(for the period 2010-2013) OF THE MUNICIPALITY OF BALETE, AKLAN HELD ON THURSDAY,
FEBRUARY 17, 2011 AT THE SANGGUNIANG BAYAN SESSION HALL.
Present:
Section 2. Policy. It is the policy of this administration to ensure full protection of its natural
resources to make for a balance and sustainable ecology for the present and future
generation. Toward this end, the Local Government shall pursue a thorough program to
eliminate illegal logging and other forms of forest destruction through the use of chainsaws,
thus, the passage of this ordinance.
Section 3. Definition of Terms. The following terms used in this ordinance shall be taken as
defined hereunder:
a. Chainsaw – any of the handy power saw that has teeth linked together to form an
endless chain
b. Chainsaw Operation – the actual use of chainsaw either for commercial or personal
purpose in converting logs, trees, coconuts or timber into lumber/coco-lumber.
a. Owners of chainsaw either for commercial or personal purpose are required to register
their chainsaw before the Municipal Environmental and Natural Resources Office every
January of the fiscal year. The MENRO, having deemed the applicants as qualified
operators shall correspondingly issue a certificate of registration thereof. Registration
under the MENRO shall however not to be taken as alternative to the mandatory
issuance of permit by the DENR per RA 9175.

Applicants shall present the following documents to the MENRO upon accomplishing the
prescribed registration form, viz.:

b. Licensing. Owners of chainsaws for commercial use shall be required to secure the
necessary Mayor’s Permit as provided for in Chapter III of the Revised Revenue Code of
the Municipality of Balete, Aklan (Ord. No. C-003, s. 2008).
Section 6. Chainsaw Operation and Nuisance Affecting Public Peace. Operation of chainsaw
within school and institutional zones shall be prohibited during class and office hours. In
residential areas, chainsaw operation may only be permitted from 9 o’clock in the morning
until 11:30 in the morning and to resume at 2:30 until 4:30 in the afternoon, provided that
provisions as stipulated in Section 5 have been observed.
Section 7. Penalty. Violation of the provisions of this ordinance shall be punishable with the
following fines:
Third Offense – Php. 2,500 and revocation of permit to operate and the confiscation of
the chainsaw unit
Section 8. Ordinance Officers. The MENRO, the Balete PNP and all the Punong Barangays and
their respective tanods are hereby designated as ordinance officers to prosecute the
provisions of this ordinance.
Section 8. Repealing Clause. Any ordinance, rule or policy which runs in conflict with the
provisions of this ordinance is deemed repealed or amended.

Section 9. Effectivity. This ordinance shall take effect 15 days after its publication in the
Official Gazette or Newspaper of Provincial circulation.
