POLICY ON RESEARCH AND DEVELOPMENT LEAVE FOR PROFESSIONAL EMPLOYEES

1. AIM To grant research and development leave to professional employees for whom it is an inherent job requirement to remain abreast of developments in their professional fields. 2. DEFINITIONS AND ABBREVIATIONS Professional employees1 i) Executive /managerial professional refers to a position in which: (a) the primary function is the management of the institution or one of its major divisions or sections, and

(b) the position requires an educational attainment equivalent


to at least four years of higher education study. The minimum qualification level must be stated in the job descriptions of such employee. ii) Specialist/support professional refers to a position in which: (a) there are no major managerial responsibilities and (b) the primary function is the provision of academic or institutional or student support services and (c) the position requires an educational attainment equivalent to at least four years of higher education study. The minimum qualification level must be stated in the job descriptions of such employees. PARC HoD/Director means the Committee; Professional and Administrative Research

means the Head of Department/Director;

means the Executive Committee of Senate.

3.1 Professional employees, owing to their training and the need to adhere to ethical codes of
conduct, have to remain abreast of developments in their professional fields. This requires periods of research and professional development for which time will be allowed by the institution.

3.2 Where appropriate the recognition of the need to remain abreast of developments in the field
of expertise is supported by the allocation of a research key performance area (KPA) in the job descriptions of professional employees.

3.3 The project for which the leave will be used, must relate directly to the work area the applicant
is involved in and on completion must make a contribution to greater efficiency and effectiveness in that area. 3.4 Research and development leave is granted by the University to professional employees in order to enable them to increase their proficiency as professionals and to afford them the opportunity of conducting research. 3.5 Research and development leave is not a right, but is granted to a professional employee who complies with the requirements of this policy. The granting of leave is subject to the operational needs of the applicant's department. 3.6 It is the responsibility of PARC to ensure that research and development leave is utilised in accordance with the provisions of this policy.

3.7 Only in exceptional cases may Senex deviate from the requirements of this policy, provided
that a written submission, that is considered satisfactory, is made by the applicant via PARC to Senex. Senex may not deviate from the provisions of paragraph 5. 4. ACCEPTABLE ACTIVITIES DURING RESEARCH AND DEVELOPMENT LEAVE 4.1 Formal study 4.1.1 Research and development leave used to obtain qualifications at masters and doctoral levels will be applicable for professional employees. Such a qualification will qualify for research output subsidy on completion. Where an applicant is not in possession of a master's degree, it is preferable that research and development leave should be used for formal study. Where an applicant is not in possession of a doctor's degree, an applicant may be granted research and development leave for a purpose other than further study on submission of an acceptable and substantiated application indicating why he or she cannot proceed with doctoral studies. Where research and development leave has been granted for formal study, research and development leave may commence only after the applicants research proposal has been approved and he/she has registered for the degree.

Research and development leave may be used to obtain degrees or qualifications by course work, lectures or research. Where research and development leave is used for formal study, the applicant is required to complete the degree. The period within which the study must be completed and its outcome must be clearly stated. In the case of a research Masters or Doctors degrees the minimum requirement is the completion of two chapters in a cycle of nine months leave. The completion of one chapter is the minimum requirement for a cycle of six months leave. Where an applicant does not complete the degree during or subsequent to the period for which research and development leave has been granted, an application for a second cycle of research and development leave to complete the degree will only be considered on submission of an acceptable and substantiated application. An application for a third or further cycle of research and development leave to complete the degree will not be considered.

Practical experience, internships, clerkships or pupillage 4.2.1 Applicants who wish to gain experience or develop their scholarship may use research and development leave to teach in their field at another university or training institution provided that the envisaged practical experience contributes to the applicants research programme. Applicants may use the research and development leave for internships, clerkships or pupillage, provided this is related to the inherent requirements of the post in which the applicant is employed as well as the operational requirements of the applicants department. An applicant may apply for research and development leave to join an organization or association in order to gain practical experience by following a programme approved by the organisation or association. An applicants direct professional duties do not form part of his or her research and development leave programme, and will be permitted only in highly exceptional cases and on submission of an acceptable and substantiated application. At least two approved research outputs as defined in the policy of the Department of Education are required as an outcome2 in a cycle of nine months research and development leave and at least one output in a cycle of seven months. Additional outcomes in relation to the teaching, practical experience, internship, clerkship or pupilage may be required.

