Association up to the last day of the month of Ashad of every Year, shall be audit by an auditor or an audit committee prescribed by the General Assembly and then presented to the General Assembly.

MEMBERSHIP PROVISION
The membership provision has been defined in the NEA constitution under the following Articles:

Article-3 Membership 1. Type: The Association has the members of the following types. a) Ordinary

b) Life- long member c) Fellow

d) Honorary member e) f) Corporate member Non- corporate member

2. Qualifications: a) Ordinary member: Those persons who, having obtained at least Bachelor's Degree in Architecture or Engineering technology from any university or higher educational institute recognized by the Nepal Engineers Association, are engaged in architecture engineer or the pertinent profession, may obtain membership of the Association b) Life- long member: Life long membership of the Association may be obtained on the following conditions: 1. In case the requisition for the life long membership made by a member who has continued the membership for at least five (5) years, upon making lump sun payment of all the dues owing to the Association as well as the fees prescribed for the lifelong membership, be accepted by the council. The council shall ipso facto make promoter members (membership of the year 2024) (1967) who have maintained the membership until their age of 60 years, who have paid up the membership fees for at least 25 years, the life long members.

c) Fellow: Any member having possessed the following qualifications may become a fellow of the Association. 3. Having continuously maintained the membership for at least 10 years engaged in the related profession and rendered outstanding contribution. Having attained the age at least of 35 years at the time of submitting an application for becoming a fellow.

In case the council decides to grant fellow, upon considering the application made by the member by having fulfilled the other qualifications and process prescribed by the Bye- laws made under this Statute.

d) Honorary Member: Honorary membership may be granted to a reputed person having contributed to the safeguard of the interests and promotion of the Association, acted for the interest of engineering sector or profession in national and international field or rendered solid contribution thereto, despite the fact that such person does not Bachelor's Degree in engineering.

e) Corporate member: A recognized Association or organization carrying out the functions relating to engineering or architecture reiterated in the name of any member or members or of which management level at least one member of this Association is involved, may be granted the corporate membership of this Association or Organization to this Association must be a member of this Association. f) The present members of this Association except those mentioned above shall be non corporate members. g) The associate members up to the amendment to this Statute.

Article-4 Grant and Termination of Membership Grant of membership


The membership of the Association shall be granted on the following conditions: a) One having attained the qualifications prescribed in Article 3(2) (a) hereof for the acquisition of the membership of the Association shall have to submit an application, proposed by at least one member and seconded by another one member, by making payment of the fees prescribed. The Council may upon considering such application grant the membership.

b) The Council may upon considering an application made by a member having attained the qualifications prescribed in Article 3(2) (b) for obtaining the life long membership grant the life long membership. c) Upon considering an application made by a member having attained the qualifications prescribed in Article 3(2) (c) for acquiring the fellow, by making payment of the prescribed fees, to the Council or the prescribed place, the Council may upon the recommendation of the fellow.

d) In case a general proposal is moved in the council for the grant of honorary membership to a person having attained the qualifications referred to in Article 3(2) (d) for acquiring the honorary membership, or a written proposal supported by at least forty(40) members is received, and the two thirds majority of all the members of Council decide to that effect, the honorary membership may be granted.

Termination of membership
All types of membership of the Association shall be terminated in the following circumstances:

a)

In case the resignation from membership in accepted by the Council.

b) In case the member dies, goes under mental disorder or ceases to possess the qualifications prescribed. c) In case the Association or Organization having obtained the corporate membership is dissolved or its validity to carry out the pertinent functions terminates.

d) The council may prevent the members, who do not pay the prescribed annual fees for a term more than two consecutive years or any other amounts payable by than two the Association even within the prescribed time, from all the rights, privileges including voting right pending the payment of such amounts. Provided, however, that the restriction referred to in this paragraph shall ipso facto cease to operate after the payment of such amount by such members. e) If a member violates this Statute or the Rules, Bye-laws framed hereunder of carries out act contray to the interests of the Engineering community or breaches the code of conduct prescribed, his membership may be expelled by way of a decision made by the two- thirds majority of the Council. Prived, however that while so expelling him, the concerned member shall not be deprived, of the right to defend him to prove his innocence. The concerned person who is unsatisfied with the Council's decision to the expulsion may appeal to the forthcoming General Assembly. Provided that suchexpelled person shall deprived of all the rights and facilities to which he is entitled in capacity of his Association's membership, for the period between the date of decision of such expulsion and the holding of the General Assembly to which an appeal may be field against the decision.

Article-5 Membership fees


Admission fees, annual membership fees required to be paid to the Association by all types of members and the fees to be paid in lump sum for becoming the life-long member shall be as prescribed by the General Assembly.

Article-6 Duties and Powers of the member


1. Duties
The duties of all types of members shall be as following: a) To be always ready to serve the interests and maintain the dignity of the Association.

b) To be under own respective profession, and not to do any act contrary to the interests of the Association. c) To pay in time the fees to be paid to the Association.

d) To render possible help in the organization of any activities to be carried out under the auspices of the Association or with the assistance of the Association. e) To actively participate in the attainment of the objectives and in the activities of the Association, without hindering and causing any harm to, the powers and duties of any members. In case own address be changed or intended to be changed, to notify the Association as soon as possible.

2. Powers
The following shall be the inherent powers of the members: a) The members of all types shall be allowed to take part in the general Assembly, Extraordinary General Assembly and National conferences of the Association. Provided, however, that only the members shall be eligible to take part in a voting for any decision at such assemblies and in the election of the executive Committee.

b) The members of all types shall be allowed to equal take part in a debate, conference, gathering, symposium, entertainment and other program held on the organization of the Association. c) The members of all types shall be allowed to equal enjoy the facilities granted under the Rules and Byelaws framed under this Statute.

A qualified engineer who wishes to become a General Member of NEA has to pay Rs.375 for the application form and an additional sum of Rs.50 for the Engineers Welfare Fund. The cost of membership renewal is Rs.200 per year. Life Membership can be acquired by a General Member after at least 5 years of service and payment of Rs.2000.

CODE/ETHICS

Will not accept compensation or remuneration from more than one party for same service or service pertaining same work without consent of all interested parties. CONCLUSION
We hereby completed the case study successfully and had a great experience during the case study. After the completion of this case study, we were familiar with various aspects of NEA and NEC such as their objectives, major activities, election procedures, executive body and many others.
