October 2005, June 2006 and March 2008. 1st Monitoring committee meeting held between 5th - 6th March,2008. Scientists from ICFRI, Shimla (regional institute of ICFRE, Dehradun) visited the project from 9th to 11th July, 2009 for post project monitoring of compliance of environmental clearance conditions.

Brief note on the compliance of the stipulated by MoEF.

2nd Monitoring committee meeting held on 25th & 26th November, 2010. status of Enclosed as Annex I. conditions

Annex-I Status of Compliance of conditions stipulated by MoEF, Govt. of India in Environmental Clearance letter No.J-12011/6/2004-IA-I dated 10.03.2005. Part A: Specific Conditions (i) Implementation of Catchment Area Treatment Plan Compliance: The CAT Plan is being implemented by HP Forest Department at an estimated cost of `.2981.53 lakhs over a period of 11 years and fund is being transferred to them in phase wise manner (yearly payment). For proper execution and implementation, activities of wildlife & biodiversity conservation have been integrated in the CAT Plan including financial allocation. Project has deposited `.2926.53 lacs to H.P. State Forest Department for implementation of CAT Plan. It includes `.87.00 lacs deposited to Deputy Commissioner, Chamba on 26.10.2007 as directed by H.P. Forest Department as 1st and 2nd year cost for development of Rural Infrastructure, Agriculture & Horticulture Support and Animal Husbandry Support under CAT Plan. Project has also provided articles in kind amounting to `.25.22 lacs for infrastructure development under the provisions of CAT Plan to H.P.Forest Department. Divisional Forest Officer, Bharmour, H.P. Forest Department vide letter no.Acctt./1146 dated 16.06.2010 has intimated that physical and financial progress of CAT Plan works for the year 2009-10 may be treated as nil. (ii) NHPC should submit the information regarding adequacy of spillway capacity of Chamera Stage-I Dam in case of extreme eventuality of floods from upstream projects to Central Water Commission and any suggestion made by CWC will be taken care of by NHPC Compliance: NHPC had provided CWC with requisite information/data for analysis and accordingly, CWC vide letter no.3/106/07-CMDDD(NW&S)1424 dated 21.11.08, has conveyed its views, which is confirming that PMF of 24417 cumecs can be passed from spillway and sluices with 10% inoperative condition. (iii) 157 families of the three villages of Churi, Moukhari and Sulakhar will be affected. The affected families should be rehabilitated as per R&R Plan proposed & submitted. Compliance: R & R plan is under finalization with the H.P. State Government. Deputy Commissioner, Chamba vide letter no. RRO/CBA/R&R Scheme/2010/3691-94 dated 08.06.2010 has requested Govt. of H.P. to convey consent to incorporate certain points in R&R Scheme as well as decision of the Govt. with regard to Local Area Development Fund so that further action to notify the R & R scheme could be taken accordingly. Part B: General Conditions (i) Adequate free fuel arrangement should be made for the labour force engaged in the construction work at project cost so that indiscriminate felling of trees is prevented Compliance: The provision for distribution of subsidized fuel for cooking purpose has already been incorporated in the contract agreement and necessary instruction has been given 4

to the contractor, to comply with the provision. The contractor is providing LPG to labourers free of cost. Workers are also provided subsidized meals in common mess at working sites. The details of fuel provided to the labourers in the period May, 2010 to Oct, 2010 is as below:

(ii) Fuel depot may be opened at the site to provide the fuel (kerosene/wood/LPG). Medical facilities as well as recreational facilities should also be provided to the labourers Compliance: Free fuel (LPG) is being supplied to the labour force engaged in the construction work. The contractor is providing medical facilities to labourers engaged by them. The project is having its own dispensaries at powerhouse and dam sites. Doctors and paramedical staffs are available for primary and emergency treatments. Two ambulances are also provided. A free medical check up camp was organized on 05.12.2009 at Dharwala Office Complex during which 450 persons from nearby villages were treated and provided free medicines. During the period from Dec 2009 to May 2010 medical facilities through project dispensary were provided to 2884 persons including employees, labourers & locals. Details of patients treated and expenditure incurred during the period from May, 2010 to Oct, 2010 is given below:

The civil contractor for the project is also providing medical facilities at working sites to labourers engaged by him. The details of patients and expenditure incurred on medical staff and medicine during the period from May, 2010 to Oct, 2010 is as below:

(iii) All the labourers to be engaged for construction works should be thoroughly examined by health personnel and adequately treated before issuing them work permit. Compliance: Medical check up of labourers is conducted on working sites by the contractor. (iv) Restoration of construction area including dumping site of excavated materials should be ensured by leveling, filling up of burrow pits, landscaping etc. The area should be properly treated with suitable plantation. Compliance: For proper dumping of muck, 19 sites measuring 26 ha of forest land were identified in consultation with State Forest Department & State Pollution Control Board. Due to problems such as road blockages during rains, road widening works etc. in disposing of the muck at designated sites, had necessitated the requirement of additional five muck disposal sites. Approval for diversion of additional 2.83 ha of forestland for muck disposal sites was obtained from MoEF. R.C.C. cladding of inclined height of 3m & 5m are being provided as protection measures at muck disposal sites along nallahs and river, respectively. The slope is being stabilized by providing concrete grids up to the top level of disposed muck surface Gabion arrangements have been provided for stability of embankment slopes. Slopes are further being stabilized by constructing concrete grids and stone pitching. Muck Disposal sites shall further be rehabilitated with suitable plantation under supervision of State Forest Department. Signboards have been erected at the muck disposal sites. The details of muck disposed at various approved muck disposal site till Nov, 2010 is as below:

(v) Financial provision should be made in the total budget of the project for implementation of the above suggested measures. Compliance: Financial provision has been made in the total budget of the project for implementation of the above suggested measures. (vi) A monitoring Committee for R & R should be constituted which must include representatives of project affected persons from a woman beneficiary. Compliance: There is no displacement at all due to construction of Project. Persons are affected partially only by way of private land acquisition for the project. An allocation of `.10.00 crores has been made for R &R Plan. The R & R plan is under finalization with the H.P. State Government. After finalization of the plan, State Govt. shall be requested to constitute a monitoring committee for R&R. (vii) A multidisciplinary committee should be constituted with representative from various disciplines of forestry, ecology, wildlife, soil conservation, NGO etc. to oversee the effective implementation of the suggested safeguard measures. Compliance: A multidisciplinary committee has been constituted vide circular No. NH/CHIII/Env/10/06-345 dated 15.09.2006 to oversee the implementation of environmental safeguard measures in Chamera H.E. Project, Stage-III. The second committee meeting was held between 25th & 26th November, 2010, during which the committee members visited fisheries complex, dumping sites and CAT sites. The progress of work done under various plans / activities identified under the Projects EMP was reviewed by the MDC, based on the presentation given by the Project Authority in the forenoon on 26th November, 2010. (viii) Six monthly monitoring reports should be submitted to the Ministry and its Regional Office, Chandigarh for review. Compliance: Six monthly monitoring reports are being regularly submitted to MoEF, New Delhi and Regional Office, Chandigarh. The last Six-monthly report for the period ending Nov, 2009 was submitted vide letter no. NH/PD/Env.110/1486 dated 22.06.2010 Other environment safeguard measures: (i) Fisheries Development Plan Compliance: The Fisheries Development Plan is being implemented by H.P. State Fisheries Department at an estimated cost of `.120 lakhs. Project has released `. 100.00 lacs to H.P. State Fisheries Department in two installments on 05.07.2006 and 19.10.2007. Assistant Director Fisheries, Chamba vide letter no. 2952 dated 22.11.2010 has intimated that construction of 18 nos. of ponds, open drain & path and boundary wall with inter chain jalli have been completed. Work of carp hatchery is in progress. (ii) Disaster Management Plan Compliance: Disaster Management Plan includes installation of alert systems, setting up of control room, VSAT communication system, notification and publication procedures etc., which shall be implemented in due course of time for which an allocation of `.199.20 lakhs has been made in EMP. At present during construction phase, Project Safety Plan has been 7

prepared and is being implemented by the contractor as per established, implemented & certified Occupational Health and Safety Management System in line with the requirements of OSHAS:18001:1999. (iii) Environmental Monitoring Programme Compliance: Environmental Monitoring Programme is being implemented by HP State Environment Protection & Pollution Control Board. It includes monitoring of Ambient Air Quality, Noise level, Water Quality and muck disposal in project area. Project has deposited `. 18.50 lakhs to H.P. State Pollution Control Board for environmental monitoring till date. One monitoring vehicle (Maruti Gypsy), High Volume Sampler (02 Nos.), Sound Level Meter (01 No.), Smoke Meter for Diesel Vehicle (01 No.), Smoke Meter for Petrol Vehicle (01 No.) and Electronic Balance (01 No.) amounting to `. 16.34 lakhs have also been provided to H.P. State Pollution Control Board. Water Quality, Ambient Air Quality Analysis and Noise level monitoring was done at various locations in project area during June- July, 2010 by State Board Analyst.