Research

The Policy and Procedures for the Measurement of Research Output of Public Higher Education institutions was published in GN 1467 Government Gazette 25583 of 14 October 2003. In terms of the policy of the Department of Education a number of research outputs are approved for subsidy purposes. The research and development leave programmes of those who already possess a doctorate must include research. At least two approved research outputs, as defined in the policy of the Department of Education, are required as an outcome3 in a cycle of nine months research and development leave and at least one output in a cycle of seven months. Where an applicant is granted research and development leave to re-work chapters of a thesis into articles, at least three outcomes are required. Deviations from this rule may be considered in terms of paragraph 3.7.

4.4

The creative arts 4.4.1 Research and development leave may be used by bona fide artists or musicians related to their job descriptions to prepare for and hold art exhibitions or to give musical performances. The art exhibition or musical performance must be an exhibition or a recital which is held at a recognised gallery or is given at a recognised institution, preferably during the period of research and development leave or shortly thereafter. Research and development leave may also be employed to compose a specific work and to write literary works. In all cases, the applicant must have a proven ability to carry out the envisaged project successfully and the results must be submitted to the head of department concerned for evaluation. At least two approved research outputs, as defined in the policy of the Department of Education, are required as an outcome4 in a cycle of nine months research and development leave and at least one output in a cycle of seven months. Deviations from this rule may be considered in terms of paragraph 3.7.

Employment, honoraria, funding and scholarships 4.5.1 4.5.2 Research and development leave may not be used to take up full-time employment elsewhere or to proactive a full-time profession. Professional employees may receive ad hoc honoraria, funding and scholarships from outside agencies associated with, amongst others, visiting fellowships during research and development leave.

5.

RESEARCH AND DEVELOPMENT LEAVE PERIODS 5.1 A research and development leave cycle is a cycle of five years service excluding any period of unpaid leave. The period an employee was employed on a fixed term contract and in a professional capacity, is taken into account in determining a cycle of research and development leave. The cycle of an employee previously employed by another higher education institution or moving to the professional ranks from the academy, will be determined in accordance with the guidelines compiled by the Department of Human Resources. A permanent professional employee may apply for nine months research and development leave after the completion of each five-year cycle, provided that research and development

leave will not be granted to an employee in the twelve months preceding his or her retirement. 5.3 Subject to the operational needs of the department, the taking of research and development leave does not affect the annual vacation leave allocated to an employee on 1 January of a given calendar year. Periods of research and development leave commence on the first day of any month. The following options are available for research and development leave with the understanding that if, in exceptional cases, a position cannot, due to operational reasons be vacated for an uninterrupted block of time, an applicant can arrange with his/her line manager for asynchronic leave periods5. The specific arrangement has to be recorded in writing and signed by both the line manager and the applicant. The signed document has to be kept on file for auditing purposes. 5.5.1 Option 1 Nine months (180 days) continuous research and development leave. 5.5.2 Option 2 Permutations of six months (120 days) and three months (60 days) taken over a period of two calendar years (6 + 3 or 3 + 6). 5.5.3 Option 3 Permutations of three months (60 days each) and taken over a period of three calendar years (3 + 3 + 3). 5.5.4 Option 4 Three months (60 days) pro rata research and development leave will be granted after three years of a research and development leave cycle have been completed, and six months (120 days) pro rata research and development leave will be granted after four years of a research and development leave cycle have been completed, and then only on the following grounds: (i) (ii) 5.5.5 where a bursary or study programme is linked to a specific period

where the HoD/Director makes a recommendation to such effect, based on the operational needs of the department concerned.

Option 5 Due to operational requirements it may not be possible for a professional employee to adhere to any of the options above. In consultation with the line manager a study programme may be structured to allow for meaningful research time to be allocated. Option 6 This option is reserved for HoDs/Directors. A maximum of three months research and development leave will be granted to HoDs/Directors after completion of five

years in the position. HoDs/Directors will submit their applications for research and development leave to the PARC via their Executive Directors. 5.6 Applications for the various periods of research and development leave in accordance with options 2, 3 and 5 must be made on one application form. Particular attention must be paid to the outcomes for the various periods as provided for in paragraph 2.5 of the Procedures.

6.

