Plaintiff, Citizens for Responsibility and Ethics in Washington, and Defendant, the United
States Department of Education, by undersigned counsel, hereby respond to the Court’s order of
February 13, 2009, directing to them to file, no later than March 13, 2009, a joint report regarding
1. In this action, Plaintiff alleges that Defendant violated the Freedom of Information
Act (“FOIA”), 5 U.S.C. § 552, when it determined that the FOIA request submitted by Plaintiff on
May 11, 2007, and assigned Request No. 07-00655-F, did not reasonably describe the records
sought. Plaintiff also alleges that Defendant violated the FOIA by denying Plaintiff’s request for a
fee waiver in connection with Request No. 07-00655-F. Finally, Plaintiff alleges that Defendant has
violated the FOIA by engaging in a pattern and practice of failing to properly respond to Plaintiff’s
2. On February 27, 2008, the Court granted the parties’ joint motion to stay proceedings
to permit them to attempt to resolve this case without judicial intervention. The parties filed joint

status reports on April 2, June 2, and July 14, 2008, advising the Court of the status of their
negotiations. On August 4, 2008, the parties filed a joint status report advising the Court that they
were unable to resolve all of the issues and proposing a briefing schedule, which the Court adopted.
3. Pursuant to the Court’s Order of August 4, 2008, Defendant filed a motion to dismiss
and for summary judgment on September 10, 2008. Plaintiff filed an opposition and cross-motion
4. After filing their respective opening briefs, the parties conferred and determined that
settlement remained a possibility. On November 12, 2008, the Court granted the parties’ joint
motion to stay proceedings to allow settlement negotiations to resume. The parties filed joint status
reports on January 13 and February 13, 2009, advising the Court of the status of their negotiations.
5. The parties’ negotiations continue to hold promise. However, over the past month,
certain Department of Education officials critical to the negotiations have necessarily been occupied
with other pressing matters, including developing policies and procedures for distributing funds
made available under recent economic stimulus legislation. Nevertheless, further negotiation, if
fruitful, may eliminate the need for judicial resolution of the issues in this case. Accordingly, to
minimize litigation costs and conserve judicial resources, there is good cause to stay proceedings in
this case for an additional 60 days, through and including May 12, 2009, to allow settlement
negotiations to continue.
6. The parties further propose filing, no later than May 12, 2009, a Joint Status Report
advising the Court on the status of their negotiations, and, if they are unable to resolve the remaining

this case, including the parties’ remaining briefing obligations, for 60 days, through and including

For the reasons stated in the parties’ Joint Status Report, it is hereby
ORDERED that this action is STAYED through and including May 12, 2009; and it is
FURTHER ORDERED that the parties shall file a joint status report advising the Court of
