Amusements (4 Pa.C.S.) - Omnibus Amendments

An Act amending Title 4 (Amusements) of the


Pennsylvania Consolidated Statutes, making extensive
revisions to provisions on gaming, etc.

This amendment adds Table Games and perpetuates a very


flawed scheme of mismanagement, a few benefitting at expense
of many. The flaws are well documented elsewhere and
expanding this regime is Against Liberty. With increasing scope of
business, concessions could have been demanded. This is a bill
favoring a specific few in a specific business.

Crane Operator Licensure Act - licensing without


certification

This act reduces regulatory burden allowing more people more


access to well-paying job of Crane Operator. Licensing is a barrier
to entry of new people into a profession or a business reducing
opportunities to work and provide a service to others for which a
person is paid. So lowering barriers to entry for new worker is
moving in right direction. More Licensing means more barriers
means less employment, less affordability, less competition, less
consumer/customer choice.

Act 8 Feb 17 SB 125 Tier 0 No impact on Liberty

Controlled Substance, Drug, Device and Cosmetic Act - offenses


of methamphetamine production, operating a methamphetamine
laboratory, illegal dumping of methamphetamine waste and
environmental costs and prohibited acts and penalties. This
amendment to existing law clarifies or is a reasonable extension
of the original purpose of the Act.

Act 9 Mar 16 HB 1533 Tier 1 For Liberty

Military and Veterans Code (51 Pa.C.S.) - Military family


relief assistance

This amendment allows medical payments to dependents of


members discharged for medical conditions while serving in
National Guard. I am surprised that this was not already in place.

This extends medical benefits, adding additional unfunded


entitlement. A Pay Go approach would be to offset other
spending. This also increases government intervention in health
care using a natural support for military to leverage additional
entitlement burden on The Forgotten Taxpayer.

Generally, this would be scored as Tier 1 Against Liberty because


it extends and Entitlement but this seems like a reasonable
extension of existing law and military, particularly in time of war,
are entitled to compensation for extraordinary risks and for their
service.

This amendment to existing law gives citizens protection against


Fraud and is a clarification or reasonable extension of existing
law.

Prohibiting limitations of wearing official military uniforms on


school property

This Act provides clarifies citizens Free Expression in wearing


uniform on school property. It is not clear why wearing the
military uniform of Armed Forces of US or Pennsylvania anywhere
should be considered illegal.

Insurance Company Law of 1921 - omnibus amendments

This Act limits applicability of Right-to-Know Law to certain


insurance company filings. Hard to say if this is legitimate. It does
add reporting requirements for Annuities.

This Act provides for additional transparency in transactions and


gives citizen consumer protection against Fraud

Crimes Code (18 Pa.C.S.) - Operation of methamphetamine


laboratory and dumping of methamphetamine waste

Crimes Code An Act amending Title 18 (Crimes and Offenses) of


the Pennsylvania Consolidated Statutes, providing for the offense
of illegal dumping of methamphetamine waste; imposing a
penalty; and providing for the offense of operation of
methamphetamine laboratory.

This Act adds some chemicals to manufacture methamphetamine


This amendment to existing law clarifies or is a reasonable
extension of the original purpose of the Act.

Dental Law - scope of practice of expanded function of


dental assistant and further providing for the State Board
of Dentistry

This Act allows expanded functions to lower barriers for


paraprofessionals, increasing employment and making services
affordable for more people. Reducing licensing requirements
allows more people to provide more services and introduces
competition and choice into market. This is similar to geologist in
training category established by Act Engineer, Land Surveyor
licensing act.

County

I am relying on bureaucracy to insure that the price is fair,


reasonable and market value, competitively bid, and not some
inside deal favoring a special person, connected to the elected.

This Amendment provides for sale of government land with


competitive bidding in accordance with existing law.

environmental costs.