INTERRUPTION OF RESEARCH AND DEVELOPMENT LEAVE 6.1 Where the research and development leave of a professional employee is interrupted for a period of more than ten uninterrupted working days owing to his or her illness or the operational requirements of the department or directorate he or she may in writing (SENEX (PARC) 2) apply that a corresponding number of days be granted as compensatory leave to him or her. Such leave may be added at the end of the period of research and development leave, or may be taken within two years after the completion of the period of research and development leave. Leave not taken in this way is forfeited. An application for compensatory leave is submitted to the HoD/Director concerned for screening, recommendation and forwarding to the PARC. The PARC considers the application, ensures that it complies with the requirements of this policy and makes a recommendation to the Senex for its approval. The applicant is notified by the Department of Human Resources of decision of the Senex. The Department of Human Resources must inform the Research Directorate of the decision of Senex. The Research Directorate then captures the relevant information on the research administration system.

REPORTING 7.1 During his or her research and development leave, the professional employee must submit interim progress reports (SENEX (PARC) 3) on his or her studies or research. At the end of his or her research and development leave, the professional employee must submit a final report6. The final report on research and development leave must include a review of the entire research and development leave period. Interim reports must reach the HoD/Director concerned within one week after each reporting period has expired.

Depending on the option chosen7, the following periods of reporting will apply: 7.4.1 Option 1 Reports must be submitted at three-monthly intervals. The final report must be submitted at the end of the last three-month period.

Reports must be submitted at the end of each period taken. 7.4.4 Option 4 A report must be submitted after three months and at the end of a six-month period of pro rata research and development leave. 7.4.5 Option 5 Reports must be submitted at three-monthly intervals or as arranged between the employees and the HoD/Director. 7.4.6 Option 6 A comprehensive report must be submitted to the Executive Director of the relevant department and the Portfolio Manager indicating what has been learnt during the sabbatical period, how the learning will benefit the Department/Directorate and (a) project plan(s) for implementation. The objectives of the project plans will form part of the HoD/Directors Performance Agreement. 7.5 7.6 7.7 7.8 8. Where applicable, completed reports are submitted to the HoD/Director concerned for screening, recommendation and forwarding to the PARC. The PARC considers the reports and ensures that they comply with the requirements of this policy. The PARC then makes a recommendation to Senex for its consideration. Senex approves interim reports and forwards copies of these reports to the Research Directorate. The PARC must forward the final research and development leave report to Senex for approval.

THE CONTROL AND MONITORING OF RESEARCH AND DEVELOPMENT LEAVE 8.1 8.2 The control and monitoring of research and development leave are primarily the functions of the HoD/Director. The HoD/Director must ensure that progress is made in accordance with the research and development leave programme, and that the information provided in the progress reports is correct. In the case of masters dissertations and doctoral theses, the HoD/Director must also request written reports from the promoter or supervisor. The HoD/Director and PARC must satisfy themselves that the approved study programme has been carried out satisfactorily. Where necessary, they must identify and/or recommend specific points of the report for further consideration or implementation.

Any publication resulting from research undertaken during a period of research and development leave must acknowledge that the leave was granted by the University and must absolve the University from any responsibility for any opinions or conclusions contained in the publication.

9.

UNSATISFACTORY PROGRESS OR FAILURE TO COMPLETE A RESEARCH AND DEVELOPMENT LEAVE PROGRAMME 9.1 If the progress made by a professional employee in any period of reporting is not satisfactory and if acceptable reasons cannot be provided for the poor progress or lack of progress, PARC may recommend to Senex that the persons remaining period of research and development leave be cancelled immediately. A professional employee who has made progress with his or her research and development leave programme but who has not yet completed the programme will be granted the opportunity to complete the programme within a reasonable period of time if an acceptable motivation is provided. Follow-up reports (SENEX (PARC) 4) linked to possible completion periods as determined by the PARC are required in respect of research and development leave programmes which have not been completed. Follow-up reports enable an applicant to report on the completion of a project that extends beyond the period for which research and development leave has been granted. PARC keeps a register of these cases, and informs the professional employee and the HoD/Director when follow-up reports are due. A copy of the follow-up progress report must be forwarded to both the Department of Human Resources and the Research Directorate. Progress reports are required until such time as the research and development leave programme has been completed. Persons who have not completed a programme for which research and development leave was granted will not be granted another period of research and development leave unless Senex exercises its discretion in terms of paragraph 3.7. This rule does not apply where an applicant is granted a second cycle of research and development leave in terms of paragraph 4.1.7. Professional employees who have not completed a programme for which research and development leave was granted and who have received a grant from the research fund for the programme will not be awarded further grants from the PARC Research Fund8. PARC may request Senex to recommend that action be taken against a professional employee who has not completed a research and development programme within a reasonable period. The nature of the appropriate action to be taken is determined by Senex but may include recommending that disciplinary steps be taken against the employee.

