Terms and Conditions

1. Information on how to enter forms part of the Terms and Conditions of entry. Entry into the Writing Competition is deemed acceptance of these Terms and Conditions. 2. The Promoter is Frankston City Council (ABN 4945 4768 065), Davey Street Frankston VIC 3199 3. Failure by the Promoter to enforce any of its rights under these Terms and Conditions at any stage does not constitute a waiver of those rights. Eligibility 4. Entry is open to Frankston residents, for children aged 8 13 years of age. 5. Stories entered MUST be written by the entrant. Any entry which is found to have not been written by the person submitting it will be automatically ineligible and therefore not considered a suitable entry. 6. The Promoter reserves the right, at any time, to verify the validity of entries, and personal details concerning entrants to disqualify any entrant who submits an entry that is not in accordance with this process. 7. The Promotion commences at 09:00am Australian Eastern Standard Time (AEST) on Thursday, 1 September 2011 and closes at 11:59pm (AEST) on Friday, 30 September 2011 (Promotion Period). Only entries that are received in accordance with these Terms and Conditions during the Promotion Period will be eligible for entry. Competition Entry 8. Stories entered must have been written by the entrant; entries by third parties are not eligible. 9. Entries must be between 1000 and 2000 words. 10. Entrants must provide typed in 11 point font, with one and half line spacing and pages numbered. Alternatively handwritten entries will be acceptable; however they MUST be clear and legible in order to be considered. 11. Entrants, as aged under 18, must submit their entry with a parent or legal guardians permission. The Promoter reserves the right to contact the parent or guardian to confirm acceptance of the Terms and Conditions. Entrants should be aware that a breach of this consent requirement will result in the entrant being disqualified. 12. Incomplete, indecipherable, or illegal entries will be deemed invalid and will be rejected. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms and Conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoters absolute discretion and discussions will not be entered into. Stories that are considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, contain objectionable content or otherwise inappropriate will be deemed invalid and rejected. 13. Entry is free. 14. Stories used for prior promotional purposes and/or which have been used for commercial purposes are ineligible. (Please note, this does NOT include community publications or blogs) 15. Stories must be entered along with the entrants full name, phone number and email or postal address. 16. Entrants can only register the Promotion in their own name. 17. Entry is permitted between 09:00am (AEST) on Thursday, 1 September 2011 and 11:59pm (AEST) on Friday, 30 September 2011. 18. Each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant that does not infringe on the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights; 20. As a condition of entering this competition, all entrants grant the Promoter the right to use their image/s in Frankston City Council and Frankston Tourism promotional material, this usage is royalty free. This usage includes but is not limited to any media including banners, signage, posters, magazines, television, and internet including social network sites, DVD, MMS or other digital or print formats. 21. Due regard will be given to the preservation of the artistic integrity of the works. The Promoter will not edit, alter or demean the entry in any way. 22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to a) disqualify any entrant or voter or b) to modify, suspend, terminate or cancel the promotion, as appropriate. 23. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the promotion. 24. Any entrant or voter who, in the opinion of the Promoter, tampers or interferes with the entry in any way, engages in unlawful or improper conduct which jeopardises or is likely to jeopardise the fair and proper conduct of the Promotion, or who does not properly comply with the entry process, will be. 25. Personal details will only be used for the purposes of this competition. Any information you provide will be processed and held by Frankston City Libraries and will be safeguarded under the Privacy Act 1988. Judging 25. Judging of the major prize winners and selection of the top 3 stories for the First, Second and Third Prize will take place in the week beginning Monday, 3 October 2011at Frankston City Library, Playne Street Frankston VIC 3199 and will be conducted by the Promoter and the panel of judges appointed. 26. Each entry will be individually judged based on artistic and creative merit by a panel of judges appointed by the Promoter. The best three stories as determined by the judges will be deemed the winners of the first, second and third place major prizes. The judges decision is final and correspondence will not be entered into. 27. The judging process will be undertaken collaboratively with the entire judging panel being actively involved and contributing to the judging process. 28. Winning entries must demonstrate a strong plot, good character development and be able to entertain. The judges will be looking for entries that demonstrate examples of these requirements. All winners will be notified by phone or email by Monday, 17 October 2011 and their names will be published on the Promoters website and in media and public relations material.

Prizes 29. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable for other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. 30. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification. 31. The Promoter reserves the right to forfeit prize/s in the event of an entrant being unable to satisfy these promotion terms and conditions or not claiming a prize. For any prize that remains unclaimed on 30 October 2011 they will become void. No further winners will be announced. 32. As the winner of a prize will be under 18 years of age, when their prize is awarded, they must be accompanied by their parent or legal guardian. 33. 1st Major Prize winner: ($350) 34. 2nd Major Prize winner: ($100) 35. 3rd Major Prize winner: ($50 book voucher)
