I, Sharad Krishnarao Dabhade, Aged 52 years, son of Krishnarao Narayanrao Dabhade, having my office at MSEDCL Prakashgad, Plot No. G-9, Anant Kanekar Marg, Bandra (E), say as follows: I am Director (Operation) of Maharashtra State Electricity Distribution Co.Ltd., the applicant in the above matter and am duly authorized by the said applicant to make this affidavit. All the other necessary details as specified in the petition are based on the information received from the concerned officers of the Company and I believe them to be true. I say that there are no proceedings pending in any court of law/tribunal or arbitrator or any other authority, wherein the Petitioner is a party and where issues arising and/or reliefs sought are identical or similar to the issues arising in the matter pending before the Commission. STATE ELECTRICITY DISTRIBUTION COMPANY RESPECTFULLY SUBMITS; Background:of load shedding

The chronological order of deciding the Principles and Protocols of load shedding to be implemented in the State is as follows: Previously, MSEB used to decide the principles and protocols of load shedding in consultation with Load Dispatch Center. In April-2005, Load Shedding Protocol as was decided by the then MSEB was challenged in Nagpur High Court. Subsequently Nagpur High Court issued order dt. 06.05.2005 that, there shall be no discrimination between Urban and Rural areas and equitable Load Shedding to all categories need to be implemented. MSEDCL filed a Special Leave Petition at Supreme Court & challenged the order of Nagpur High on dt. 11.05.2005. The Hon. Supreme Court heard the matter & was pleased to pass the order as under: "The load shedding protocol needs to be determined in consultation with Maharashtra Electricity Regulatory Commission". Since then, MSEDCL is implementing Principles and Protocols of Load Shedding in consultation with MERC, MERC, after taking public hearing at Thane, Nashik, Aurangabad, Pune, Nagpur, Amravati has issued detailed order in the matter of Principle and Protocols of Load Shedding on dt. 03.08.2005. Subsequently, as per the petitions filed by MSEDCL time to time in the matter of Principles and Protocols of load shedding, the Honble Commission has issued orders on dt. 10.01.2006, 20.02.2007, 20.06.2008 and 28.11.2008 to address the then present demand & supply position at different times. MERC has approved Six no.s of Scenarios of Load Shedding for different levels of demand-supply gap vide order dt. 28.11.2008. (Annexure -I ) MSEDCL decides the particular Scenario for implementation on the basis of shortfall by considering anticipated Demand and Firm power availability which is a vary dynamic situation

In real time implementation MSEDCL takes all out efforts to increase the availability from following sources Day ahead power available with reasonable rate UI power from Central Grid depending upon Grid Frequency

Unscheduled Hydro utilization as a short measure.

If the availability increases by above means then the load shedding is withdrawn sequentially as per DCL groups. The above power is un-certain so while deciding the load shedding Scenario it is not considered. Accordingly, MSEDCL has implemented the Load Shedding Protocol from dt. 01.12.2008. to 15.04.2010 Annexure-II Present availability position Chandrapur TPS Generation: The Generation from Chandrapur TPS is not up to its full capacity. The Generation from the Units is gradually picking up. At present only about 1000 MW generation is available as against a capacity of 1940 MW RGPPL Generation Block- I is out due to failure of Power Potential Transformer since 17.06.2010 Block- II is out due to failure of Step up Transformer from 12.07.2010 Present RGPPL Generation. 660 MW Central Sector Share Following Central Sector Units are under outages due to which central sector share is also reduced. Koyna Hydro Generation MSEDCL has to utilize Koyna water to meet the shortfall Koyna water utilized from 12.07.10 to 16.07.10 for four months by the Irrigation department. Hydro generation of about 1000 MW thus will not be available in this period Over drawl from Central grid In view of the better frequency in the month of June & July MSEDCL had met the demand by overdrawing unto 10 to 30 MUs ( 400 to 1200 MW) in the month June & July 2010. In case of low frequency profile the over drawl is not possible and the shortfall Increases by 400 to 1200 MW MSEDCL has to carry out distress load shedding to meet the situation 0.1 to 0.616 TMC An Outage has been taken on Koyna stage-IV (1120 MW) from 16.07.2010

Considering this critical Situation wherein none of the approved protocols was sufficient to manage the system. In this extreme and critical dynamic

situation MAHAVITARAN had to take decisions on a continuous basis to manage loads and prevent grid collapse. Hence to control distress load shedding and for System stability, a new load shedding protocol is proposed. MSEDCL has been implementing this protocol which was submitted to MERC for consultation on 26.04.2010 and published in news papers. MSEDCL is now enforcing this new Schedule proposed as Scenario VII and desires to continue with the same. MSEDCL is continuously monitoring this extremely dynamic situation.