11.

REJECTION OF APPLICATIONS 11.1 Should a HoD/Director not recommend an application for research and development leave, such application must nevertheless be forwarded to the Executive Director of the relevant Department and PARC for consideration. If the Executive Director of the Department and/or PARC disagrees with a rejection, the application will be returned to the HoD/Director for reconsideration. 11.2 If the PARC rejects an application, such application is returned to the applicant together with a statement indicating the reasons for such rejection. 11.3 The applicant has the right to appeal to the Chairperson of Senex against the decision of the PARC.

12.

TERMINATION OF CONTRACT OF EMPLOYMENT 12.1 On completion of a period of research and development leave, a professional employee is expected to remain in the employment of the University for at least the same period for which research and development leave has been granted. 12.2 A professional employee is expected to complete a programme for which research and development leave has been granted. 12.3 A professional employee undertakes to repay the University the amount of money received as remuneration while on research and development leave if his or her contract of employment is terminated and he or she has not complied with paragraph 12.1 or 12.2. The undertaking to repay the University will not be enforced where the contract of employment is terminated due to death, ill health or a dismissal as a result of an operational requirement. 12.4 A professional employee will give the undertaking in terms of paragraph 12.3 when accepting the decision of Senex as required in terms of paragraph 1.8 of the Procedures. 12.5 The Department of Human Resources and the HoD/Director is responsible for the implementation and monitoring of paragraph 12.

13.

IMPLEMENTATION OF POLICY Related policies of the former institutions that were in force prior to the commencement of this Policy are replaced with effect from the date on which Council approves this Policy.

ANNEXURE A

APPLICATION PROCEDURES
1. PROCEDURES 1.1 1.2 Application forms for research and development leave (SENEX (PARC) 1). The Department of Human Resources certifies that the leave cycle has been completed and that the periods of research and development leave applied for have been calculated correctly. The completed application form is submitted to the HoD/Director concerned for screening, recommendation and forwarding to the Executive Director of the Department. The Executive Director submits the application to the Chairperson of PARC.

Research and development leave applications must be submitted to the PARC in time for the application to be processed via its regular meetings. Applicants must allow for at least two Senex meetings to take place before the period of research and development leave concerned commences. The PARC considers the application, ensures that it complies with the requirements of this policy and makes a recommendation to Senex for consideration. The Executive Director of Human Resources presents the applications to Senex. The Department of Human Resources notifies the applicant and HoD/Director of the decision of Senex. The applicant must inform the Department of Human Resources and HoD/Director in writing of his or her acceptance of the decision of Senex before his or her research and development leave commences. The Department of Human Resources must inform the Research Directorate of the decision of Senex. The Research Directorate then captures the relevant information on the research administration system.

INFORMATION TO BE SUBMITTED UPON APPLICATION 2.1 In the case of further formal study, it is necessary to indicate the intended degree or qualification, as well as the date of conferment of the previous degree. As regards dissertations and theses, the provisional title must be given, the research proposal must have been accepted and it must be indicated that the applicant has already registered. If applicable, an indication must be given of how many chapters have already been completed, which chapters will be completed during research and development leave, and the intended date of completion of the dissertation or thesis. Where research is to be conducted, the project and research method must be described briefly. The form in which the results are to be published and the expected date of completion of the project must also be indicated. Applicants who intend working in a research institute must provide the particulars of the institute, the research envisaged and the resultant publication(s). Where work with a practical orientation is to be performed, the name of the organisation or association concerned, as well as the particulars of the type of work to be undertaken, is required. Where possible in the above-mentioned instances, an applicant must assign periods to the progress envisaged and specify which part of the project and/or programme he or she expects to complete at the end of each period of reporting provided for in paragraph 7.4 of the Policy. Where applicable, an application must include a detailed description of the applicants research and development leave programmes and projects undertaken during the two preceding periods of research and development leave. Where applicable, candidates must also indicate what progress they have made with the preceding programmes and projects, that is, whether they have been completed or how they have progressed since the previous period of leave. In the interim this condition will not apply.