Prohibiting use of certain ticket purchasing software and


penalty

An Act amending the act of May 2, 1947 (P.L.143, No.62), entitled


"An act regulating the sale and resale for profit and the carrying
on of the business of selling or reselling tickets or other devices
for admission to places of amusement; providing for the licensing
of persons reselling such tickets for profit; providing for the
suspension and revocation of such licenses; imposing duties on
licensees and owners or operators of places of amusement;
imposing powers and duties on the Department of Revenue,
county treasurers, district attorneys, and the receiver of taxes,
and city solicitors in cities of the first class; making disposition of
moneys collected and providing penalties," further providing
for definitions; prohibiting use of certain ticket purchasing
software; and prescribing a penalty.
Protection of private property is fundamental purpose of limited
government.

A “yes” vote adds 1 point 1 from grade and a “no” vote


subtracts 1 point to grade. The Governor will have 1 point
added to his grade

Act 24 May 12 HB 961 Tier 0 No impact on

Municipal Waste Planning, Recycling and Waste Reduction
Act - Recycling fee for municipal waste landfills and
resource recovery facilities

This bill reauthorizes the $2 per ton fee on municipal trash


disposal to pay for recycling and grants to local governments.
Without the grants, municipalities would have to raise local taxes
substantially to comply with mandatory recycling. The State
should fund its mandates to municipalities. There is an argument
that if we didn't recycle, the glass, aluminum, newspapers, office
paper, etc. would go into our landfills, which would fill up quicker
resulting in multi-million dollar landfill expansion costs. I don’t
know if this is true but it seems reasonable. Analyzing the impact
on liberty is not a simple matter.

Act 25 May 12 HB 975 Tier 1 For Liberty

Engineer, Land Surveyor and Geologist Registration Law -


General powers of registration board, procedure for licensing as a
professional geologist, continuing professional competency and
education requirements, practice by firms and corporations

This Act adds category “geologist in training” reducing regulatory


barrier to business or profession of geologist. Although it adds
additional testing requirements and CLE requirements, more
regulation and more regulatory cost added to cost of providing
professional services reducing competition and choice for
individual and small business consumer, it also adds allows more
people to engage in providing services of a geologist.

A “yes” vote adds 1 point 1 from grade and a “no” vote


subtracts 1 point to grade. The Governor will have 1 point
added to his grade

This Act seems to be only a language change.

This Act adds the Military Officers Association of America to the


State Veteran’s Commission Board

Pharmacy Act - refusal to grant revocation and


suspension, drug therapy protocols, collaborative drug
therapy management and for construction of act

An Act amending the act of September 27, 1961 (P.L.1700,


No.699), known as the Pharmacy Act, further providing for
definitions, for refusal to grant revocation and suspension and for
drug therapy protocols; and providing for collaborative drug
therapy management and for construction of act.

This Act allows Pharmacies to manage drug therapies reducing


cost and making service more affordable and available to more
people, particularly, the most vulnerable. Lower costs raise
standard of living.

Judicial Code (42 Pa.C.S.) - organization and jurisdiction of


courts of common pleas and authorizing establishment of
problem-solving courts

An Act amending Title 42 (Judiciary and Judicial Procedure) of the


Pennsylvania Consolidated Statutes, in organization and
jurisdiction of courts of common pleas, authorizing the
establishment of problem solving courts.

This amendment to existing law clarifies or is a reasonable


extension of the original purpose of the Act.

Act 31 June 3 SB 828 Tier 1 For Liberty

Public Eating and Drinking Place Law - providing for definitions


and applicability

An Act amending the act of May 23, 1945 (P.L.926, No.369),


referred to as the Public Eating and Drinking Place Law, further
providing for definitions; and providing for applicability. Prime
Sponsor: Senator VOGEL This is known as "Pie Bill," which
exempts home-baked goods for nonprofit organizations from
Department of Agriculture enforcement. This bill reduces
regulations for events where home baked goods are
contributed to a charity event. Reducing regulations increases
freedom.

A “yes” vote adds 1 point 1 from grade and a “no” vote


subtracts 1 point to grade. The Governor will have 1 point
added to his grade

This bill avoids the fundamental reform of selling this government


monopoly control of the sale of liquor. There is not demonstrable
evidence showing this reduces alcoholism or abusive use of liquor
